mid-50s, we do have our usual start to the day. but then as we go into late morning into the afternoon, you're going to see temperatures heading up, and especially for the inland valleys it's going to be much hotter compared to yesterday, with san jose reaching 82 degrees. we'll see a high of 83 in santa rosa, while san francisco will reach into the mid-60s. take a look at livermore and morgan hill, upper 80s there, and 91 in fairfield. we'll talk about the weather as we go throughout the week coming up. mike, you're already tracking a few crashes. >> we've got a lot of work going on. a number of incidents on the grid. no major injuries, but highway 84 we do have a crash and there are a number of vehicles involved. if you travel this cut-through here coming toward sunol, we do have a shift for the lanes as well. so this vehicle activity blocking just one lane is causing a good amount of slowing before you get to 680. the northbound side has crews

from overnight work. there's another crash on highway 4. the commute direction is coming toward the bay bridge moving smoothly through contra costa county and alameda county. over to you. >> thank you so much. a b.a.r.t. train and truck collide on the tracks. this happened last night at about 11:30 between fruitvale and lake merritt stations in oakland. investigators say the pickup truck was driving down east 8th street and crashed into the b.a.r.t. tracks. then an oncoming train crashed into the truck. a passenger on the train also hurt. police do not take the truck driver to the hospital or into custody. b.a.r.t. workers are there, they have cleared the tracks, and normal operations have resumed. this morning, angry protesters are not giving up in san francisco, they are demanding criminal charges be filed against the walgreens security guard who shot banko brown. >> this comes after that surveillance video shows the moments leading up to his death.

"today in the bay"'s ginger conejero saab live for us there with more details this morning. >> reporter: good morning, marcus and laura. there were calls to release that surveillance video, but the district attorney had said she would not release it because of the ongoing investigation. however, as you both mentioned, now the video is released and the reactions to it are growing louder. [ crowd chanting ] >> reporter: protesters gathered last night in san francisco outside the walgreens on market and 4th street. they marched to city hall, demanding criminal charges against the security guard, michael wayne anthony, who shot banko brown. this coming hours after d.a. brooke jenkins released surveillance video of the shooting and the moments leading up to it. it shows a fight between brown, a suspected shot shoplifter and

anthony. banko brown is lifted off the ground and put into a chokehold. brown starts to leave, but then turns around and motions toward the guard. the guard said he felt threatened and then shot brown. protesters and members of san francisco's board of supervisors say more needs to be done. d.a. jenkins says she is taking all sides into account. >> with the video that has no sound, no audio to it, it is difficult to have context to what is going on, and that is why we must listen to the security guard's statement, the witness statements. >> if you allow a black person to be executed in the street, that tells me that black lives don't matter to you. yes, a black person most certainly can feel that way, unfortunately. >> reporter: board president aaron peskin says he will ask attorney general rob bonta and

the u.s. department of justice to review jenkins' decision not to press charges. meanwhile, an nbc bay area legal expert said the brown family may have a civil lawsuit against walgreens. laura, back to you. >> thank you very much for the latest there, ginger. police questioned the walgreens security guard two separate times, each lasting about three hours. he said he feared for his life and said walgreens repeatedly changed its shoplifting policies. >> at one point, it was hands on. i think it's still hands on now, you know, um, to be honest. they kept on changing it back and forth. now it's like particular, it's like, okay, if you suspect or if you seen it, then -- then you can go that route. but if you haven't seen anything, you can't follow nonobody, and i never did that. >> among the other new detetail from the interviews, he told

police the second guard on duty that day was on break at the time of the confrontation. time is running out. congressional leaders are set to meet with president biden at the white house today. this is an effort to hammer out a deal on raising the nation's debt limit by june 1st. experts say an unprecedented debt default could trigger a financial disaster. "today in the bay"'s drew petrimoulx is live in washington. there's still so much up in the air right now. >> reporter: good morning, marcus. over the last several days we've heard some optimism from the president and from other people in congress, but it's not clear what a potential deal would look like and time is running out. >> what's your message for the speaker? >> reporter: with the fate of the fragile u.s. economy in their hands, the president and top congressional leaders meet at the white house today. the treasury secretary says if congress does not lift the debt ceiling, the federal government could run out of funding as soon as june 1st. over the weekend, president

biden sounding optimisticeally desire on their part as well as ours to reach an agreement and i think we'll be able to do it. >> reporter: but publicly the two sides appear far apart. republicans are demanding spending cuts in return for their votes to raise the debt ceiling. democrats accuse the gop of holding the economy hostage and republican house speaker kevin mccarthy says no deal is in sight. >> i don't think we're in a good place. >> mccarthy says they need a deal by this weekend in order to get legislation through congress. >> we just had our secretary say june 1st we could run out of money. we only have so many days left. >> it would be a catastrophe. no one should play with it. no one should flirt with it. no one should hold it hostage. >> reporter: the stakes are clear. what's not is whether lawmakers can reach a deal before time runs out. now, on monday, treasury secretary janet yellen sent a letter to congressional leaders, saying waiting to the last

minute to increase the debt limit could cause serious harm to consumer confidence, raise interest rates for borrowers and negatively impact the credit rating of the u.s. drew petrimoulx, nbc news. >> thank you. the internal revenue service is promising to look into a recent stanford study finding racial disparities in taxpayer audits. in january, stanford's institute for economic policy research found black taxpayers were three to five times more likely to be audited. a study pinned it on a computer algorithm used to spot tax cheats. yesterday the head of the irs sent a letter to congress outlining plans to address the issue and keep tax enforcement laws fair and impartial. the commissioner says in part, quote, i will stay laser-focused on this to ensure that we identify and implement changes prior to next tax filing season. johnson & johnson's long stalled covid vaccine now

officially no longer available. americans have been unable to receive the j&j vaccine for more than two years but the cdc says last week all remaining vials expired. fewer than 10% of americans received the johnson & johnson shot, which scientists tied to a rare blood clot disorder. taking a live look outside, a little hazy sky out there. san francisco. let's check the forecast with kari. does that mean it will be cooler? >> absolutely. any time we see that thick layer of fog over san francisco, that keeps the temperatures held down a lot more. as we head to the north bay, we're going to start out with a mostly cloudy morning. temperatures in the mid-50s. we are going to see our trend starting to clear with the skies at about 9:00 to 10:00, and then clear the rest of the day. and our temperatures warming up into the low 80s in the north bay. now, as you head toward the east bay, it's going to be a lot

warmer, upper 80s, even 91 degrees. for the south bay, we're up to 88 in san martin and 81 in mountain view. mike has a look at where we can find lower gas prices. >> we have movement in the prices. i don't think this is the right direction, though. the price moved platinum on washington street in santa clara, but it's up 4 cents, so only $3.95. solano county, the shell on tennessee street, that best is holding at $4.11 for that region. contra costa county, $4.25 for spots in concord, let's recognize arco. as we look at the roadways, we're looking at a smooth flow of traffic and a crash on highway 84 did clear. this highway 4 crash, we're looking at opposite the commute, and it looks like only the slow lane might be blocked. the commute goes the opposite

happy tuesday to you. the time is 6:14. as you're heading through the east bay, it's a cloudy morning, temperatures in the low 50s. ce and mild morning.to have but really starting to heat up for the inland valleys later on this afternoon. we'll get a look at what to expect as we go through the weekend, the full microclimate forecast coming up. behind those temperatures, we have two event centers. we have ring central coliseum and the oakland arena. both will have events tonight. we'll talk about traffic involved in the area. there may be lots of crowds that you can see from the freeway as well. good morning. very happy tuesday to you. so the markets don't seem too concerned about a potential default. drew was just talking about that

before the break, but i never heard anything out of washington to be very optimistic. roku is giving up more real estate in san jose, according to the san francisco business times. a recent study from analysts at a firm called scoop says the number of people in offices in america is going down, not up. >> wells fargo has agreed to pay out a billion dollars to plaintiffs that sued over the fake account scandal. the investors were retired funds and other interested parties who say wells fargo hid the truth from them about how long it would take to clean up the mess. the settlement was first reported by the "wall street journal." >> the former head of silicon valley bank will join an executive from signature bank to testify before a senate committee about bank failures. greg becker will try to explain why silicon valley bank failed. also expect a lot of tough questions about how much he was

paid and the timing of some of his stock sales. >> in written testimony submitted ahead of time, becker will testify, quote, the takeover of svb by the government has been personally and professionally devastating, and i am truly sorry for how this has impacted employees, clients and shareholders. becker is expected to testify at the height of the bank run depositors withdrew $42 million a day, or roughly $1 million a minute. >> busy day on capitol hill. also testifying before a senate subcommittee, sam altman from open ai. he's not in trouble. he's there to educate senators about artificial intelligence. i'm sure he'll face tough questions. coming up on the "today" show, aaron ross sorkin will sit down with satya nadella. it's good for everyone, including lawmakers, to ask

from the weather department. >> it looks good. temperatures are going to be heating up for the valley but other areas are still going to have a nice and mild day. take a look at san francisco. we're going above the clouds and the fog because you can't even see the sunrise this morning. so we are going to show you the view from our sutro tower camera. let's zoom into the south bay. our temperatures are headed for the upper 80s in morgan hill, compared to the low 80s we'll see in downtown san jose, los gatos reaching 81 degrees. moving toward the east bay with walnut creek reaching 89 degrees. compare that to the 73 we'll have in oakland and hayward. much of the coastline will have a nice breeze picking up, but it just doesn't make it over a lot of the hills, so the valleys will be hot today. as we make it toward the coastline, half moon bay reaching 61 degrees, so really nice there. and some low to mid-60s for san francisco. you can see the clouds and the fog. that's going to take a while to clear out. the north bay, we're heading up

for 87 in ukiah, with 62 expected in bodega bay. we're going to have a lot of action going on between oakland and san francisco. we've got the giants game today and it's right at about the same time as the a's game, but the temperatures are going to be several degrees warmer, starting out in the low 70s, dropping down to the low 50s by the end of the game. we're going to have some hot temperatures inland today, but there will be a nice little cooldown for the next few days. especially this weekend, with some low 70s there. as we take a look at our inland temperatures, it's going to go from 88 today to some low to mid-80s, and even 70s for the rest of the week. it's going to be nice to get that sunshine and some comfortable weather for the rest of the week. mike, you've been watching a crash. >> we have a crash and slowing. i think they're independent because the crash is in the eastbound direction. we told you about that. possibly one slow lane blocked. highway 4 westbound has started

to show slowing through pittsburg. that's a little earlier than we typically see on a tuesday. no drama once you pass by the area. walnut creek is moving smoothly and so the the eastshore freeway. a smooth flow of traffic on the tracks. you might have heard about an overnight crash on the b.a.r.t. cracks. that has been cleared. everything is back to normal schedule for b.a.r.t. operations this morning. same for the rest of these transit agencies. the roadways are still moving smoothly. the crash cleared from 84. we had one near the dublin interchange but it shouldn't be affected traffic. back to you. >> thanks, mike. a heart-stopping shark attack caught on camera. coming up next, an incredible story of survival one fisherman is now sharing. we'll be right back.

welcome back. it's 5:25 right now. a frightening scene caught on video in hawaii. >> a fisherman is talking about his all-too-close encounter with a shark. this happened on friday about a mile off the coast. you can see the tiger shark emerge out of nowhere. fortunately, only leaving teeth marks in the man's kayak. pretty scary video. so this shows him try to kick off that shark, which actually

then sunshine for the rest of today. a slow warm-up as we reach into the upper 60s there. in mountain view it's going to be significantly warmer. we'll see temperatures reaching 82 in san jose, 87 in livermore, 91 in fairfield. we're still in the mid-60s near the coast and upper 70s and low 80s in the north bay. tomorrow we see a little bit more of a breeze to help bring down temperatures a few degrees, and it's going to be pleasant the rest of the week. mike, you're watching the fog for the golden gate bridge drive. >> it looks cool, so i wanted to show folks. let's take another look. not only the golden gate bridge, but also the bay bridge is low clouds are descending down. we can still see treasure island. drivers are doing okay, but there may be an issue for visibility from time to time. not presenting a problem. the arrows are showing you where there's slowing, typical for highway 37 and 4 in your commute direction. the rest of the bay looking nice. chp did just call out 680 by 84,

under investigation. 5:33 right now. in just a matter of hours, oakland teachers will finally be back in class. it comes after many spent a week on the picket lines trying to fight for a new contract. >> "today in the bay"'s kris sanchez is joining us with a look ahead. >> reporter: the teachers will certainly have their work cut out for them. they are returning to class after a week on the picket line and they'll be returning to a lot of students who are worried about grades and about graduation, because now there are just two weeks left of school. now, the strike ended with a $70 million deal that will allow the district to increase salaries by an average of 15%, it also gives teachers a one-time $5,000 stipend. oakland unified will bring on more counselors, librarians, nurses, and even performing arts teachers. also, the teachers say they fought for what they call common good agreement to provide resources for unhoused students, school closures and a possible

path toward black student reparations. >> i think the tide turned when the district knew that we weren't backing down, through the weekend we were continue to go push forward. there were some real intense moments, but we didn't blink. >> i just hope for the best and pray for the best that we make sure we get through this week altogether and that we all graduate on time. >> reporter: so this is technically a tentative agreement, but the teachers are still going to return to class. this week the union members will have to ratify that agreement, agree to it, then alameda county has to agree to it, then there is a final vote from oakland unified school district, and that will happen later on as well. in oakland, kris sanchez, "today in the bay." >> thank you. 5:35 right now. a live look at the state capitol where today registered nurses are organizing a march and rally. this coincides with today's nurses lobby day as leading

representatives meet with legislators about key issues. the march is set to start a little after 10:00 this morning. a rally is scheduled for 11:00. attorneys for disgraced theranos founder elizabeth holmes have filed a new motion that may further delay her reporting to prison. holmes last month received a last-month hold in starting her 11-year sentence for criminal fraud, an appeals court agreed to let her remain on bail while her attorneys appeal that verdict. following yesterday's motion, the state now has 21 days to replay. holmes' lawyers will also have a 21-day window to respond. by that math, she may not enter prison before late june. a south bay mother accused of hosting alcohol-fueled parties for minors is expected back in court today. attorneys say shannon o'connor has been trying to negotiate a plea. she's been held without bail for more than a year, and pleaded

not guilty to 39 charges, including child endangerment, providing alcohol to minors and sexual battery. illegal sideshows has been a growing problem, no doubt about that, and now today oakland leaders will discuss a plan to crack down on them. youu might recall earlilier thi montnth the video of the car th caught fire and anonother drive crashingng into it. the public safety committee passed a resolution that would impose fines on illegal stunts. the city council is expected to discuss the matter during its meeting later this afternoon. the sun is coming up over the bay area. kind of a cooler start. some cloud cover out there. kari is tracking a warm day ahead. >> for some of our inland valleys, temperatures are going to be a little warmer than yesterday. but we still have a wide range in temperatures. so it really just depends on where you are. in gilroy we start out with clouds, a light wind temperature at 57 degrees. and as we go into the morning it's going to really start to

clear up here quickly, at about 8:00 it's mostly clear, sunny the rest of the day. we'll go from upper 50s to upper 70s by lunchtime, eventually making it into the upper 80s. you compare that to san jose where it's going to be in the upper 70s for fremont and low 70s for hayward, and we're reaching 83 in santa rosa and in san francisco we'll see temperatures in the mid-60s. we'll see a breezy wind and a full microclimate forecast here we'll be in the mid-60s near the coast and mid to upper 80s for the valleys. mike, what's the update on that crash? >> everything is clear as far as any major crashes, but now we're looking at delays for oakland. obviously the bay bridge. we're going to see more slowing, the traffic is building and we should see the metering lights turning on. folks are already slowing approaching the toll plaza. that's for this morning's commute. this evening starting at about 7:00, a little before, we're looking at highway 13, heading

away from 580 and toward the merge, the warren freeway will have one lane closed tonight, tomorrow and the rest of the week until 6:00 in the morning. the commute doesn't build in that direction. this evening we have an a's game at 6:40 at the coliseum. dual events because next door we have an 8:00 concert, suga is having a concert tonight and tomorrow. that will mean for crowds through the area. watch after work and after the game and concert, there will be crowds there as well. and across the bay, the giants will be playing at oracle. that's a 6:45 game. just warning about crowds heading to and from the areas. after the game folks will be heading toward the bay bridge from oracle park. the rest of the bay moves smoothly. we have the build coming out of san martin. back to you. >> thanks, mike. 5:39 right now. alarming conclusions in a new

good tuesday morning. the time is 6:42. let's head to the north bay with a look at novato and how the morning shapes up, we have low 50s right now and it's mostly cloudy. we will have a cloudy start and then gradually turning sunny, with slightly warmer temperatures today compared to yesterday. we'll get a look at all of our microclimates and the wide range in temperatures coming up in a few minutes. cloudy and crowded for the bay bridge, westbound with taillights starting to slow down a bit on the span. that's why they've activated the metering lights. the backup forming at the toll plaza. the visibility down a bit as well. ukraine's capital under heavy new fire from russian air strikes. new video overnight showing one of the series of missile

won't agree to. reporters caught mccarthy on the stairwell, where he said he did not expect much progress today. reporters found president biden on a bike sunday where he was far more optimistic. everybody getting in their cardio. in the middle of all of this, treasury secretary janet yellen reiterated her warning the government would likely default on its debt as of june 1st. earlier, the congressional budget office speculated we have more time, yellen says we don't. the justice department has released a report put together by special counsel john durham looking into the reasons and methods behind the fbi investigation into donald trump, and any potential connections with russia. a different report, the mueller report, found no criminal conspiracy between the campaign andusthe durham investigation c later, after allegations the fbi lied on some of the original documents that launched the trump investigation.

moon bay, then you head over to redwood city, it's 78 degrees and 80 in palo alto. for san francisco, we're up to 66 downtown, the mission district 67 degrees. take a look at clear lake, reaching 85 degrees and 81 in novato. let's talk about our water year, where we're seeing those rainfall totals right now still standing well over what we typically get throughout the year between october into the current date. now, oakland is doing the best at 183% of its normal amount of rain, and most likely we're not going to see any more rain, at least as we look at this forecast. but check out the sierra. we're still talking about that snowpack, because last year at this time it was at about 22% of its normal amount, and there was very little left at this point. but right now we still have a lot of snow in the sierra, and as of today it is at 337% of its

normal amount of sierra snowpack. now, the reservoirs are going up so quickly, right now we're nearly at capacity for a lot of them or over capacity. look at lake oroville, 122% of the historical average, and trinity lake, even though just a couple of weeks ago it was at 36%, it's now at 52%. that's because it fills up with the sierra snowpack. so that's already starting to melt. around the bay area, we're seeing our reservoirs at about 100% of capacity, with east bay mud at 92% and lake sonoma at 69% of capacity, so even pretty high there. we don't have any rain in the forecast, we're not going to see anything filling up the reservoirs locally, but we are seeing them across the state, some of the larger ones filling up with sierra snowmelt. we're going to see more warm temperatures, causing more snowmelt as well. in the bay area we'll head for the upper 80s today and then

there in livermore and will be used for traffic enforcement and livermore police say they currently have two hybrid cars, with plans to add more of the hybrid patrol vehicles to their fleet. clean air vehicles help with our air quality and make us less dependent on the use of fossil fuels. this is a part of livermore's client action plan to cut emissions and help residents plan for a greener future. it was recently published in november of last year, which includes details reducing carbon greenhouse emissions and how residents can help reach their net zero carbon emissions by 2045. the plan also talks about water conservation, cooling centers in vulnerable neighborhoods, planning for more energy efficiency and planting trees. you can learn more on the city of livermore's website and also your city as well. we have a lot of stories on our climate in crisis page on nbcbayarea.com. click on the tab at the top left of the screen. >> good to check out.
