bullets in the east bay. the search for the suspect right now, and all of this coming days after a 5-year-old girl was killed in a separate freeway shooting. a key ruling is blocked overnight affecting women in the bay area and the country. and then the decision made overnight about the commonly used abortion drug. plus -- facing resignation calls. the renewed efforts to get senator dianne feinstein to give up her seat. her reaction this morning. this is "today in the bay." good morning to you on this thursday. thank you for allowing us to be part of your morning. i am marcus washington. >> i am laura garcia. we begin with breaking news, another deadly overnight interstate shooting happened in the east bay, and this happened on 580 near the lakeshore avenue

off-ramp and park boulevard in oakland. there were bullet holes in the driver's side of the truck that crashed into the pole following the shooter. it's not clear if the driver died from gunshot wounds or in the crash. no others are being reported in the vehicle at the time of the accident. as of right now the lakeshore avenue exit is closed but the lanes on the highway are open. we will have a live report in our next half hour. right now we want to get you caught up with what is going on in the forecast. meteorologist, kari hall, is monitoring that for us. >> we are starting out with jacket weather with low 40s in fremont. we are seeing temperatures in san francisco to start in the upper 40s. as you are heading out in oakland, we will continue to see

temperatures in the upper 40s for the next few hours. 52 degrees at 9:00. notice it will be nice and sunny as we go throughout the morning, and slowly warming up as we head to the mid-60s here and low 60s for the peninsula. we will talk about the weekend ahead coming up in a few minutes. >> thank you. more breaking news, and this time nationally a federal court of appeals is blocking a judge's ruling to block the use of the drug mifepristone. drew, california is among the states looking at the chance the ban could be a reality here. >> yeah, the ban set to go into effect on saturday is partially blocked. last week a district judge in texas suspended the fda's

original approval of mifepristone from the year 2000. the appeals court ruled for now the original court does not have the authority to do that because of the statute of limitations, but the decision upholds the target of in order to get mifepristone patients will still need to have three appointments with their doctor and the pill may only be used within the first seven weeks of pregnancy. in its ruling the appeals court said it would expedite consideration of the case. >> drew, the justice department does still have the ability to ask the supreme court to completely block that original ruling there, but if it does it faces an uphill battle? >> yeah, i mean, obviously it could face an uphill battle. it was a 6-3 majority in the supreme court that overturned

roe v. wade and opened the door to some of the laws passed across the country, and that majority still exists. under that assumption there could be a similar ruling in this indication, although president biden speaking in ireland today repeating he thinks the administration does have the law on its side and feels confident going to the supreme court in this case, and we will see if it ends up in the supreme court, one, and two, what that ruling is. >> thank you so much. speaking of washington this morning, new calls from a bay area leader for senator feinstein to resign. she insists she's not going anywhere. she's been recovering from shingles and working remotely from home. she last cast as senate vote on february 16th. and ro khanna now calling for her to resign, saying feinstein cannot fulfill her duties

especially when it comes to judicial committees. ro khanna is also helping organize the campaign for barbara lee. >> it looks like he's moving this along in lee's favor. >> for now senator feinstein is requesting senate leader chuck schumer to ask lawmakers to allow another democrat to fulfill her spot in the judiciary committee, which he may do as soon as next week. and the race for senator feinstein's seat is well under way, and there's representative porter, she's from orange county, as well as congressman

adam schiff. bay area representative, barbara lee, she is throwing her hat in the race recently and she represents the bay area in the house of representatives since 1998. in a major win for santa clara county a superior court judge is ordering calvary church in san josé to pay up for fines in the height of the pandemic. this battle has been going on for a while, emma. >> reporter: that's right, laura. calvary chapel is on the hook for $1.2 million. but the county claiming the church violated the indoor masking requirement while holding indoor church services.

this legal battle goes back to early on in the pandemic when in 2020 calvary chapel sued santa clara county over claims the public health orders violated the constitutional right to religious freedom. the court largely dismissed those claims, but santa clara county fought back and sued the church saying the church violated many of the public orders. and the ruling applied only to one count, indoor mask wearing. the attorney representing calvary chapel says the fight is far from over and plans to file a motion for reconsideration and/or appeal the case, and the battle could go on for years before a resolution is reached. and calvary chapel claiming the

county illegally surveilled churchgoers. >> thank you for that details. berkeley council members will hold a closed door session voting on whether or not to make the police chief permanent. her confirmation vote was supposed to be last year but that was delayed after a pair of scandals within the department. interim fire chief has led the berkeley fire department since june, and this is after his predecessor retired from berkeley and took another job. city leaders did not say if there were other candidates are under consideration. and then helping to break

ground on a interim housing site in san josé. when completed it will offer more than 200 rooms in what is reportedly a first of its kind facility. it will be built faster and more cheaply than traditional housing models. let's look outside live, looking at san francisco. kari is tracking our forecast for this thursday morning. how are we looking? >> looks good. those temperatures yesterday felt more chilly because of the gusty winds. it's still going to be windy today, at least through 11:00 we have a wind advisory in these areas in orange, but a lot of the wind funnels through sacramento valley, and we feel the gusts may reach up to 45 miles per hour.

we can still see the gusty winds that will be with us throughout the morning. elsewhere we are looking at breezes at about 15 to 20 miles per hour and may kick up to about 25 in san francisco and even 30 later this evening. that's when the temperatures will start to drop after hitting the highs reaching in the mid to upper 60s for later today. so as we take a look at these numbers, it looks like it's going to be another nice one. this is what we are going to see into the weekend. i will have a look at that coming up in just a few minutes. coming up on "today in the bay," the latest inflation numbers show it's getting more and more expensive to eat at restaurants. plus, not much care for self care. the surprising number of men paying less attention these days to their hygiene and grooming. also, a real-life twin for the popular peanut pup, snoopy. we will we will

of now. we will see when the metering lights come on. i will monitor that and a look at bay area traffic coming up in a few minutes. happy thursday to you. checking local stocks, meta, facebook's parent company is now about 45% lower than its all-time high as that company tries to figure out whether it's bet on virtual reality will pay off. bloomberg quoting analysts who expect tesla to cut prices on cars again. that would be the sixth cut this year. we're not expecting a lot of movement on the markets on the open because we are waiting on the latest reading of the producer price index. the ppi measures the changes in prices producers receive for goods and services they sell, so the ppi is a predictor of inflation because the higher prices will be passed on to

consumer. the consumer price index, the cpi is a lagging indicator because it shows what we paid last month. inflation has peaked and is falling. that means all the interest rate hikes my finally be taking affect, and maybe we don't need more of them. the next fed meeting is in may. the cpi also told us the cost of eating out has gone up again faster than the price of groceries. it's always more expensive, of course, to go out to eat. this is the first time in a long time the data show prices at restaurants rising faster than prices at the grocery store. i don't know about you, but sometimes i am shocked when you get that restaurant bill. there are a couple restaurants i have gone to that add a 20% service charge, that is not the tip. i don't go to those anymore. i get that they got costs, but so do i.

los gatos hitting 68 degrees. the same in martinez and napa. on saturday it will be beautiful out there. another nice one and slightly warmer with some of our inland valleys reaching the low 70s. make plans to get out there and go for a nice long walk, by yourself or the family, doesn't matter. and we are watching this, and we are looking at a slight chance of rain in the forecast on tuesday and possibly early wednesday and the rest of the week is looking dry as that high pressure returns. look at the temperatures, still going up and down. it's fairly mild and then warming up to 72 on saturday, and upper 60s on sunday. early next week, as people go back to school and work, in the low 60s, so a taste of winter

freeway shooting. what are you learning? >> reporter: yeah, yet another bay area shooting on the freeway off of the lakeshore off-ramp in oakland. you can see the car that was involved crashed into that pole, so all of this is under investigation. here's what we know so far. it's early in this investigation, but according to chp they are saying it happened roughly around 12:00 a.m. that driver eventually crashing into the pole i showed you there, following the freeway shooting. again, it's right near the off-ramp, the 580 off-ramp near lakeshore avenue. it's unclear if the driver died from the bullet holes or when that driver drove into that pole. unfortunately, it's an all-too

common incident. last week, a 5-year-old was shot and killed while riding in her car along 880. that suspect is still at large. and then jasper wu also was shot on 880 while he was asleep in his parents' car. we are still waiting to get more information as far as if any arrests have been made. it's too early to tell on what the motives are, and as we get more details we will bring that to you in the news room. pete suratos for "today in the bay." >> becoming all too common. >> very much so. pete mentioned the case of jasper wu. that case now leaving one bay area district attorney under fire of opponents.

new alameda d.a., pamela price, is showing signs she could be too soft on crime. among them, jasper wu's friends and family. price calls the recent criticism a false narrative with racial over tones manufactured by her opponents. >> i won because people did not trust this office. we're here because this community did not trust this office and for good reason. this office has a long history of over criminalizing young people, over criminalizing black and brown youth. my predecessor fought against criminal reform.

a former fire commissioner is expected to be arraigned. prosecutors have charged the man with felony assault. new this morning, the president of san francisco's board of supervisors is putting pressure on the mayor's office over the use of drugs around city hall. london breed to be confronted about the crisis playing out each day in the city civic center, and this is an area for the open air drug markets and open air drug use. a spokesperson said breed is

judgeships. that's a huge problem. feinstein has asked to be temporarily replaced on the committee, and she has not said she will resign. she said she will not run for re-election, but it was a california congressman, ro khanna, who publicly said it was time. she said while she has had a lifetime of public service, it's obvious she can no longer fulfill her duties. now, california congresswoman, nancy pelosi, disagrees saying i never have seen them go after a man that was sick in the senate that way. there have been calls for senators to step down for health reasons before, notably john mccain, after he revealed he had cancer. generally those calls don't come from colleagues. feinstein has had an extraordinary record of leadership, and leading the

assault ban and women's rights and mayor of satisfy. we are waiting on president biden to comment publicly about the issue. he's in ireland marking the 25th anniversary of the good friday agreements. he will address the irish legislature at 9:00 a.m. our time. there could be a break in the leaked document case soon. "the washington post" says it has talked to a friend of the leaker, a minor that the post did not name. that source says the leaker works on a u.s. military base and has allowed reporters to view more than 300 pages of material that have not been made public. while the post did not share its findings with the fbi, the fbi is good at pulling on threads. nbc has not confirmed anything in the "washington post" report. >> thank you so much, scott.

we are going to reach 66 in mountain view. 68 in martinez. upper 60s in santa rosa. south bay in the mid-60s for today. and tomorrow, reaching 68 degrees in morgan hill and the same in livermore and martinez. san francisco topping out at 60 degrees. and saturday we are looking at the same and even warmer for some inland valleys. los gatos reaching 71 degrees there. we will see low 70s for concord. the mid-60s for oakland on saturday afternoon. looking over all at what to expect over the next few days. dry conditions continue. next week we could see a possibility of slight rain chances starting late monday into tuesday. it's showing spotty light showers but not a significant storm here. much of the rain has been drying up before it gets here. by the end of next week, we are back to the dry conditions but
