this is what it looked like at a legal port of entry in arizona. this was shortly afterwards. the department of homeland security says more than 10,000 were apprehended two days before it was stopped. the laws now revert back to traditional immigration laws known as title 8. the biden administration is facing criticism it will now be too easy for people to illegally enter and stay in the united states. alejandro mayorkas addressed that earlier today on "today." >> you say the border is not open but there is a subset of people who are being released into this country with no court date and no way to track them. i mean, that sounds like the border is open for some. >> oh, savannah, the vast majority are being removed. i think if one asked any one of the 1.4 million people who were

expelled, removed or returned last year, i don't think they would tell you that the border is open. >> nbc's brie jackson leads off our coverage on the u.s. side of the border in el paso, texas. brie, what have you seen in the past 24 hours? >> reporter: good afternoon, kate, vicky. well, we've seen a steady flow of migrants coming into the area over the past several days. now, i'm standing outside of gate 40 here at the mexico and el paso, texas, border and earlier today we didn't see much action when it came to this particular gate. now, down the road a few miles, that's gate 42, that's where we saw several bus, several dhs buses going to pick up migrants, and so the city says this is what they were expecting. they knew there was going to be a steady flow of migrants coming into this area. they've been seeing that for the past several months and been preparing for that. the mayor says that this has -- this is just the beginning, the end of title 42 is just the beginning of what they expect to

see and he stressed that el paso has been preparing for the unknown for quite some time. they don't know how many migrants they'll's get here. they don't know how long they will be staying but they are committed to protecting them and sheltering them and supporting them while here. earlier today, the city did release a warning, they said that it was important to know that in the coming day each year water is released from the rio grande for irritation season and that is expected to reach el paso on may 17th so that they're warning that the extra water flow could pose a rick for migrants who might be crossing and so they're working with local nonprofits to hand out flyers in juarez to make sure migrants are informed. >> all right, brie jackson at the border for us in texas, thank you. as we talk about the numbers of people crossing the border, we can't forget they are people. msnbc jose diaz-balart has been speaking with families as they come looking for a better life,

good afternoon, jose. >> reporter: kate and vicky, good afternoon from el paso. what we have seen today are similar scenes of what we saw yesterday and the day before. there aren't a lot of people in the streets, you know, at different times. certainly last december when we were here, there were hundreds of people sleeping just outside the sidewalks at this sacred heart search in el paso. this building behind me has been made into a shelter and it is full of people that have arrived. the great hope and dream of the overwhelming majority of the people that are already in the united states that have requested asylum is that they be allowed to stay. we spoke with a family that just arrived from venezuela. it took them a month and a half to get here, and they were bringing their 5-year-old daughter and 3-year-old son. their dream is to be able to

have a better future for their children. here's part of what they had to say. video. witnesses tell nbc news new york jordan neely started acting aggressively and was soon after restrained by daniel penny and two other passengers. neely was unconscious when police arrived and was later pronounced dead at a nearby hospital. in a statement penny's attorney said, quote, he risked his own life and safety for the good of his fellow pennsylvanias, the unfortunate result was the unintended and unforeseen death of mr. neely. earlier today penny pleaded not guilty to the chree leased on bail. rehema ellis is in new york city. rehema, talk to us, what was behind the decision to charge penny and also what is the response been? >> reporter: there was a growing outrage in this community and in this city for charges to be filed against that 24-year-old former marine, daniel penny, and that came after the coroner's report that labeled this death of jordan neely as a homicide, but it did not say at that point

with the homicide finding it was a result of the chokehold but didn't say who was liable and what the culpability was. but people felt it should have led to an arrest and as i say the pressure was mounting on the district attorney's office who said he was going to continue to investigate. the police would investigate as well as the prosecutor's office. what happened after that, he said that he was -- might be turning this over to the grand jury for consideration. but then just yesterday, he filed a charge of second degree manslaughter against daniel penny. and his attorney, penny's attorney says his client did not set out to do harm. take a listen. >> he's dealing with the significance characteristic of who he is with his service in the marine corps and held up his head high. >> reporter: that did not sit well with the family of jordan

neely. their attorney spoke out also. take a listen. >> no one on that train asked jordan, what's wrong? how can i help you? he was choked to death instead so should daniel penny be charged with manslaughter, absolutely. he acted with indifference. he didn't care about jordan. he cared about himself. and we can't let that stand. >> reporter: now the family is just hoping that their loved one, jordan neely, can get justice, vicky. >> rehema ellis in new york city for us today, thank you. communities in central oklahoma are cleaning up after several tornadoes reportedly touched down. take a look at this video, eerie video captured by storm chasers as the severe weather rolled in. the storm tore off rooftops and destroyed businesses in the town of noble. this video taken this morning over that same town shows the extent of the damage there.

the nearby town of cole was also hit, even as residents are still cleaning up from a tornado there last month and more storms are on the way. nbc news meteorologist angie lassman tracking all of it for us. angie, what's in store? >> a couple of rounds of heavy rain, kate, and for severe storms including tornadoes through the dare and into the evening hours tonight. here's what we're dealing with. the heavy rain draped across really the high plains and out towards the mideast down towards the southeast and we'll have that impacting folks for the next couple of days including southern plains where we received plenty of rain but have more round that is could lead to flooding and have a newly issued tornado watch that will go until 9:00 p.m. central time. that is going to include parts of iowa, nebraska and south dakota. we will continue to see the threat of tornadoes, really the ingredients there to see some of these tornadoes develop through the evening hours tonight. it isn't just there we have that threat for severe weather. it extends all the way down to the south including texas, 16 million people at risk to see

buried often a property belonging to her new husband. nbc news correspondent dana griffin is tracking this story and trial for us. dana, walk us through the verdict. >> reporter: so as that verdict was being read, lori vallow stood there and listened, showed no reaction, again, she faced six counts including two counts of first degree murder, three counts of conspiracy to commit murder including for tammy daybell, her husband chad's former wife and also grand theft for taking social security checks that should have gone to her kids and knowing that they were dead. the jury deliberated yesterday for several hours and stayed for a dinner and went back to deliberating so thought we would get a verdict late last night but did not happen and deliberated for an additional three hours and guilty on all charges. she faces life in prison for the deaths of her two children who vanished in september 2019. tammy daybell, chad daybell's wife, the man that lori married

just months after she died, she died and then two weeks later she married chad and then her kids went missing in september. they weren't reported missing until november by j.j.'s grandparents. lori was arrested in february 2020 and her children's bodies were discovered in june buried in chad daybell's backyard. we're seeing video of them in hawaii as the world was looking for her two children, she was off to hawaii seen in a bikini poolside and that's what really created a lot of outrage is the fact that she never reported her kids missing and although she claims that she, you know, did not kill her kids, the judge made it clear even if she was in on it or had her brother alex cox who was another key figure, he passed away and chad daybell, even if they may have committed the murders, she is still being convicted on these deaths. now, an interesting part about this whole thing, prosecutors

really pointed to her fringe religious beliefs and painted her as this doomsday cult mom who believed her kids were zombies and had dark spirits and believed that may have been she eliminated them but the prosecution painted a different picture and said sex, money and power was what this was all about and here we are with a verdict. they have not set a sentencing date but, again, lori vallow daybell faces life in prison for the death of her two young children. the owner of houston's only lesbian bar says her business is in jeopardy after it was denied insurance coverage and she is putting the blame in part on an anti-drag bill moving through the texas legislature. andy cerota has more. >> reporter: julie always dreamed of running her own bar and after working hard for so many years in 2013 she made that dream come true when she opened her bar.

the state's superintendent takes a break. student housing set did the backs. and pilots are on strike. they have been working without an active contract for years now. recent deals at other airlines is raising the pressure. united is trying to negotiate and promises flights will not be disrupted. the push to build new student housing on people's park in berkeley took a blow. the project's developer, a non-profit resources for community development, is backing out. the people's park plan has been confronted with delays and an ongoing battle with protesters. school leaders say they are committed to building on that site and they are hoping to bring another non-profit on board. the state's school superintendent took a break from

thefts. it joins seattle, st. louis and other cities suing the automakers for failing to equip certain models with industry standard immobilization technology. baltimore officials say 577 kias and hyundais have been stolen in the city so far this year. the ohio emergency medical technician who vanished over the weekend believed to be in danger has been found safe. lachelle jordan was reported missing after she went to get something from her car saturday and never came back. our nbc affiliate in cleveland had reported jordan was set to testify earlier this week in a rape case against a former co-worker. that co-worker was not named as a suspect in jordan's disappearance. a drug that reverses the effects of an opioid overdose is now available at a college university for free and has a vending machine that dispenses it. they will get instructions on how to recognize the signs of an

overdose. other colleges and universities have installed these vending machines, as well, to help combat a rise in overdose deaths. the four university of idaho students murdered last november will be honked at tomorrow's graduation. the university says it will be a moment of healing after a painful year for the school and the community. nbc news correspondent steve patterson joins us from moscow, idaho. how will they remember them. >> reporter: it's about honor, remembrance and giving these kids the next step in life that they would have taken had their lives not been tragically shortened. so commemorations means posthumous degrees and certificates for kaylee and maddie and they would have graduated this year. one should have been walking across the stage. for zana and ethan they will

receive certificates honored alongside another classmate killed in a driving accident as well, separate but also being awarded a certificate as well. this on top of a memorial garden is also being planned. we spoke to some of those classmates and everybody is studying for finals. here's what they told us. >> they worked hard. they studied hard. they deserve to have that work recognized and honored and remembered for sure. >> we're going to remember those four individuals and the remember the legacy they left on, and just kind of take that and move on. >> reporter: one thing that's not clear is if the families will attend. we know they're thankful for everything the university has done but there's still quite a

bit of pain. not sure if they'll be in attendance as well. >> i know, steve, you're back in town and had a chance to go by the site of the crime, the house where the murders took place. it's set to be demolished. right? do we know when that could happen? >> yeah, that is boarded up. it's essentially condemned given by the previous owner to the university. the university said let's just knock this down. it's a symbol of sadness for our students. the earliest possible is probably at the end of this semester, kate. >> all right. steve, and we understand the case against the accused killer, bryan kohberger is moving closer to trial. what's the latest on that? >> reporter: kohberger is scheduled to make an appearance at the end of june. he has hired a defense attorney certified in handling death penalty cases, kohberger, of course, pleading not guilty and see how it plays out in court. >> steve patterson, thank you.

we are now getting a look at a chaotic and deadly police confrontation in virginia. video appears to show a man who was shot and killed by police after investigators say he attacked an officer. nbc news reporter julia jester joins us now. julia, walk us through how this unfolded and at this 39 what we know about the man killed. >> reporter: vicky, first a warning that viewers may find this video disturbing. it's important to know we only know the police department's version of what happened before the video recording began. brandon lemagne is dead after the police chief called a highly unusual scene late thursday afternoon. the 38-year-old man had stolen a u-haul from richmond, virginia, about a week ago. an officer alerted to the truck's location and approached the suspected driver in a gas station parking lot about the u-haul. you can see in this video quite

a shocking scene. according to police lemagne violently assaulted the officer. he attempted to disarm him, struck the officer in the head, pulled him across the lot into the front driver's seat of his police cruiser and during the struggle, the vehicle reversed into the parking lot of a mcdonald's next door crashing into other empty parked cars along the way. during this chaos the officer radioed for backup telling dispatch the suspect had his firearm. police later said lemagne had pulled the officer's firearm but it remained holstered to the officer's belt throughout the incident. when additional officers arrived, you could see them approaching the vehicle, one shot at the man inside before a second officer pulled lemagne out of the car and shot at him again. he was declared deceased at the scene. here's what the police chief said shortly after the shocking incident. >> police officers arrest people

in a recent interview saying, quote, the party is over for disney, but, again, this feud is escalating just as speculation mounts about governor desantis' potential run for president, kate. he is planning to be in iowa tomorrow, the critical primary state of iowa. >> that may not be an accident. gabe, disney expanded its lawsuit, i understand, against the state of florida this week. what have they done here when they expanded? what did they say, and has there been any response from the state? >> reporter: you know, as i said it's been escalating, and the florida legislature wrapped up its session within the past week. part of what the state lawmakers did was give or try to give the state more authority once again over disney, and, kate, they included the authority -- giving the state authority to inspect the famous monorails at disney, so disney decided to amend its lawsuit to include that saying that that is, again, retaliation. no direct response from the state yet, but, again, governor desantis says this is about making sure that disney does not

particular because it was racially motivated and had hut -- put his hasn'ts on social media. >> one theory of liability here is that these products are essentially defective in their design, whether the algorithm or whatever the case may be and i think that's a really uphill battle for the plaintiffs because they're essentially saying that these products, these social media outlet, the way they're designed is itself a problem. and i think they're going to have a hard time with the obvious intervening cause of it was an actual shooter who did the evil. it was the people who used the platform who were evil and even if there were algorithms that guided people towards certain information, that still, i think, will be difficult because just the mere exchange of information, we have come to think of the social media platforms as -- we sort of understand they're not liable

for the speech on them. >> danny, we have seen these other lawsuits against gunmakers, so get off the platform but gunmakers are also named. the gun parts manufacturers as well. walk us through that. have there been successful lawsuits in those instances? >> where they have successful is workarounds. there is federal law that says generally speaking you can't sue gun manufacturers for liability arising out of people who were shot with these guns and you may think, well, that doesn't seem fair because of all these shootings but you can't really say a gun is a defective product because it shot somebody. that's what guns do. that probably went into it. that plus lobbying by the gun industry but these are all work-arounds. >> also the lawsuits naming the shooter's parents. is that a novel approach gentleman. >> it is in the sense that you want to name every defendant you can. normally you do that in order to get to as many insurance policies as you can. i don't think that's the case here. it's just, again, more sticky theories of liability that you

an important issue that people don't talk about very much. mom guilt. >> yeah, we don't talk about it but we do feel it. it is the guilt we moms sometimes experience when we feel we're not doing enough for our kids. well, this is interesting. it turns out feeling that way can be a good thing if we learn to use it properly. >> i'm interested. joining us is women's career coach elizabeth pearson. elizabeth, thanks for being with us. how does it affect our mental health and what are the signs who aren't moms? >> yeah, thanks so much for having me on. i'm excited to talk to you. a couple of super working moms and i think you're excellent role models but sometimes it can impact your mental health. instead of impacting your work function do you feel like you're half in, half out when you're away from your children. another big one, are you letting basic needs go to the side? are you not maybe showering as much or getting your hair done because you feel so guilty about

being away from your children and want to be with them as much as possible when not working? >> yeah, that self-doubt we're feeling of inadequacy is a red flag. we talked about you said there is a good side to mom guilt. how can we use these feelings to our advantage? >> i think there's a great side to mom guilt with everything, right? you can have a different perspective and i think we can choose to see it as a wonderful reminder that it's really important we take care of ourselves and prioritize our happen that is because if we are just living for our children, not only does that put a ton of pressure on them, but when you deteriorate yourself we're setting an example for them of a certain standard so if mom has a nice size standard for herself, a great job, a great relationship and takes care of her physical and mental health, that is what our children will watch us set as a model for them and believe they should have the same standards for themselves but if we're deprioritizing herself all the time we risk our

children growing up to deprioritize themselves in their relationships and careers. >> that's powerful. >> that's a powerful thing to say. what are some things we can do? is there such a thing as too much mom guilt? >> maybe? >> what do we do to lessen that feeling? is there absolutely. i think first give ourselves a break. someone beautifully explained to me when i was a younger mom with young kids they said there will be others. and this was other recitals, other things at schools, things i had missed every time i was on a work trip. you guys know. when i would back up the out of the driveway i used to well up. don't you cry a little every time you go on a work trip i asked my work husband, he said, no, i don't. i know when i'm away, beating myself up and having a really hard time and feeling guilty doesn't help you at home with the kids so i think if we remind ourselves if we can take that time to ourselves we're actually
