the shooters and what police believe led up to that shooting. >> today is a life-changing day for the theranos founder, elizabeth holmes. she is to report to prison. we'll talk about that. >> a battle over the debt limit moves to congress. we're live from washington, as lawmakers work to approve the tentative deal in hopes of avoiding a devastating government default. this is "today in the bay." well, good tuesday morning to you. i'm scott mcgrew. marcus washington continues his vacation. >> i'm laura garcia. we're not bitter at all. i'm back, i'm back, and so is mike. we'll get a look at the morning commute, but first kari has a look at our forecast. >> we're starting out with a nice, mild morning across the bay area. temperatures mostly in the mid-50s and a few clouds here and there. it's clear in dublin where the temperature is at 53 degrees, a light, westerly wind. as we go throughout the morning,

we are going to see the sun coming out and increasing sunshine going toward the noon hour and then the rest of the day it's going to be nice and sunny. it's back to what we've seen the past few days, highs in the upper 60s and low 70s, martinez reaching 68 degrees, in san francisco today 62 degrees. we'll get a look at the rest of the week's forecast and also the weekend coming up in a few minutes. mike says chp might be working along 101 with flashlights. >> i'm going to call it out because one of our friends asked what's going on. this is 101 before san jose, coming up out of morgan hill, around the coyote creek area, we found out chp early morning had a crash that was reported and they were alongside highway 101 with flashlights looking about 100 yards off of the freeway. you will be curious. no slowing, no lanes blocked, but crews may still be there in the brush. i'll let you know if there's anything that's going to affect your morning commute, but right

now it looks like that's just an investigation that's continuing. should be wrapped up, but we'll track it, along with the rest of the bay. the expected slowing at the altamont pass. today disgraced theranos founder elizabeth holmes is set to report to a federal prison to begin serving her 11-year sentence for fraud. kris sanchez joins us with the day that some people thought was never going to come. >> we say people because we know there were a lot of high-profile investors who lost a lot of money, but they were very real people who got bad test results because elizabeth holmes claimed that her technology worked, when we know now that it absolutely did not. so through her rise and her fall as she was here in silicon valley, she will report to a prison in bryan, texas, about 100 miles from where she grew up in houston. it is a minimum-security facility where her day will start at 6:00 in the morning,

she will have to work every single day for 12 to 40 cents an hour, and she will have limited visitation with her family. >> she's not going to be able to see her family any time she wants to, she's going to be able to do things only on what the schedule is for the institution she ends up reporting to. >> so, kris, this got delayed. this was not the original prison date. >> right. >> so is there a possibility -- i hate to bring it up. she's supposed to report at noon texas time. is there a possibility that it would be delayed again? >> at this point it doesn't look like it will be because that federal judge did give her a break, a minor break for that, you know, that first date to report. and now it just seems like it's time to move on. there is a possibility that she may not report. >> there's always that. >> analysts say sometimes people choose another way out. >> and we do have cameras at that prison and we will cover

that as it happens, if it happens. the other thing is 22 cents an hour, she has to make restitution in the millions of dollars. >> we just told you how much money she's going to make, 12 cents to 40 cents an hour. she does have assets, her family have assets and she and sunny balwani were ordered to pay $453 million in restitution. our legal analysts say that likely --. won't happen. >> yeah. >> and this affected investors and entrepreneurs all over the valley, particularly women. >> you know better than anybody. on sand hill road, you talk about the capitalists and we know it's already difficult for women in silicon valley. you have to be a little smarter, faster, more convincing. add to that the fact that the timing of her pregnancies had a lot of people feeling very cynical, that she had her babies at a time where she might get maximum sympathy.

>> she knew she was going on trial. >> exactly. and she knew she was going to prison the second time. so as women, we like to support each other, but this makes it difficult. >> i know you'll be covering this all day. again, we do have a camera at the prison. we'll have continuing coverage leading up to her surrender on air and online, and of course we have our app available on most mobile devices. nine people are recovering this morning after being shot near a popular beach in florida. police are still searching for one of the suspects. it happened before 7:00 local time last night in hollywood, florida, about 20 miles north of miami. four children were injured, including a 1-year-old. we have footage from the city tower cameras that actually show the panic that ensued at the hollywood beach boardwalk. investigators say it started after an argument between two groups of people. police detained a person of interest but say a second person is still on the loose. the mayor of hollywood says they

will not rest until they find the people who committed this reckless behavior. >> the hollywood police department will leave no stone unturned. we do not appreciate when people come into our city with guns and have an altercation in the midst of a public setting here. >> the beach was very full due to the memorial day holiday. a florida woman accused in the botched plastic surgery death of a kim kardashian look alike returns to court today for a bail hearing. vivian gomez faces two charges of involuntary manslaughter and practicing medicine without a license. prosecutors say she traveled from florida to a burlingame hotel room where they say she gave unlicensed plastic surgery-style injections to christina gourkani, an antioch native who died hours later. also today, a former san francisco fire commissioner is expected to return to the stand in an ongoing preliminary hearing surrounding a violent

confrontation caught on video. don carmignani was involved in a fight with a homeless man last month in san francisco, he was hit in the head by a metal bar, suffered a skull fracture. authorities arrested and then released the other man allegedly involved. the man says carmignani often sprayed homeless people with bear spray, which his attorneys have denied. in just a few hours, a state appeals court will hear arguments tied to a lawsuit accusing san francisco police of ignoring surveillance rules during the 2020 george floyd protests. the suit claims police tapped into a network of hundreds of surveillance cameras to monitor protesters real time without the legal authority to do so. last year super court judges ruled in favor of the city, believing police were exempt. advocates believe police needed prior approval from supervisors. the race to get bipartisan agreement to raise the u.s. debt

ceiling has reached the capitol. >> "today in the bay"'s brie jackson is live in washington this morning. what's being done to make sure that this actually becomes a done deal? >> reporter: good morning, scott, laura. so behind-the-scenes conversations, a lot of that is happening for this to get through congress, and we do know the white house is working the phones, trying to secure support for moderates, as well as progressive democrats. with a bipartisan deal to avoid a government default, the focus is now on securing enough votes to get the bill through congress. >> i spoke to mcconnell, i spoke to a whole bunch of people, and it feels good. >> reporter: the two-year deal suspends the nation's borrowing limit until early 2025, holds non-defense spending flat next year with a 1% increase in 2025, while bumping up military

spending, something president biden wanted. >> i think president biden did about the best he could do in a very difficult situation. >> reporter: republicans are touting wins, including a new congressional budget office estimate projecting the deal would cut spending more than anticipated. but democrats aren't happy about the deal's expanded work requirements for federal food stamp recipients. >> i feel like we are being held hostage, we should be in regular order, we should never be in this position again, and yet i cannot and will not be a rubber-stamp. >> reporter: some hard-line republicans also voiced concerns. >> there are going to be detractors. >> reporter: despite pushback, there's optimism. >> it's going to get through the house, through the senate, be signed into law. >> reporter: the race is on to get the debt ceiling bill to the president's desk before the june 5th default deadline. and the rules committee meets today to process the debt ceiling bill. the measure is expected to go before the full house for a vote

on wednesday. scott, laura. >> we'll continue to watch to see what happens. let's check in with kari. we've got a live look at the golden gate bridge this morning. yesterday there weren't any cars at all. >> there's a few now. people are waking up, heading back to work. let's go a little bit farther north from the golden gate bridge and get a look live in san rafael this morning. we are starting out with a mostly cloudy morning, temperatures in the mid-50s, as we go into late morning we will see our usual clearing temperatures, going from mid-50s to low 60s. another cool day as we see our high temperature reaching into the upper 60s for much of the north bay, low 70s for the tri-valley into the south bay, and 71 today in mountain view. we'll get a look ahead at the rest of the forecast. mike, you have a warning about an issue coming through san jose. >> that's right. if you look at highway 87, that's the concern. right now traffic is very light, the 280 interchange everything moves smoothly. there's a police investigation

north 101 here in palo alto. it looks like they just exited at willow. hopefully it's a whole lot of nothing. let's check in on the business world with silvana. good morning. i'm silvana hanao from cnbc. wall street is set to open higher after the white house and house republicans struck a tentative deal this weekend to raise the debt ceiling, and congress could vote on the measure as soon as tomorrow. although there are still a few hurdles to clear and lawmakers have until june 5th to pass the measure before the government potentially runs out of cash to pay the country's bills. the market closing higher on friday, posting gains for the week. in focus, we get data on home prices and consumer confidence. a cybersecurity firm says a popular android screen recording app has spied on its users, stealing microphone recordings and other documents from phones and the firm found that the app

called i-recorder screen recorder introduced a malicious code almost a year after it was listed in the google play store and the code allowed it to upload a minute of audio from a device's microphone every 15 minutes, and access documents, web pages and media files. the app is no longer listed in google play, but users are being advised to delete it. i-recorder had racked up more than 50,000 downloads. apple and netflix have emerged as potential bidders for future nba media rights with the price tag expected to top $5 billion a year. currently disney, of abc and espn and warner bros. discovery, the parent of tnt, are in exclusive negotiates windows to renew their contracts with the leagues, which expire in 2025. bloomberg reports some tech giants have expressed interest in bidding once the window ends next spring. the nba is expected to sell the rights to more than two

companies and may carve out games for a streaming service. back to you. >> we'll have to pay attention so we know where to watch. >> thank you. well, mike is looking at a problem in san jose. here is a picture of san francisco. we have traffic and weather together, starting with kari. good morning. >> that's a beautiful live look outside. >> we're starting out with clouds and this is our usual start we've seen the past few days. and we're not seeing much of the change today, so what it was like yesterday, the day before, the day before that will be what we see today. starting out at 50 degrees in morgan hill. it will gradually start to warm up as the sky clears. great evening for baseball. we have still a lot going on around the bay area, even though the holiday is over. we're heading back to work and it's going to be busy from the a's game happening, first pitch at 6:40, and it's going to be about 62 degrees and temperatures in the upper 50s

later this evening. also pretty breezy as we get more clouds coming in. but right at about the same time there will be first pitch for the giants game. so it is going to be really busy in that area, a time that people are getting off of work and then trying to get to the game, too. so expect those temperatures to be nice and cool this evening, after reaching 62 degrees in san francisco and 66 in oakland today. dublin headed for 69 degrees, and once again, another day with cooler than normal weather as we wrap up the month, we're going to see low 70s in san jose, as well as much of the north bay. on thursday we're still looking at 70s, but it will be a touch warmer in some spots with some mid to upper 70s. and we're also seeing clouds near the coast, eventually that's going to be clearing out as well. but this month has been so chilly, we've had 108 days in napa with temperatures below normal, and it looks like that

continues because we had this area of low pressure that's not budging. it's giving us a strong ocean breeze and that will continue into the rest of the week. so we are going to see it moving just enough for us to see those temperatures going from low 70s to low 80s for the weekend, but still looks nice and sunny. no major spikes in temperatures coming our way. mike, you're still watching san jose? >> yeah, police activity continues right here on north 87, as you're approaching downtown. we learned there's a double shooting investigation. the slow lane is blocked and this will be going on for a while. likely when investigations of these type are going on, they'll need daylight so they can take photos and look for more evidence. so north 87 will get very slow heading into downtown because the right lane will be blocked for a while. north 80 moves smoothly past washington. the off-ramp is affected by the crash, but the on-ramps and the freeway moves smoothly.

jacket. we'll head into late morning into the afternoon, with our sky gradually clearing out. we'll reach 68 for today and 73 in san jose, as our may gray continues. we're only up to 66 in san mateo and 62 in san francisco, with some mostly upper 60s for the north bay. we'll talk more about the way we'll wrap up this week and begin the month of june, that's coming up. mike, you have a big issue for san jose continuing. >> that's right, i want to give folks plenty of time. san jose is where the big news is. let's take a look at the big map. you see your route coming through the area, it should look standard, including throughout san jose for 101 and the build for the northbound direction toward oakland road. that's standard. the arrow and the incident showing north 87 coming toward downtown, we continue with an investigation. the police activity will block the slow lane for the time being. we don't have word of when it's going to reopen. we see the slowing develop as the volume starts to build.

the reason that is closed, we'll send it back to you. >> that is the breaking news we're following into our newsroom. san jose police are there investigating a double shooting. it's in that area mike just mentioned near willow street and highway 87, which is shut down in that area. officers say one woman, one man were shot, both are being taken to the hospital. so far, there's no word on any arrests or motive. we've got crews heading to the scene as well as on the ground. we'll have live updates throughout the morning. time is running out for the oakland a's, getting a green light on a new stadium in las vegas, which is why nevada lawmakers last night held a special legislative session. >> there's a lot of money running on this deal and a lot of hearts of fans in the bay area, hoping against hope the team stays here. ginger conejero saab is live this morning. one way or another, a decision is coming. >> reporter: that's right, scott. good morning to you and laura. the legislative session ends on

june 5th, which means a decision will need to be made by then. but it isn't a grand slam by any means just yet. a special hearing went into late last night to talk about this, even on a memorial day holiday, lawmakers making a case either way. now, the stadium bill was introduced to the state senate late friday. it says the state would commit up to $380 million towards constructing a baseball stadium in las vegas. it would have 30,000 seats and a retractible roof. and the a's would enter a 30-year lease. the stadium authority projects nearly 3.2 million would attend baseball games each year, but some lawmakers are not completely convinced. the new stadium would be financed in part by a county and state struggling to fund public services, including schools. one assemblyman says the a's will need a better record to attract a local fan base. >> it's no secret the team is

not very good right now. how much of your projections about visitation, about money that's going to be generated, is dependent on las vegas locals taking the trip over to the tropicana site and going to the game there? >> reporter: proponents to the bill say the construction of a new baseball stadium on the old tropicana site on the strip would bring positive revenue, new jobs, and help make las vegas, quote, the sports capital of the world. now, those opposed to it are concerned about funding a stadium, again, while public services, including schools, are having trouble being funded. so all of this comes to a head by june 5th. we'll find out more whether or not to see if this debate will go into extra innings or not. 5:34 right now. prosecutors are shooting down

defense attorneys' arguments to toss criminal charges against disgraced crypto king sam bankman-freed. he's currently out on bail living at his parents' home in palo alto. in may his attorney filed papers insisting prosecutors overreached in their case, turning regulatory issues into federal crimes. prosecutors responded yesterday, calling the claims meritless. happening today, disgraced theranos founder, convicted felon elizabeth holmes is expected to surrender to federal prison after a judge rejected her bid to remain out of prison while she attempts to overturn her 11-year sentence for fraud. the judge ordered her to serve her time at a minimum security women's prison camp in texas near her hometown. the facility is about 100 miles north of houston. "today in the bay"'s kris sanchez is following the latest. we'll have a full report coming up in our next half hour.

also today, the man accused in the deadly stabbing of a tech executive in san francisco is expected back in court for a preliminary hearing. in early april investigators say momeni killed cash app founder bob lee in a dispute surrounding momeni's sister. he has pleaded not guilty. today the judge is expected to hear arguments about whether the case should go to trial, a routine step in criminal cases. 5:35. to a live look in oakland where the topic of crime and violence in that city will take center stage tonight. north oakland city council member is holding a community meeting in person and virtually. it comes as police are expected to release more information today following an attack of a 63-year-old woman in the city's rockridge neighborhood. it follows an announcement last week that a group of young people ages 12 to 17 were arrested following 35 robberies across oakland. the meeting starts at 6:30 tonight at a building along 42nd

street near broadway. it will also be streamed on facebook. happening now, san jose police are searching for a driver who hit a cyclist and dragged her 400 feet. the department is releasing new surveil ins video in hopes of catching who did it. the crash happened march 18th around 1:00 in the morning on park avenue near barack obama boulevard. you can see the suspect vehicle, described as a small black suv or sedan. the car was last seen on san carlos street. witnesses who live in the neighborhood say it's routine for cars to speed past red lights. many say they feel unsafe. >> i tell my family, my children, look both ways, follow the guidelines, but what use is it if we follow and the drivers don't? >> police are asking for help from anyone who knows anything or has new information. we've got new details, two deputies with the santa clara county sheriff's office are recovering after an attack at

the main jail in san jose. >> that's where we found "today in the bay"'s bob redell are more on what we know. >> reporter: sources tell nbc bay area this past sunday night at the main jail behind me in san jose that at least one jail trustee, possibly more, attacked two santa clara county sheriff's deputy guards, attacked them with handmade shanks. trustees are incarcerated people who have more freedom to move around the jail due to good behavior. the attacker or attackers were allegedly upset their privileges were going to be taken away. the deputies sustained puncture wounds and defensive injuries. we are expecting the sheriff's office to release more details later today. bob redell, "today in the bay." a live picture in san jose where it looks like it's going to be another lovely day. let's check back in with kari. >> we've been having a stretch of some cooler than normal temperatures and that continues

today. no major change as we start out with clouds, and then eventually we'll see that turn to sunshine going into late morning into the afternoon. right now in oakland, it is 56 degrees and we'll be in the mid-50s through about 9:00. and then low 60s into the lunch hour. as we zoom into the south bay, we're headed for 73 degrees in san jose and morgan hill and 75 in los gatos, the east bay reaching 72 in walnut creek and hayward reaching a high of 68 degrees. along the coastline it's upper 50s with low 70s for palo alto. mike is still following that issue in the south bay. >> we have a live shot. our crews have arrived on scene. this is not your normal suv or squad car. there's actually a mobile investigation going on right here, the crews have arrived with the larger vehicles, i believe they have some lab facilities and other resources to do the investigation. this is alongside northbound 87 right around willow street. we'll check back in in a second,

start, partly cloudy skies today and temperatures staying cooler than what we normally see for the end of may. but we are going to have a warm-up. we'll talk about that in the microclimate forecast coming up. here is our live look. we continue at the scene with a live investigation, blocking one lane of north 87. this activity causing a slowdown as the commute builds toward downtown. we're covering the reason for the activity and the ripple effect on the roadway and beyond. new overnight, the russian defense ministry confirms a series of drone attacks in moscow. this is new video nbc has verified showing minor damage to one building, another clip shows what appears to be a damaged drone on the ground. no injuries reported, but buildings that were hit later evacuated. the russian ministry calling it a terrorist attack and blames ukraine. ukraine says it has nothing to do with those drones in moscow. crews have put plans on hold

to start demolishing the apartment building that partially collapsed sunday in iowa. take a look. [ cheers and applause ] >> they were applauding firefighters after they safely pulled a woman from the building. she was trapped, but not injured, in the fourth floor unit. so far, no deaths have been reported. still not clear why that building collapsed. demolition had been slated to start today until authorities learned yesterday about that trapped resident. >> police are searching for a group of thieves that stole more than $50,000 in merchandise from the berkeley apple store. it happened on sunday. according to the berkeley scanner, the four young men were in and out within minutes. they got away in a carjacked toyota siena. police spotted the van but lost it on the freeway. they later found it abandoned in

oakland and many of the stolen items were still inside. authorities are saying little about the investigation and apparent arrest in a stabbing at a san francisco bakery that critically injured a woman. it happened yesterday in chinatown. witnesses say a man walked in, made his way behind a counter, repeatedly stabbed a worker. we spoke to a witness who was inside the store when it happened. he said the attacker did not appear to say anything and then walked out after without saying a word. >> this guy looks like he's got a mental problem. he say nothing, his lips are shaking and the eyes are very -- no focus anywhere. >> he later shared a photo of the man standing outside the bakery after the attack. our crew later saw him in the back of a police cruiser. investigators also collected a knife outside the bakery that may have been the weapon used.

cal state students may want to brace for higher tuition costs by the fall of 2024. that's what fiscal advisers are recommending in a new report. among the suggestions, raising annual costs 3% per year through the year 2030. another possibility is raising tuition costs by 5%, but only for each freshman class. right now tuition is about $5,700 a year, where it's been since 2017. no decision is expected before september at the very earliest. your triplets are a little ways away from graduating high school, but this has probably got you thinking. >> every day i think about tuition. check this out. 12 sets of twins and one set of triplets just graduated from the same high school in illinois. vernon hills high school. many admitted graduation for them is special emotional because it means they're getting closer to paving their own paths separate from the others. >> funny enough, i'm going to

from the west at 13 miles per hour. we're seeing the same weather pattern we've seen for the past few days, with a cool start and a mild afternoon. it's been cooler than normal and it's going to be no different today with san jose reaching 73 degrees, about the same in cupertino, and then as we move toward the east bay, 68 in hayward and martinez, 71 in livermore. so we're only low 70s for palo alto, but it's been chilly along the coastline and not much clearing, with a high today expected 59 in half moon bay. also 59 in the outer sunset, with some low 60s for the mission district. for the north bay, headed up for 80 in ukiah, sonoma will stay in the upper 60s this afternoon. breezy winds and cool temperatures near the coastline. so we're looking at all of the cloud cover that's been with us and every now and then we get little disturbances caught up in the coastal fog. that's what happened on sunday that brought in those scattered showers. but for today we're looking at

still some slowly clearing skies and that's been keeping temperatures down. for napa, we've been counting up the days. we're at 108 days of below average temperatures. that's 73% of this year so far that has been cooler than what we normally see. and we're going to add another day today. the setup has been this area of low pressure off the coast and also extremely warm temperatures, so the pattern has kind of flipped compared to what we normally see with a strong area of high pressure farther to the north. we've been talking about wildfires over canada. for us, we're getting a lot of moisture and that cool ocean air that continues. eventually that's going to slowly change and allow our temperatures to warm up just slightly. as we go into our first weekend of june, it's going to start a feel a little more like late spring, early summer. but we do continue with a few more days of cooler than normal temperatures, while san francisco won't see much of a change. we're going from low 60s today

to upper 60s for the weekend. still looks really nice there. mike, you've got some more information about that police investigation? >> we do. we see the vehicles have moved over a little bit onto the shoulder, but still for the sake of safety and a building commute, you see the lanes of northbound 87 are restricted. your far right lane is blocked. i'm going to step into this shot and show you that we do have cones, and approaching the area, at willow street just before you get to 87, folks are slowing. we're looking at the slower drive, where traffic usually eases up. now it's all the way into downtown. at this time we typically see curtner start to building around that stretch. 87 is a tough drive coming into downtown, some folks may shift toward 101 and take that north. we may see more traffic building and then taking 280 toward the area. we often see a ripple effect when something happens in this
