to them. charges that could send this homeowner to prison for the rest of his lifer. this morning, mounting calls for justice after a missouri teen was shot when, according to his family, he simply rang the wrong doorbell. 84-year-old andrew lester, the kansas city homeowner who is white, is facing first-degree assault and criminal action charges for shooting the 16-year-old, who is black. the high school junior went to pick up his younger twin brothers thursday night. but his family says he accidentally went to the wrong home and rang the bell. according to the probable cause warrant for his arrest, lester thought ralph was attempting to break in and was, quote, scared to death. >> there was a racial component to the case. >> reporter: clay county prosecutor zachary thompson says he never crossed into lester's home. and alleges he was shot through a glass door with a revolver. lester also said, don't come

around here. civil rights attorney says he was shot twice, including once in the head. after he was shot, running for help, knocking on multiple doors. >> and then the third neighbor gave him instructions to put his hands on the air and lie on the ground. >> reporter: the shooting garnered the attention of the nation. making headlines in hollywood, too. halle berry and viola davis posting on social media demanding justice. president biden called and invited yarl to the white house. he is a marching bandstand out with dreams of attending a&m for chemical engineering. his family thankful he's alive. >> he's alive. that's the biggest message that i want people to remember, that he is alive. >> after you describe him being shot, what do we know about his injuries? >> reporter: yeah. so no surprise the family says

these are serious injuries. the family saying that the 16-year-old was shot first. the first time in the head, they say the second time in the arm when he was on the ground. they say the first bullet left ralph with a traumatic brain injury and a cracked skull. after having surgery in the hospital, ralph has already been discharged from the hospital. he's home and dealing with it one day at a time. >> maggie vespa for us. thank you. jailed american journalist appear anything a russian court to appeal his arrest on spying charges. nbc's chief international correspondent keir simmons joins us with the latest on this. good morning. >> savannah, good morning. evan gershkovich lost the appeal. earlier he looked relaxed and determined. a fellow reporter in court calling out, evan, stay strong. his newspaper saying he was doing his job as a journalist.

year to 18 months, savannah. >> keir simmons with the update, thank you. now to arrests in new york. two men were taken into custody by the fbi, accused of setting up a secret and illegal police station right here in manhattan on behalf of the chinese government. nbc's peter alexander has that story. all right, peter. walk us through what we know. this sounds bizarre. a secret police station. >> this is a stunning scheme. the more we learn about it. you have these two men linked to the chinese government who were apparently operating. they were running what was in effect this illegal overseas police station. it was in lower manhattan. as you see there, literally just blocks away from where the fbi is located there. the justice department says it was part of a plot to monitor and intimidate critics of the chinese government, anybody that was basically doing anything that would interrupt with the rule of law. they were helping to amplify those thoughts, as well. china called the accusations unfounded. they deny these stations even

exist. but the bottom line is you have these federal officials who say the men were operating directly at the behest of a chinese government official, and one of the defendants here allegedly helped locate a pro-democracy activist who was working out in california. this was an activist of a chinese descent living in california they were basically cracking down on this, as well. said to include 100 of these clandestine police stations. 100 in all according to a human rights group around the world. >> you are saying there are other police stations in other parts of the world that the chinese government is operating? a separate group tied to the chinese government was charged. what do you know about that? >> yeah. federal prosecutors just unveiled these separate charges yesterday against more than three dozen officers with china's national police force for using social media t harass dissents within the united states right now. well, those charged are abroad the doj is accusing -- i want to

get this right they accused them of creatin fake social media accounts of critics living in the u.s. covertly spreading propaganda. this is all an attempt by th justice department to crack down on beijing's influence here in the united states. as you noted from the start, this will only raise tensions between the two countries. >> right on our doorstep here, peter. thank you very much on that breaking news. we turn to today's delayed start to the closely watched trial, the defamation lawsuit by voting machine maker dominion against fox news nbc's stephanie gosk joins us from the courthouse in wilmington, delaware good morning. >> reporter: as you mention, this trial was supposed to start on monday. and then the judge issued an unexpected delay without giving a reason there were reports that there were last-minute settlement negotiations underway, but neither side would comment nbc news has not confirmed those reports. the judge says the trial starts today. with the start of the landmark trial finally here, some of fox news's biggest stars could be taking the stand in the coming weeks, along with company heads,

including 92-year-old fox corporation chairman rupert murdoch. at the center of the case, 20 statements following the 2020 presidential election. president trump's lawyers were repeated guests on fox news claiming dominion voting machines rigged the election. >> the machine ran an algorith shaved votes from trump and awarded them to biden. >> at the center of it all, dominion voting systems, are they the culprit here? not the only culprit, but are they the principal culprit? >> reporter: all of the allegations false, judge eric davis says writing in a recent decision the evidence was crystal clear none of the statements relating to dominion about the 2020 election are true. but dominion will have to prove actual malice, that fox published lies knowingly or with reckless disregard for the truth. a necessary standard for a democracy, say legal experts >> otherwise, we're going to create a chilling effect where it is actually hard for people to get information.

money. if you want money to spend, get a job. >> it's got to be good with for kids. >> it shows their self-esteem is better they have friends. you worked at scoops. speaking of work >> i delivered "the washington post" was my first job at like 14 and i think it teaches you, first of all, discipline you have to get up at the crack of dawn. after a whole month of delivering the paper, when you showed up to get the pay, they would hand you a buck. and you were like $1 for 30 days but it also taught you how to deal i worked at a restaurant when people were unkind or dissatisfied, you just had to make it work and you are around grown-ups, so you learn all that stuff. >> it is so funny because i was thinking last night. i worked through high school, too. but i don't think my parents pushed me into it. it's so funny. it's like, how can we give our kids the nudge without overwhelming them? >> you didn't need the nudge you didn't need the nudge. >> but there was something in that

good morning. 8:56. i'm marcus washington. a breaking news update, southwest airlines finally resuming flights after a brief pause. several passengers on board flights across the country tweeting out they were stuck on the tarmac. more than 30% of southwest's schedule faced delays this morning. this is all according to flight aware. all of those flights are now taking off again. southwest issued a statement which reads, quote, early this morning a vendor supplied fire wall went down and connection to some data was lost. southwest teams worked quickly to minimize flight disruptis. weon
