in this. >> a consequential ruling in the fight for women's health care. a texas federal judge suspends fda approval of an abortion pill. we'll head to washington with calls for action. this is "today in the bay." good morning to you on this monday. i'm marcus washington. >> i'm laura garcia. we're going to start out with a look at the forecast. we've really been enjoying spring-like temperatures. >> it seems like it was such a long winter with all of the cold weather and rain. it's been so nice to enjoy the warm weather and sunshine and it's going to be a warm start to the week. feeling kind of mild out there right now, temperatures in the low 50s for many of us as you're heading out the door. take a look at palo alto, 54 degrees. it's going to be in the low 50s throughout much of the morning, a few clouds here and there, maybe drifts of fog. as we go into today, mostly sunny and temperatures feeling

nice by noon, reaching 66 degrees, eventually making it into the low 70s today. hayward headed for 71 degrees and 77 in san martin today. mike, you have a crash in san jose? >> i do, but it should be cleared very soon. north 101 approaching 880, it sounded like everything was about off to the shoulder. no slowing has shown up. really the commute doesn't kick in for another 40 minutes for the first burst. over here we have a little slowing for 84 and crews are coming in out of the altamont pass. there's a little bit of slowing until things widen out and come into the rest of livermore and the tri-valley. a smooth flow of traffic at the dublin and walnut creek interchange. west 24, there's a crash reported. sounds like everything is off to the right. there's a live look at oakland, still a steady flow. back to you. >> thanks, mike. developing now, three people are in custody for their possible connection to a freeway shooting that took the life of a

5-year-old girl. >> eliyanah crisostomo was killed on saturday night on southbound 880 between milpitas and fremont near warren avenue. the chp says her parents were also in the car when the shooting happened. they were not hurt. here is what we know. santa cruz police, along with chp and scotts valley police say they took three people into custody during a high-risk traffic stop on highway 17. the council member in close contact with police confirmed three people are in custody in fremont, possibly connected to the freeway shooting and a second shooting that happened minutes before. the second shooting happened on fremont boulevard. no one was injured and fremont police say that shooting could have been gang-related. thom jensen is tracking the latest and will join us with more details ahead at 5:30 this morning. and later today, three men charged in another freeway shooting we've been following will be back in court. 2-year-old jasper wu was killed after the car he was riding in

got caught up in the crossfire of a gang battle on interstate 880 back in november of 2021. prosecutors are expected to -- protesters are expected to gather outside of the courthouse ahead of today's hearing. they're upset over reports that district attorney pamela price is going to give the suspects a lesser sentence by dropping enhancement charges. price has denied requests for an interview, but in a pre recorded video she denied the reports. >> i want to clear the record. i assured the parents of jasper wu that the men we believe are responsible for his death are charged with very serious crimes and they will be held accountable. >> last week members of the aapi community came out demanding an apology after price was, quote, condescending and divisive in an email sent to the community members, asking about the charges in the case. in an email obtained by nbc bay area, and allegedly written by

price, the community is told that they've been misled by local chinese community and the media. new video this morning, the late night fire at a private bus yard started about 10:00 last night at pennsylvania and 23rd street underneath interstate 280. no one was injured. the flames destroyed 12 mini buses. so far firefighters are not saying if they know how that started. a woman remains in critical condition in the hospital after being hit by a driver in san jose yesterday. police say it happened while the woman was walking on 11th and santa clara streets, about a block from san jose state. she was taken to the hospital and she's listed in critical condition. the driver did stay on scene to talk to investigators. today abortion rights protests are set to take place across the country, and right here in the bay area, including san francisco, berkeley and san jose. this video of a protest yesterday in san jose, this is where community members gathered

in front of city hall. these demonstrations, they come after a texas federal judge suspended fda approval of a commonly used abortion drug. the ruling comes less than a year after the reversal of roe v. wade. "today in the bay"'s brie jackson is joining us live from washington. brie, the biden administration is appealing this ruling, correct? >> reporter: that's right, good morning. the biden administration is pushing back and says that it is considering all legal options to ensure that the abortion pill remains available. the future of reproductive health care remains uncertain this morning, after a texas federal judge suspended the fda approval of the most commonly used abortion pill. >> this is not america. what you saw by that one judge in that one court, in that one state, that's not america. >> reporter: for now, women still have access to abortion medication, but if this judge's ruling holds up, the pills would be banned nationwide.

13 states already have bans in place. >> i think it's important that we protect the sangt tee of life. i believe in state rights. >> reporter: some democrats say the white house should simply ignore the judge's ruling and not enforce a ban. the biden administration vows to put up a fight and is appealing the decision. >> for america's sake and women's sake, we have to prevail in this. >> reporter: the issue could make its way to the supreme court, after a federal judge in washington state ruled to protect the drug in more than a dozen states. the dueling rulings set up more contentious court and political battles. >> this isn't a call to action for everyone, whether it's in the court system, when we go to vote. >> we can win this issue at the ballot box if we show up with reasonable positions, if we have our head in the sand we're going to lose. >> reporter: a new poll found 64% say abortion should be legal in all or most cases.

and new this morning, we're learning that house democrats plan to introduce a bill aimed at protecting access to the abortion pill. the measure would reaffirm the u.s. fda's final approval authority of abortion medication. but that bill is unlikely to pass in the gop-led house. >> all of that we will certainly be following. we know you will as well. thank you. 5:07 right now. oakland leaders this week take up the heated debate over ending pandemic related eviction protections. council members will take a look at a plan, debating it, to gradually phase out the city's lengthy moratorium. right now it calls for a full end to the moratorium by september, which some local landlords argue is still too far away. tenant supporters argue the phase-out is needed to give renters time to prepare. >> we knew the moratorium would end at some point, but we need a

responsible phaseout instead of just dumping people all at once onto the streets. >> before they ask any further owners to take on this responsibility, there has to be funding. because we're all going to be homeless if the banks get our property. >> eviction bans in some bay area cities and counties have already expired. alameda county's ban expires at the end of this month. we take a live look out in san jose. dark and early for you. getting set for another great day? i don't know. let's ask meteorologist kari hall. she's been monitoring what we can expect weather-wise. we are hoping to get a bit of what happened yesterday. >> we're going to have that again today, even a little warmer. so as we take a look at martinez and your morning as you're starting out the door, it's in the low 50s, all clear, and our temperatures will stay in the low 50s. we do need a jacket for the start of the day. but look at the trend that's heading upward, reaching 70 degrees at lunchtime.

so i would probably make some plans to head outdoors for lunch today. in dublin it's headed to 75 degrees, even upper 70s for the south bay. this will be the warmest day of the week. we'll talk about the cooldown in a few minutes. mike has a look at numbers going up. >> unfortunately. contra costa county has gone from one of our lows to one of our highs today. $4.17 at concord super stop on willow pass road. $4.09, that's the low for santa clara county county, calling out alliance in cupertino, a couple other options at the same price. in vallejo, the best in the bay, $3.97 at the shell on tennessee street. so good options for you reported at gas buddy. on the roadways, everyone is moving smoothly. the incident on 880 has cleared from the area right around 16th. we still have the incident on the chart here at 24, but no major problems. in fact, everything is off to the shoulder. no injuries there. a smooth drive and drive times

good monday morning. it is 5:13. it's going to be a day to enjoy more time outside, going for a hike, enjoying a little walk around the neighborhood. we're starting out in the low 50s in the east bay and reaching into the low to mid-70s and it's going to be nice and sunny. things change heading into tomorrow. temperatures dropping, clouds roll in. i'll have more in the forecast coming up. fremont, 880 moves nicely with the headlights, top of the screen on the left, you can kind of see the signs coming off the auto mall area and toward tesla, where there's a smooth flow of traffic. the pattern we expect coming out of the tri-valley. we'll show you speeds coming up. good morning. very happy monday. some pent-up buying and selling maybe on wall street. the markets were closed friday for good friday.

we've got the jobs numbers on friday and those were goldilocks, not too big, not too small. it was exactly ten years ago facebook bought instagram for a billion dollars, it's more accurate to say it's been ten years since mark zuckerberg used facebook's money to buy instagram for a billion dollars. he did it overnight, he did it without checking with the board, and we all thought at the time, oh, that's kind of crazy, a billion dollar decision on your own. well, it turns out that was a good decision. instagram probably worth $200 billion today. >> the biden administration will make big announcements about electric cars, including those that will qualify for big tax breaks. it's our understanding the tesla model 3 will not qualify for full tax credit after the deadline come this monday. so one of the reasons, presumably, this is tesla's cutting prices of its cars five times. so far this year.

it's going to warm up and turn out to be so comfortable, with a mostly sunny sky. temperatures reaching 69 degrees. we'll see a high of 66 today, san mateo low to mid-70s for parts of the east bay, livermore reaching 75 and 78 in morgan hill. going into tomorrow, notice the dip in temperatures. we'll have more clouds coming in and possibly even some spotty light showers near the coastline, mainly some drizzle. and it's going to be about the same on wednesday temperature-wise, as this system comes in. it's going to change our temperatures, cool it off a few degrees. it did get pretty warm fairly quickly. so we're going to head back to more seasonable weather for the rest of the week, after a warm start. not seeing any significant rain chances or storm systems coming our way. it's pretty dry. let's take a look at our temperatures for san jose. starting out in the mid-70s for the start of the week for today, and then look at that dip by

wednesday, the high is only 62 degrees. but we'll climb our way back up in time for the weekend. still looking at very pleasant weather throughout the week and the sunshine continues. at times it will be windy as we transition from some very warm temperatures today to some milder weather for tuesday and wednesday. mike, you were checking on the tri-valley. >> we talked about the commute building a bit, and it is a bit. dublin, 580 folks getting off, smooth drive toward the dublin interchange. travel times look great and speeds are great for 680, a little bit of slowing out of the altamont. you saw the smooth drive over the dublin interchange. we just changed from 24 to 25 minutes. that means traffic is building out of the altamont and heading toward livermore. 84 a little bit slow coming through this section. you see the sensors. there was no overnight road work or closures so smooth drive

but you know how fast those temperatures drop once that wind picks up in the evening, and we're going to see that once again. we're headed for 77 degrees in the south bay, and some low 70s for novato, mid-70s for the interior parts of the east bay, like livermore reaching 75, and 64 in san francisco. mike, you're tracking an incident headed toward the eastshore freeway? >> folks on highway 4, the transition ramp might be affected. listen up, this is west highway 4 at west 80. a crash is reported in the middle of the connecter, so that will be a factor. for folks coming down, west 80 does move smoothly past the scene and it looks like the contra costa county sheriff is on scene. i'll let you know if they need to close anything. an incident south 880, maybe on the right side of the roadway. you'll see flashing lights. no injuries reported just yet. no backup at the bay bridge toll

plaza, a smooth flow out of oakland and into san francisco. developing now, three people are in custody for their possible connection to a freeway shooting that took the life of a 5-year-old girl. >> thom jensen is live for us off of i-80 near fremont where the fatal shooting happened over the weekend. thom, so sad here. what have you been able to learn? >> reporter: marcus and laura, that shooting happened saturday night on the southbound side of i-80, near warren avenue between milpitas and fremont, where we are right now. the family of that little girl was headed to a birthday party dinner at a restaurant near here, and they said bullets tore through their car, 5-year-old eliyanah crisostomo of santa clara was hit by the gunfire and is the victim of the shooting. her family said they're still in disbelief she's gone. her family said she was excited

area, creating so many heartbreaking stories. a few notable cases we've covered, february of 2022, former cal basketball star was shot and killed on 880 in oakland during rush hour. one suspect was arrested. and just a month before that, 28-year-old david nguyen, an alameda county sheriffs cadet on his way home from training when he was shot and killed near the bay bridge toll plaza. in 2021, 20-year-old mother was killed on i-80, in the car with her fiance and son heading to a job interview when she was shot. 5:34 right now. a deadly shooting in oakland under investigation. police responded to a shot spotter activation last night on filbert street. officers found a gunshot victim when she arrived. the victim was pronounced dead at the scene. the victim's identity has not been released and so far no

arrests have been made and the motive is unclear. palo alto police are asking for help to find a suspect who sexually assaulted a woman in broad daylight, this happened shortly before 3:00 yesterday afternoon on california afternoon. the pedestrian underpass below the caltrain tracks. a woman in her 50s tells police that a man walking his bicycle suddenly struck her from behind, attacked her and then took off. the woman was walking her dog through the same underpass late last night and this reaction to that attack. >> it's scary because we passed by and we saw blood in that one. >> the victim has been treated for a laceration to her head and a bruce to her neck. palo alto police department is asking for the public's assistance. in just a few hours the man accused of a high profile attack in san francisco is set to

appear before a judge. police say garret doty beat former san francisco fire commissioner don carmignani with a metal bar in the marina district last week. carmignani remains in the hospital with injuries to his head and face. the 24-year-old, doty, is due to be formally charged at 9:00 this morning. he faces three felony assault charges. happening now, police in union city are telling drivers to avoid west of mission boulevard due to a sinkhole. the street is located in a commercial neighborhood on the east side. the hole is sitting in the middle of the street. so far, there's no timeline on repairs. moving you forward on a covid front, stanford begins major changes to its covid vaccine policy starting today. the university is lifting its vaccination requirement completely, that means people will no longer need the vaccine to go onto campus. the university still strongly is recommending people to get the vaccine as well as booster shots. the vaccine requirement will remain in effect for anyone

working at stanford health care settings in line with federal guidance. let's take a live look outside toward san francisco from sausalito. you see the bridge there, really nice start to our day. let's check the forecast with meteorologist kari hall. she's tracking the weather for us. yeah, we have such a beautiful start to the day. it's clear for many spots, except for the little bit of fog you could see there across the golden gate bridge. temperatures at 52 degrees, it is definitely a milder start. these are the kinds of temperatures we see late spring into early summer to start out the day. it will be cool in napa with a temperature at about 49 degrees. jacket now but not so much this afternoon. you will need the sunglasses because the sunshine continues as we head for upper 60s at lunchtime, eventually reaching 73 degrees. 75 will be the high in concord

today, 66 in san mateo. look at the south county, upper 70s today. now, enjoy it, because we will see temperatures dropping by tomorrow afternoon. we're going to talk about those changes coming up. mike says it's a pretty smooth drive right now. >> it is. but despite that fact, they've turned the metering lights on at the bay bridge. maybe folks are expecting a little more traffic. remember, we have this week and next week which continue with spring breaks, so you may see a lighter flow of traffic. again, the metering lights are on and the backup is forming and it is 5:37. we're looking toward the departure from oakland. departing from oakland southbound, we still have the crash on the grid around franklin, but off of the roadway. no lanes blocked. a smooth flow of traffic. the north bay, i want to call out highway 1, near marin elementary, there will be some road work, tree trimming going on, pg&e work. that will be going on, a look

the nimitz with headlights toward the fremont area. we're looking at a smooth drive despite a couple of crashes. northbound toward the bay bridge, we have the metering lights activated, so we'll talk about the build coming up. 5:42 right now. the pentagon is investigating how dozens of classified documents connected to the war in ukraine were leaked. more than 50 pentagon documents were posted online revealing details of u.s. intelligence into russia's war on ukraine. some of them labeled top secret. the most damaging documents leak shows that ukraine's combat power is relatively weak and that the u.s. spied so its allies in matters connected to ukraine. specifically that the u.s. gathered intelligence on south korea and israel. a criminal investigation has been opened into that breach. now, the leak comes as the russian invasion of ukraine rages into a second year. russian president vladimir putin is planning to stage nuclear weapons to its east in the

allied nation of belarus, which shares a southern bored are with ukraine. president putin said it would not violate nuclear nonproliferation agreements. for now, it will not change the strategy in ukraine. we talked with a journalist who has been covering the russian invasion from the start. he says this is about putin making a statement, rather than making a move. >> i think it would be suicide for putin to really be serious about this. it's probably intended, this escalation is probably intended as a kind of rhetorical device to make sure that belarus stays inside putin's strategic framework. so that he can use belarus in the future, maybe for attacking ukraine, and maybe also for saber waving against nato without actually having any clout. >> the president of belarus,

i guess. so this is right in time for the easter holiday, there's a northern california police department that has a new officer, and it isn't a typical recruit. this is percy, the rabbit. a police officer found percy several months ago, took him to animal control to be reunited with his family. when no one claimed him, percy was adopted by an officer and officer percy was quickly added to a wellness program that promotes improving mental health within the department. so he doesn't have an official title yet, but you can watch percy roaming throughout the police station, and that's a very cute recruit there. >> no kidding. >> how often do we hear the name percy? that was my grandfather's name. i rarely hear that. >> it's so tame, too. >> you should see when he gets into an aggressive mode. >> i bet. >> let's bounce to the movie

theatre. turning to the box office, super mario brothers had a movie weekend and it was record-breaking. taking me back to childhood. audiences came out to the theatres and came in droves to watch this film. the animated film based on the classic video game. the movie already earning a global total of $377 million, the film from universal and illumination has had the biggest opening of any film so far this year, and it's the second biggest three-day opening for any animated film in history. and we should note comcast, which owns universal, is our parent company. a lot of people are saying, i want to go see that. >> it looks fun. >> first i was questioning it and then i started seeing the previews and i'm kind of excited. >> it's good timing with a lot of kids off. tiger woods has withdrawn

from this year's master, if you hadn't heard. he withdrew yesterday. before the resumption of the third round. because of his plantar fasciitis. he ended his streak of completing all 72 holes, that's all rounds on all the tournaments he had ever played at augusta national. he didn't go out without a fight. woods was seen limping throughout the weekend. if you see the clips, it's very evident. he had to withdraw from the tournaments. >> he is the ultimate competitor, up there with brady and m.j. but this is going to be an uphill climb for him for the rest of 2023. i would not be surprised if tiger woods hangs up his golf shoes and his clubs, if you will, for the rest of 2023. the "today" show will have much more on augusta ahead at 7:00 a.m. dylan dryer is probably right on that. she's a golfer. >>
