his own career. >> also, the battle over reproductive rights continues and returns to court. the key decision which will impact millions of women across the country. this is "today in the bay." a very good morning to you. it is wednesday, 5:00. thanks for starting your morning with us. i'm laura garcia. >> i'm marcus washington. we're going to get a look at the commute in just a bit. first let's start with the forecast. meteorologist kari hall has been tracking that. >> it was very warm yesterday in some of the inland valleys and today we're going to see temperatures coming down a few degrees. it looks exactly the same as it did yesterday at this time with temperatures in the mid to upper 50s. it is 58 degrees right now in san jose. it's also cloudy. as we go into today we're going to see temperatures going from upper 50s to low 70s and reaching into the low 70s by noon. a nice and mild day. notice our afternoon highs will

reach up to about 80 degrees in san jose, a little cooler than yesterday with novato reaching 78 degrees, 64 in san francisco. we'll see some low 80s for a lot of our inland areas. heading into tomorrow, we'll see temperatures coming down even more, so we're leading into a nice end of the week. mike, you were checking in on a crash in the east bay. >> we're looking toward 680. the reason i'm concerned, it's in danville, southbound 680 right around sycamore valley road. reports are, a witness said the car hit the center divide and went the way to the right shoulder. we haven't heard any follow-up. chp will let us know if there are injuries or lanes blocked. meanwhile, the rest of the east bay moving smoothly. we'll check out why there's slowing near the golden gate bridge coming up. a toddler is recovering after being hit by bullet fragments during an attempted robbery in oakland. >> "today in the bay"'s bob redell joins us live. have police made any arrests in

this case? >> reporter: no, not any arrests we're aware of. good morning. this happened just before 11:00 yesterday morning. this is in the tressel glenn neighborhood, an upscale part of oakland. a nanny was pushing a toddler on the sidewalk when she was assaulted by a man who jumped out of the passenger side of a car. in an interview, the nanny said the man put something to her head and said, don't move. she screamed as he started pulling on her bag, fired a shot into the ground and left with her purse. shrapnel hit the baby in the stroller, who according to police, is recovering in the hospital with just minor injuries. the nanny was not hurt. this man we spoke with witnessed the attack. >> they didn't even get her purse. she was a courageous lady. she's trying to guard a

15-month-old baby. >> it makes me want more police, of course, and it makes me afraid, being an older citizen. >> it's a nice neighborhood, but you have to be aware of your surroundings at all times, even in nice neighborhoods. >> reporter: that first man you heard from, he tells us this attempted robbery is the third attack in eight days in that area. oakland police tell us that they are looking for two suspects in yesterday's attack. again, no arrests as of yet. reporting live, bob redell, "today in the bay." >> can't even go for a walk in the neighborhood. thank you. in just a few hours the legal battle over the use of the abortion pill heads to court, federal appeals court is set to hear arguments about whether the pill should remain on the market t. fda approved that drug more than two decades ago as a safe method used to terminate

pregnancies in the u.s. anti-abortion groups want to limit access to that medication. also today, two people accused in a murder are scheduled to return to court for an arraignment. deputies last month arrested former stanford on-campus child care worker diana ornelas. investigators say they shot and killed a san jose man whose body was found near felton in mid-april. they also believe the victim knew the suspects, and soon after her arrest, ornelas was fired from her teaching job at childrens' center of the stanford community. a former apple employee and mountain view resident stands accused of stealing trade secrets for self-driving cars and fleeing to china. a newly unsealed indictment says webao wong was hired by the company back in 2016.

he then gained access to apple's sensitive materials before accepting a job in china in 2018. he did not let apple know that he was leaving until four months later. the u.s. justice department says the tech company discovered wong accessed large amounts of proprietary data during his last days on the job. that's when the fbi raided his mountain view home, something his former neighbors remember. >> open the door, fbi, open up, if you don't open up the door, we will. >> we ran to the peephole and i could see all the way up the stairs, fbi agents, full gear. >> according to the indictment, wong bought a one-way ticket from san francisco to china and took off on the same night his home was searched. if convicted, he faces up to ten years in prison for each violation. we reached out to apple for a statement but have not heard

back. disgraced theranos founder elizabeth holmes will soon start her prison sentence. she was found guilty for defrauding investors. she was avoided serving her sentence while her lawyers filed an appeal, which is working its way through the court. yesterday her motion for bail was denied. here is the digital legal analyst. >> what the court said was we don't feel that the appeal really raises any questions of law or facts, but even if they did, we don't feel that anything that you're showing us is going to change the ultimate result. >> a new date for holmes to report to prison is set to happen any day now. mourners will pay tribute to a long-time catholic leader who served the bay area for decades. patrick mcgraw lost his battle with pneumonia earlier this

today. jpmorgan chase has warned it will lay off some employees at first republic bank. you'll recall chase bought first republic after that bank had financial trouble. the san francisco standard was the first to report the news. employees will be given three possibilities, they keep their job, they have their job for the next few months, and layoffs. they'll learn what happens the first week of june, according to a memo seen by the standard. >> elon musk spoke to david faber in a wide-ranging interview. musk says tesla will start advertising, something tesla has never done before. musk was asked why he insists on tweeting controversial things, some of which has been interpreted as anti-semitic. musk says he's not an anti-semite, but says he will tweet what he wants. >> you just don't care? you want to share what you have to say? >> i'll say what i want to say.

the u.s. trademark office to cancel two small rivals' trademarks on that phrase. taco john's owns taco tuesday in 49 states, while gregory's restaurant and bar owns it in new jersey. taco bell says she wrongly monopolized the use of that phrase. taco john's has a history of defending its trademark, even taking legal action on companies that use the #tacotuesday. it could take two years for the trademark office to make a decision. who would have known? >> i thought it was just a phrase. >> i better check my posts on social media. dear mike inouye -- >> i was thinking, i've never heard of taco john's. >> they don't have them around here. >> i guess the trademark still

works. >> what about a hashtag with tac, then o, then tuesday. >> we're talking about it on a wednesday, though. >> that's true. that was yesterday. today is way back wednesday, i guess, and hopefully that's not trademarked. let's get a look at our temperatures. upper 50s right now in san jose. it's in the 50s across the bay area, low 50s for san francisco, and about 50 right now in sonoma. let's go into our forecast today. that's going to be a little lower compared to yesterday afternoon, more of a breeze picking up. san jose will hit 80 degrees and then that's about it. but we are still in the mid to upper 80s for morgan hill to gilroy, so you're still feeling that warmth this afternoon. 87 in antioch, and compare that to the 81 in martinez and 71 in hayward, and then near the coast

we're only up to 60 degrees today in half moon bay. then as you roll over toward redwood city, it will be in the upper 70s and 67 in the mission district, while the marina district is 59. we're seeing a wide range in temperatures with our microclimates and upper 50s near the coast. as warm as 89 as you move from ukiah to clear lake. this is what's going on. there's a storm system off the coast, but it's been so warm and sunny that high pressure that's giving us that warmth is blocking any chance of the cooler or wetter weather from moving in. that's going to be moving to the north of us, not much of a change ahead. but we are going to start to see rain chances increasing for the sierra and areas off to our east, and also watching out for people who will be traveling in that direction. a little bit closer to home, temperatures coming down. we're headed for the mid-80s today and then upper 70s tomorrow. a really nice weekend ahead. make plans to get outside,

especially saturday. it will be heating up a little bit once again for early next week. but overall we are going to see our temperatures in the upper 70s and low 80s through at least the next week. mike, you said that we would check on the bay bridge. >> it's looking pretty good. the berkeley curve in emeryville, we're looking toward westbound traffic. from time to time as you see these signs overhead, folks are deciding, are they going to go to the bay bridge or the maze, that split has been showing a little slowing as the volume starts to build. no major problems. a nice drive coming off the carquinez bridge all the way down toward that split. a smooth flow of traffic throughout contra costa county, a little bit of a build for highway 4. a build for 84 but no problems. northbound 680 i did see slowing approaching 84. i believe crews should be clear but i'll double-check. the south bay, the northbound

in dublin. we're going to start with temperatures in the mid-50s and as we go into the rest of today temperatures slowly warming up. it won't be as warm as yesterday and we'll have the breeze picking up as we go into the afternoon. dublin heading for 79 degrees and 80 in san jose. comfortable weather for the north bay with santa rosa reaching 80 degrees. we'll take a look at the rest of the week's forecast in a few minutes. mike, you were concerned about a mini-van in san jose. >> a mini-van on 87. i want to point out that 101, just like we talked about, shows a little bit of brake tapping. that happens as the volume builds. this is a wednesday. we'll see a heavier build. 87 is a concern, but not until later in the commute. it is southbound with a disabled mini-van is reported in the middle of the freeway. chp said there were a number of people in the van and they're helping escort it off the freeway. no slowing, no problems. again, we'll track that and let you know if that affects the south bay any further. north bay, we see slowing toward

the carquinez bridge, highway 37, as well as highway 4 coming through contra costa county. traditional builds, back to you. >> thanks, mike. activists promising a new round of action in response to the da's decision not to file charges in the high profile shooting of banko brown. >> it's creating a divide in city hall and reaction from the grieving family. >> reporter: ginger conejero saab is live for us. what are the demonstrators planning to do today? >> reporter: marcus and laura, we're going to continue to see the fallout on the streets of san francisco, this time a rally is set just hours from now outside the da's office. community groups and activists have rallied in recent weeks to show their disappointment with the decision to not charge the security guard who shot banko brown. also showing disappointment is

supervisor aaron peskin, taking things to a vote. peskin is the author of a resolution that will go out asking the state's attorney general and the united states department of justice to review the surveillance video and the evidence surrounding the fatal shooting of banko brown at a downtown walgreens. peskin wants a different conclusion from the feds and the attorney general's office. >> the same conclusion that the san francisco police department came to when they presented this case as a homicide case to the district attorney. >> my hope is to make sure there's full transparency and that we get the kind of accountability in any case that will serve to help the public and the family understand exactly why a decision was made. >> reporter: mayor breed has said she fully supports the da, civil rights attorney is now handling the case for the family

and says he will contact state and federal law enforcement agencies in hopes of criminal charges. regardless, he says, there will be a civil lawsuit, and that will happen against walgreens and the security guard company. there's a lot to still watch out for, including the resolution that will go out for a vote next week. meanwhile, that will need to pass, so then the attorney general's office will need to make their decision or the feds will make a different decision before anything changes with the filing of charges. we'll be keeping you updated on air and online at nbcbayarea.com. back to you guys in the studio. >> thanks for the latest. developing out of oakland, police are hoping you can lead them to the whereabouts of this pickup truck. take a look at your screen. so witnesses in east oakland yesterday afternoon reporting seeing two men force a woman into the truck. this was on e street near 101st avenue. at least one of those men was

wearing a mask, they say. the license plate number is 8y51451. if you've seen it, you are asked to contact oakland police department. happening today an east bay assisted living worker accused in the death of an elderly patient is due in court. letitia starling worked at atria senior living center? walnut creek. she is facing charges of elder abuse resulting in the death of a 94-year-old dementia patient. investigators say he became ill after drinking cleaning solution. today's hearing is a felony readiness conference. nbc bay area's investigative unit has been covering this story and two similar incidents at the san mateo location. both facilities are facing new legal action, leaving their futures in limbo. head to our investigative tab

section for more coverage at nbcbayarea.com. this morning we are getting a glimpse of a heart-stopping moment for one family. this video shows that speeding car narrowly missing the 8-year-old, valerie ortiz, and her friend on mother's day. the two were playing in the front yard at the time. it happened at the corner of marys avenue and hill street. the incident has left valerie and her mother, mitary guzman, shaken. >> my daughter, you know, she explains that she doesn't feel safe at home anymore. she doesn't feel safe to play in our front yard. it's extremely sad. >> just playing in the front yard. thankfully, no one was hurt. guzman was not able to get the license plate, but another video angle shows that car did strike her vehicle and then took off. she has contacted police and the city, requesting speed bumps to

be installed in her neighborhood. workers from two unions plan to lay out safety grievances they claim are leading to hazardous learning conditions in the south bay. organizers will hold a news conference calling out the santa clara county office of education. the unions are calling for more safety procedures, increased support staff and more training. we did get a response from the county superintendent. it says in part, quote, student and staff safety remains top priority for the santa clara county office of education. the office values the privileged opportunity to serve the students under our care and highly value the personnel who provide educational services to the students. moving you forward this morning, and another bay area county is moving covid from an emergency to a virus. the health department will monitor it like the flu. kris sanchez is live with a reminder that this all means what for us, kris? >> reporter: well, it means that

we have to take things into our own hands, really, and monitor for ourselves and with our doctors where covid is in the community, because now without a state of emergency in effect, the data is lagging. so we won't know in real time whether or not cases are surging. sonoma county is the last county to move covid from emergency operations into the public health department, and so you'll likely remember that the state and federal emergency already ended. this is really a clearing up the books kind of thing. the county says whatever covid vaccine stockpile they have had continue to be free. for people with insurance, you'll have to go through your doctor for vaccines and treatment. california department of health is reworking how it's tracking covid, as is the cdc, and as of last week it is sampling wastewater to keep track of the virus, rather than how many people are ending up in the hospital. dr. peter chin-hong says san francisco is also tracking

wastewater coming in on international flights in order to stay ahead of surges in other parts of the world. >> the wastewater data only, i think, targets about, you know, not the whole population, only about 140 million, and the reason why they can't get more population covered with wastewater is because of funding. so, again, what's tied to public health emergency is funding, and i hope that that might be able to be reissued if deaths and hospitalizations rise. >> reporter: want to refresh you on what the cdc's recommendation regarding covid vaccines is. anyone age 6 and up, so our kids all the way through our grownups and parents, one updated pfizer or moderna vaccine, the bivalent one, anyone 65 years and older should get a second updated dose. if you have babies in the house, anyone 6 years to 5 years old,

although they will say they're big kids, you should talk with your pediatrician because there is a certain schedule they want to follow with that. so, again, just common sense reminders about washing your hands and not sharing utensils and things like that. but we won't know for sure when covid is super activity in the community in real time, so take precautions that you can. in san jose, kris sanchez, "today in the bay." >> good advice there, kris. we may not hear about covid so often, but it is still out there and actively working. >> reporter: it's still out there just like the flu and chicken pox. a lot of snow as well. california's historic snowpack is starting to melt and it is creating a major flood risk for many parts of the state. 30 back-to-back atmospheric rivers left 55 billion tons of snow in the center. that is enough to fill every major state reservoir twice. now there's an urgent new effort to track the danger from the air. aerial expeditions above the

snowpack are collecting sophisticated data using high-tech sensors. >> our information gives the complete picture over the mountain basin. again, we're touching every square foot of snowpack with our lasers and spectrometers. they say their goal is to give water districts a much better model of the snowpack, previously only possible through simplistic measurements. meteorologist kari hall joins me now. you've been tracking this big melt for some time now, with the summer temperatures they are already heading up, especially in the central valley area there. i mean, we've really got to keep track of the situation. >> absolutely, because as the uc berkeley central sierra snow lab measured more than double their usual amount of snow. they're saying about 34% of that has melted in the past five weeks, some of it e evaporates, some soaks into the ground, some flows down the sierra into those rivers and makes them flow quickly and causes it to be

dangerous. so over the next several months, weeks, the yosemite region will have the highest impact as we go toward the next couple of weeks. the tahoe region a little bit later in the month of may, and that will create some dangerous conditions for rivers, waterways, as they're just saying stay out of it because it may cause a shock. we don't know, also, what it has picked up along the way. so looking at the merced river in yosemite, here is a look at the forecast throughout the week. we are expecting it to stay above flood stage and we know the merced river just snakes through yosemite valley and is causing dangerous conditions there. you do want to make sure you're calling ahead to see if the campgrounds are still open. closer to home, we talked about the warm temperatures, and it was definitely warm yesterday. today some of our warmer spots inland will reach into the upper 80s. mike, are you seeing any surprises for the south bay? >> no surprises. the first slowing we saw is now going to condense around 680 and

clear over the next 15 for 101. the tri-valley looking great. we can look ahead. there are dual events over in oakland, but different times. today the a's play at 12:37, a midday game. that means traffic should be clear from the area well before the concert, which is the second time suga will have the concert at 8:00 p.m. we're looking to the peninsula where you might be going to the giants game. the giants also have a midday game at 12:45. crews will clear from -- clouds will clear from the area when people start leaving for work. bad news, one-way traffic control near the quarry. they're working on the road. celebrating one leading bay area lawmaker's lasting legacy. still ahead, the big event in washington with former house speaker nancy pelosi and the surprise twist in both actions and words, courtesy of president biden. >> also in washington, appears

negotiating with the new speaker of the house over the debt ceiling. >> that's right. good morning. so you can kind of say it's sort of the same as it ever was. the speaker making demands of the president, as the full faith and credit of the united states hangs in the balance. we had a similar situation a few years back with pelosi and trump, now it's mccarthy and biden. the good news is both sides say tuesday's talks went very well. >> we just finished another good, productive meeting with our congressional leadership about a path forward to make sure that america does not default on its debt. >> it is possible to get a deal by the end of the week. it's not that difficult to get to an agreement. >> to remind you, in 2019, then speaker pelosi wanted the government to commit to spending more on social programs and defense, trump, president at the time, wanted to increase just the defense budget. that led to headlines much like today about the speaker of the

house holding up progress on raising the debt ceiling in exchange for what the speaker wanted. and as we have shown you in the past, trump, the president at the time, said exactly what president biden says now, the debt ceiling should not be negotiated over. >> other news, james clapper, the former director of the national intelligence, scheduled to testify behind closed doors at a republican-led house committee looking into an open letter he and dozens other former intelligence officials signed warning the alleged contents of hunter biden's laptop spelled like a russian plot. 51 intelligence leaders who at that point were private citizens, signed onto the letter at the height of the biden/trump presidential race, saying the evidence being shopped around by rudy giuliani seemed fishy. well, it turned out later, much of the content of the laptop was authentic. they were wrong. now, clapper may point out the letter itself acknowledges they

may be wrong. quote, we do not know if the emails are genuine or not, and we do not have evidence of russian involvement. >> president biden recognizes some heroes at the white house this morning, then he's off to anchorage and then japan for the g7. he'll cut his asian tour short to return, ideally, to sign the bill raising the debt ceiling, marcus. >> thank you so much. well, a volunteer police officer in southern california is recovering after being attacked by a swarm of bees on monday in encino. we know another person was also sent to the hospital. we're told that those bees stung that officer dozens of times. there's no update on how he's doing this morning, but that incident led the neighbors being told to stay indoors until a beekeeper could remove that nearby hive. >> yikes. >> wow. >> watch out out there. >> i've seen a lot of bees out recently with the flowers. >> with all the blooms everywhere. >> be careful out there.

we're going to see more sunshine and slightly cooler temperatures for us today as we take a look at how high we're going to see those temperatures getting in the south bay. we're up to 80 in san jose, 85 in east san jose, and for the south county it's headed up again for the upper 80s. some of these temperatures will be a little cooler compared to yesterday, with danville reaching 83 degrees, as well as 83 in livermore, 87 in antioch, and martinez reaching 81 degrees. compare that to the 69 we'll see in oakland today. much more of those breezes coming across the bay and keeping those temperatures down there. but for palo alto, it will be in the upper 70s and although 78 for redwood city. for san francisco, we have some mid to upper 60s today, and for the north bay reaching 74 in mill valley and 89 in clear lake, 80 today in santa rosa and sonoma. as we look across a wide view of what's happening with the satellite and radar, we are seeing this system well off the coast and it's not going to have an impact on our weather. it's going up and around that

area of high pressure that's bringing us the warm weather now. we'll also see rain chances increasing for the sierra, going into the weekend there may be thunderstorms developing there. but most of it is staying to the east of us. we'll continue to monitor. if you will be traveling to the sierra, just keep in mind that you want to make sure you can get inside quickly in case one of those storms do pop up. around the bay area, it's staying nice and quiet and some of our warmest temperatures inland reach into the upper 70s and low 80s and 60s in san francisco will continue. mike, you're seeing the bay bridge toll plaza filling up quickly. >> heavier volume expected on a wednesday and that's what we're seeing. no drama on the approach. the maze is fine. the north bay, east bay, all looking standard as far as the patterns of traffic. we're looking to the south bay, the first burst starting to ease up. the second one will kick in in a few minutes. in the tri-valley we are seeing a slow flow of traffic.
