we will check the drive times with mike in a bit and see if folks are getting a jump already on this weekend. we have a look at our forecast, kari. we are going to have winter-like temperatures to start, even though it's milder right now compared to what we had earlier this week. we are still at 39 degrees in los gatos. 42 in dublin. it's 44 right now in oakland as you get ready to step out the door. in dublin, our temperatures will go from 42 to 47 degrees at 9:00. notice there will be more clouds in the mix today. the sun just kind of peeking out as we reach in the mid to upper 60s for this afternoon, reaching 66 in concord. 64 in napa today. 62 in san mateo. we will get a look at what is ahead as rain comes in tomorrow. that's in just a few minutes. mike, you have a bart station that has been closed? >> yeah, it's the montgomery station. there's a medical emergency at the montgomery station so nobody is getting on or off and they
6:02 am
have closed that station. we don't have a lot of details on what is going on, but no word of single tracking. if there was an issue on the tracks they would have to single track in the area, and i am thinking this is going on on the platform. the montgomery bart station is closed right now, and this could be reflected in more traffic at the bay bridge. we have the backup forming. we will track to see if there's an appreciable build there. also over here, 880 northbound, there's still that crash over on the shoulder. all lanes northbound appear to be open passing the coliseum. we will give you a live shot of that with our camera coming up. back to you. >> thank you. 6:02 right now. a judge in the east bay could be sidelined from hearing any criminal cases. >> today in the bay's bob redell joining us live right now. bob, the alameda district attorney issuing an unusual request here, and this is to have him -- we are talking about
6:03 am
the judge here, to qualify from hearing any criminal cases brought by the d.a.'s office. >> yeah, newly-elected d.a. price wants to bar judge mccannon to hear any cases brought forth by her office because in her words he overstepped his authority in a plea deal. the d.a. offered one defendant 15 years in prison for a triple murder, and the judge said the case should go to trial and let a judge decide the man's fate instead. the d.a. said judge mark mccannon overstepped his boundaries as a judicial officer, as i mentioned. she reminded her viewers that a judge is supposed to be an impartial referee. >> because of judge mccannon's inappropriate comments and conduct on two separate
6:04 am
occasions, my office will file a motion to disqualify him from hearing any criminal cases being prosecuted by our office. >> to issue a blanket challenge against a judge is something that is highly irregular and it also calls into constitutional questions of separation of powers. >> that was a legal analyst, steven clark. he said it's common for judges to get taken off single cases, but all cases, that's unusual. clark points out that the d.a. price has a right to take judge mccannon off criminal cases. under the law the d.a.'s office is not required to state its reason and the judge does have a right to object or ask for an explanation. >> i want to go back to the triple murder case that the judge rejected the plea deal on. what will happen in that case? >> the judge has set a date for the trial to begin later this month, and as for judge mccannon, we asked for comment

and did not hear back. >> interesting. thank you, bob. right here in the bay area a lot is going on. you know those students yesterday that walked out of the classrooms over gun violence. sky ranger captured the crowds of the students in san francisco as well as mill valley yesterday. >> this is all in the wake of the tragic national school shooting. students want to send a clear message to lawmakers on capitol hill, do more to protect children. brie, the students are vocal. >> yeah, that's right. good morning, laura and marcus. we have heard these rally cries before. students say they don't want to live in fear and they are pushing for lawmakers to pass legislation that would help protect schools from gun violence. >> no more silence! >> from california to massachusetts, students walked out of school taking a stance against gun violence. >> because school shootings are
6:06 am
terrible and people shouldn't have to be scared of going to school every day. >> it's just scared to think at any moment somebody can enter the building with bad intentions and shoot class members. >> gun violence is happening all around and we just want to do our part. >> the country has failed us by letting this happen and letting it happen so many times over and over. >> the nationwide protests come nearly a week and a half after a school shooting in tennessee. three children and three adults died. in a separate demonstration, clouds took to the tennessee house floor led by three democrats. today statehouse republicans will vote on whether to expel those lawmakers from the general assembly. >> because we wept to the house floor to speak up and hear the voices of our constituents. >> if we are smart we are going to prevent the guns from ever getting to the schoolhouse door. >> legislators agree on some
6:07 am
measures, such as preventing people who are a threat to themselves and others from gaining access to weapons. >> to the degree we can do that, protecting the constitutional rights of our people at the same time. >> students say it's time to do something about gun violence, but from capitol hill to state capitols, the political battle over the issue continues to be contentious. president biden has repeatedly called on members of congress to pass legislation on gun laws, saying that his executive actions can only do so much. laura, marcus? >> many of the students don't have a vote but they do have a voice and they are certainly using that. thank you. a follow-up for you, the third and last suspect connected to the shooting death in the east bay now in custody, but it happened after a police standoff. yesterday authorities arrested the man.
