jacket because it's chilly out there this morning. and then by the lunch hour, there will be plenty of sunshine as we go into today, tomorrow and through the weekend. we will talk about the full warm-up coming up in a little bit. where are we going on the roads, mike? >> most of the bay is looking great. look at this. typical slowing in san josé holding on and that will clear up and then kick in again in another 40 minutes. build here for the east bay and tri-valley looking lighter because of one really tough drive, it's the one getting out of the altamont pass. the sensors just turned to green a couple seconds ago, and still back from 205, and the altamont pass jammed up as well. the backup is standard but maybe a little lighter as the bay bridge has movement, and it has movement but still metering lights. >> movement but not movement. breaking news, while you

were sleeping the a's taking a huge step forward in plans to leave oakland for good. they have locked in a deal to purchase land for a new stadium just off the las vegas strip. funding will be the next step. the oakland mayor issued a statement indicating her disappointment with the deal. there are a lot of steps that have to happen including the a's sorting out the lease deal with the coliseum. the a's made similar comments about moving but it never happened. now, not only are the warriors playing in the playoff game tonight, but the giants are back in town. before those events begin, san francisco is gearing up to host 4/20 events at hippy hill and golden gate park.

>> emma gosk is live with what we can expect. a big festivity. >> reporter: yeah, the event opens at 10:00 a.m., and we expect more people will come and the crowd will grow because everybody wants to be here at 4:20 p.m. sharp this afternoon, and that's the big moment of celebration. this is the second year that on-site cannabis sales are legal. the city's rec department and the city's office of cannabis has been working for months with the organizers to keep this event safe and peaceful. representatives from the city said it was hugely successful last year after taking two years off due to the pandemic. >> walk, take public transit. the best ways to get here are the 7 line, and muni will be running free shuttles starting

at 4:00 from the civic center part, so it will be easy. >> reporter: there will be 100 security guards, 163 portable toilets, extra parking, patrol officers and, of course, a robust cleanup crew. the city is encouraging people to take public transportation rather than drive, so as you heard there's free muni shuttle service today. because there are onsite cannabis consumption and sales going on here during the celebration, nobody under the age of 21 is permitted past the fenced in area of golden gate park. reporting live in san francisco, emma gosk for "today in the bay." >> thank you, emma. we have new overnight news. a hazardous material situation underway in oakley right now.

contra costa deputies arrested a driver on an outstanding warrant but then found chemicals and glassware in the trunk of the car. one traffic lane and a bike lane are still closed because of that investigation. investigators say there's no public safety threat. we learned a class action lawsuit will be filed today after racist and homophobic texts were sent by officers. as we have been reporting, the fbi discovered the homophobic and racist texts between the police officers. 45 officers are now under investigation. the city council approved the audit of the internal affairs process. the conference will be at 11:00 this morning. in just a few hours the suspects tied to a freeway shooting in which a 5-year-old little girl was killed are set to appear in court. all three now face murder

charges. the two on the left of your screen are scheduled to appear for a plea hearing. the man on the right is scheduled for a probation hearing. this is the 5-year-old. on april 8th, she and her family were in their car when she was struck and killed by random gunfire. all three suspects are gang members and the shooting was a case of mistaken identity. a grand opening takes place today aimed at those trying to make it in the bay. the gateway at millbrae station transit village includes affordable housing. it includes 400 apartments and 80 that are veteran preferred. a ceremony will get under way at 11:00 this morning. let's look out at san josé this morning where things are off to a mild start.

the mail as far back as 2020, the department of insurance says you were misled. investigators say these notices claimed your home warranty was expiring. it wasn't. the final notice was an ad, the employ to get you to buy a home warranty. the brand names on the notice were all fake. the state said the final notice mailers worked. the state said hundreds of thousands of people got these ads and some people paid 2,500 to $3,500 each. people got a home warranty, but they were not legal to sell here. the state investigators and got a settlement with the integrity admin group. part of the settlement is a refund for homeowners that took the bait. you can get your money back if you got a final notice and paid money to any of these bogus

full forecast, but now let's take it out to the roads. we have trouble on the altamont pass? >> yeah, this is the backup, the one big backup. westbound 580, there's a disabled big rig,ing a delivery-related truck and that's in the middle of the roadway. it has been there for hours. the backup is all the way into tracy. a smooth and easy drive in the south bay, no problems. the backup at the bay bridge standard, so slowing throughout much of the east bay area routes. back to you. >> thank you. we start with breaking news that happened while you were sleeping. the a's taking a major step forward in plans to leave oakland for las vegas. >> late last night the team confirmed an agreement to purchase land for a new stadium right off the las vegas strip. the a's signed a purchase

agreement to buy those 49 acres of lapd near the raiders allegiant stadium. the funding is still to come. the a's coliseum lease ends next year, and it's unclear how the a's could play in the desert without some sort of domed coliseum. the a's said the process to build a new ballpark in oakland has made little forward progress. we realize it's hard to hear as we shift our focus to vegas. we will continue to share details about the next steps. oakland mayor issued a statement saying i am deeply disappointed the a's have chosen not to negotiate with the city of the oakland as a true partner.

for mr. balwani has come and he will have to surrender. the defense team will still continue with their appeals. he will remain in custody while that is going on. so for him the battle is going to continue, but unfortunately he will not be remaining out of custody while that is going on. the government was very concerned about the image this was portraying. why are these two not going into custody? i think the message the court wanted to send is the only way to send a message is to start doing time. his fight will continue but he will be in custody. >> what will that look like? when he arrives in prison, what does that process look like? >> there was a big fight about where he was going to go to prison. he was initially assigned to the federal prison in atlanta even though he is a low-risk offender because he has a lot of time. that could be difficult time. >> for balwani and holmes, how

much time do you think they will spend behind bars? >> in the federal system you don't get much of a discount like in the state system, and they will have to do 85% of the time, so a lot of time. there are incentives to ensure good behavior by inmates, so he could shave a little off, but in federal prison you do 85% so that's going to be a long, long haul for him. >> will we see the same with elizabeth holmes? >> elizabeth holmes is continuing her fight, and she will continue fighting the bail issue, and i think the appellant court will say it's time to start your time, and she is supposed to schedule at the end of april, and she will have to report. that will be difficult for her. she will be away for her children and that will be challenging for her for at least the next ten years. >> thank you so much.

palisades tahoe, 50s and 60s up there. make sure you keep an eye on the road conditions, getting up there things could change in the blink of an eye. mike, the roads are your forte. >> yeah, a lot of cars at the bay bridge. it's not bad, and it will get more congested as folks head to the area. we are looking at a smooth flow of traffic around most of the bay. the east bay, no problems or problems. typical slow spots, but lighter overall right now and it will consistently build through the day towards oracle park, and you will get foot traffic across the bridge here, and there will be some congestion. wait, there's more. we have the warriors playing at chase center. let's focus on the traffic there

the altamont pass. we will give you the progress they have made or hope to make and talk about the rest of your commute as well. washington running out of time raise the debt ceiling. >> one good sign, republicans are offering a path to the solution. >> yeah, there's a path but the white house hates it and senate hates it. kevin mccarthy outlined the plan on the floor of the house yesterday. the republican leader wants the white house to agree to spending cuts. he didn't specify where. a number of those programs are popular with americans. not clear mccarthy has full support of his own party on some of these points. the house might be able to pass it but the democratic-led senate won't. the bigger picture really is whether we should be negotiating

over the debt ceiling at all. not raising the debt ceiling would mean the country would default on its debt for the first time in american history. the full faith and credit of the united states, which is an iron-clad promise worldwide, would be at risk. here's the president's response. >> the threat of defaulting on america's debt for the first time in 230 years. we have never ever defaulted on a debt and it would destroy this economy. who do you think would hurt the most? you, hard working people, the middle class, the neighborhoods i got raised in, not the super wealthy or powerful but working folks. >> you know who agrees with president biden? president donald trump. nancy pelosi, the then-speaker of the house, just like mccarthy is now, had conditions just like he does before she would bring a

vote to raise the debt ceiling to the floor. "the washington post" described it this way. pelosi said the idea of raising the debt ceiling on its own and not in conjunction with a budget agreement was not acceptable to our caucus and therefore did not stand a chance of passage. just like today, the speaker of the house was holding the full faith and credit of the united states over the president looking to get something out of it. here's the president at the time calling for reason. >> when they start talking about using the debt ceiling as a wedge to negotiate or things they want, they have told me strongly they would never use that. that's a very, very sacred thing in our country, the debt ceiling. we can never play with it. >> we will look for progress but we are not seeing any. if we do, i will report it on social media. on facebook follow me @scottmcgrewtv. a live look this morning

where passenger service workers are planning to rally demanding the airlines increase their wages. they say the increase will help keep up with the cost of living in the bay area. that rally is set for 2:30 this afternoon. let's take a look at our forecast, in case you are headed out to a ball game today. >> yeah, a ball game or maybe out of town. over sfo, have a great trip and stay safe out there. if you are staying local, plenty to write home about. 73 in fairfield. we have upper 60s as you make your way into oakland and into the tri-valley. look at the santa clara valley. 70s for you. we are bumping up the temperatures 5 to 10 degrees as we go into the day tomorrow, of course, and i will show you that in a little bit. i wanted to squeeze in here, the warriors forecast taking on the kings. you want to bring a jacket as you head out of chase center

because it will be chilly. otherwise, look at the beautiful temperatures we will see on the board tomorrow. 79 in napa if you want to take a trip up there. 75 degrees, the high in santa cruz. saturday's forecast, 80 in concord and 79 in san josé, and 66 in san francisco. we are heading into some warmer weather, of course, so stay hydrated and wear sunscreen, and never leave your kids or pets in the car, and temperatures warm up fast with the warmer temperatures. even warmer and mild as we go inland this weekend where we are celebrating earth day with 81 degrees. we are taking the folks out to the altamont pass where we have had a change there, and it's a change in status.

to. san francisco is getting ready for a big day of traffic. we're talking about a warriors playoff game, a giants game and activities to celebrate 4/20. today in the bay's emma gosk is at hippie hill with what we can expect. >> reporter: the city is expecting about 20,000 people to come here to hippie hill. you can see behind me, things are getting set up for the event. it starts at 10:00, and they are expecting more people to come in the afternoon, specifically to be here at 4:20 which is the big moment of celebration. this is the second year the on site cannabis sales will be legal. the city has been working for months with organizers to keep the event peaceful. they are encouraging people to take public transportation rather than drive, and nobody under the age of 21 is permitted
