this week because we know the supreme court is now taking a hard look at this. as of right now, again, they have paused those lower court decisions, which essentially cast doubt about the availability of it all of that is on pause right now. but the justices want to hear from the plaintiffs that originally brought this case by noon tomorrow. and after that point, then the court could rule at any time. that's when we might see some critical action, after noon tomorrow >> and, laura, this is interesting because the justices have a couple of different paths that they could go down. tell us what they are and what the implications are. >> yeah. there's a couple different scenarios. the justices could essentially grab the case for themselves and decide they want to hear it and go through oral argument and hear from all the parties on both sides or they could decide to keep this pause essentially in play while the case goes back down to the fifth circuit court of appeals. in that case is status quo would be maintained. everyone would get access to this pill but you would see the same thing playing out, just in the lower courts

or the justices could deny what the justice department and the biden administration want here, which is you would see more restrictions on this pill, but the case would, again, still be down in the fifth circuit. so a lot of different scenarios. the key question is whether access to the pill is maintained while the case plays out that's what the justice department and the pill manufacturer want. >> all eyes on that case all eyes on another case, this one involving religious freedom, individual religious freedom and also the post office. talk to us about this one. >> this is an interesting one. so a devout christian, a former postal worker doesn't want to work on sundays. he's happy to work on every other day but sunday because of his religion he would like that day off limits his employer tried to make accommodations for that for a long time but at a certain point said, sorry, this isn't going to work anymore he quit and sued and used a civil rights law that said you can't discriminate on the basis of religion. however, for a long time, the court has said employers

essentially can do what they need to to make reasonable accommodations, especially if there is a hardship on the actual business, then you can't. right? you just can't you have to find someone to cover the shift. the fact that the case is coming before the supreme court is super interesting because it suggests the justices might want to take a second look at it. >> great to see you, laura. also this morning senate republican leader mitch mcconnell is returning to a full schedule on capitol hill today, following a six-week absence after a fall nbc senior capitol hill corresponden garrett haake joins us for more on all of this. garrett, good morning to you what is the latest on mcconnell's recovery >> reporter: good morning. look, his whole recovery process has been kept private. mcconnell fell at an event more than a month ago and almost no one outside of his closest aides laid eyes on him until we saw him coming back to the capitol on friday. a broken rib he suffered in that fall

>> reporter: this morning, a desperate search for three american sailers lost all the coast of mexico is underway. the mexican navy and u.s. coast guard scouring a 2,500 square mile search area at sea for husband and wife frank and kerri o'brian and their friend william gross. all are said to be experienced sailors. the o'brians are licensed coast guard captains. none have been seen in nearly two weeks. >> we're pleading for anyone out there to be on the lookout. we miss you so much and love you so much. we just want you to come home. >> reporter: the trio was on their way to san diego and last heard from on tuesday when they set sail for a mexican port city. they planned to stop for supplies in cabo san lucas two days later, but the coast guard says there is no record of them arriving, and their location is unknown. >> there is no confirmation they had filled the vessel's fuel tanks, nor confirmation they took on food and supplies.

>> reporter: the group was traveling on the sailing vessel "ocean bound" with minimal technology onboard. they may have encountered winds over 30 knots. and 20-foot waves. >> it is significant. it could have affected how fast they were able to travel on the coast. >> reporter: their disappearance coming after four americans kidnapped, likely by drug cartels in the border town. while the three missing sailors set sail from a do not travel zone, the coast guard says they are strictly focusing on the search and rescue operation. >> hopefully somebody sees them and gets them to make contact or relay some messages out there. >> reporter: this morning, the families of the lost sailors hopeful their experience at sea will help them make a safe return home. again, this is day 13, and the coast guard tells us they don't believe those sailors had enough food or fuel onboard after

your past. your mom wanted to be a country singer and taught you and your siblings how to sing three out of four of you would go on to sing. what was that like to see her dream come true for her kids >> she was as nervous as we were when we got on stage, she would hold somebody's hand and squeeze it so hard so nerve racking for her she was channelling all her energy to us and she would mouth every word we sang >> living vicariously through you. >> yeah. because she didn't get to do what she wanted to do. that's what she said to me when i was first going to nashville i was dreading it. she said if you don't want to do this let's go on home. if we go on to nashville, i'll be living all my dreams through you. i said, shoot, why didn't you say that in the beginning? yeah, let's go. >> when she passed, it was hard for you. you had to find a spark to find that passion for music again what was that that re-sparked your love of music >> i think it was my anguish, my sadness that momma was not going to be with us on earth anymore i told my little sister, i don't think i want to go back. she said, you will get it back.
