all with stories of their own. hali scruggs was nine. one of five children. the only daughter of the pastor of the church. evelyn was 9, too. she loved to sing and perform. >> katherine kunz was the school's headmaster. cynthia peek was a substitute teacher. her family and friend say she was devoted to her faith. mike hill was a member of the custodial staff. he was known around the school as big mike. he had seven children and 14 grand kids. >> katie is in nashville. katie, the community is preparing for a vigil. how are folks still dealing with this loss? >> we expect there will be a lot of people at that vigil as we've seen the me moral behind me grow and grow. more folks coming, bringing their children, paying their respects, grieving, leaving flowers. we now know that first lady jill biden will be attending the fun

y'all. she will not be speaking but in attendance. an educator herself, to lend support to this community that is grappling with how this could have possibly happened. i think there is a reality sinking in with parents trying to explain this how they lost friends and teachers. one couple we spoke to yesterday traveled here from atlanta to pay respects for the head of the school, katherine kunz who was one of the first to try and confront the shooter during the incident, and they described hers a impeccable leader, make everyone feel like they were the most important person in the room. they said when they heard this news, they had no other option but to get on a plane and be here in nashville to tell the story of her, the wonderful anecdotes of how she changed her

and their children's lives. here's some of what they said to us yesterday. >> pretty devastated at the loss. i mean, not just for us personally, but her family, the church, the school, they lost an amazing person who's headmaster. powerhouse of a woman. >> reporter: there are heartfelt signs of grieving all around like that. there are trees that lined the street all the way up to the school, and we saw students tying red ribbons around the trees in remembrance with their parents as well. it is certainly a grieving community right now. >> yeah, you can just feel it beating through the television. are investigators saying anything about their investigation, have they determined a motive? >> reporter: investigators were

hit rolling port, mississippi. maggie vespa is there. you have been speaking with survives who don't have a lot of options. what are they telling you about the challenges they're facing? >> reporter: this is the challenge of getting utilities turned on. they basically want a roof over their heads. they're staying in shelters, motels while they're temporary, it's better than this. this would be impossible. this is a chiropractor's office and juice bar, and now obviously rubble. over to the left, i want to show you, this is what's left of the water tower, just a mangled, downturned, collapsed mess. the stories coming out of friday's deadly ef-4 tornado are stunning. case and point, alton lee, a man who tells us the tornado picked him up, through him down, and threw him down from 30 feet in the air. listen to his story. >> just spinning around out of control. felt so helpless. ain't nothing you could do. i seen a drier floating in the

air towards me, and i'm thinking, this is going to be the end. but the drier what saved my life. when it hit me, it knocked me out that cycle and i fell back to the ground. >> reporter: he was unconscious in a field after he was knocked out of that tornado. for hours. rescuer found him in the field around 3:00 a.m. saturday morning. miraculously he's going to be okay. as for people here, they're hoping the newly announce visit by president biden at some point in the near future is a sign that the federal disaster relief the president promised will come to fruition. >> elton lee has quite the survival story to tell. let's bring in our meteorologist. bill, there's a nasty system that's battering california now. what's happening there, and when it is moving east? >> two days we have been tracking this storm, and look like the last of the heavy rain went through los angeles, light rain heading for san diego. center soft storm coming onshore near san francisco. we have had reports of hail,

especially around berkeley earlier. that will be the case. nothing too dramatic with winds or flooding. we're going to take the storm southwards tonight into tomorrow, then try to take it and redevelop it into the plains late thursday into friday. not a lot is going to happen thursday, but as we go into friday, the storm taps the moisture from gulf of mexico, holds it up, and that's when the thunderstorms will explode. chance for a severe weather jout break starting friday afternoon. quad cities. the des moines area. headed to st. louis, memphis, little rock, possibly chicago. the enhanced risk area is in orange, and that has 47 million people in it. this is a large population centers. at least has the potential to see impact severe we think intercontinental we think multiple tornados are possible with this storm surgery along with damaging wind gusts. of course we're watching the rolling fork and central

mississippi. they're in the southern tail end of this. doesn't look like they're going to have the worst of it, but any severe weather or thunderstorms will hamper the cleanup effort. >> all right, bill, maggie, thank you both. we now know more about the migrants killed in a fire at a desanction center in mexico, some of whom trapped behind a padlocked door. at least 38 migrants died in that desanction center operated by the mexican government. many killed were from venezuela and el salvador. outrage is now building among advocates. they say the condition there is are inhumane. nbc news national correspondent gabe gutierrez is following the story, joins us now. what is the mexican government saying about that fire in. >> reporter: mexico's president lopez obrador is promising a full investigation, but he's facing mounting pressure about all these questions regarding that surveillance video that has

attorneys for gwyneth paltrow are presenting witnesses. paltrow accused of slamming into a skier at ath you think resort, though she is countersuing claiming the other skier is at fault. the case could be in the hand of a jury by the end of this week. maura barrett has been tracking the case for us. maura, who's been on the stand today? >> reporter: we've heard from a series of medical experts today all specializing in neurological function, because remember, terry anderson who's suing paltrow says he suffered injuries to his rib bus neurological issues from a head injury. the first one is interesting. we heard from dr. carl black. he's a neuroradiologist and he was hired to review mri images of the brain, of sanderson from 2009 leading up to 2021. this incident happened in 2019,

and the exchange we heard in court indicates there might have been neurological problems prior. i want to you hear that exchange in court. >> does that mean that imaging both before and ski accident and after the ski accident? >> yes. >> and in your review of the imaging, duh see any evidence of traumatic brain injury after the accident? >> no, no. >> duh see any image evidence in the imaging before the accident that might be consistent with mr. sanderson's post accident symptoms? >> yes. >> reporter: now, we also heard evidence from some of these medical experts detailing sanderson's issues that she's experienced with anxiety and depression, but another neurological expert pointed out that based on the injury that they sustained with the ski incident, they would have only diagnosed him with a mild concussion with symptoms lasting a few weeks, which is not what sanderson has been alleging.

>> do we have any sense a what comes next? >> reporter: attorneys have been under this intense time crunch. pushed the judge for more time, but the judge has been firm in the eight-daytime line. the court is in lunch break now, with you we anticipate hearing from terry sanderson himself as well as paltrow's husband if time allows. if not, closing arguments will happen thursday before the jury start it deliberation. >> maura barrett for us, thank you. an appeals court in maryland has a win stated the murder conviction of adnan sigh yesterday. the decision comes months after he was freed. . he spent months in prison after convicted of killing his girlfriend. >> reporter: adnan syed's legal journey made famous by the podcast "serial" and a hbo documentary is not over a 2-1 decision, the appellate court of

maryland ruled giving her brother one day's -- instead, lee took part by video conference. because of that, syed's murder conviction was reinstated tuesday. >> we are delighted that the court did the right thing. the process was flawed. >> reporter: last year, syed walked out of court after spending 23 years behind bars for the strangulation murder of h ark e min lee, his former high school girlfriend in 1999, a crime he maintained he did not commit. his commission was vacated when a judge ruled prosecutors failed the turn over evidence and found new evidence that could have impacted syed's case. >> if there is another hearing to you expect that to change the outcome? >> we don't know, because we don't know what the state has as evidence. we want to see the evidence. >> reporter: appellate court

found the short notice violated lee's rights, saying it is obligated to remedy those violation as long as we can do so without violatingg mr. syed' right to be free from double jeopardy. syed's attorney pointed out the reinstatement was no because of error in the motion to vacate, but because lee's family was not physically present, telling abc news in a statement, ensuring justice for hae min lee does not require injustice for adnan. just last month, syed talked about his conviction being possibly reinstated. >> we definitely understand that h ark e's family suffered so much. the just that we suffered, too. >> reporter: it does not appear syed will have to go back to prison. his attorney said they'll appeal to the maryland supreme court, and lee's attorney says another round of appeals could take until the end of the year of

reservoirs refilled. their reservoirs are 88%. they expect them to fill to 100% once the snow melts in the spring and summer. the water agency is no longer mandating customers to cut back water usage by 10%. they are just asking them to cut back 10% voluntarily. no longer a mandate. you might wall earlier this year the board for east bay mud voted to roll back its 8% drought surcharge, that's effective march 1. some water conservation methods are in effect. they ban landscape watering within 48 hours of the last rain. if you water your car, have a valve at the end, a nozzle that shuts off. this comes after the governor signed an executive order that

eased water restrictions. water districts that serve 27 million californians, they will get at least 75% of the water they requested from the state this year. last year, they only received 5%. because of the drought. here is the latest from the drought monitor. you can see, most of the state, including the bay area, is no longer in a drought. there are some parts of the north bay classified as abnormally dry. >> what a change. thank you. here are some other stories. one bay area city retains its title of happiest city in america. the suspect in a high speed crash is in court. first, san jose police arrested a man accused of sexually assaulting minors. the 33-year-old man committed the crimes over a span of several years. they say their investigation began last week when they were contacted by a surviving victim. the investigation uncovered there were numerous other victims in age from 6 to 13 years old.

records. in california today, a 6-year-old boy is leading the push for change. he and his family have teamed up with a state lawmaker there. that lawmaker is proposing a bill that would allow accent marks over letters on birth certificates and marriage licenses. accents are common in other languages. valerie castro joins us now. you spoke with that little boy. what did he tell you? >> reporter: you'll see in a moment how cute this boy is. he has a simple question. he just wants to see his name spelled correctly. what's in a name if it doesn't have the right accent marks? in california, names like jose are prohibited from having accents of tildes or marking on birth certificates. but this 6-year-old and his parents are hoping that changes. >> my name is nikolai. >> reporter: how would it sound if it didn't have to tilde?

mother who lost her son last year after he spent the night out in a popular new york city neighborhood. investigators say john umberger died after a group of men drugged him before draining his bank account. gary, this mother has been pushing for justice ever since this tragedy unfold. what is she saying now? >> reporter: she sat down with nbc's stephanie gosk. she was notified arrest warrants were issued over the weekend, and nbc news just confirmed there were six indictments. on's death has been under investigation by the nypd as part of a larger string of robberies and assaults. he was found dead in a townhouse after a night out in june. 25-year-old social worker julio died in a separate but eerily similar incident. the medical examiner there ruled both deaths were homicides caused by drug related deaths.
