influencer scheduled to face a judge. the hoax prosecutors claim she orchestrated all in an effort to go viral. this is "today in the bay." and a terrific tuesday it is, we want to thank you for joining us. i'm marcus washington. >> i'm laura garcia. we're going to check in with mike, but first let's check in with kari. what happened to the spring-like temperatures we had this weekend? >> it's coming back. it will be back for the weekend. we're taking a bit of a break today. we had early-morning showers that rolled through fairly quickly and are already pushing to the south. there may be some very isolated showers in parts of the north bay, but in spots like mountain view, we're headed for more sunshine for today, as our temperatures go from 45 degrees this morning to 52 at 10:00, and reaching the upper 50s. it's still going to be a cool day, feeling like winter out there, and as we head through the next few days, we're back to spring. we'll talk more about that in a few minutes. mike, you have a crash

affecting the commute through hayward. >> we do. look at the green sensors around the bay, despite the rain and slick pavement, we don't have any major problems. this is causing a problem, the crash south 880 just past the 92 interchange. we see the slowing with the build coming down into hayward out of san leandro. this may affect folks heading toward the san mateo bridge. once you get on 92, a live look shows an easy drive across. good spacing, less spacing. folks are making their way to the peninsula, no problems on the peninsula. the bay bridge actually looking pretty good. the backup in most of the lanes back to the end of the parking lot, just starting to build. this is fill in over the next ten minutes. back to you. >> thanks, mike. in just a matter of hours a pivotal meeting gets under way. the oakland city council are going to vote on whether to end the city's eviction moratorium. >> "today in the bay"'s kris sanchez joins us. this has been a hotly contested

issue for renters and owners for months. >> today oakland's moratorium is possibly on its last leg. landlords could have evicting people who are behind on their rent as early as next month unless something changes tonight. tonight oakland council members will finalize the wind-down of the city's eviction moratorium, which has been in effect for three years. it's set to end july 15th, but tenants behind in rent could be evicted in may if they can't prove that their late rent is covid related. so balance that, landlords could evict ten ends under just cause, however they have to show substantial damage or unreasonable behavior. some landlords have been pushing for balance in the policy, saying that some renters are abusing the protection policies and leaving them holding the bag. >> we're proposing a phaseout approach we think is reasonable

and thoughtful in terms of avoiding an eviction cliff that could lead to dramatic homelessness and really allowing certain evictions to proceed. >> i pay taxes, and no way in hell should they get away with this kind of stuff. this is mad. if it wasn't for chase bank, i would have lost my house. >> alameda county supervisors did allow the county-wide protections for those unincorporated areas to expire at the end of april. >> so a lot of people are saying that we could see a wave of evictions. do we know how many people we're talking about? >> because oakland's protections lasted so much longer than other communities, we do have a sense of that and the alameda county development agency put together a report they released not long ago saying there could be about 5,000 households that are subject to eviction when the protections end. and that is based on what happened in santa clara county when the eviction protections ended and contra costa county. so there's a little anecdotal data. >> interesting to follow.

thank you. also in oakland, neighbors in the fruitvale district are demanding for more security from oakland mayor as well as the police chief. they held a meeting last night to discuss their demands for change. it comes after multiple daytime shootings near arise high school. the school's principal among those calling for change. >> it was not just one gunshot. i counted around nine, at least. and it was an extremely traumatic event. >> opd is saying violent crimes are on the decline compared to last year, but they admit that they are struggling within the department with understaffed police force. neighbors say they want more bilingual officers on the street and police from neighboring cities to work together. neighbors hope that law enforcement officials and city leaders can provide a solution within the next three months. it's 6:05. breaking news just coming into our newsroom. a russian court is upholding the detention of american journalist

evan gershkovich, being held on spying allegations. russia's federal security service detained the 31-year-old in march and accused him of trying to obtain classified information about a russian arms factory. gershkovich, his employer and the u.s. government, all deny he was involved in spying, and they are demanding his release. happening today, the high profile case between dominion voting systems and fox news gets under way. the company is suing the cable news outlet for more than a billion dollars. fox spread false claims that its voting machines rigged the 2020 election in favor of president joe biden. this morning in a delaware court room. the case pitting the fox news corporation against dominion voting systems, centering around false claims made about the 2020 presidential election. dominion supplied vote counting systems in dozens of states. the company claims fox news personalities knowingly pushed false and wild accusations that it rigged the election for joe biden. >> we cannot allow america's election to be corrupted. >> this is an election nightmare. >> reporter: dominion is demanding $1.6 billion for damages to make up for lost business. fox news says its broadcasters are protected by the first amendment. >> what dominion has to prove is that fox actually knew the statements were false or reckless disregard. a number of people have said the standard is way too high. >> reporter: experts say the case is a major threat to fox news, whose top personalities hold significant sway in american politics, especially among republicans. >> the clock is ticking for fox on this because behind the dominion case there's another

lawsuit filed by smartmatic, another voting machine manufacturer. other legal pressure from stockholders. it doesn't get any better for them after this. >> reporter: the case already revealed text messages between high profile fox anchors ridiculing former president trump and his legal advisers. the trial could cause more embarrassment for the network if those anchors and executives are called to testify. now, this trial is actually starting a day late. the "washington post" reporting the delay was meant to give both sides more time to negotiate a possible settlement. jury selection is set to resume this morning for a trial that's expected to last about six weeks. reporting from washington, i'm drew petrimoulx. back to you. >> it will be interesting to see. will they settle at the 11th hour or move ahead? thanks, drew. 6:08 right now. happening today, opening statements are set to start for north bay social media influencer accused of reporting a fake kidnapping attempt three

years ago. katie sorensen claimed a couple attempted to abduct her kids while she was shopping at a michael's store. the video went viral before police concluded it was a lie. sorensen has denied any wrongdoing. she's charged with three misdemeanor counts of making a false report of a crime. the trial gets under way at 10:30. we take a live look outside in san francisco. a beautiful start to the morning. meteorologist kari hall has been monitoring what we can expect across the bay area. we did have some rain move through earlier this morning. >> yeah, you can't even tell that it rained overnight. we're seeing the sky starting to clear already as we take a live look outside in dublin. the roads may be damp this morning and maybe even around the playgrounds if you're going to be going out this morning in castro valley. temperatures in the low 50s. it's going to be partly cloudy and overall still a cool day. we'll keep the jackets on. we're only headed for 60 in

says it will lay off about 50 people. united airlines just announced a bunch more routes out of sfo. christ church, sydney, melbourne. they say it's the biggest expansion in aviation history. apple is going to offer a 4.15 interest rate on savings. you have to get the apple card. this is a tremendous interest rate availability. interest rates have been going up for quite some time and that's mostly on what they charge you to have credit. but now savings as well, and many banks are offering higher interest rates. what else shall we talk about? that's the 4.15%. this is an amazing rate. but, again, you have to sign up for the card. let's talk about twitter. the cbc is saying that it is going to temporarily pause

twitter use after twitter labeled it government-funded media. cbc complained and you can see musk then changed it to 69% government-funded media. now, the cbc actually is government funded, the way the bbc is, but it's entirely independent from the government in ottawa. the law specifies cbc has editorial independence. elon musk was on the tucker carlson program last night where he talked about twitter and the massive layoff of staff. >> how do you run the company with only 20% of the staff? >> it turns out you don't need all that many people to run twitter. >> but 80%, that's a lot. >> yes, i mean, if you're not trying to run some sort of glorified activist organization and you don't care that much

about censorship, you can let go of a lot of people, it turns out. >> musk claims before he came to twitter the u.s. government could read everyone's direct messages. there's no proof that's true. he's scheduled to speak at a big advertising conference in miami later today. advertisers part of the conference are reportedly uneasy about the whole thing, worried about what they're calling his racist rhetoric. there were internal emails published showing the heads of major corporations talking very frankly about musk's appearance today. we did reach out to several organizations, including nbc, which is taking part. nbc referred us, and again i contacted them as a reporter, they referred us to the conference, repeated calls and emails to the conference resulted in nothing. >> thanks, scott. >> you bet. a missouri bald eagle going viral for his quest to be a dad.

the sanctuary outside of st. louis says that a rock became the focus of the 31-year-old's eye. murphy even began sitting on it, hoping that it would hatch. earlier this month an orphan eagle arrived, after the baby's nest was blown away in the storm. murphy stepped up and adopted the little one, getting a chance to be a dad, after all. and the pair had to be separated due to murphy protecting the baby too aggressively. they are now back together. >> so murphy got what he wanted. manifesting from a rock. >> just wanted to be a dad. we're moving you forward ahead of earth day this saturday. today we're shining the spotlight on technology aimed at eliminating food waste. a government report indicates americans waste up to 40% of the food supply. one company called too good to

go is trying to change that. the app is teaming up with restaurants throughout the country, including about 700 right here in the bay area. it sells food that otherwise would have gone to waste. a spokesperson tells us too good to go connects users with restaurants that will sell you surprise bags of food at one-third of the retail price. >> so users actually don't know exactly what they're going to get through too good to go, they just know they're coming in to pick up food that's perfectly good to be eaten and then the restaurant can put whatever they have in that surprise bag. >> too good to go tells us that it saved about 5 million meals in the u.s. that otherwise would have been thrown out. i don't know about the surprise meals there, because if you have an allergy, what's for dinner? we're getting a first look at one of the companies taking part in the program actually here in the bay area, in fact, this ice cream is part of the project that they're doing.

very slight chance that the north bay could see a bit of rain. even that is clearing up as we get a live look outside in oakland. we're starting out our tuesday morning with a few clouds, and even as we head into the evening, eventually that's going to be clearing up. a cool day as those gusty winds continue, and if you're going out to the a's game tonight, it's going to be about 55 degrees at first pitch. and those gusts close to 20 miles per hour. wear extra layers because it's going to be chilly tonight as it dips down to the upper 40s. but that's after hitting 59 degrees today. we'll see a high of 60 in fremont and low 60s for much of the east bay, and also looking at highs in the low 60s for santa rosa. tomorrow it's going to be a touch warmer, reaching 62 for parts of the east bay, the inner bay, and then for the south bay to about 64 degrees. for thursday it's even warmer, with some 70s popping up here, with morgan hill reaching 71

degrees, 71 in fairfield, and in concord. and looking ahead, it's going to be fairly quiet. we had light showers with most of us getting about a tenth of an inch of rain or less, and that's about it for about the next week. if you were hoping to get some water on the lawn and the garden, that's not in the cards for us for quite a while. and our temperatures warm up significantly. check out morgan hill going from 60 today to 80 on friday. so if you are looking forward to spring weather, you've got it. it's going to continue in the forecast throughout the weekend. mike, you're starting to see a backup on the nimitz. >> if you were looking for relief, they just cleared the lanes, i'm told. chp's report says everything is off of the roadway. south 880, we should see a better flow of traffic. there's still a buildup coming down through san leandro. look, 238 even at speed now. that's easing off of the bulk of the commute coming through 580. we'll see more slowing because we've got a lot more traffic

which pauses this morning to remember the great quake that flattened the city in 1906. >> and a call for more accountability. the police department scandal sending shockwaves through one east bay city taking a new turn. the action advocates are organizing today. this is "today in the bay." good tuesday morning to you. 6:30 right now. i'm laura garcia. >> i'm marcus washington. we do have a lot to get to. first we want to get you caught up on the forecast. meteorologist kari hall has been tracking light showers this morning. >> that has moved in and out and now we're back to the sunshine for today. but don't expect it to be very warm. now we're seeing a cold front sweeping across the state, and as we get a look at our temperature trend for vallejo this morning, starting out clear, temperatures in the low 40s. we'll see a mix of sun and clouds, but for the most part we're staying in the 50s, only reaching 60 in martinez and concord.

san francisco reaching 57 and low 60s for the south bay. it's going to go back to spring eventually. we'll take a look at that in the forecast coming up. mike, you said something about a car fire. >> the car was engulfed in flames, so that sounds dramatic, but notice it was the eastbound direction and that's green sensors. it's off the side of the road and it must not be a spectacle because we don't see any slowing. no injuries reported. that's great news. westbound does show slowing, but that's a typical pattern. i'll keep my eyes on that part of the south bay. 101 is starting to build. south 880 recovering from the earlier crash near 92. 92 itself shows slowing on the high-rise. same thing for the arrows throughout the east bay, there's of course a backup at the toll plaza and the metering lights. we begin with a somber commemoration in san francisco. today marks 117 years since the great earthquake.

the 7.91906 earthquake destroyed the city. >> bob redell is live for us in san francisco. an emotional moment a little more than an hour ago. >> reporter: good morning to you, marcus and laura. it ended right here at 20th and church with this fire hydrant. this fire hydrant is significant because this is the location of the fire hydrant that saved the mission district 117 years ago, that the firefighters used to keep the district from burning down. this is video from moments ago, what happened here. people, including firefighters and the ordinary citizens, came up here and they spoke about what the city means to them or if they had any personal connections to the earthquake in terms of their ancestors, and then they spray painted this fire hydrant gold. it's a tradition that started a number of years ago to recognize the significance of this location as far as it saving the mission district. this is from earlier this morning, 117 years ago, at 5:13 in the morning, that's when the

earthquake struck, and a lot of people gathered at the fountain afterwards. so there was a moment of silence. it was supposed to be at 5:13. they did it a little earlier. the fire department set off their sirens, again, to recognize what happened, the destruction and the death. this is some footage, aftermath of that quake. roughly 3,000 people died. we believe about 80% of the city burned down. it's estimated that was a magnitude 7.9 quake that occurred when the san andreas fault ruptured. there are no living survivors of the quake, but mayor london breed did speak about why they still commemorate this tragedy, and it's to celebrate the resiliency and recognize the resiliency of this great city. >> we saw the same resiliency during the global pandemic when none of us knew exactly what covid was and what it meant.

we knew that there were lives that would be lost, but first responders, time and time again, continued to show up and be there for the people of the city and county of san francisco. that's why it's important that we celebrate, to remind us what happened in the past, so that we cannot only begin to prepare for the future, but we can also remember what we are as san franciscans. not what other people defined us as, but who we know we are. >> reporter: and the city is also using this commemoration to remind people to assign up for alert sf to help you prepare for an earthquake and they're letting people know they're going to have an emergency preparedness fair this saturday at the civic center in san francisco. reporting live, bob redell, "today in the bay." >> it's nice they continue to come out and commemorate and dress up. >> never forget the past. >> definitely. thank you, bob.

happening today, we are expected to learn more about two freeway shooting investigations that includes a freeway killing investigators say took the live of a 5-year-old. she and her family were driving southbound on 880 near the mission boulevard exit when the shooting happened ten days ago. three suspects now face murder charges. prosecutors believe the trio believed her family's vehicle belonged to a rival gang member. the chp plans to deliver an update at a news conference on that case, as well as another shooting that happened on the same day in fremont. that starts at 1:00 this afternoon. happening this afternoon in antioch, outraged community members plan to march from the police department to city hall demanding reform and accountability. it comes in the wake of the explosive racist texts first released in a report last week by the contra costa county district attorney's office. prosecutors yesterday releasing a second investigative report containing more text messages.

many of those texts were sent and received by police department members who the chief says are not currently patrolling the streets. 17 officers are named in the two reports and the fbi is also taking part in that investigation. this morning, scientists are raising concern over a potential new covid subvariant being reported in more than 29 countries. it's being called the arcturus variant and it is a subvariant of the powerful omicron. the world health organization says they have been monitoring the variant since last month. this is after an uptick in the reported variants in india, as dr. peter chin-hong explains, the variant stands out and brings a new covid symptom that many may associate with allergy season, pink eye and dry mouth. >> that is more red eyes, sticky eyes, not a lot of pus. it looks like pink eye. more common in kids than in adults.

and then a little more propensity to high fevers. >> with this, doctors are saying that if your eyes are feeling itchy, it may be good to just take a covid test. but many, including dr. chin-hong, don't believe that the variant will cause a major surge like we've seen in the past. this morning, the warriors suddenly in uncharted territory. >> to move on, they're going to have to do what they so far have never had to do before. they're going to have to come back from a 0-2 series deficit. last night fans gathered outside of chase center. this is the game against the sacramento kings, game two. just like in game one, the score stayed close, but the kings, sadly, came out on top. dub nation is still confident that the team can turn things around. >> it's definitely disappointing to see them, like, lose, but i still have hope. i think that they'll be able to defend themselves.

some of the cooler temperatures behind that system that moved through this morning. and overall it's going to be a chilly day. castro valley is only going to reach into the upper 50s this afternoon. we will eventually see a lot more sunshine and then our highs reaching 60 degrees in fremont, 60 in martinez. looking forward to warmer weather, we'll see it starting to warm up tomorrow. that trend continues into thursday as well. before you know it, we'll be seeing 70s and possibly some 80s in spots. we'll talk more about that in a few minutes. mike, you were studying the slower sensors. >> the pattern is varying. we're seeing predictable spots, usual suspects. and now slowing into novato develops, as well as slowing into walnut creek for southbound 680. a little more traffic in that area than yesterday. we're seeing slowing through american canyon heading west. that's unusually heavy. i'll check for incidents, but nothing reported. we are looking at what will be ahead of you tonight from 5:00 to 5:00 a.m., they're still doing the clearing and the

good tuesday morning. the time is now 6:44. let's head to the north bay with a look at san rafael. it was raining earlier this morning. now things have cleared out. as we go into today, it's mostly sunny and temperatures going from low 40s to mid-50s. it's going to be a cool day. we'll take a look ahead to warmer weather in a few minutes. you said cleared out. i'm trying to manifest this for the san mateo bridge because i just learned the reason for the slowing is a disabled vehicle mid span in the commute direction. we'll talk about alternates and i hope i have a better update coming up. russian president vladimir putin makes a surprise visit to the occupied kherson region of

ukraine. new video showing him visiting the headquarters of an army group to discuss the ongoing war. kherson is among four ukrainian regions russian annexed last september. it's not yet clear when he made the visit, but that video was just released. russia's war in ukraine has turned into a stalemate. back in d.c., republicans say they will block any attempt to temporarily replace california senator dianne feinstein on the judiciary committee. the 89-year-old democrat has been absent from the senate for weeks recovering from shingles. feinstein asked for a temporary replacement for her seat after calls for her to resign. her absence leaves president biden's judicial nominees in limbo. republicans say they are not in any hurry to appoint any of his picks. the republican leader of the house is challenging president biden to make a deal on the debt

ceiling. >> scott mcgrew joins us. the president says that's not the sort of thing you make deals over. >> that's certainly his argument. we've often compared the debt ceiling to a consumer paying his or her credit card or mortgage. you don't make a deal with your spouse over whether you're going to pay the mortgage this month. it gets paid. you deal with your household budget after you get the mortgage check in the mail. president biden has that same line of reasoning. we can negotiate over a budget later, but we have to raise the debt ceiling now. something mccarthy and the republicans did three times under president trump with no conditions. this time mccarthy there on the right has conditions, no negotiation, no action on the debt ceiling. >> the day is coming. i do not want to see this president bumble into a default. i want to sit down and solve the problem together. >> now, to be clear, raising the debt ceiling is not the president's job. if it were, biden would just do

it himself. congress raises the debt ceiling. president biden just signed an executive order designed to expand americans' access to child care, increasing pay for head start teachers, increasing improvements and access for veterans, among others. the order depends on existing funding, so we'll see what effect it actually has. the president will speak about the issue later today. >> this is a ford mach-e, an electric car from ford. the biden administration just released a new list of what does and does not qualify for big tax credits, and the mach-e will only qualify for half the maximum tax credit because the battery is made overseas. as we were saying last week, the promise of $7,500 in tax credits comes with the words "may" and "up to". the new list is on our website, nbcbayarea.com. >> lastly, mitch mcconnell is back on the senate floor after taking a nasty fall in march.

>> it's too bad you can't do back in the day where you could go to the airport and go inside and eat. >> greeting people at the gate. olden days. >> now you can't even take peanut butter. >> or yogurt. thanks, tsa agents. >> at least our weather is just like what people travel to go see. it's also going to be a really nice day, a little bit on the cool side. we can do better in terms of our temperatures, and we will. so here is a live look in san jose. it starts out cloudy early, earlier this morning we had showers that passed by. it's clearing out and we have nice weather for the a's game tonight. it's just going to be cool. at first pitch it's only going to be about 55 degrees, and the wind will be picking up. so we'll have some of those gusts reaching about 20 miles per hour throughout the evening. and then the temperature is going from upper 50s to low 50s, and then upper 40s.

so it's going to be chilly out there tonight. only reaching 60 in fremont. we're looking at upper 50s and low 60s for much of the north bay. tomorrow we start to see temperatures going up a few degrees, so reaching the low 60s for hayward tomorrow, about the same in oakland and san mateo reaching 60 degrees. some mid-60s for the tri-valley. then look at thursday, a few spots will reach 70 degrees. but overall upper 60s across the bay area. and we're going to continue to warm up as dry weather continues. in fact, very few sprinkles that we had this morning, that's about it for the next week. if you're hoping to get some water on the garden or lawn, it's going to be dry. and our temperatures warm up. this is what we've been looking forward to. take a look at san jose. our trend for the next ten days, we go from 60 today to 70 on thursday. 80 degrees on friday. and then just a little bit cooler for the weekend. but the mild weather extends into next week and the sunshine

will continue. mike, you're seeing delays for the san mateo bridge. >> absolutely. and this is what we're talking about. things are jammed up across the span from the hayward side to the high-rise. it looks like the high-rise is moving a little better and that might mean a good situation there. the delay i saw looked like, from the cameras i'm able to access, i think it was very close to the high-rise. so if it is moving better on that shot, that might mean they cleared the lanes. but 12 miles per hour per hour. dumbarton bridge, that's your alternate. an easy drive. a little more slowing off of 880. the south bay shows 101, 87 and 85 showing slowing. the build traditional at this time. the rest of the east bay commute showing a typical pattern. back to you. happening now, we're still awaiting the results of a vote over whether teachers and school staff in oakland will hit the

picket lines. last night the oakland education association started voting on whether or not to authorize a strike. union educators are demanding higher wages and accuse the district of action in bad faith in contract bargaining. ousd says it is confident it can reach a deal with the union. if the strike is approved, it will be the second in a month. dozens of teachers walked off the job back in march. a quick look at the top stories this morning, including brand new recommendations on a covid booster shot for some people. >> and some people who are renting in oakland could see eviction moratorium protections coming to an end. we'll talk about the discussion that's on the table. >> coming up, a major new move against tiktok. montana has become the first state to block the popular app from being downloaded. so what does that mean for other users across the country?

month. >> reporter: under the proposal, the oakland city council could take up, landlords could start evicting people who are behind in rent as early as may. those are tenants who are behind in rent who can not prove that their late rent is covid related. the entire moratorium is set to end july 15th under the proposed wind-down. landlords would be allowed to evict people for just cause if they can show substantial damage or unreasonable behavior. on the other hand, tenants could not be evicted if they owe less than one month's rent. the alameda county community development agency estimates that county-wide about 5,000 household could face eviction once the protections come to an end. >> thank you, kris. we continue to follow some breaking news this morning. a russian court upholding the detention of american journalist evan gershkovich. the wall street journal reporting that he's being held on spying allegations.

he was detained in march and accused of trying to obtain classified information about a russian arms factory. gershkovich, his employer and the u.s. government all denying that he was involved in spying, and are demanding his release. also breaking, the fda authorizing a second dose of the updated covid booster for older adults and people with weakened immune systems. those 65 and older can get a second dose of pfizer, biontech and moderna's booster four months after their last dose. the cdc is meeting tomorrow to talk about the issue. if the panel votes in favor, shots could begin immediately. we are expecting to learn more about two freeway shooting investigations that includes the freeway killing investigation that took the life of a 5-year-old. she and her family were driving south on 880 when the shooting
