"it is 7:00 a.m. on the west coast. nice to have you with us bright and early monday morning. hope you had a beautiful easter weekend. it is still going for one person and a lucky group of kids. >> yeah. al roker is at the white house. this is part of al's tradition. he is kicking off the festivities. we will check in with al a little bit later. first let's get to our top story, the intensifying showdown about abortion rights. roe v. wade turnover left it up to the states if abortions are legal. a federal judge has now issued a ruling that would halt the use of a commonly used abortion pill nationwide. this is a case that could rise all the way to the supreme court. nbc's senior legal correspondent laura jarrett is here with the latest. laura, good morning. >> good morning to you. for weeks many wondered how that judge in texas would rule in the most significant case on abortion since roe was overturned. but that judge wasn't the only

federal court that had something to say about a pill that's been on the market for 23 years. >> reporter: two judges will differing decisions. leaving the fate of a widely used abortion pill in jeopardy this morning. a federal judge invalidated the fda's approval, but has given the biden administration a week to appeal. >> the scientific judgments of the medical experts and those who did all the clinical research is now being questioned, second guessed, by one judge in one state in one court. >> reporter: at the same time, a different federal judge in washington state ordering the fda to keep the drug on the market. but that decision only applies to the 17 blue states and washington, d.c. that sued over it. someone like britney house now worried about access to the pill in the blue states. >> i had the opportunity to do this from the comfort of my home. >> reporter: britney had just graduated from howard university in d.c. when she got pregnant in the summer of 2012.

she used mifeprexone and worries that other won't be able to access it as easily. the texas decision a clear victory for anti-abortion advocates. but most lawmakers stayed silent on the ruling. the justice department worked swiftly to appeal the decision.n but some democratic lawmakers say that's not enough, calling on the biden administration to ignore the judge's order the secretary of health and human services not ruling anything out >> are you taking it off the table that you will recommend the fda ignore a ban >> everything is on the table. >> laura, we'll talk about that in a moment. but first the supreme court. i mean, generally the court will take a case when there is a conflict in the lower courts, and there is a conflict here. >> yeah, you have a direct conflict because of the washington state order of course, that only applies to those 17 states. but in those 17 plus the district of columbia states you have a directly conflicting order because of the texas ruling so the fda will say how are we

supposed to possibly comply with both i think that's why many ar expecting it to go to the supreme court quickly. >> i was going to say, can they fast track it? >> yeah, they could. they could go straight to the supreme court. that's just a strategic call for the justice department. >> we heard the health and human services secretary say could the fda just ignore a court's ruling he said everything is on the table. that's rather astonishing for any government to suggest it might just ignore a court ruling you go up and your litigate your piece in the courts. you don't ignore the courts. >> i was surprised to hear him say that, especially since the justice department already filed a notice of appeal if the fifth circuit doesn't, there have been some legal scholars out there saying the fda could ignore the ruling. but does the biden administration want to be in that position after criticizing the trump administration for years saying they don't follow the rule of law? >> yeah. it would set a precedent that could be disturbing as we go along.

thank you very much. another major story. the growing fallout from wha could be the biggest u.s. intelligence brief in a decade a trove of documents posted online that appeared to detail and exposed national secrets on everything from the war in ukraine to china to the middle east nbc's justice and intelligence correspondent ken dilanian is here with the latest how did these documents wind up online >> good morning, hoda. as officials scramble to identify the source of the leak, these documents look like pentagon briefing slides, and they include a lot of sensitive reporting from the cia and other intelligence agencies, including some labeled "top secret." most are about the russia-ukraine war there is intelligence about iran and israel, south korea and france believe it or not, the open source intelligence agency says one of the first place these documents appeared was on a video game chat server, of all places, devoted to the online

sensation minecraft. the pentagon said last night that the documents appear to contain sensitive and highly classified information they stood up in interagency effort to assess the impact on national security. the images we have seen look like photos of printouts but that itself could be a head fake to disguise how they were stolen >> why don't you put this in perspective to us? how damaging is this to the united states? what kind of damage control is the government in right now? >> look, this breach has been deeply embarrassing for the united states because it fuels perceptions around the world that our spy agencies just can't keep secrets on the intelligence gathering front the markings show that a lot of the information came from communications intercepts and other digital spying work. any exposure of that is considered really harmful because our adversaries, such as russia, might be able to figure out where it came from and shut it down. the justice department will be looking into whether this was a hack, a leak, a russian spying

it will decide if any of the eight officers involved will be criminally charged city officials are taking steps to guard against any possible unrest jesse, what do we expect today >> reporter: good morning. this special grand jury selection comes after a more than nine-month investigation into walker's death. you mentioned the 25-year-old was shot according to officials 46 times in an incident involving 8 police officers who are now all on administrative duty police have said that there was a car chase, a shot came from the suspect's vehicle, then a foot pursuit and then finally walker was shot and killed officials have also said that a gun was found in his vehicle as you mention, this is a proceeding about figuring out if any of the officers could face trial. 7 of the 9 special grand jurors that are impanelled will have to decide if they feel there is probable cause, then an indictment could be issued and then we could see a trial for any or all of the officers
