covid border restriction that is expected to lead to another migrant surge. we have reporters in both locations this morning. let's start with morgan chesky and that shooting in allen, texas. morgan, good morning to you. >> reporter: this massive complex remains locked down by authorities who are calling it an active crime scene, as the memorial for those eight lives lost only continues to grow. and this mall has been a shopping destination for families all across north texas, so many of those families scrambling for cover saturday when that gunman opened fire. and we do want to warn you, some of the video you're about to see is disturbing. overnight, a community marred by gun violence coming together to mourn. a vigil honoring the eight lives lost in what is now the second deadliest mass shooting this year. >> gunshots at the outlet mall. >> reporter: the frantic scene unfolding in allen, texas, just north of dallas. police say 33-year-old mauricio garcia opened fire on saturday

at this crowded outlet mall. >> i have victims. >> reporter: law enforcement officials tell nbc the crime is now being investigated as a case of racial or ethnically motivated violent extremism. the suspect interacted with neonazi and white supremacist content online. one official telling nbc authorities found a patch with a right wing acronym on his chest. sources also confirm police are reviewing this footage, showing the moment the gunman began to open fire on innocent shoppers. as families barricaded themselves inside. authorities tell nbc news the shooter wore a tactical vest and was armed with a rifle and handgun. more weapons and ammunition were later found inside his car. >> i heard pop, pop, pop. shooting. and everybody ran. >> reporter: the suspect fatally shot by an officer who police say was already there for an unrelated call. amid the chaos, acts of heroism.

some people were huddled inside an h&m store, one of them called his father. former police officer steven spainhower, who raced to the scene. he immediately began performing first aid on victims, but for some, it was too late. >> the young child was underneath one of the victims. laying on the ground. >> reporter: and their parent? >> they were on the ground, dead. >> reporter: the father forced to wait agonizing minutes as officers led hundreds of shoppers out of the mall before he was finally reunited with his son. the former officer agreeing with so many others that something needs to change. >> this is not a democrat thing, it's not a republican thing. it's an american problem. >> it is indeed, morgan. what do we know about these victims who passed away? >> reporter: yeah, we have learned of those seven who were taken to area hospitals. the youngest just five years old, and three of those recovering remain in critical condition.

and overnight, we learned the idebty of one of those whose live was lost on saturday, the family identified him as 20-year-old christian lacour, working as a security guard here at the mall when the gunman opened fire. his grandmother posting to facebook, he was only 20 years old with so many goals ahead. savannah. >> lives lost and lives forever changed as well. morgan, thank you. let's move now to the other weekend tragedy in texas. an suv plowing into a group of people outside of a migrant shelter in brownsville, killing eight people, injuring several others. nbc's national correspondent gabe gutierrez joins us with more on that story. gabe, good morning. >> reporter: hoda, good morning. overnight, the death toll rose from seven to eight and law enforcement officials tell nbc news they're looking into whether this driver plowed into this group outside of the migrant shelter intentionally or whether it was an accident. some of the video of the crash

and the aftermath is disturbing. this surveillance video shows the seconds right before an suv plowed into a crowd waiting at a bus stop sunday outside a migrant shelter in brownsville, texas. the mayor says eight people were killed, some of them migrants from venezuela. at least nine others were injured. this morning, investigators are still trying to determine a motive. >> one, it could be intoxication. two, an accident one, or three, intentional. >> reporter: a bystander telling nbc news he heard from other witnesses that the driver yelled anti-immigrant language, but police say they can't substantiate that. the driver is a hispanic male who is not cooperating with investigators. he's been arrested and charged with reckless driving, but more charges could be pending. >> just a terrible situation to witness, such a tragic loss of so many lives. >> reporter: the migrant deaths come just days after alejandro

mayorkas visited brownsville touting the new processing center ahead of the lifting this week of the covid border restriction known as title 42. the policy change is expected to bring yet another migrant influx to the southern border, as many as 10,000 people a day. >> the situation at the border is a very serious one. >> reporter: last week, we visited juarez, mexico, where thousands of migrants have author gathered. what's been the hardest part? the hardest part is never having work, food, or water, this man from guatemala told us, saying he planned to cross the border with his 2-year-old son. the biden administration is preparing for the end of title 42 by sending 1500 active duty troops to the border and setting up asylum processing centers in guatemala and colombia, but the president telling stephanie ruhle that congress needs to act. >> there has to be a legal pathway to citizenship. >> reporter: meanwhile, back here in brownsville, this

and calling for criminal charges. some even jumping on to subway tracks in protest. leading to clashes with police. authorities say 13 people were arrested so far. it comes as we're learning more about what happened on that deadly train ride, when neely was placed in a head lock by another passenger for at least several minutes. that passenger now identified as 24-year-old daniel penny. in a statement, his lawyer writing, when mr. neely began aggressively threatening mr. penny, daniel acted to protect themselves until help arr arrived, adding daniel never intended to harm mr. neely penny has not been charged with a crime. the calls for his arrest are intensifying >> we will try our hardest to make sure he's held accountable. >> reporter: a source telling wnbc that before help arrived,

good morning to you as well. in an effort to boost flyer rights, today, the biden administration is expected to announce new rules for airlines. in the case of any controllable cancellations or significant delays, airlines will now be held accountable to address expenses or inconveniences experienced by passengers. tom costello covers aviation and joins us from reagan national airport. tom, again, could be good news for all of us who fly. how exactly is it going to work, though >> reporter: bottom line here, president biden and transportation secretary buttigieg are now today going to roll out the beginning of a rule making process that will essentially say if the airlines have controllable delays or cancellations, in other words, if they're delayed or canceled because of a maintenance issue or taking too long to load bags or a staffing issue. then you should be eligible for compensation this is what it lays out, according to the new d.o.t. proposed rule, number one,

airlines would have to provide compensation in addition to refunds and other amenities for passengers in the event of these controllable delays or cancellations. as well as a meal or meal voucher, overnight accommodations, and transportation and rebooking they'll also be required to offer timely customer service during and after periods of widespread flight irregularities think about the southwest airlines flight meltdown this last winter, and newly expanded customer service information on the dashboard the d.o.t. has rolled out that's flightrights.gov. first launched last summer, you may recall it's going to highlight the airlines offering already cash compensation, for example, travel credits or vouchers or rewarding frequent flyer models and will cover the cost for other amenities. and this is really all about trying to empower passengers with more information and more, if you will, more rights >> so when is it going to happen

without teachers as that strike enters its third day. but there are some signs of hope here. this is a live look outside of oakland high school where teachers are back at the picket line, after a round of marathon talks yesterday. teachers are saying that they did make progress on reaching a new deal. late last night the district issued an update telling families to expect more of the same with school open but no teachers on site. redwood city police are investigating a shooting that injured five people sunday before 5:00 a.m. near hudson street. investigators say a man fired at people drinking on the sidewalk. four men and a 16-year-old boy were hit. some injuries are serious, but the victims are all expected to survive. no arrests have been announced. time to get a look at the forecast. meteorologist kari hall is tracking the numbers. >> we started out with spotty showers in parts of the north bay. as we go into the afternoon it's going to start to become partly cloudy and we're headed for the mid-60s for the inland areas.

al and i traveled to two hospitals across new york to say thank you in person. i am at new york presbyterian. cornell medical center nurses behind me, y'all. many have worked a full shift. they stayed to be here with us now we are here to celebrate them we want to say thank you this is awesome. i'm so happy all right. one way to show the world how amazing you are is to hear from a former patient jennie and baby artemis spent 136 days here. their team of nurses saved little artemis' life and all jennie can do is say thank you. jennie was rushed to the hospital she was just 26 weeks pregnant doctors and nurses at new york presbyterian worked tirelessly to save her baby's life. >> it is not the experience you expect i could see my girl in the other side of the room in a box but we

anything, schedules, food, allergies, play dates, the jersey school, you know, spring fling. you know, there are things on my calendar that i'm navigating through that i have never, you know. >> sometimes it feels like 90% of parenting is logistics, just like who goes where. but the other weight, i'm sure, is because you love these babies so much. >> i want to be everything for them and i think as a single parent, there is -- for any parent, but as a single parent, there is a feeling of, i need to be there and i'm always kicking myself for time not spent with them and trying to dissect what it all means and seeking out parent friends for advice yeah but i wouldn't trade it for the world. >> having a second child, was that a layup for you were you like, i've got to do that >> you and i talked about it a lot. look, i wanted a girl. and also just for ben. i just wanted him to have a family i have an older sister we were always a unit growing up
