administration's investments in manufacturing and jobs created under his administration, a possible preview of the pitch he plans to give to voters moving forward. >> all right, let the campaign season begin. thank you so much. 6:04 right now. new overnight a suspected car thief is now in custody after an overnight high-speed chase that zigzagged across the east bay. chp says it started at about midnight when officers tried to pull over a stolen car in pittsburg with two people inside. the driver took off and made it all the way to oakland before turning around and heading back the other direction. officers say that after reaching pittsburg, he then drove back toward oakland again. the officers set out spike strips near the caldecott tunnel which stopped the car and led to the arrest. the passenger not yet facing any charges. well, it has happened again, an innocent child is shot by

gunfire on a bay area roadway. it happened just one day before three suspects returned to court on murder charges in the death of a 2-year-old boy killed in a freeway shooting. "today in the bay"'s kris sanchez joins us with more on how that little toddler is doing. >> it really was a miracle that that 15-month-old little girl was just three blocks from an oakland fire station, where firefighters were able to start treatment immediately. she's now being treated at ucsf benioff childrens' hospital. the little girl was in the red sedan you see in the distance. this is video from a nearby business on international boulevard. you see frantic people asking for help at the fire station. it's not clear if the people in the car were targeted or if they were just in the wrong place at the wrong time. now, this is video of the little girl being loaded into an ambulance, headed to the trauma center. a shocked witness told us it was

chaos. >> she was on the floor and doing i think cpr, maybe, for her. they were like, oh, my god, and stuff like that. it's very harmful because i have a sister, a little sister. i wouldn't want that to happen to her. >> you can see a number of bullet holes on the right side of that vehicle. it's not clear if anyone else in that vehicle was hit. oakland police were alerted by shotspotter activity and it was only 6:30 in the evening. oakland police have not told us of any arrests, nor have they given us any information on the suspect vehicle that people might be able to watch out for. we certainly hope the little girl is okay this morning. we know she's at the hospital. we just don't know what her condition is. >> the thing is, this has happened far too many times. one time is too many. >> absolutely. and this is just a day, like as other suspects are in court for a different one, we're talking about jasper wu. you guys remember him.

his sweet little face. this is the little boy asleep in his car seat when he was shot and killed by a stray bullet on 880, fired by rival gang members shooting at each other from different cars. three men will face a judge now, who will decide over the next couple of days whether there is enough evidence to go to trial. and you guys will also remember that the district attorney there in alameda county is getting a lot of heat because she was talking about perhaps dropping the gang enhancements from that case. so people are watching this case very closely. but it is just really unfortunate when you see innocent people, and you say innocent bystander, but we're talking children. >> families with children in their cars, just trying to live life. >> sad. >> we certainly continue to follow these cases as they develop. you can find the very latest on air and online at nbcbayarea.com. here we go, taking a live

look out at the palisades tahoe ski resort. after a cold and wet winter, this warm-up is raising concerns about potential flooding from the runoff. forecasters do fear the near record snowpack could lead to flooding if it melts too fast. san joaquin basin is the most at risk along yosemite. the waterways will likely be in full force. but the bay area not expected to feel the impact from that flooding. want to bring in meteorologist kari hall because i know scientists have been talking about this potential flooding, that likely won't start until may. but then we're talking about so much of that snow that we could see this continue up until july. >> this is going to continue to be ongoing throughout the next several months. there is just so much snow, when we compare it especially to last year. it was at 29% of its normal amount of sierra snow and this year it is more than double. there's so much snow still piled up there, and it's been holding

on for a while. now that we do see temperatures warming up, we do expect it to quickly fill up our reservoirs, which will continue the water storage into the summer. but also increase the risk of severe flooding for the southern san joaquin valley. then the department of water resources is really monitoring that tulare lake basin region that just magically formed after all of this time, and it was also still causing a lot of flooding there. the merced river in yosemite is expected to reach flood stage on friday, and that's also when they say do not enter any of the floodwaters or the water that's moving very swiftly, because it's also extremely cold and can cause some shock. so that's definitely a heads-up for all of us who may be traveling to different areas over these next several months. and you may be hitting the road. mike has a look at where you can find lower gas prices. coming up again, two of the

tuesday to you. microsoft and alphabet report their profits to investors this afternoon. we figure alphabet may discuss more cost cutting. parent company of fox news saw its stock sink after it parted ways with the guy that made them the most money. the big story is first republic bank. you recall a lot of account holders pulled their money out of first republic after the failure of the similar silicon valley bank. now, as we talk about this, while the bank is cutting costs and laying off workers, the bank itself is safe, the same way all u.s. banks are safe, with deposits up to a quarter million insured by the federal government. but first republic as a business is having tough times. it owes high interest rate loans, it's cutting workers, it may close offices. the bottom line here is a lot more money was withdrawn from first republic than we first suspected. >> apple had another victory in

court as the ninth circuit reaffirmed a lower court's decision that apple can keep its app store as the only store on the phone. no third-party app stores. though apple does need to allow app makers to allow users a different way to pay. apple sometimes takes as much as 30% of the fees you pay for apps, which is why you can download the netflix app on your phone, but you have to sign up on the web. netflix doesn't want to give apple a cut. >> let's talk about ai. as you might suspect, artificial intelligence is helping scientists in the lab. the scientists tell the computer the results of their experiments that they're running and the computer helps analyze those results. but lately ai has been suggesting what experiments to run, telling the scientists what it wants to see. that's a huge turnaround. ai is telling us what it's learning from its experiments. i spoke with an expert who thinks that's a huge, huge step.

thanks. 6:18. new details on a plan for new high-speed rail line connecting los angeles and las vegas. lawmakers from california and nevada are now asking for federal money to speed things along. the idea has floated around for more than a decade. trains would deliver passengers from one city to the other in about two hours. a new bipartisan plan from lawmakers in each state asks federal regulators to fasttrack funding. permits for construction may be finalized as soon as july. trending this morning, a high school senior breaking college records. >> not a mention a lot, and i mean a lot of decisions to make. dennis barnes is believed to be the first person in the u.s. to receive offers from 125 colleges and universities. he also received $9 million in scholarship offers. the cbs station in new orleans reports that barnes applied to 200 schools across the country, and he says that he'll announce

dublin. we're getting started with sunshine and nice temperatures. head out to the park, enjoy this day outside. in san ramon, temperatures will be in the mid-70s at noon and not yet quite enough to where you have to touch the slide to make sure it's not too hot. it will be in the upper 70s today. cooling down quickly this evening for the giants home game where temperatures at the first pitch will be in the 60s, and it will drop down to the 50s and it will be gusty out there. that's after seeing a high temperature of 68 today. 78 in novato. as you move toward the east bay, low 80s today. let's take you to tomorrow. you've probably already seen at the bottom of the screen that temperatures are going to be hot in the inland valleys these next few days, reaching 85 in fremont tomorrow and 87 degrees in concord. look at fairfield, 90 degrees. we're going to see a lot more 90s on thursday.

mostly upper 80s as you make your way across napa, martinez, and then over toward fremont. and that warmth continues into friday and saturday. so it sticks with us for a few days, but quickly moves out of the way as cool air dips in. we'll see the showers staying off the coast. so it's going to be dry, but our temperatures are going up and then way back down. so take a look at this trend. we still will need jackets and sweaters and all of that stuff eventually, but the next few days it will be short sleeves and shorts, and, also, where is the sunscreen? we need some of that now. it's going to be in the upper 80s for the next several days. then take a look at next week. we are back to very early spring. if you want to go to the coastline, half moon bay will be in the mid-60s these next few days. a lot more sunshine in the forecast and we'll be tracking temperatures heating up over these next few days. mike says right now, even though it's tuesday, the commute is pretty smooth. >> it's smooth, crowded but

here is more of a clip. >> that's why i'm running for re-election. because i know america. i know we're good and decent people. i know we're still a country that believes in honesty and respect and treating each other with dignity. that we're a nation where we give hate no safe harbor. we believe that everyone is equal, that everyone should be given a fair shot to succeed in this country. >> this announcement probably inevitable. most presidents do decide to run for a second term. johnson the only one who decided otherwise. but for all the inevitability, it's not really what americans wanted. an nbc poll, a brand new one over the weekend, shows 70% of americans prefer he not run and also prefer donald trump not run. and when you put the matchup together, biden versus trump, america is really preferring that that doesn't happen. now, we've got a long way to go, but this is starting to shape up

as the race. we shall see. also, president biden does not have a very strong approval rating, 41% approve, 54% disapprove, according to the same poll. this is not good news for his opponents that this may look like, because, remember, a lot of this disapproval comes from the far left. democrats who think biden isn't liberal enough. they don't prove of him but they're going to vote for him. this was one of his challenges in his first presidential one, that he was too far to the right of the modern democratic party to run in 2020. senator kamala harris of california accused him of being too liberal. he's got two more challenges. one is his age. both literally a challenge for him, he's 80, and then a challenge to voters who would have to trust that he could do the job all the way through a second term at 86. and let's be frank, he's not a

very strong campaigner at any age. he was in his 40s when he ran a very strong campaign for president in the late 1980s, but that campaign imploded on gas and accusations of plagiarism, when he ran in 2020, then president trump accused him of hiding in the base many. biden had a very limited campaign schedule. we were in the height of the pandemic. but it actually worked out as a strategy. fewer appearances meant fewer gaffes, let trump make the mistakes. don't campaign, just govern, be busy being president. as president biden once say, a presidential campaign is really a job interview with 30 million managers. >> so interesting to follow. thank you very much, scott. 6:35 right now. and new overnight, police are investigating what is now a deadly double shooting in west oakland. within the last 30 minutes, they confirmed one of the two victims has died. the shooting happened about

10:00 last night at mandela gateway apartments from the b.a.r.t. station. we do know the other victim is stable. an oakland police officer is wanted this morning on several charges, including lying under oath and threatening and bribing witnesses. opd confirming that the arrest warrant has been issued for detective phong tran. those allegations stem from a 2011 murder trial and the conviction of a man that has now since been overturned. "the oaklandside" says one witness has recanted her testimony and accused tran of secretly paying her before the trial. we did reach out to the mooed alameda's da office but have not heard back. the man accused in the deadly stabbing of cash app founder bob lee is due in court for his arraignment. >> the arraignment apparently took as long as it has due to

the suspect's attorney being out of the country. "today in the bay"'s emma goss is live outside the halls of justice. what do we expect to see happen today in court? >> reporter: well, we did hear from the lawyer of lee's accused killer, nima momeni, that momeni will enter a not guilty plea today and will also be asking for bail. now, court documents claim that lee and momeni got into an argument over momeni's sister on the morning of april 4th and that momeni drove lee to a secluded area in san francisco and then stabbed lee with a kitchen knife three times. the big question that the prosecution and defense will focus on is the motive. here is nbc bay area's legal analyst, steven clark. >> i think the defense is going to focus on this relationship between mr. lee and mr. momeni, were there any prior threats, what was the reason that mr. momeni stabbed him, was there a sudden quarrel, was it a

heat of passion type killing, which could lower this from first-degree murder to manslaughter. i think that will be the big issue in this case. >> reporter: he added that the prosecution has laid out a strong case that this was premeditated murder, deconstructing the relationship between the two tech executives, lee and momeni, and how momeni's sister fits into all of this will be at the center of this case. momeni's arraignment is at 9:00 a.m. this morning. reporting live in san francisco, emma goss for "today in the bay." >> certainly a case a lot of people will be following. emma goss in san francisco this morning, thank you. developing this morning in the south bay, a mother and daughter are speaking out after a girl says she was attacked at her san jose charter school. the mother of 13-year-old guadalupe enriquez says she suffered a concussion and injuries to her back during a fight on the alpha blanca

alvarado campus. she says four girls she never met confronted her and attacked her. school administrators forced the girl to apologize and her mom went to the school seeking answers. here is what she says happened next, as translated by nbc bay area's stephanie magallon. >> translator: they told me she was never forced to apologize, it was all a misunderstanding because guadalupe didn't understand english. >> both claim administrators used the family's cultural background to cover up their mistakes. in a statement, the school says in this instance our policy and procedures to support students in a challenging moment were followed. this included quickly addressing the students involved, working with families to inform them of the incident and any pertinent follow-up, as well as continuing to offer support, which includes access to our mental health counselors. happening later today in san francisco, police and transit leaders will hold an open discussion on how to improve safety on trains and buses

the time is 6:44 on your tuesday morning. it's going to be a cool morning, warmer afternoon. let's take a look at antioch. it's 57 degrees. we'll be at 67 degrees at 10:00 and 78 at 1:00. you can see how fast it's going to be heating up today, and even hotter the next few days. we'll get a look at that in our microclimate forecast coming up in a few minutes. you can see how fast it is on the san mateo bridge westbound, the volume is playing a factor. speeds are starting to dip below the speed limit, around 55, 60 miles per hour across the span.

"today in the bay"'s bob redell is live this morning talking about their vote. it will still take several hours before we find out what their decision was. >> reporter: correct. good morning to you, laura. teachers and staff with oakland unified had until last night to cast their vote on whether or not to go on strike, possibly as early as this upcoming monday, may 1st. but the union is not going to announce the results of the vote until a press conference at 5:00 tonight. the teachers and oakland unified have been locked in a contract dispute for a long time, and the union accuses the district of bargaining in bad faith. ousd says it is confident it can reach a deal with the union, but if a strike is approved, this will be the second one in just

over a month after dozens of teachers walked off the job back in march. according to the "chronicle," the district has filed a request with the public relations board to issue an injunction to stop the teachers from going on strike. the district argues a walkout would be illegal and a violation of students' constitutional rights. the teachers union has filed a rebuttal to the claim with the employee relations board. reporting live, bob redell, "today in the bay." >> we'll find out what happens tonight at 5:00, thanks, bob. 6:46 this morning. and it is national minority health month. the health advocates are pushing for a new national ban on menthol cigarettes. so the fda says such action would save up to 654,000 lives in 40 years and includes 238,000 black americans. lung cancer is the leading cause of cancer deaths in the black community. menthol, an ingredient used in the cigarettes, can make it more addictive and something

advocates say that make quitting really more difficult. >> there needs to be cessation services that are available that are culturally appropriate and language specific, and when i say that, people need to feel comfortable about having this discussion, because getting off cigarettes isn't an easy thing to do. being addicted to nicotine is truly a very bad thing, a very hard thing. >> advocates hope that the nationwide ban on menthol can bring health equity among minority communities. we should note that california already has a similar ban in place. scientists say the spotted lanternfly is making a comeback in the northeast, and at the current rate it could establish itself in california. despite the innocent-sounding name, it can cause a lot of damage to plants. the spotted lanternfly measures about an inch long and targets dozens of plant species.

one expert says vineyards need to be extra cautious. >> it poses a threat for our grape growers where it's caused tens of millions of dollars of damage. this is a sucking insect, it puts its beak into the plant and withdraws the nutrients and so many tiny beaks feeding on a grapevine can kill the vines. we've had several in deep trouble with the spotted lanternfly in the mid-atlantic region. >> even just one lanternfly can pose a problem because it can lay dozens of eggs at a time. another surprise twist in the epic playoff series between the warriors and sacramento kings. one of the kings star players may not be available for tomorrow's game. >> all-star guard aaron fox fractured an index finger on his shooting hand during the fourth quarter of the game four. now listed as doubtful. fox probably the kings best

dropping down to the mid-50s. but it's also going to be very windy. take a look at the seven-day forecast at the bottom of the screen. yes, we will need air-conditioning over the next few days. today not so much. it's going to reach 80 in dublin, we'll see a high of 81 in napa and 68 in san francisco. so it's starting to warm up today, but then we take it to tomorrow where we see highs in the mid to upper 80s and 90 degrees in fairfield, 77 in san mateo. and then going into thursday, even hotter, we may see a couple of low 90s on the map as well, reaching 94 in fairfield and 90 in san jose. the warm air is surging in and we're going to see this for a few days, and then quickly the cool air dips in for the end of the weekend into early next week. so it's not going to last long, but we have several days of hot temperatures. take a look at san jose in our

deadly stabbing of cash app founder bob lee is due in court later this morning. the suspect, nima momeni, is scheduled to be arraigned at 9:00 a.m. court documents indicate he and the victim got into some kind of argument the morning of april 4th. momeni allegedly then drove lee to a secluded area in san francisco and stabbed him with a kitchen knife. prosecutors are expected to argue the killing was premeditated. legal analysts expect the defense to argue that the killing was an act of passion. we are just getting word right now that famous singer harry belafonte has died at the age of 96. he was a very successful caribbean american pop star, you may remember the song "shake, shake, shake senora", one of many he had. but harry belafonte we have
