deluth. what do we know about the man suspected of leaking this information? >> reporter: that's right, the fib has arrested without incident the suspected leaker, janell teixeira, an air national guard airman, 21 years old, in massachusetts. obviously nots of a high rank. we don't know why he had apparently such access to so much classified and sensitive material. he did work in the intelligence wing of this national guard unit in massachusetts. now, at least for the government's view, they have got a suspect. they hope that at least there will be no further damage, but even as we speak, the pentagon and the administration are still trying to gauge and evaluate the damage that has been done by these documents, dozens of them, possibly hundreds that were

posted online initially to a private chat room, and the discord gaming app, but then it spread, of course, and finally last week exploded across news media. just a week later now, the fbi has their suspect. >> i just want to note that people are seeing on the screen video just coming into us. this is in massachusetts. this is apparently the apprehension or the arrest of this person. i don't know exactly what we're looking at, but that's new video out of massachusetts. dan, u.s. intelligence agency, they didn't spot these documents online for weeks. they were out there, they were on discord and other sites. what kind of concerns does that raise in the intel community, that this stuff was out there and nobody noticed? >> this is a difficult question. some republican lawmakers are asking very critical questions i think it is moment, what's different about previous

episodes of leaks, this suspect was apparently not setting out to tell the world about these secrets. he was sharing with a very small group of people, and at the moment also, there aren't indications it was somehow orchestrated by a foreign adversary. this is a new situation in terms of leaks. i think there are to the questions that the intelligence community is trying to tackle right now, which is, did he have authorized access to these documents, or did he gain unauthorized access. the other question is, are they going to scale back the pool of people. >> he'll have an initial appearance at the u.s. district

court. >> dan, what happens next? this person i assume could be up for some pretty serious charges. >> yes, the attorney general was citing the removal, retention and transmission of national documents. that is a very serious crime, and we will now await possible charges. they no doubt will probably have searched his house. they will be questioning a lot of people connected to this chat room that he reportedly was involved in, and allegedly was sharing classified documents. i think we also still don't have a full picture of the potential motive here of this suspect. i think we're going to be hearing more about that at some point. then, again, the discussion about why the u.s. did not know these documents were floating online. this will raise yet again questions about how much legal

it's at a plastics recycling for a silt, forcing 1500 people from their homes. there's concern the smoke may be drifting into new areas of the city. ron allen, that's easy to believe the smoke could be moving, impacting more people. we just got an update. is there any timeline on when people can go home? >> the short answer is no. they said the fire is still burning. smoke is still billowing out from the site. they said that they're doing a lot of air sample ling, yet they don't have results yesterday. what they found so far is not alarming. they said this could be another couple days or so. they also said there's been some debris that has blown from the fire scene out into the residential area. it was tested, found to be positive for asbestos, a

cancer-causing material. they warned residents not to touch the material, not to disturb it if they find debris on their property. the fire chief was asked, when can people go back home? there's still some 1500 evacuees. here's what he had to say. >> i want to get some air sampling back, get the fire extinguished, i want to get the plume taken care of to where it's not floating into the neighborhoods per se. >> reporter: they hadding saying saturday was the day when they thought all of that would happen and the fire would be out. there wassing some interesting information about the facility itself. the city and the owner had been involved in a years-long fight about the conditions at that place. there have been a court order forcing them to shut it down. the facility was not operating as a recycling plant or storage site at all. the owner was only trying to

remove materials, doing it slowly. the city was very frustrated by the process. the city has been trying to solve a problem. they said there wasn't a question of if, but when there would be a fire. we still have not heard anything from the owner. >> ron, quickly, what do we know about the owner? >> we have not heard from them. they have not released his or her name, as far as i can tell, but they gave more detail about the ongoing legal dispute between the city and the owner of this facility. the city went so far as to buy some property at the site somehow, so they could go on to the property and start the remove process. it's been described as six buildings, 14 acres, wall to wall with plastics, and how it

have had for a drug to be removed. the fda has generally found great latitude before the united states supreme court on matters that go back nearly a century in terms of challenges brought by different petitioners and states involving fda decisionmaking. historically the supreme court has been given great deferens to the food & drug administration, but in this case, in a highly politicized court, it's not clear how the supreme court would rule. >> i'm wondering if the supreme court -- i'm get ahead of ourselves here, but if there were a ruling, what kind of precedent would it set if they ultimately removed the approval. what would that mean for drugs moving forward? >> it's an excellent question, which is what makes this a

highly unusual case for all of us to watch. that is, that it would mean usurping from the fda in a way its role in deciding what drugs are safe for the u.s. marketplace. it could also mean petitioners, who have some sort of hostility toward a particular drug -- for example, there's a number of people who don't believe that covid is real, people who believe that medications that have been used in vaccinating folks in order to prevent the spread of covid that that's harmful. one could see people peating the court, finding particular judges they would hope to give some support to their viewpoint. so this opens a door to pandora's box, unfortunately. >> michelle, great to have you with us. thank you.

good morning, everybody. first of all, i would like to express my deepest condolences to the family and friends of mr. robert lee, known as bob lee. i'm going to be brief on the details. but here is the summary and the update. on april 4, 2023, at approximately 2:30 a.m., san francisco police officers from southern station responded to the 300 block of main street for a report of a stabbing. officers arrived on scene and located the victim later identified as 43-year-old robert lee, suffering from an apparent stab wound. officers summoned medics to the scene and administered aid. despite efforts by first responders and medical personnel, mr. lee died from his injuries. the san francisco police department homicide detail responded and took over the investigation.

our homicide investigators developed information that identified the suspect as 38-year-old nema momima of emoryville, california. we can confirm they knew each other. however, we will not be able to provide further details at this time regarding the evidence that confirms that information. this morning, members of the san francisco police department's investigations bureau and tactical unit served several search warrants and an arrest warrant. mr momima was booked on one charge of murder. i would like to remind everybody that this is still an open and

ongoing investigation. we will not be able to provide further details at this point. before i turn this over to our district attorney, i want to assure everyone that our investigators have been working tirelessly to make this arrest and bring this case to justice for the lee family. and his loved ones. just as we would for every homicide that occurs in the city. i would like to thank our homicide investigators led by detective brett ditmer and detective thomas mcwilliams. also lieutenant kelvin sanders and our homicide team. i said from the start that i have every confidence in the men and women and the members that work homicide. they have an 85% clearance rate year to date. that is expected to go to 92% because we just solved a 1994 case yesterday as well. we never give up finding justice.

announce the charges against mr. momeni for the murder of bob lee. the charges that we are filing today include murder in violation of code section 187, as well as a special allegation also known as an enhancement alleging that this murder was committed with a knife. as for next steps, as i know you are eager to follow this case, he is expected to be arraigned in department 10 of the hall of justice tomorrow afternoon at 1:30 p.m., my office will be filing a motion to detain him without bail to ensure that he remains in custody during the pendency of this case due to the obvious and severe public safety risk that we believe that he poses to the public. i want to end by saying, thank you to mr. lee's family and the people of san francisco for being patient with law enforcement during the course of this investigation.

i know that everyone has wanted answers since this tragedy happened. while nothing can heal the pain of mr. lee's loss, thank you for putting your trust in the san francisco police department and now in my office to ensure that we seek justice in this case. i acknowledge and understand how the lots of a young, vibrant leader, an innovator, has rocked our city and beyond. since taking office last july, i have worked tirelessly to ensure that people in san francisco not only feel safer but actually are safer. even one murder is too many. regardless of the facts, violent acts like this are jarring to us all. as you already heard, mr. lee was murdered by somebody that he knew. while we are not going to release any additional facts at this time, i must point out irresponsible statements like those contained in mr. must's tweet that assumed incorrect

circumstances about mr. lee's death serve to mislead the world in their perceptions of san francisco and also negatively impact the pursuit of justice for victims of crime as it spreads misinformation at a time when the police are trying to solve a very difficult case. we all should and must do better about not contributing to the spread of such misinformation without having actual facts to underlie the statements that we make. victims deserve that. and the residents of san francisco deserve that. while public safety continues to be a top concern and priority for every resident and businessowner in san francisco, i will continue to work with the mayor and our police chief and other city leaders to ensure that public safety in our city continues to improve. i have dedicated the last eight years of my career to holding some of our city's most violent offenders accountable.

on this case. there is still evidence we need to locate. we are very limited in what we need to say at this point. i want to re-emphasize what has been said by me and the district attorney. at the end of the day, we want to make sure we get justice for the families and mr. lee. i really appreciate everybody's enthusiasm to get information. but we have to put the case first. we won't be able to go into details about any evidence today. >> what can you tell us about the suspected on the victim's time together before the incident? how long were you tracking the suspect? >> the evidence shows they knew each other. that's as much as i can say. this case started over a week ago. we have been working around the clock since then. the things will come out as this case proceeds. particularly when it gets to court. at this point, that's about as much as i can say. i will say this, we have been on this around the clock, from the start.

i just want to make sure that the world knows that we have other homicides that we work just as hard on. i understand and appreciate the interest in this case. that's not lost on any of us. but let's not forget that we have lost other lives in this city. and there's work to be done on those cases as well. >> you can say anything about the motive? was it an altercation that erupted, a fight, anything about that? >> can't say anything about the motive at this point. we do know they knew each other. the evidence has told us that. >> good morning. my question is, how would you respond to the people who portrayed this death to make san francisco out to be a lawless and crime ridden place? >> what i will say to that is, this is more about human nature and human behavior than it is about our city.

you take this out of san francisco, they knew each other. put it in another city. i'm not going to name any other city. i don't want to do that to any other city. put it in any other city. i don't believe it would have changed the circumstances one bit. this is not about san francisco. it happened in san francisco. that is unfortunate. it's even more of a tragedy it happened at all. this speaks to human nature. facts show and research shows that most people who commit homicides know the people that they kill. the research shows that. i do understand how people see and view things. i see it. i read it. i live here like you. but this has nothing to do with san francisco. this has to do with human nature. i don't have that information right now. in terms of what mr. lee had on him, that will come out as far as the investigation, that will come out as the investigation proceeds. thank you. >> you said there were two warrants served. is there any expectation of another arrest or anyone else involved in this that we should be aware of? >> the case is not closed yet. at this point, we are focused on the person that we know is the suspect. the case is not closed. it's an ongoing investigation. this is right now -- he is our focus and a single suspect in this case. let me clarify. we served two search warrants in san francisco and an arrest warrant and search warrant in emoryville. >> were you -- why was the arrest made now? was there new evidence in the case? how early on did the department know he was the suspect? >> in any investigation, when we

get to the point where we are comfortable that we have enough evidence to make the arrest and we are comfortable, this is where working with our district attorney's office really matters. just as an aside, it's not too common where you have a district attorney who prosecuted homicides and a chief of police who has worked homicide. we understand the nuances with these investigations. we both do. so we appreciate the work that our teams, our respective teams do. but when we work together and we communicate, we know at which point, because we are taking advice from our prosecutors, when we are ready to proceed with an arrest, when we have enough, when they feel comfortable enough we have a case we can move forward with. once that's done, we will make the arrest. that's what happened in this case. >> let me just say this. the police arrest standard is probable cause. whether they hand a case over to my office, the standard is

beyond a reasonable doubt. we have to remain in communication about when enough evidence has been mounted not simply for an arrest in a case like this but so that when the d.a.'s office is handed a case that we have enough evidence to prosecute to our standard, to charge and to prosecute to our standard, which is higher than the police arrest standard. >> has he been under surveillance? it sounds like you knew he was a suspect. >> what i will say is this. we said multiple times now that we are not going to discuss any other facts about this investigation. this is still an ongoing investigation. we are not at the end of the road. we are truly at the beginning of the road. my office has to, again, have sufficient evidence to be able to prosecute this case to a jury, which to do that, his department still has more work to do. at this time, we would ask you respect that fact. we have a family who is entitled to justice here in this case.

the only way that can be delivered to them is if we protect the integrity of this ongoing investigation. >> people have indicated the motivation for the attack was a personal entanglement between mr. lee and a member of the other man's family. is that an area of focus? do you have a comment on that? >> i don't have a comment in terms of confirming or not confirming that. i will say, ongoing investigation. we know they knew each other. we know that much. we have confirmed that. it there is work to be done. what i don't want to do is put out information that's going to come back and haunt us or the prosecution of the case. i understand how hard that is. i know everybody wants answers. please be patient with us on this. we definitely -- we are where we are in terms of the arrest, the filing of charges. there's more work to be done though. thank you. >> a few more after this.

>> chief, with regard to what you have just said that you treat every homicide case the same way, there was a murder back in june of this year, less than a year ago, his name was samuel st. pierre. his parents are from arizona. you have the make of the vehicle, the person shot. it was in the marina. his family wants to hear you say that you are still working as hard as possible. what do you say? that has not been solved. >> we are. we are working as hard as we can on those cases. sometimes evidence comes together, and sometimes we have evidence that we have to continue to develop. we have to continue to corroborate. every case is different. we are working that case. i'm familiar with all cases. we are working that case. we don't give up. i mentioned earlier, we just

solved a case from 1994. let me be clear. every case is not solved. i wish that were the case. i wish that we could solve every case. we try our best. but we don't give up on these cases. if there's active evidence that we can follow, we continue to follow those cases. we solved cases this year from prior years. what i would say to the public is, we don't lose hope. please don't lose hope if your case is still out there. we know some cases go dormant. we invested resources in cold case investigations. we hire retired officers, retired investigators to assist in these cases. we have a cold case unit. we don't give up on these cases. if the evidence takes us to an arrest, we will make that arrest. with that case, we still have more work to do. we will do more work. thank you. >> absolutely it does. our members work ten hours a day. when you have a homicide investigator that basically is spending the night in his office, that's done on overtime. as you all probably might imagine, the onset and the first week or so of a case, the first couple of days, you are hot on leads. we work very hard. our folks work very hard. yes, you can't do that without the resources. i'm grateful that the mayor put that to the board. i'm grateful for the board for approving that. otherwise, we can't do what we do. most of our homicides, there is a pretty significant amount of overtime that we have to expend. working weekends, nights. then when the trials come, we
