welcome back. please join me in welcoming nbc news political director and moderator of "meet the press" chuck todd who has a preview of today's show. hi, chuck. as always, thanks for joining us this morning. good to see you. i want to start with the supreme court, not the abortion battle but the scandal over justice clarence thomas accepting that luxury travel and failing to disclose those gifts. my understanding, and correct me if i'm wrong, there is no supreme court ethics code to
7:13 am
disclose, but justices are required to submit public financial disclosures, which does include gifts over a few hundred dollars. one of your guests this morning, senator dick durbin, has requested that the chief justice appear before the senate judiciary committee to answer questions. what is the likelihood of that happening? >> doesn't look very likely. already the chief justice has kind of responded. senator durbin says he hasn't taken it a know, but the chief justice said he received the letter and forwarded to the folks that oversee the judicial code of conduct for every other federal judge. but that's the point here. if it is against the law, if a federal judge purposely leaves out something in their financial disclosure form, but it is not a crime if a supreme court justice does it.
7:14 am
and the reason there is a distinction is that supreme court justices are considered constitutional officers, and with separation of powers. congress can make a law that ties the hands of financial disclosure and makes it a crime if you don't do it properly for district and circuit judges, but not for constitutional officers, which are the supreme court justices. similar to the executive branch. the president and vice president are exempt from any criminal violations for not doing financial disclosures, but a cabinet secretary would be subject, facing criminal charges. so the point is, and that's the reason why he wants the chief justice to appear before the committee and not just justice thomas, because he's basically saying justice roberts, it's up to you as head of the judiciary branch, to put an enforceable ethics code on the books. the bottom line is, there is none. all of this are essentially simply suggestions to the nine supreme court justices.
7:15 am
>> there is so much i want to say right now. unfortunately, we don't have enough time with you. it's like, the supreme court, which is to uphold the law of the land, isn't abiding by the same laws. >> they're above the law. >> quickly, i saw some breaking news this morning, a new nbc news poll shows 70% of gop voters stand behind donald trump. joe biden is expecting to announce that he will run for re-election this coming week. are we expecting a 2020 rematch? what does this poll show us? >> our poll shows that's the most likely scenario. look, ron desantis has a healthy level of support inside the republican party. but it doesn't come close to trump's yet. there are severally indications that trump has the ability to rally a majority behind him, particularly as he faces these legal threats that -- and the
