a good tuesday morning to you. thanks so much for starting your morning with us. i'm marcus washington. >> i'm laura garcia. let's start with a look at the forecast. meteorologist kari hall is tracking what we can expect. >> we had some early-morning rain that moved through this morning. it is in and out, with a possibility of some lingering showers in the north bay. elsewhere we are going to see things drying out. and this is a cold front that's quickly sweeping through the bay area, dropping our temperatures. in dublin right now, still some wet roads in some spots, but overall we'll have a chance to dry out. we're feeling it, though. it's 43 degrees and it's going to stay cool throughout the morning. noon, it's only 55 degrees. cool today, but warming up as we head toward the end of the week. i'll have more on that coming up in a few minutes. >> thanks, kari. in just a matter of hours, a pivotal meeting gets under way for those trying to make it in the bay. the oakland city council will vote on whether to end the

city's eviction moratorium. >> "today in the bay"'s kris sanchez is joining us. this has been a hotly contested issue for both renters and owners for months now. >> and not just in oakland, but all around the bay area. but oakland's eviction moratorium is really on its last legs. landlords could start evicting people who are behind in their rent as early as next month, unless something gives this afternoon. at 4:00 this afternoon, oakland city council members will finalize the wind-down of the eviction moratorium which has been in effect for three years. the moratorium is set to end in july on the 15th, but tenants behind in rent could be evicted in may if they can't prove that their late rent is covid related. that is in response to pressure from landlords who say some renters are really abusing the protection policy and leaving landlords holding the bag. to balance this out, the council may block landlords from evicting tenants who owe less than one month's rent.

it is all a delicate balance. >> we're proposing a phaseout approach that we think is reasonable and thoughtful in terms of avoiding an eviction cliff that could lead to dramatic homelessness and allowing certain evictions to proceed. >> i pay taxes and no way in hell should they get away with this kind of stuff. this is mad. if it wasn't for chase bank, i would have lost my house. >> alameda county supervisors are allowing eviction protections. so every municipality did their own thing after the whole california eviction moratorium ended, but like i said, the county-wide protections are ending. >> we knew they would be coming. in oakland, neighbors in the fruitvale district are demanding more security from oakland mayor as well as the police chief.

they held a meeting last night to discuss their demands for change. this comes after multiple daytime shootings near the arise high school. the principal is among those calling for change. >> there was not just one gunshot. i counted around nine, at least. and it was an extremely traumatic event. >> she says violent crimes are on the decline compared to last year, but they admit they are struggling with an understaffed police force. neighbors say they want more by lingual officers on the street and police to work together. neighbors hope law enforcement officials and city leaders can provide a solution in the next three months. breaking news, a russian court is upholding the detention of american journalist evan gesh cove its. the 31-year-old was detained in

march accused of trying to get classified information about an armed factory. happening today the high profile case between dominion voting systems and fox news gets under way. the company is suing the cable news outlet for more than a billion dollars. it claims fox spread false claims that its voting machines rigged the 2020 election in favorite of president joe biden. "today in the bay's" drew petrimoulx is with us. this could set a precedent. >> it has far-reaching implications, not only for the fox news empire, but for first amendment protections. opening statements expected this morning in a delaware courtroom. the case pitting the fox news corporation against dominion voting systems, centering around false claims made about the 2020

presidential election. dominion supplied vote counting systems in dozens of states. the company claims fox news personalities knowingly pushed false and wild accusations that it rigged the election for joe biden. >> we cannot allow america's election to be corrupted. >> this is an election nightmare. >> reporter: dominion is demanding $1.6 billion for damages to make up for lost business. fox news says its broadcasters are protected by the first amendment. >> what dominion has to prove is that fox actually new the statements were false. a number of people have said the standard is way too high. >> experts say the case is a major threat to fox news, whose top personalities hold significant sway in american politics. especially among republicans. >> the clock is ticking, because behind the dominion case there's another lawsuit filed by smartmatic, other legal pressure from stockholders.

it doesn't get any better for them after this. >> the case revealed text messages between high profile fox anchors, ridiculing former president trump and his legal advisers. the trial could cause more embarrassment for the network if those anchors and executives are called to testify. >> reporter: now, this trial is actually starting a day late. the "washington post" reporting that the delay was meant to allow both sides more time to negotiate a possible settlement. jury selection is set to resume this morning and the trial is expected to last six weeks. reporting from washington, back to you. >> drew, thank you very much. happening today, opening statements are set to start for the north bay social media influencer accused faking the kidnapping of her kids. she claimed a couple attempted to abduct her kids while she was shopping at a petaluma michael's store. the video she posted went viral before police concluded it was a

lie. sorensen has denied any wrongdoing. she is charged with three misdemeanor counts of making a false report of a crime. the trial gets under way 10:30 this morning. let's take a live look at san jose. meteorologist kari hall is tracking some rain this morning. >> it moved through early this morning. roads may be wet as you get ready to head out. you can leave the umbrella at home. we'll see a slight chance for showers in parts of the north bay and take a look at these temperatures. another cool one. we're only going to reach 60 degrees in fremont today and 60 in martinez. upper 50s for the inner bay, as well as up toward napa and novato. but it would be warming up soon. we'll get a look at that in a few minutes. mike, you were following up on an issue in fremont. >> as we look at the big view, everything is mostly smooth. we did have a cluster. we've sorted it out. it is not mission boulevard, it is the warren off ramp here north of tesla, where a disabled

we made it past monday. right now as you're heading to work in burlingame, we're starting out with upper 40s up and down the peninsula. it's a cold morning. and also kind of wet after early-morning showers. but it dries out today, but it does stay cool, only in the 50s throughout the next several hours. we'll get a look at some warmer weather in our forecast in just a few minutes. and we're looking at highway 92, to and from the peninsula, moving very smoothly right now. i'm looking at the pavement because we can see good spacing and i don't see any major slick roadways. we have seen drops fall on the lens in fremont and san francisco as well. there may still be wet pavement

on the on and off ramps. that's the concern, especially the off ramps. good morning. very happy tuesday to you. china reported its latest economic growth, very strong. china, as you know, gave up on its zero-covid policy, so it's economy is changing. the death toll associated with that, we don't know for sure. therapeutics in china basin says it will lay off about 50 people. apple now offering a savings account for its apple card. you sign up from your phone. the savings rate is 4.15%, way more than what most banks are offering, as interest rates go up on borrowing, interest rates on savings go up, too. it's only fair, right? now, some smaller banks that don't offer enough of a return on savings are seeing their depositors bail out for better offers elsewhere.

>> the canadian broadcasting corporation temporarily pausing use of twitter after elon musk labelled it government funded. the cbc objected, so musk changed it, as you can see right there, to 69% government funded. now, the cbc is government funded, just the way the bbc is, but it's entirely independent from the government in ottawa. the law specifies the cbc's editorial independence. musk was on the tucker carlson show last night where he talked about twitter and the massive layoff of staff. >> how do you run the company with only 20% of the staff? >> it turns out you don't need all that many people to run twitter. >> but 80%, that's a lot. >> yes. i mean, if you're not trying to run some sort of glorified activist organization and you don't care that much about

censorship, you can let go of a lot of people, it turns out. >> musk claimed the u.s. government could read everyone's direct messages. he provided no proof that was true. he's scheduled to speak at a big advertising conference in miami later today. advertisers are reportedly uneasy about the whole thing. worried about what they say is racist rhetoric. there were emails published showing those concerned about the reputation hit the conference could take by allowing musk to appear. an nbc executive will be asking musk questions at this conference. i've asked as a reporter, not as an employee for comment, they referred me to the conference organizers, who never returned any messages. so we'll see how it goes today or if he comes at all. >> right. >> thanks, scott. >> you bet. we're moving you forward. ahead of earth day, saturday, this morning, we're shining the

spotlight on technology aimed at eliminating food waste. according to the federal government, americans waste about 30% to 40% of the food supply. a company called too good to go is trying to change all that. the app has teamed up with restaurants throughout the country, including about 700 in the bay area. it sells food that otherwise would have gone to waste. a spokesperson tells us too good to go connects users with restaurants that will sell you surprise bags of food at one-third of the retail price. >> so users actually don't know exactly what they're going to get through too good to go, they just know they're coming in to pick up food that's perfectly good to be eaten and then the restaurant can put whatever they have in that surprise bag for the user. >> too good to go tells us that it saved about 5 million meals in the u.s. that otherwise would have been thrown out. and we're getting a first look at one of the companies taking part in the bay area. in fact, this ice cream is part of the project. >> here you go. which one do you want?

>> all right. >> salted caramel chocolate nibs. >> nibs? >> yeah, little chocolate nibs. >> oh, this is delicious. that's it, it's over. i'm having ice cream for the rest of the day. that was delicious. >> really good. >> i'm going to eat while you're doing your homework. >> i'll go ahead and get started. it is cold, and we've had some chilly weather, but now we have another cold front sweeping on through the bay area. earlier this morning we had some showers and now it's just a little bit farther to the south of us, so it continues to move away. there's still some lingering, very light, spotty showers in parts of the north bay, but for the most part we're going to be drying out today. take a look at san francisco right now, roads are still wet, we had a nice little refresher earlier this morning. and now we're getting ready for the a's game later this evening. it's going to be in the mid-50s and mostly sunny.

it's also going to be windy and it's going to be cool out there, so make sure you're dressed with lots of layers, because those temperatures continue to dip later on tonight. we're only going to reach 59 degrees today, a lot of these temperatures much cooler than what we typically see. and eventually it's going to start to feel a little better. by thursday we're in the low 60s. tomorrow, i should say, we're in the low 60s and thursday in the upper 60s and low 70s and that leads us to a nice and warm weekend. no more chances of rain in the forecast after today. and today's chances are very slight. most of us won't see any wet weather. as we get a look at the next several days in morgan hill, people have freshly planted gardens, you're looking forward to warmer weather, you're going to get that this weekend, we're possibly going to hit 80 degrees. we're going to see that on friday into saturday, and then just a little cooler for the end of the weekend into early next

week. overall the sunshine continues. we go back to it later today. and eventually it's going to warm up and start to feel a lot nicer around the bay area. mike says right now the commute is pretty smooth. >> everything is smooth because i just had ice cream. we're looking great around the bay. a smooth drive, the green sensors dominate the map. slick roadways in patches because of overnight sprinkles. we're looking at no major slowing. i'm watching the little blips, 5:21, about the time we see slowing. we're seeing those signs of the early commute but no problems and no backups at the bay bridge toll plaza. as far as travel times, these are the minimums you'll see, so 14 minutes from highway 4 down to the bay bridge. that's the most extensive part of the eastshore freeway commute. back to you. >> thank you. next, nbc bay area responds. >> today is technically tax day,

battered the bay area back to back to back to back, both uncle sam and the state gave us a breather. they pushed back our tax filing deadline to october. everyone in every bay area county now has until october 16th to file your tax returns and pay your tax bills. both state and federal. a couple things, if you expect a refund and you have time to file now, well, why wait? get your money asap instead of waiting until october. you should get your money quickly, especially if you file electronically. >> most refunds, if error-free, for the most part or mistake-free, three weeks or less. >> here is another reason to file now. imposters sometimes file bogus tax returns in people's names to steal refunds before the real taxpayers claim those refunds. that scam creates a mess that will take you a year, along with the irs, to fix. so the sooner you file, the more

>> i'm marcus washington. let's take a live look outside as we get a look at what we can expect from the weather. meteorologist kari hall is tracking what we can expect. do i see rain on the screen? >> yeah, it moved through earlier this morning. now it's leaving the bay area with wet roads and a little bit of dampness as you get ready to get this tuesday morning started. most of us have seen the rain clear. as we get a look at hayward, temperatures are cooler. we're in the upper 40s and we're going to stay there through about 8:00 and then start to see our temperatures warming up into the mid-50s. it's going to be cool, only reaching 60 in fremont and upper 50s for parts of the north bay. we'll talk about warmer air in our forecast. mike, you're tracking a traffic break. >> we still have it. it looks very dramatic now. this is southbound 101 across the golden gate bridge. notice coming out of the robin williams tunnel, just as you get to the top of the bridge, the north side things are slow. they're moving the crews.

by the time these folks get to the end of the bridge, the crew will be clear and the traffic break will be recovering. we'll have quick recovery. but for the time being, just as the sensors change, it will clear. 37, highway 4 showing more slowing than just ten minutes ago. the bay bridge toll plaza, a little slowing on the incline. we'll see metering lights and we should see 680 clearing in the next ten minutes. back to you. >> thanks, mike. this morning the warriors are suddenly in uncharted territory. >> to move on in the postseason, they're going to have to do what they've never had to do before, that is come back from a 0-2 series deficit. last night fans gathered outside of oracle to watch game two against the sacramento kings. just like in game one, the score stayed very close. but the kings came out on top. dub nation is still confident that the team can turn things around. >> it's definitely disappointing to see them, like, lose, but i

there's no longer any living survivors from the quake. >> reporter: unfortunately, no. you're correct. the last living survivor of the 1906 earthquake, who was 3 months old at the time, passed away back in 2016. the city still commemorates the great quake, as it's known, that destroyed the city. they do it every year. right now we're across the street from delores park at 20th and church where the fire department is going to be spray painting that fire hydrant gold. this is the location of the fire hydrant that was still working at the time, 117 years ago, that the fire department back then used to save the mission district, which was obviously on fire, as the whole city was. i want to show you video from about a half hour ago this morning on market street in san francisco. this is where a lot of the survivors met after the great quake. there was a moment of silence. and then the city, as you can hear right there, they sounded the sirens to, again,

commemorate -- they were trying to commemorate the exact time, this was 5:13, but they went a little early. usually it's at 5:13 when the quake hit. this is some old footage of the aftermath of the quake. again, 117 years ago. it's estimated the quake was a magnitude 7.9, killed roughly 3,000 people and burned down most of the entire city of san francisco. this morning mayor london breed explained why we still commemorate this quake, frankly, because it's to recognize the resiliency of this city. >> we saw the same resiliency during the global pandemic when none of us knew exactly what covid was and what it meant. we knew that there were lives that would be lost, but first responders time and time again continued to show up and be there for the people of the city and county of san francisco. that's why it's important that we celebrate, to remind us what

happened in the past, so that we cannot only begin to prepare for the future, but we can also remember what we are as san franciscans, not what other people define us as, but who we know we are. >> reporter: and the city pointed out that san francisco, the bay area for that matter, still under threat of another great quake. we sit right here on the san andreas fault. they encourage people living in the city to sign up for alerts and there will be an emergency preparedness fair this weekend from 11:00 to 3:00, they can help you go over the things. you want to have the 72-hour bag, your provisions and that sort of thing. we're waiting for them to spray paint the fire hydrant to gold. again, this is the fire hydrant across from delores park where the original fire hydrant was that saved the mission district. reporting live in san francisco, bob redell, "today in the bay." >> 80% of the city was damaged

from that quake. it could be felt all the way down to salinas. so interesting. thank you, bob. happening today, we are expecting to learn more about two freeway shooting investigations that includes a freeway killing, investigators say, look the live of eliana , and her family were driving when the shooting happened ten days ago. three suspects now face charges in her murder. prosecutors say the trio believed her family's vehicle belonged to a rival gang member. the chp plans to deliver an update in a news conference on that case as well as another shooting that happened the same day in fremont. it will start at 1:00 this afternoon. happening this afternoon, in antioch, outraged community members plan to march from the police department to city hall demanding reform and accountability. this comes in the wake of that explosive racist text messages that first were released in a

report last week by contra costa county district attorney's office. prosecutors yesterday releasing a second investigative report containing more text messages. many of those texts were sent and received by police department members who the chief says are not currently patrolling the streets. 17 officers were named in the two reports, the fbi is also taking part in that investigation. happening today, an affordable con plex breaking ground aimed at trying to help those make it in the bay. listen to this, your rent could be under $1,000 a month. it will go up near levi's stadium near lafayette street. partners for the $81 million project include google and the city of santa clara. residents with an income range of about $35,000 to $106,000 are encouraged to apply. studio apartments start as low as $850 a month. work is expected to be completed for early 2025. this morning scientists are

raising concerns over a potential new covid subvariant being reported in 29 countries. it's being called the arcturus variant. the world health organization says they have been monitoring the variant since last month, after an uptick of the variant in india. as dr. peter chin-hong explains, it brings covid symptoms that many associate with allergy season, pink eye and dry mouth. >> that is more red eyes, sticky eyes, not a lot of pus in the eyes. it looks like pink eye. more common in kids than adults. and then a little more propensity to high fevers. >> doctors say if your eyes are feeling itchy, it may be a good thing to just take a covid test to be sure. many, including dr. chin-hong, don't believe that this variant

good tuesday morning, as you head out in the peninsula. we're taking a look at palo alto. it is clear, 46 degrees. it's also damp outside. we had early-morning showers. the rest of the day is going to be clearing out, but staying cool, and it's eventually going to warm up. more on that coming up in a few minutes. i told you it wouldn't take long for this to clear and it didn't. all of the headlights easily driving from the north bay into san francisco. crews have cleared.

russian president vladimir putin makes a surprise visit to the occupied kherson region of ukraine. new video showing him visiting the headquarters of an army group to discuss that ongoing war. kherson is among four ukrainian regions russia annexed last september. it's not clear when he made that visit but the video was released just now. russia's war in ukraine has turned into a stalemate. back in d.c., republicans say they will block any attempt to temporarily replace california senator dianne feinstein on the judiciary committee. the 89-year-old democrat has been absent from the senate for weeks recovering from shingles. feinstein asked for a temporary replacement for her seat after calls for her to resign. her absence leaves president biden's judicial nominees in limbo. republicans say they are not in any hurry to appoint any of his picks. the republican leader of the house is challenging president biden to make a deal on the debt

ceiling. >> scott mcgrew, the president says that is not the sort of deal that he wants to make. >> they just don't want to make a deal at all. good morning. we've often compared the debt ceiling to a consumer paying his or her credit card bill or mortgage. you don't make a deal with your spouse over whether you're going to pay the mortgage this month. it gets paid. you deal with your household budget after you get the mortgage check in the mail. president biden taking that line of reasoning. we can negotiate over the budget later, but we've got to raise the debt ceiling now. something mccarthy and the republicans did three times under president trump with no conditions. this time mccarthy has conditions, no negotiation, no action on the debt ceiling. >> the day is coming. i do not want to see this president bumble into a default. i want to sit down and solve the problem together. >> now, to be clear, raising the

debt ceiling is not the president's job. if it were, biden would do it himself. congress raises the debt ceiling. president biden just signed an executive order designed to expand america's access to child care, increasing pay for head start teachers, improving child care access for veterans, among other things. now, this order depends on existing funding, so we'll have to see if it has the effect that he's hoping for. he'll speak on the issue later today. >> this is a ford mach-e. the biden administration just released a new list of what does and does not qualify for big ev tax credit, and this one only qualifies for half the maximum tax credit on the new list because its battery is made overseas. the promise of $7,500 in tax credits comes with the words may qualify and up to. the new list that gets the null amount is on our website,

toward the animals. you'll see him waving his arms, they scatter, barking and diving into the water. the marine mammal center tells us law enforcement has been informed and they are investigating. >> not cool. happening today, it is tax day and that means it is the last day for most americans to file their taxes. however, many californians have until october 16th to file their taxes. this is if you were impacted by the recent winter storms. here's some tips. if you're scrambling to file, make sure you have all your documents ready and make sure your information is accurate. then, book an appointment with a tax preparer or go to irs.gov to file your taxes. lisa greene-lewis from turbotax explains that you should always be aware of schemes. >> the irs are never going to reach out to you via email or text, so definitely don't give any information out over email, like social security numbers.
