"7:00 on the west coast. hoda is a bit under the weather. we have craig with us. the indictment of donald trump marks the first time a former u.s. president has ever faced criminal charges. >> here's a look outside the d.a.'s office here in new york city. also a look at trump's mar-a-lago estate in florida. we can tell you there were no major protests at either location overnight. >> as for what happens next, the former president is expected to surrender and appear for arraignment. he will go through the standard booking process. including fingerprints and a mug shot. >> of course, a lot of folks are asking this morning, what does this mean for trump's 2020 campaign. he is allowed to run while under indictment, even if he is convicted of a crime. as for the timing of a possible crime, it could be months away, leading to a possibility of it unfolding during the

presidential campaign. >> we have every angle of the story covered this morning, including a live interview with trump's attorney. let's start with garrett haake. at the new york d.a.'s office this morning. good morning to you. >> reporter: good morning. the grand jury handing up this historic indictment two months to the day after they were first impanelled. now donald trump former president of the united states will have to travel here to the courthouse in lower manhattan and face a judge. grand jurors in manhattan setting off a stunning legal earthquake thursday, voting to indict a former president for the first time in history. the political aftershocks rippling across the country this morning even while the specific charge or charges against trump remain secret and under seal. the district attorney's office saying it contacted donald trump's attorney to coordinate his surrender. the manhattan d.a.'s investigation centered on the $130,000 2016 payment to stormy

daniels. who claims she had an affair with mr. trump a decade prior. mr. trump has denied the affair or any other wrongdoing. on social media thursday night blasting the investigation as a, quote, political persecution and election interference at the highest level of history and labeling d.a. bragg a disgrace. the former president adding he, quote, cannot get a fair trial in new york. republican lawmakers rallying to the former president's defense from long-time allies -- >> this is going to destroy america. >> reporter: to even former campaign rivals. >> the indictment of a former president of the united states on a campaign finance issue is an outrage. >> reporter: congressional democrats praised it as upholding the law, while the white house has refused to weigh in. >> i have no comment. >> reporter: the criminal processing will be another historic first as mr.

trump will have his mug shot taken, fingerprints taken and even a dna swap all while his agents stand guard. mr. trump's former fixer michael cohen pled guilty to campaign finance violations in connection with those hush money payments, which the department of justice called an attempt to influence the 2016 election. cohen said he was acting at the direction of the former president. but mr. trump has pushed back saying he was the victim of extortion by stormy daniels. federal prosecutors decided not to pursue charges. but all eyes are on bragg as he makes his case against former president trump. this morning we are learning that prosecutors questioned at least some witnesses about a previous alleged hush money payment also from 2016. this one involving a former playboy model. named karen mcdougall. although, it is not clear whether there are any charges in this indictment related to that matter specifically.

as for tuesday, security here in new york city will be tight. all nypd officers have been ordered to report in full uniform today and be prepared to deployed ahead of any possible protests. so vanna? >> thank you. joining us now one of the attorneys representing president trump. good morning to you. >> good morning, savannah. >> what was the president's reaction when told by his lawyers of this indictment? >> you know, despite all the scuttlebutt and rumors and whatnot, we believed and hoped that rule of law would prevail. so he initially was shocked. after he got over that, he put a notch on his belt and he, you know, he decided we have to fight now. and he got into a typical donald trump posture where he's ready to be 's ready to be combative on something he believes is an injustice his knees don't buckle, savannah, so now he's in the posture where he's ready to fight this.

>> have you been told anything about when this indictment may be unsealed and you and the rest of the public will have a look at what the charges are? >> not definitively, savannah. we're talking about early next week but that day isn't set yet likely tuesday but, again, that's still to be determined. >> have you been told anything about the nature of the charges in this indictment >> no. i mean, specifically no. we don't know how many counts. we don't know what the actual charges are. but we do know it centers around, you know, a legal very common confidentiality agreement that was signed years and years ago with stormy daniels, between her attorneys and michael cohen. those were the parties to the confidentiality agreement. so it is nothing more than that, which is really what makes this shocking this is a historic case. a monumental case. a case that will have wide reaching ramifications i feel very concerned about the rule of law in this country

because it endangered the rule of law for all americans. today it is donald trump the day after it is a democrat the day after it's your friend the day after it's you or me that's what concerns me, when the prosecutor can use the law and the system to go after a political opponent, it is something that frightens me. >> we don't yet know, in fairness, what these charges are and what the substance is behind them. there is a report that there are 30 plus charges. >> well, we know -- >> what do you make of that number, if it's correct? >> if it's correct, it means they have taken each transaction, each check, each payment, each entry as a separate charge. i still think it's all going t rise and fall on the issue of this settlement agreement, a very legal, a very common settlement agreement and how it applies to campaign finance laws, savannah remember, that's where we are here

the only other precedent that' remotely close was john edwards. it was prosecuted because there was a donor involved instead of using personal funds like here in that case, the justice department openly dismissed that case when they could have gotten a conviction that was federal prosecutors who, in this case, turned it down i spoke to chairmans there they turned this down. they said there was no crime yet, somehow a state prosecutor who doesn't have jurisdiction over the federal elections is prosecuting a case it makes it obvious as to why. and it is very concerning. >> and, again, we don't yet know what the legal theory is, but there is, of course, wide speculation that campaign finance may be what brings i into the realm of a felony conviction this has to do with the falsification of business records. i know we don't have the time or the facts to litigate it here. one point that i hope you can clear up for me. these legal services that this all centers around these

payments made to stormy daniels being called legal services and whether that was true or not here's my question where on the books of the trump organization was that written? did it ever go to any third party, or was this just strictly internal business records? >> savannah, that's really a great question it is the first time i have been asked that in the last month that's the point they were internal business records. they were not filed. look there was no tax deduction taken here, which originally was the theory here. when they put in to the grand jury two years ago no tax deduction taken and there was no obligation to file this with the fdic. if there were that would be a different story. can you imagine if donald trump paid for this settlement agreement with campaign funds alleging it was something to do to help the campaign they would be begging for his -- >> these business records, i want to make sure we are clear as day whether it's campaign finance or anything these business records were solely, internally only for the trump organization, no irs, no third party, no one else outside

of the trump organization ever relied on these records that were called, falsely, legal services >> i wouldn't say falsely. but that's another issue we could debate later or right now. but, yes, you are correct. the answer to the initial question no one else relied on them no one else had to rely on them. this was a personal resolution for a personal matter that would have been made irrespective of the campaign so with those facts together, there is no crime. it is not a bad act. >> a couple of things. do you expect the president to voluntarily surrender? will he come for his arraignment? >> we're working out those details. absolutely he is not going to hole up in mar-a-lago he'll face this and we'll face it and we'll be successful, i'm sure. >> do you expect this to go to trial? do you see any scenario in which you or the former president would take a plea deal >> zero, zero. first of all, i'm not taking a

plea deal for anything president trump will not take a plea deal on this case it is not going to happen. there is no crime. i don't know if it's going to make the trial because we have substantial legal challenges that we have to front before we get to that point. >> long road ahead thank you for your time this morning. good to see you. >> thanks, savannah. >> again, this all comes with donald trump running for president, adding a new level of uncertainty. to the 2024 race nbc's senior washington corresponden hallie jackson picks up that part of the story. good morning to you. >> hey, craig. good morning we are seeing former president trump's republican rivals rallying around him, this morning, for the most part echoing his attacks on this investigation, like mr. trump, defiant >> reporter: a show of support this morning from gop competitors lining up to back up donald trump's claim his indictment is politically motivated.

>> this appears to be just one more example of the two tiered justice system. >> reporter: ron desantis not officially not race but widely seen as mr. trump's republican competitor accusing the manhattan district attorney of stretching the law to target a political opponent mr. trump himself has said even if indicted his campaign would continue. >> i wouldn't even think about leaving. >> reporter: his team already fund-raising, selling his new t-shirts overnight featuring the date of the indictment the president has used the allegations against him to rally supporters. >> and people see it's [ bleep ]. and they go and they say unfair. >> reporter: for now mr. trump is getting backup from allies on capitol hill, too. house speaker kevin mccarthy saying the gop controlled house will hold alvin bragg and his presidential abuse of power to account. many of the attacks describing the d.a. as a soros-backed prosecutor, a reference to george soros, a target of

conservatives. soros was among those that donated to a political action committee that supported bragg's campaign but a soros spokesperson said he has never met, spoken with or communicated with alvin bragg. bragg has criticized the former president, something mr. trump's allies seized upon to cast him as a partisan prosecutor. >> i'm seen him up front and the lawlessness that he can do >> reporter: he's touted going after the president legally saying in 2021 it is a fact i have sued trump more than 100 times. the manhattan d.a. investigation itself has been in the spotlight with top prosecutors resigning last year, including mark pomeranz who wrote the probe had plane crash under bragg and t of was due to pilot error something that bragg pushed back on when you talk about the political sphere here, mr. trump's numbers have hardly moved. like after the fbi search of the

mar-a-lago home. if you look at the most recent polling, including some just out this week, it's shown his support has actually grown compared to last month's craig? >> washington correspondent hallie jackson for us, thank you. let's turn now to kristin welker as well as laura jarett lots to chew over here but let's turn to the politics because it is so interesting here donald trump is indicted. it's history from a political perspective, you have to ask whether this helps him or hurts him right now. at the moment, he has every single republican elected, every single potential political rival singing from the same sheet of music and defending him. >> that's absolutely right there is no doubt in the short term this energizes his base as one republican said to me overnight, they like a fight and now they've got one. that's for sure. he's defiant he's digging in. here's the question. will his gop rivals start to take the gloves off at some point?

will they take a page against hillary clinton? remember what he argued. he said she has too much legal baggage to govern. will they start to use that argument, for example? >> it's not just this case it is the classified documents his, his alleged involvement in the january 6th election do we suspect at some point his rivals lump all of this together and use him to paint the president as someone who is too troubled to run? >> that is the x factor here do we see more indictment surrounding the legal cases you mentioned, craig if we do, that's when you could start to see cracks around the edges of his base of his support. if people that support him say, hey, we love trump but we're concerned about the prospects in a general election, that could have an impact but his republican rivals would have to take the gloves off for that to happen. >> there is a huge question mark the fact is nobody right now,

other than the prosecutors, know what the legal theory is underpinning this case and that, to me, is the question. >> yeah. >> because we can't assess the strength of this case until we see the underlying facts and the underlying legal theory. >> and the underlying evidence will be key here because what you got just now was this idea that it didn't go to a third party, this false representation if, in fact, this is a false business records base, the d.a. brings that all the time but the business records needs to go outside of the company in order for prosecutors to prove that someone has been defrauded. so if prosecutors had that theory, that would be very different from what we understand those facts to be right now. that will be key when the indictment comes out. >> do you think an indictment will be unsealed before this arrangement on tuesday >> it could be the prosecutors could go in today and ask for it to be unsealed sometimes they want it unsealed so they can hold a press conference sometimes they decide to wait

appearing in court to answer drug charges. >> reporter: i'm kris sanchez. this afternoon, the san jose police officers association office manager will face federal drug charges before a u.s. magistrate judge. the 64-year-old is accused of having 61 drug shipments mailed to her san jose home from foreign countries, then distributing them across the nation by mail. segovia allegedly used the union u.p.s. account and a union email in some of those transactions. the president told me in his only one-on-one interview, that as office manager she had no decisionmaking power and no access to the union's finances. in the federal complaint, investigators say that segovia told them in a voluntary interview that she blamed a woman that she knows as a family friend and housekeeper for making the shipments to her home. she will appear in court at 1:30 this afternoon. >> thanks. it's time to get a look at the forecast. it's going to shape up to be nice. >> we're enjoying sunshine across the bay area, finally, as

"the wall street journal" denies the allegations and is seeking his release. if convicted, gershkovich will face up to 20 years in a russia prison he will be held in pretrial detention until at least may 29th pope francis spent his second night in a rome hospital. he is being treated for bronchitis the 89-year-old pontiff was admitted on wednesday. he experienced some difficulty breathing. a vatican spokesperson says the treatment has resulted in marked

nbc national correspondent miguel almaguer joins us with more on the verdict and the fall-out and what gwyneth paltrow whispered to her accuser as she left that courtroom miguel, good morning to you. >> reporter: good morning. the jury made up of eight people found that not only was gwyneth paltrow not at fault, but the man that sued her caused harm to the actress. this was a civil trial, so there only needs to be a majority of clearing her of wrongdoing but that decision was unanimous. >> was gwyneth paltrow at fault? no. >> reporter: it took the jury two and a half hours to reach their verdict. gwyneth paltrow was not at fault and caused no harm to terry sanderson during their collision in 2016 on a park city ski slope. the actress turned defendant stopping to wish sanderson well after the verdict. >> her exact words, i wish you well very kind of her. >> reporter: paltrow was awarded $1 as the eight-day courtroom saga came to an end.

>> very happy. >> reporter: steven owen is paltrow's attorney >> she has a history of advocating for what she believes in this situation was no different, and she will continue to stand for what she believes is right. >> reporter: with dueling allegations, the trial boiled down to who the jury believed. the now 76-year-old retired optometrist sued paltrow for a minimum $300,000, but the attorneys asking the jury for $3 million after he broke three ribs and said he suffered permanent brain damage >> was it worth it >> absolutely not. >> reporter: the jury deciding sanderson was 100% at fault. >> i believe she thinks she has the truth. i believe she thinks that. and i said i would not bring any falsehoods i'm going to tell the truth, and i did. absolutely >> reporter: during the trial, both said they were the ones hit from behind. a parade of witnesses theorized who was at fault but it all came down to the
