today is friday, may 26th, 2023. ready, set, delay? millions of americans headed out for the holiday weekend. what you can expect in the air on the roads and on the rails. under fire, texas attorney general ken paxton teetering on the brink of impeachment. two lululemon employees ousted after calling the police when the store was robbed. why retailers have told their employees not to call the cops. making contact. how the pandemic changed our sense of touch and the ways we can reconnect with others. key begin in the air and on the roads and rail lines. >> no matter if you choose a plane or train or automobile to get to your destination, aa says they will all be busier than last year, the biggest increase at the bottom of your screen,
12:02 pm
bus, cruises and trains up 20%. >> more than anything this weekend is a test for america's airports after those flight delays and cancellations last su. pete buttigieg says this year will be different. >> so, look, this is a big stress test of the system. we're seeing huge, huge demand but so far this holiday weekend appears to be headed in a good direction and see weather coming in and keeping a close eye on that. >> the roles of steve martin and john candy, angie lassman has the forecast but first george solis is at the philadelphia international airport. george, you've been tracking conditions at the airport all day long. what are you seeing and what are people trying to catch their flights telling you? >> reporter: hey, happy memorial day weekend to you. true to what the secretary said it seems things are moving along fairly smoothly especially at phl, about 2.5 million expected to go through security checkpoint, the second busiest travel day.
12:03 pm
we can see efficiency with two tsa agents at every gate here and could be in part because they don't want a repeat of what we saw last year when the delays, airlines did not have the staffing there, all the airlines saying if they had the adequate staffing, we're trying to get people from point a to point b weather withstanding and more byways in the airways to make sure people get to their destinations safely. the travel here, certain sense of giddiness, many are eager to get out there and trying to get to reunions, barbecues, a lot cooped up and a lot have not done real travel. >> last year there was a lot of delays and cancellations, was that a factor in your decision-making? >> well, yes, because i chose a direct flight to avoid any kind of issues with transferring between planes, busy airports but other than that, no.
12:04 pm
>> last year i was kind of stuck in an airport for almost two days. >> yeah, we were stuck in texas. >> it's a new experience. >> yes. but we've done a few travels this year already and think they have it together. >> reporter: people trying to put bad experiences into the rearview mirror pun intended but as you mentioned, the real test outside of the rails and cars, the airlines and so far things looking pretty good. guys. >> we like things looking good, well, angie, hopefully you have good news too. >> should i start with the good or bad news? >> always start with -- get the bad out of the way. >> let's do it. hey, we've got a low pressure system sitting just off the shore of the carolinas and it's eventually going to bring with it more range. a couple days' worth. focused throughout memorial day weekend and stronger storms developing in parts of the plains and chance to see some of those storms develop some large hail, baseball size even and those gusty winds over 60 miles
12:05 pm
per hour. can't rule out tornadoes too. that's through the afternoon and evening hours tonight. the good news, warm throughout the midwest, the northeast will look great the rest of the day today. we'll see heavy rain and wind stick around for the carolinas, even into tomorrow. the strong storms will be there as well but still the chance we could see some developing and impacting us through the afternoon hours tomorrow. how about sunday, looks great across the great lakes, perfect for the lake, out west we'll see desert heat into the triple digits. as we get to memorial day sunny and warm for the middle of the country, showers are stubborn across the carolinas and may be some indoor plans. >> angie and george, thank you so much. congress is in recess and most lawmakers have now left washington for the holiday weekend without an agreement to raise the debt ceiling. key negotiators are still working to strike a deal but time is running out. we are now just six days away from june 1st. that's when the treasury secretary says the u.s. will no
12:06 pm
longer be able to guarantee payments on all its loans. nbc news white house correspondent ali raf is here. here's what kevin mccarthy said. >> i thought we made progress last night. we have to make more progress now. >> what is it looking like now and what would a final agreement possibly look like? >> reporter: we're hearing optimism from both sides. permitting reform and know of things still gumming up this process that's still under way. these are things like cutting some irs funding from the inflation reduction act, adding more work requirements to some federal relief programs both on the republicans' wish lists and debate over how much spending should be cut for next year, as well as exactly how long the debt ceiling should be extended.
12:07 pm
so obviously the caveat with all of those things, though, should be to take all of them with a grain of salt because as these negotiations are still ongoing, any of that could change really by the minute, joe, so any of those things could potentially be included in this eventual deal, some could not be. >> so,allie, striking a deal is the first step then it has to go through control, the house, the democratic controlled senate and then to the president's desk. can that happen on this tight time line? >> reporter: yeah, so when you back time this from that earliest default deadline estimate of june 1st, remember that is six days away. it looks more and more bleak when you think of how much has to be done. as you said, this then goes to -- this then gets written up, then reviewed by members of congress and voted on in the house and the senate. that could take days, remember, it only takes one senator to block this from getting across
12:08 pm
the finish line in that narrow majority in the senate. so as far as we've heard right now, that june 1st deadline still sticks and how they are able to get it done before that still remains to be seen, joe. >> allie raffa, thank you. ron desantis is rebounding after the technical difficulties. in the 24 hours since announces his rung his team says they've raked in more than $8 million. now desantis is using that cash to hit the trail himself and to find himself within the race. dasha burns is following the campaign for us and joins us from miami. dasha, what is governor desantis' next move now that his launch is behind him? i saw there was tension within his campaign, right? >> reporter: well, zinhle, that $8.2 million you mentioned there, that is going to be a big factor. they will be underscoring that as they try to make the case that there is interest and enthusiasm for an alternative to
12:09 pm
former president trump and that the best alternative is ron desantis. they are going to be underscoring that that number is evidence for that case. they're also making the case to donors here in miami that those legal woes that trump is dealing with will drag him down while desantis is able to make the case to voters that he has executed here in florida and that he can do that nationally. he will particularly emphasize what he has done on covid here in florida and you've already seen him start to do that a little bit just today. take a listen to what he said here in orlando. >> you had health bureaucrats say you shouldn't have kids in school, shouldn't have the economy open but you absolutely should be out protesting regardless of covid. that's when you knew this was all a total fraud. they were using political ideology, and they were trying to control your behavior. >> reporter: meanwhile, zinhle,
12:10 pm
you're right when it comes to that initial launch of his campaign, there was a little bit of division within team desantis. some were concerned that it was a little bit too risky, thought he should have gone with something more traditional, more controlled, but the moment happened, team desantis still saying that he broke the internet and, again, emphasizing that fund-raising number, and now they will be hitting the trail early next week in iowa, new hampshire, south carolina, of course, those critical swing states where he needs to win over voters, zinhle. >> so the race to decision 2024 begins, and, dasha, desantis is no stranger to the national stage. he's, of course, championed policies restricting race and sex education and more. how do you think that will translate as a national presidential candidate? >> reporter: well, look, a lot of those right wing policies are policies that he is going to emphasize because he wants to chip away at that trump base. he wants to win over some of those voters, and so that move to the right, whether it's on
12:11 pm
education or abortion, or limiting trans rights, he is focusing in on those culture war issues so that he can rally the base around him, again, show that trump has a lot of baggage to deal with that, that he can still champion some of those culture war issues, those fight against the woke mob as he likes to say on the campaign trail and not be dealing with some of the distractions that the trump campaign has to deal with, zinhle. >> yeah. a lot to follow, dasha, thanks so much. another round of layoffs is coming to the banking world and ford and tesla are teaming up. >> morgan brennan joins us with today's cnbc's "money minute." >> well, jpmorgan is laying off a thousand employees of defunct lender first republic bank. they took over the failed regional bank a few months ago and offered new roles to nearly all of the 7,000 first republic employees. now the employees who are not part of the transition have been notified that they will be let

developments in the death of jordan neely. the lawyer for penny is dismissing reports that he will testify before a grand jury and video may be disturbing. pen economy is charged with manslaughter after he was seen putting jordan in a minutes' long chokehold. any speculation regarding a client's intent to testify at this stage would be premature particularly where there is no indication a grand jury presentation has begun. i want to bring in danny cevallos. let's just back up because penny has already been charged with manslaughter over neely's death so why exactly is there a grand jury looking at an indictment? >> because the charge is really one-sided. all the charge now represents is the d.a.'s office, alvin bragg's decision that this person, the defendant, should be charged with a crime. under new york procedure and it's a similar procedure
12:19 pm
nationwide, the people, the state doesn't actually bring charges until one of two things, in new york that is almost always a grand jury indictment, in other words, presented to the people and the people hand down the indictment. in other jurisdictions, pennsylvania, which we were just talking about, often those cases begin without a grand jury by criminal complaint, information in other jurisdictions but in new york state, the people speak through the grand jury. so while technically the defendant here is charged with a crime, he hasn't formally been charged with a crime until a grand jury returns an indictment and bragg, the clock is ticking for him to get that indictment. you can't just charge someone and let that hang in the air, you have to convene a grand jury and present before the grand jury and the grand jury decides finally whether or not this case goes forward and it's possible the grand jury may say, may return no true bill, in other words, no charges in spite of what alvin bragg thinks there should be charges.
12:20 pm
>> all that said, if you were penny's lawyer and he was your client, would you have him appear in front of the grand jury? >> yes, absolutely. i mean, this is a case, one of the rare cases where i would say you need to get out ahead of it and actually tell your story. in the vast majority of cases there is zero reason to have your client testify before the grand jury. it will only hurt him later on. daniel penny here is -- will probably take a different strategy which is tell the grand jury what really happened in his mind on the subway car that day and take his chances. >> something all eyes will be on. danny, thank you. coming up, what we know about the international search to find a missing american teenager in the bahamas. you're watching "nbc news ily.y." da imagagine if youou could geget ahead ofof your ibs-sc by treatining it with h linze. ththen you couould start proactivively managiging yourur constipatation withth belly paiain. say yeyess to linznzess. linzess isis not a laxaxativ. it's's a once-dadaily pill that h helps you g get ahead of your r symptoms.. itit's proven n to help yoyu haveve more freqequent
