country so far this year another community is left mourning as the cries for action against gun violence grow louder border agents brace for an influx of migrants as the clock counts down to the lifting of title 42 pull out those little red corvettes, ready to go crazy for a new stretch of road named in honor of prince. the ultimate dose of inspiration. how this woman didn't let tragedy stop her from reaching her goals. it's monday, may 8th "early today" starts right now >> good morning. i'm phillip mena. >> and i'm frances rivera. we begin in allen, texas, where vigils are being held after saturday's horrific mass shooting impromptu memorials are appearing outside the mall where nine people died, including the alleged gunman and hundreds attended a vigil in cottonwood creek church where allen's mayor ken falk said, quote we will recover. as the devastated community
3:32 am
tries to come to terms with tragedy, police are searching for a motive, focusing on the suspect's apparent neo-nazi sympathies priscilla thompson starts us off. >> reporter: gunshots shattering the peace of a saturday afternoon shopping trip. >> we need an ambulance. we can't get these people to the ambulance. >> reporter: eight people were killed and seven more injured, including children, police say, after a gunman opened fire at this sprawling outlet mall in allen, texas, just north of dallas the victims' identities not yet revealed. >> a male subject wearing black tactical garb armed with an ar he has white lettering on the vest that says police or security. >> reporter: dash cam video shows the moment the alleged shooter got out of his car and began firing the suspect was killed by an officer who police say was already on scene for an unrelated call
3:33 am
>> he heard gunshots, went to the gunshots, engaged the suspect, and neutralized the suspect. >> reporter: law enforcement officials say the shooter was 33-year-old mauricio garcia, who had interacted with neo-nazi and white supremacist content online overnight officials searching the home of the alleged shooter as neighbors watched in disbelief. >> kind of quiet, you know, wearing a little hoodie. just walked up and down the block. stayed to himself. always alone. >> he went to high school with some of the neighbors. they just said he was always very quiet >> reporter: this scene one that is all too familiar. americans in fear, forced to run, hide, and pray. >> we ran to the back, barricaded it with concrete bricks, and then right then on the security cameras, thank god we went in the back at that time, we saw him walk right by masked up, fake police outfit on >> reporter: survivors returned to the scene to collect their vehicles, many still in shock.
3:34 am
>> we heard all these shots started -- and she had just been out there and if she hadn't come in the store, she'd have probably -- >> i was on the edge. >> reporter: as another grief-stricken community gathers to mourn and to heal >> our thanks to priscilla for that report. a controversial trump era immigration policy is set to end this week, and is expected to make the ongoing border crisis worse. title 42 allows border patrol agents to quickly deport migrants crossing america's southern border and restricts how many are allowed over the border it's set to coincide with the official end to the national covid emergency which is what allowed for title 42 in the first place. for more on this, we go to brie jackson in washington. brie, good morning what's the plan once title 42 is gone >> reporter: well, there is a new policy, title 8. it's expected to take effect after title 42 ends on thursday. now this would deny asylum to
3:35 am
most migrants if they pass through another country on their way to the u.s once title 42 is gone, border officials are expecting to see a surge in illegal crossings aid workers at the border right now are also worried about the influx many shelters are already at capacity >> some of them have been here for two days some of them have been here for 24 hours, or more. and so we're just concerned that, you know, that there is a risk to their livelihood if they stay here for much longer period of time. >> and u.s. officials are hoping that title 8 lets them quickly process incoming migrants and deport them if they do fail that initial asylum screening >> and brie, how are the border towns preparing for thursday >> well, several texas city, including el paso, laredo, and brownsville have already declared a state of emergency. the federal government is also sending support to the area.
3:36 am
nearly 500 immigration officials have been assigned to help process the expected migrants. the pentagon is also sending 1500 troops to support the border patrol agents so federal, state, and local officials are all bracing for what's to come. >> we've already seen what is now. all right. agree brie jackson for us. brie, thank you. treasury secretary janet yellen double downs on her debt ceiling warnings yellen said the u.s. will be unable to pay its bills as as soon as early june she reiterated that the treasury has been using extraordinary measures to give the country as much runway as possible. without movement from washington lawmakers, yellen says the u.s. is headed toward what she calls an economic calamity president biden has invited party lead precious the house and the senate to the table this week to try and break the imp impasse. that meeting is set for tomorrow, may 9th. at least one republican official in new york is pushing back against the new york city mayor's plan to relocate hundreds of homeless men to the

suburbs. on friday, maisch eric adams announced that the city would be paying for 300 men to be housed at hotels in orange and rockland counties following the announcement, rockland county executive ed day declared a state of emergency to try and block the measure. back in october, adams declared his own state of emergency here in new york city and asked the federal government the send resources to deal with the influx of migrants to the area "the new york times" reports that more than 60,000 migrants have arrived in new york city since last spring. priorities across new york city are calling for criminal charges for the former marine who choked hochmeless man jorda neely to death on the subway his attorneys give his side of the story. emilie ikeda has the latest. >> reporter: outrage over the chokehold death of jordan neely intensifying this weekend. >> say his name! >> reporter: calling for criminal charges in the case and better city support for mental health, protesters clashed with the nypd and spilled on to subway tracks.
3:38 am
a train seen stopped just down the line. >> until we see justice and accountability we will be out here we will be online. >> he was murdered because he was poor he was murdered by the system. >> reporter: the mta called the track takeover which led to more than a dozen arrests saturday dangerous and reckless playing out nearly a week since this minutes' long deadly struggle on the subway the rider holding neely in the chokehold that authorities say killed him was questioned by police but not charged lawyers identifying him as 24-year-old college student and marine veteran daniel penny. they say he, with the help of others, acted to protect themselves, adding he never intended to harm mr. neely and could not have foreseen his untimely death. several 911 callers that day reported neely had been making threats according to a source. the 30-year-old michael jackson impersonator was homeless and struggled with mental illness since his mother's brutal murder in 2007 according to his family's attorney. police say he had 42 prior arrests.
3:39 am
>> even to say who he was as a person and what his history is, it had nothing to do with this incident so what we're asking is why did daniel penny get the benefit of the doubt? we know for a fact that he killed jordan neely. if there is a defense to it, charge him and let him bring that defense >> our thanks to emilie ikeda for that report. in the ukrainian capital of kyiv, five people were injured sunday after a series attacks, including from the wreckage of a fallen drone this comes as russia is upping its strike against ukraine while moscow gears up to celebrate an important anniversary for them for more on this, we go to josh lederman in london josh, what's the latest from the capital city >> the ukrainian armed forces are saying that the damage caused by that drone c came durg a wave of some 35 drones f from
