rain-free forecast this morning. meteorologist kari hall has a look at that. >> yesterday was just a little bit of something to keep things green around the bay area. >> nice way to look at it. >> now it is clearing out, you don't have to keep the umbrella close, and we're starting out with clouds in san rafael and temperatures around 50 degrees. it's going to be a cool morning, you do still need the jacket. later on today it will feel much milder, headed for the mid-60s, eventually reaching about 68 degrees. san francisco up to 62 for a high, 66 in hayward and fremont, and upper 60s for the south bay. expect it to continue to warm up, so i'll have more on that in a few minutes. mike takes us to the south bay where we're seeing slowing. >> we expect this for north 101, the first burst of traffic easing up. 680 is completely recovered. i saw gradual improvement over the last five minutes, right on schedule. they had a crew scheduled to be clear by 6:00. the rest of the south bay

looking good, but there is a build out of san martin. nothing dramatic. what we would expect for north 101. slowing for hayward just down past 92. a new incident in the area, 680 just south of the fremont/sunol border. we'll check on that coming up. back to that breaking news we're following this morning, five people injured after a fire in a san francisco high-rise, it started about 1:00 in the morning in the inner sunset. firefighters say multiple people had to be rescued and at least one person jumped to safety from the second or third floor. we know that three people are now in the hospital, but they are all expected to be okay. one person who lives there says he woke up to a lot of commotion and he knew he needed to get out. >> i thought maybe someone was having a party or something like that, and then -- so i was kind of dreary, thinking, what's going on? and then i hear, like, fire

alarms go off and start smelling a plastic smoke smell, and i'm, like, oh, that's not good. so as soon as i put two and two together, i just rushed right out of the building. >> at least eight people are now displaced. firefighters now believe it started from a lithium-ion battery. now to continuing coverage of the oakland teachers strike, now teaching its fourth day. this morning there's still no deal between the teachers and oakland unified, which means those teachers will be back on the picket lines for a fourth day. >> bob redell joins us with more on this ongoing strike. has there been any progress in negotiations, bob? >> reporter: there appears to have been. a member of the teachers union told me yesterday that the district is willing to negotiate on the so-called common good proposals, which in their mind is a step in the right direction. but there is still no deal. the oakland education association, the teachers union, and the district presented and discussed counteroffers for

hours last night, but oea says there are several key proposals that are not moving forward, such as the push for more full-time employees, and then the common good proposals, which include resources for homeless students and reparations. so far oea says they've only received a memorandum of understanding that consists of creating a committee of teachers that would tackle the issues. they want language that would allow teachers to enforce those issues. >> we're pretty far apart on compensation, there are some big differences in the hours of work proposals as well. >> just 13 school days left in the academic year, it is imperative that our students conclude the year positively, with the many exciting and memorable experiences we cherish during this time of year. the district team will continue to work around the clock to end this strike. >> reporter: that was the

oakland unified school superintendent, who expressed disappointment over the fact that the teachers strike is now entering day four. here live outside oakland high school, we expect teachers to be grabbing their signs and walking the picket lines within the next hour or so. also taking a stance this morning, the naacp calling on the teachers to reconsider striking during this critical time of the school year, especially when you've got so many seniors who will be graduating soon. reporting live in oakland, bob redell, "today in the bay." >> you're right, those kids aren't learning right now. thank you so much. we'll continue to monitor this story as the negotiations continue today, and bring you updates both on air and online at nbcbayarea.com. developing new, the martinez amtrak station will be partially closed today following a chemical spill outside the station. it happened around 3:00 yesterday afternoon. hazmat teams from contra costa confirming there was a mercury spill in the parking lot. no one was hurt. hazmat teams are still searching for where the mercury might have

come from. for now, trains will continue to run and will stop at the old station depo near ferry street. developing now, the fda starts a two-day meeting to debate what may lead to the first over-the-counter birth control pill. "today in the bay"'s drew petrimoulx joins us. this is a hot button issue. i'm guessing it will draw a heated debate. >> reporter: yeah, this always draws heated debates. good morning, lawyer. the drugmaker perrigo in this case is requesting approval to sell a decades old prescription drug over the counter, it's called opill. if the fda grants the company's request, it would become the first contraceptive pill to move from behind the pharmacy counter onto store shelves. however, initial signs suggest skepticism among regulators. on friday the fda raised concerns about previous studies. the agency cites problems with the reliability of some of the

data and concerns about labeling instructions. there are also questions about whether it could cause harm to people with certain medical conditions. now, at the end of the meeting the fda panel will vote on whether the benefits of making the bill more widely available outweigh the potential risks. >> drew, can you talk a little more about the data the fda is really concerned with? >> reporter: sure, the company's main study tracked nearly 900 women in the u.s. taking the pill without professional super vision for up to six months. now, the group was paid to track and record their usage, including whether they followed instructions to take it during the same three-hour window each day. the goal was to find out about opill's ability to block pregnancy. the fda says nearly 30% of women erroneously reported taking more pills than they were actually given. now, the fda review also flagged concerns that women with

potential health problems will not appropriately avoid taking the drug, including women with breast cancer. perrigo says it plans to present a reanalysis of the data that excludes participants who overreported. the company says the results show most women took the bill consistently. >> interesting. just to be clear then, whatever the fda decides today, that won't be the final decision? >> reporter: yeah, that's exactly right. this panel's vote is nonbinding. the fda is going to take this up and is expected to make a decision later on this summer. >> we'll continue to follow. a lot of details there. drew petrimoulx live from washington, i appreciate it. 6:09 right now. new developments this morning in what is now oakland a's plan to move to las vegas, a plan that may be starting to unravel. the nevada independent reports that the a's are inquiring about

other potential sites in the las vegas area. last month they announced a land deal for a stadium near the strip, provided funding gets approved. they're now in the process of trying to secure hundreds of millions of dollars of public money. that plan is facing some major opposition. it's also unclear if the a's will remain in oakland once their coliseum lease expires next year. 6:09 on your tuesday morning. how about a peek outside? a lovely look at san francisco this morning. kari has a look at our forecast. another cool start to our day. will we see a warm-up? >> yes, we are going to start a warming trend. the rain chances are behind us and we have our usual cool morning with temperatures in the upper 40s, low 50s. and we go from here to the upper 60s for today. so as you're making your way to work in gilroy, it's a cloudy start. we're seeing temperatures at 49 degrees at 7:00, at 10:00 as you're running errands, it's going to be about 56 degrees, at lunchtime it's 61, and

eventually making it into the upper 60s today. we'll see low 70s in spots like concord, fairfield and santa rosa and more of us will feel the warmth going into the end of the week. i'll have more in a few minutes. mike has a look at lower gas prices. >> the only bay area city on gasbuddy's top ten list is dublin, the exxon on amador valley boulevard. from the tri-valley to the south bay, sunnyvale costco, $4.05. the arco on south delaware street, the lowest for san mateo city and county at $4.39. even higher prices listed throughout san francisco county. let's get a look at the roadways. traffic flows nicely around most of the bay. we checked on this crash at fremont, 680 southbound, there's an incident. it looks like everything is clearing to the shoulder.

good tuesday morning. it is 6:14. we're taking a look at richmond. it's going to be a mostly clear morning, temperatures in the low 50s, and still in the low 60s, a chilly day with a mix of sun and clouds. but we are headed for a warm-up and we'll talk more about that and look ahead to the weekend in a few minutes. san rafael, taillights there

heading in your commute direction. it shows you exactly north san pedro road, from santa rosa all the way to the golden gate bridge, we're at speed. we'll show you how it shapes up across important parts of your commute. happy tuesday to you. goldman sachs will pay out more than $200 million to settle a complaint it underpaid women. microsoft-owned linkedin more or less leaving china, cutting jobs there. today is the day republicans and democrats meet at the white house over the debt ceiling. wall street doesn't really appear to have worried about it too much. markets are mostly strong. but at some point we have to start talking about who does and who does not get paid if washington can't pay its bills. for instance, do we give the money to treasury bond holders first? they loaned the government money, they ought to get it back. or do we pay social security checks first?

people need those. treasury secretary janet yellin was on cnbc a short time ago and she refused to say. >> i really don't want to get into discussing them and ranking them because as every treasury secretary has known, the only option that really leaves our economy in good shape and our financial system, is raising the debt ceiling and making clear that congress stands behind the basic principle that america pays its bills, we're not a deadbeat country. >> government debt is a lot of things beyond the big stuff. it's the medicare payment to your doctor, it's a salary for a soldier, it's invoices from a restaurant that catered lunch. if washington can only pay out when the money comes in, somebody is not going to get paid. >> chase bank, which now owns bay area bank first republic, is warning first republic customers

not to fall for scams. if you get a call, for instance, purporting to be from chase offering to help you transfer your money from one bank to another over to chase, that is a scam. the transfers are going to be automatic with the change of ownership. chase warning, quote, you should not respond to calls or texts claiming to be from jpmorgan chase or first republic that ask for your personal financial information. we don't do that, or as marcus pointed out earlier, if you have doubt, first of all, don't talk to that person, period. they'll understand, because they're not going to call you in the first place. but even if they did, if you say, i can't talk to you. go to the bank and talk to them. but i get it that a lot of people have never had their bank sold from underneath them. the money is moved automatically. nobody is calling to help you out. >> can you imagine? scammers are on it so fast.

>> very creative. >> get the older people out there a lot of times. we've had the conversation, don't. >> my dad will talk to them on the phone. 6:18 right now. if you're a pasta lover, beware, italy's minister says the country is in crisis over the rising cost of pasta. last month prices for pasta increased by more than 16.3% compared to the prior year. the rising costs are linked to energy costs and supply chain issues. on thursday italy will launch a new committee to monitor the high prices. >> well, overnight for you, a possible meteorite crashes through an east coach home, a metallic object flying from the sky crashed into this home. luckily, no one was hurt. now scientists are investigating the large rock. they think it could be related to the recent meteor shower.

looks small there, but coming from space, certainly a lot of speed. >> if it's coming through the roof, i don't want it. a woman is safe after spending five days lost in the austrailian bush. >> get this, marcus. police say she survived on lollipops and a bottle of wine. my kind of lady. the woman was on vacation late last month when she hit a dead-end on a dirt road and her car became stuck in the mud. there was no cell phone service. she was unable to walk to try to find help due to some health issues. she was finally found about a week ago, and of course treated for dehydration. this is video of the moment that police were able to locate her by air. interesting note, though, the woman doesn't even drink alcohol. she had that bottle of wine in her car as a gift for her mother. maybe she'll start drinking it now. look at what you have in your car. >> keep bottles of water in your

car. >> i've got a lot of snacks going with all those kids. a lot of crumbs, too. >> check the seats. >> maybe we can go to the car wash, kari. >> yeah, you can go to the car wash. everything is good and dry for the next few days. as we go beyond that in the forecast, we may have some more rain coming our way. let's talk about how much rain we've already measured this year so far. so santa rosa has had nearly 42 inches of rainfall, and that's more than 9 inches above what we typically see for this year. and looking at oakland, well, we've had over 30 inches of rainfall. that's a surplus of 12 inches above normal. you can see how much rain we've measured since october 1st, with san jose getting about 15 inches of rain. that's 118% of normal. we're doing the best in oakland, 172% of our normal amount of rainfall. it was a busy season.

our reservoirs continue to vil up. look at lake shasta at 98% of capacity. there's not a lot of room in some of the reservoirs, but trinity lake will be going up. here in the bay area they're still running pretty high at 99.5% of capacity for marin water, and that's the combination of several reservoirs. coyote reservoir is not supposed to be full, so we are still watching the reservoir levels and also looking ahead to see if we're going to see any more rain. now it's just clouds and temperatures are in the mid to upper 60s today. gradually it does get warmer as rain backs off, high pressure builds, and we could see more rain chances farther down the line for next week. but we are dry all the way up until then. we're going to be talking a lot about this, temperatures heading up. take a look at santa rosa, going

good tuesday morning. the biggest development would mean cash in your pocket. the transportation department says it's proposing for the very first time in history compensation for passengers when there is a controllable airline cancellation or significant delay. so how much money? that's up for discussion. if the u.s. looks to european rules which have required cash for years, passengers could get

up to $600 each, 600 euros in this case, for delays or cancellations on a sliding scale. the d.o.t. said it's looking to make airlines pay when there's a controllable delay or cancellation. the new rule will define controllable. right now the feds say no airlines guarantee cash, only one offers miles and a travel voucher, that is alaska. we asked alaska for comment, it referred us to the airlines trade route, the lobbying group said u.s. airlines have no incentive to delay or cancel a flight and do everything in their control to ensure flights arrive on time but safety is always the top priority. we asked to clarify whether that suggests paying passengers might somehow compromise safety. we did not receive a response. generally federal rules take months to implement and input is a vital step. when the d.o.t. opens its docket for public comment, we'll show you how you can add your opinion.

right now at 6:30, the death of a bay area football legend. a look back at joe kapp's legacy on the field and the sidelines. >> new demands for transparency. san francisco supervisors are calling on the d.a. to release surveillance video of the recent deadly shooting by a walgreens security. why the d.a. is saying not so fast. this is "today in the bay." tuesday morning is here, so are we. getting you started with the day. thanks for joining us. i'm marcus washington. >> i'm laura garcia. let's get a look at that forecast for this tuesday. nice start to the day. a little cool. >> a little cool. we are seeing our usual marine layer clouds to get us started on this tuesday morning, as we take a live look outside in san jose. as it eventually clears up today, we're going to see our temperatures held down and we'll only reach into the mid-60s, about like yesterday minus the rain.

and we are going to see some dryer conditions over the next few days. take a look around the bay area and what you can expect in your microclimate in concord, reaching 71 degrees, 62 in san francisco and 66 today in mountain view. we'll talk about a warm-up in our forecast. mike gives us a quick look at 580 in dublin. >> a little more crowded. i guess everything is at speed. we'll show you the map sensors as we look at westbound across the top of the screen. the arrow is showing you southbound 680. folks passing that camera heading down toward pleasanton and sunol, you see the build, traditional at this time. nothing extreme, nothing unexpected. the south bay via 680 or 880. 880 slowing by the arrow as you're approaching hayward out of san leandro. 101 slows a bit around oakland road and also out of san martin. back to you. breaking overnight, the death of a legendary cal bear. according to multiple reports,

joe kapp has died. kapp in 1958 quarterbacked the cal bears to what remains their last rose bowl appearance, and he went on to go pro for the minnesota vikings, taking them to the super bowl. after that he returned to cal as the head coach for five seasons in the 1980s, including the season cal beat stanford with what is still known as the play. family members say kapp died after a 15-year battle with dementia. he was 85 years old. 6:32. in just a few hours san francisco supervisors will vote on a measure calling for more transparency following a deadly shooting at a walgreens. >> this comes as the district attorney says she will not release that security video. "today in the bay"'s ginger conejero saab is in the newsroom with the reason why. the public's reaction has been very vocal. >> reporter: that's right. district attorney brooke jenkins says she is not releasing the security footage because it would compromise ongoing

investigation, but protesters are upset over the decision and not backing down. over the weekend they rallied and called for justice for banko brown, the suspected shoplifter at the center of the investigation. jenkins maintains the evidence gathered so far shows the guard could claim self-defense in the shooting. supervisors are moving ahead with a measure demanding more transparency in this case, and, again, that will happen at today's board of supervisors meeting. >> i think it's really disappointing that the d.a. is deciding not to release the video, stating the reason being that for some reason it will hamper the investigation. videos get released all the time by police departments during investigations. >> reporter: district attorney brooke jenkins has released a statement saying in part, quote, i hear and understand the concerns from people calling for transparency, but releasing any evidence before the investigation is complete could compromise the investigation and is unethical. i have asked sfpd investigators to locate and interview

additional witnesses and gather additional evidence. a final charging decision will be made when the investigation is complete. now, supporters of banko brown plan to be at today's meeting, while also holding memorials at city hall and at the walgreens on market street. back to you. >> ginger, thank you. we will continue to follow today's meeting and we will let you know what happens there. make sure you download our free nbc bay area app, that way you'll get the information when we send out alerts straight to your phone. 6:34. happening today, oakland's chinatown is launching a new patrol team to try to boost safety. oakland mayor sheng thao last month held a roundtable meeting to discuss a spike in break-ins. community members proposed a new volunteer team working in tandem with oakland police on top of patrols that are already in place. it will all start today with what will be a two-hour patrol at 10:00 a.m. also today, san jose leaders are expected to reach a

settlement with a protester who sued over the actions of police during the george floyd protests. so in march of 2020, timothy harper went viral for helping a san jose police officer who had been punched in the face and thrown to the ground. this is in front of city hall. hours later harper himself was shot in the stomach with a rubber bullet by a san jose police officer. he later sued the city and the police department claiming officers were under-trained and overly aggressive responding to demonstrators who were unarmed and nonviolent. that settlement calls for a $75,000 payout. well, the warriors suddenly have a much steeper mountain to climb if they hope to advance to the nba playoffs. >> ain't no mountain high enough, right? the dubs did come up just short against the lakers last night in a back and forth game four. the warriors led down the stretch but lost the lead with about two minutes left. steph curry then missed a long three that would have given the dubs the lead in the closing seconds. that miss would be the dubs'

today it's still nice and mild and we're starting out with clouds that will clear up as we head toward the afternoon. we can see the clouds across the region that won't bring us any rain. yes, you do need the jackets, and if you're going out for a run this morning around the east bay, we're taking a look at danville where it's going to be 49 degrees to start, a mix of sun and clouds throughout the morning and then see it peeking out for the afternoon. we head for the 60s today, so really feeling nice later this afternoon. outdoor dinner sounds amazing, especially when the temperature in concord will reach 71 degrees. we'll be in the upper 60s in napa and san francisco in the low 60s, and it will feel like summer by the weekend. we'll get a look at that in a few minutes. mike, you're saying the drive is pretty predictable. >> right, but you still need me. the backup at the bay bridge, we knew that was going to happen and it happened pretty aggressively and then sorted out to its typical drive.

katie porter is among those vying for senator dianne feinstein's seat. last night she met with supporters in san francisco. porter is making a name for herself as a progressive focused on oversight, a platform she tried to hammer home last night with voters. >> the reason why i came here today was because i really like how she's holding corporations accountable, and i really appreciate what she had to say about her role in being congress' main person for oversight. that's so important. >> porter is one of three major contenders now looking to replace feinstein. the other two are bay area congresswoman barbara lee and l.a.-based representative adam schiff. president biden is going to need feinstein's vote in the senate to raise the debt ceiling. >> just one of the many, many worries for the white house right now, scott. >> maybe three, four, many worries. both the house and senate have to vote yes to save america from

default, but once we do get everything settled, assuming we do get everything settled, the white house is going to need feinstein's vote in the senate to get the debt ceiling taken care of. democrats need feinstein to come back to the capitol to do that. she's in san francisco recovering from shingles, has missed dozens upon dozens of votes. democrats have a razor-thin majority and she refuses to say when she's coming back, but senate democrats will worry about that later. they've got to come to some agreement with house republicans, today would be best. republicans say they will not raise the debt ceiling without massive cuts to current government programs. what programs they haven't said. the meeting at the white house today, 1:00 our time this afternoon, and will include mccarthy and jeffries from the house, schumer and mcconnell from the senate. mccarthy is the hard-liner, mcconnell a fellow republican, but there's a lot of secret hope

mcconnell will bring mccarthy around. mcconnell has acknowledged in the past, the debt ceiling should not be tied to conditions. he says he's confident they will lift it between this time. now, if the government can't borrow more money, it will default on its debts. it's never happened before. this is different than a shutdown. we've done shutdowns. a shutdown comes when government organizations can't spend money because congress won't give it to them. a default comes when the government has no money at all. >> the judge in the case accusing donald trump of misrepresenting hush payments on its business records says trump may not post any of the evidence on social media. he and his lawyers can look at it but they can't post it and cannot learn the names of staffers in court. there's concern the former president's fans or even the former president may harass those involved in the case. >> now, in the other current case, the rape and defamation case, trump's lawyers decided not to put up a defense and the

case will be in the hands of the jury today. >> a reminder, this one is a civil case, so the jury just needs a preponderance of evidence. the plaintiffs did not need to prove their case beyond a reasonable doubt. >> thanks so much, scott. well, this week is national stuttering awareness week, and according to the stuttering foundation, some 3 million americans struggle with this speech related issue. new for you this morning, i recently spoke with vondell and antwan who both have lived their entire lives with speech impediments. vondell recently got accepted into san jose state's speech pathology graduate program, and they're working to break the stigma surrounding stuttering, when which he says can be extremely harmful. >> for those that do stutter, it's okay to share, like, what your thoughts are, it's okay to share that you don't like your voice one day, it's okay to

toward fremont, san jose as well as san martin reaching the upper 60s. about the same tomorrow, you can see with the seven-day forecast it's not until the weekend when our temperatures really start to warm up. we're going to get a lot more dry weather over the next few days and we start to see this high pressure building, a very strong area of high pressure building. but then as it quickly breaks down early next week, we could start to see rain chances returning as early as mother's day, and it's going to be a slight chance of spotty showers. the main story will be the temperatures. take a look at walnut creek. we're going from upper 60s to low 70s to upper 80s. almost 90 degrees there in the inland east bay. then it comes down several degrees going into the middle of next week. so it's going to start to get really hot around here, but we have a few more days to enjoy those fresh breezes and the milder weather, and we start to feel that warm-up ramping up on friday into the weekend. i'll be keeping you updated on those isolated storm chances

because i know you want to take mom out on mother's day. we'll be watching out for the possibility of any isolated thunderstorms. mike, you were seeing something on the san mateo bridge. >> i was looking at the brake lights. for a few minutes we did see those stacking up. i showed you the sneak peek and i was worried about that. everything seems to be smoothing out now. no chp incidents reported. the sensors did have a backup for about three or four minutes. everything is easing up, 880 holds steady and the dumbarton shows more slowing on the peninsula side as you get toward menlo park. that's the tradition. the peninsula is moving clearly. east bay shows a traditional westbound build and the build into walnut creek out of contra costa county shows clearly the best route. back to you.

news as firefighters say they already know what sparked an overnight fire in a san francisco high-rise. >> it started about 1:00 in the morning in the inner sunset and left fire people injured. a faulty lithium-ion battery was found close to where the fire started. firefighters say multiple people were rescued, with at least one person jump to go safety from the second or third floor. three people are now in the hospital, but all are expected to be okay. >> also breaking, the death of a legendary cal bear. according to multiple reports, joe kapp has died. kapp in 1958 quarterbacked the cal bears to what remains their last rose bowl appearance, and as a pro he led the minnesota vikings to the super bowl. after that, he returned back to cal as a head coach for five seasons in the 1980s, including the season cal beat stanford in what is still known as the play. family members say kapp died after a 15-year battle with dementia.

san francisco supervisors are expected to vote on a measure calling for more transparency in a recent shooting death by a walgreens security gar. supporters of the person who died have been calling for district attorney brooke jenkins to charge the guard and they're demanding jenkins release security videos. jenkins maintains releasing any evidence before an investigation would be unethical and she says a final charging decision has not been made. she said the evidence gathered so far shows the guard would claim self-defense. the martinez amtrak station will be partially closed following a chemical spill outside the station that happened around 3:00 yesterday afternoon. hazmat teams confirming there is a mercury spill. they're still searching for where the mercury might have come from. for now, trains will continue to run and stop at the old station depot near ferry street. many students will be at home today as teachers in oakland continue their strike,
