"early today" starts right now >> glad you're with us, i'm frances rivera >> i'm phillip mena. the bipartisan agreement that would prevent a catastrophic debt default narrowly made it through a committee on tuesday and now faces an equally-tight fight to pass the house before the june 5 deadline. for more on this, we go to brie jackson in washington. the deal has now cleared one major hurdle still has a few more to go before it becomes law. what's next in. >> reporter: good morning, phillip. that bill known as the fiscal responsibility act was brought before the house rules committee on tuesday vocal criticism from some
4:02 am
hard-line republicans prompted fears that the bill might gudien the committee and not make it to the larger house but ultimately it passed through the panel on a 7-6 vote. it only made it through the committee with republican votes. chip roy and ralph norman joined with the four democrats in voting against t it roy notably referred to the bill as a turd sandwich, while norman said they should have walked away from the negotiating table after passing their own bill last month jim mcgovern criticized the bill for the expanded work requirements for those on food stamps in comments that echoed of fellow republicans
4:03 am
marjorie taylor green described the bill as an expletive sandwich and that she'll need sides and dessert to secure her vote a white house official told nbc news that staffers spent another day on the phone with democratic house members and their ongoing effort to injury ssecure support >> what about those republicans who will take out frustrations on speaker mccarthy? >> reporter: on a call to the freedom caucus who have issued vocal criticism of the plan, they floated the idea of using a motion to vacate against speaker mccarthy which would force a vote to potentially remove him from the speakership he said he's not worried about these threats, while florida republican matt gaetz predicted that things likely won't reach that point >> frankly, i think that he's probably got pretty good chances
4:04 am
to get over that 112, 113 threshold. the motion to vacate i think is something that's not very likely >> reporter: and the government has just under a week to act on this plan. on tuesday the deputy treasury secretary was on msnbc and reiterated that june 5 is a hard deadline to raise the debt limit. >> that would be monday. thank you. now to a rare move in the national debate over abortion rights nevada governor joe lombardo has become one of the first republican leaders to present abortion rights in his state he signed a law that protects abortion providers and prevents state agencies from helping in investigations into people who might travel to the state for the procedure. he promised on the campaign trail that he would respect the will of voters who codified abortion rights up to 24 weeks

he may be the republican frontrunner, but the legal troubles are casting a shadow over trump's candidacy already manhattan prosecutors are in a tug-of-war with his lawyers over where this trial will be held trump's lawyers argue the case belongs in federal court, not state court, because some of the alleged in alleged conduct took place in 2017 a manhattan judge will decide at a hearing on june 27 he is facing 34 charges stemmin from a hush money payment paid to stormy tan daniels. pauline bower, who called for police officers to bring out then house speaker pelosi so the mob could hang her was sentenced

4:07 am
we're joined by chapman bell what more do we know about these drone strikes? >> reporter: well, frances, certainly, there's uncertainty over exactly who's responsible for these attacks, as it's been with other attacks inside russia that have been allegedly made by ukraine. ukraine saying they're not directly involved in this, but it's definitely sending shockwaves through the russian capital. the russian defense ministry says five drones were shot down and three were electronically jammed, causing them to fly off course, but it did cause residential buildings to be evacuated and mild damage to the buildings, as well as two people said to be injured with minor injuries but it has solicited a big response from no, si from moscom
4:08 am
putin. saying it's clear what needs to be done to plug the gaps, calling the attacks an attempt to intimidate russians and civilians and calling it terrorism for attacking the civilian population. but what we do know is that it has definitely caused more uncertainty in moscow. this of coursefollowing the alleged drone attacks earlier this month on the kremlin. so a lot of uncertainty over who's responsible. but it's definitely sending shockwaves through russia. >> and chapman, ukraine's capital has also seen a fresh wave of attacks. tell us what's been happening there in kyiv. >> reporter: there's been a huge uptake in attacks from the air on the ukrainian capital a massive bombardment over the month, at least 16 air attacks, and while there haven't been any today in the last 24 hours prior to that there were several waves of attack and one person was killed several people injured
4:09 am
