this marks the first time that a former president will face federal charges. >> we have everything you need to know about this case and what's next. plus, in a moment, we will talk one-on-one with the former president's attorney but we will start with nbc's garrett haake. >> reporter: good morning. the former president broke the news himself from his golf club here in new jersey, then adding in an interview overnight that quote, of course he plans to plead not guilty to the federal charges. this morning a historic first, a former president charged with federal crimes donald trump indicted over seven federal charges. in connection with his alleged mishandling of documents the former president posting on social media that his lawyers had been indicted in what he called the box's hoax. adding he'd been ordered to appear at the federal courthouse next tuesday, an releasing a video message to supporters. >> i just want to tell you i'm an innocent man. i did nothing wrong. we will fight this out, just

like we have been fighting for seven years. >> reporter: one of the president's lawyers telling cnn how he reacted to the news >> this is a sad day i can't believe i've been indicted >> reporter: the charges against mr. trum remain under seal this morning but include conspiracy to obstruct and a violation of the espionage act relating to the handling of sensitive national security defens information, sources tell nbc news special counse jack smith has been investigating mr. trump's handling of documents after the former president and his team repeatedly refused to turn them over for months. the former president has argued he was not only unfairly targeted by investigators -- >> i had every right to. i was, there and i took what i took, and it gets declassified >> reporter: but even once suggesting -- >> if you are the president of the united states, you can declassify just by saying declassify, even by thinking

about it. >> reporter: but the grand jury has heard an audio recording of mr. trump discussing keeping the classified document after leaving office and acknowledging he knew it was classified at the time mr. trump is facing legal battles on multiple fronts and was already the first former president to face federal charges in new york city where he was accused of falsifying business records to which he pled not guilty. the federal indictment is more serious an coming in an election season mr. trump's rival so far siding with him, tweeting, the weaponization of federal law enforcement represents a mortal threat to a free society while former governor chris christie wrote, no one is above the law mr. trump and other republicans have suggested there is a double standard at play here pointing out president biden retained several documents while out of office that is the subject of another

special counsel investigation. sources tell u that investigation is very much still ongoing. garrett, thank you attorney james trusty, one of the members of former president trump's legal team, with us now. good morning to you. >> good morning. >> just, first of all, what was the president's response to the charges? and when did you first learn that this grand jury in florida had -- was being used? >> yeah. well, on that last part fairly recently it is a really intriguing shift of events. there has been endless grand jury dragging people up from florida to washington, d.c., for many months. everyone from the vice president of the united states to maids to secret service agents to lawyers that supposedly hold privileges so there's been a real bum rush in d.c. in terms of using the grand jury and getting a lot of rulings that are historic and potentially very bad for the country.

recently we heard about witnesses going to florida to appear in front of the grand jury it could be an acknowledgment they had venue problems. they shouldn't have venued it in d.c. but they were very happy to get the rulings they wanted. in could be something where they want to sanitize, related to that, sanitize all of the proceedings from d.c., and repackage an remarket it for consumption down in south florida we'll see. the president is a resilient guy. this just in, he's a pretty tough guy. it is a difficult conversation when you are talking to a client who is actually factually innocent of these charges. there is a long story we could get into about the presidential records act. he was upset for the country but in terms of him, he's a fighter and he will come out swinging and he will be fine but that was the interesting inside part of that was to see him talk about what it means for our country and not just about himself. >> is he going to appear on

tuesday? jim, do you think he will also face charges in d.c. as well >> he will appear in court on tuesday, no doubt. you know, he's not afraid of this thing it is a ridiculous criminalization of a non-criminal dispute so he'll be there, we know so will secret service and we'll coordinate with the u.s. marshals and make sure it is as efficient and safe as we can make the whole situation as to any other charges, we don't think so we think this is an overreach, something that was never criminal for any other president in history has been weaponized by this department of justice. it would be another bridge too far for them to try to break up charges for some reason to hedge their bets and charge them in washington, d.c. as well so we think this is it we will see the indictment sometime between now and tuesday afternoon and we think that's the only indictment we're facing. >> you're his lawyer, so obviously you will maintain his

innocence. but a lot of folks have a hard time understanding how the president can maintain he did nothing wrong when the fact of the matter is the president had documents at his home that were classified as we understand it, there was a subpoena issued to turn over those documents in august of last year. the lawyer maintains that all the documents were overturned. the fbi finds roughly 100 classified documents how can the president maintain he did nothing wrong >> the starting point is up until the presidential records act, any former president could possess anything they want. that was the nature of the business we entrusted them under the constitution with the nation's secrets. so if they want to keep stuff, they can keep it the pra, presidential record act, kicked in because of richard nixon. and what it anticipates is nothing criminal there is nothing that says it is a violation to possess any of

these things, even the most sensitive documents. what they say is the world is presidential or personal and the president, of all people, the former president, makes the call if the archive disagrees, it doesn't turn into a criminal case, they can sue civilly in washington, d.c. so the whole system anticipates we entrusted the former president with the nation's secrets, documentary or otherwise, and if there is a fight, it gets fought civilly. not with rage. not with a leaked campaign, what we've seen in this case. >> i know you've spent a number of years in the justice department you know jack smith pretty well. even if your client did nothing wrong, why not tell your client to knock off the personal attacks on the special counsel >> look, you know, this guy has lived through seven years of misplaced aggression, of ridiculous impeachments, of accusations, of michael cohen/stormy daniels lawsuits or criminal cases being revived by politicized

prosecutors. when you look at what we've seen in terms of the conduct of this investigation, he has ever right to be offended, as should all of us it's just broken in the last couple days. we have known about it for a while, that one of the deputies for jack smith extorted an attorney to try to get him to flip his witness. >> to be clear and i've heard you make this claim before we don't have any independent evidence and you haven't produced any independent evidence to back that up to your point there, twice impeached. now twice indicted the president plans to campaign this weekend to those that would say we like the former president, we like some of his policies but now the guy has too much baggage, what would you say to those voters? >> i'm not in the political lane i'm in the legal lane. to go back to your kind of dismissal of what i just said, there is a statement by the officer of the court of a well-respected attorney submitted to a federal judge detailing what i just said, the extortion, the violation of the obstruction statute by those

trying to pin an obstruction charge on president trump. that is a momentous moment and nothing i have ever seen in the department of justice in history. it will play out this is not just lawyer talk. this is the real thing >> you are talking about a sealed letter to a judge there jim, thank you thanks for your time, sir. >> all right thank you. all right. let us bring in nbc legal correspondent laura jarett and our chief white house correspondent, kristin welker it seemed like they were sort of surprised by the fact that this indictment came down what do you make of that >> it's interesting. they were almost in the position of all of us this time last week, not knowing about the florida grand jury and seemed to only fairly recently been informed by it even though jack smith had been working away on this for the better part of a month and witnesses were unbeknownst to us. he's making this point as if everybody does it. everybody does not keep the documents after they have been

asked to return them repeatedly. that's what makes this willful under the statute, and that's why this has escalated into a criminal case. it's very different that finding some documents by accident and then immediately turning them over that is not this case. >> for a year trump has had these documents. he was asked repeatedly to return them. so in these charges, which we don't know what they are because they were sealed, it has something to do with the retention of them. >> it has to do with the retention of them. he is no longer president, and he is keeping them in an unclassified setting. >> so kristin, let me talk to you for a second will this help trump or hurt trump? moments after the indictment came dow he was fund-raising on it. so it seems like former president trump thinks this will be something that will help him out. >> there is no doubt this is emboldening him yet again. we saw this in the wake of the new york indictment, as well you have a number of his republican rivals rushing to

criticize the process, accusing doj of being weaponized by the biden administration but i do think there are a couple of differences here one, you do have some challengers who are criticizing him, saying he has too much legal baggage. and you also have the potential fatigue factor here again he's asking people to give him money you see his challengers make the case that his campaign is about defending him instead of the american people. i'm told you might start to see some republican candidates make that case. >> if he is, by chance, convicted on this, people wonder what is the end game what could happen? >> we have to see what he's being charged with, but obstruction of justice related charge, we're talking about 20 years in prison. this is not some low-level felony this is very serious. >> and let's play this out for one second if that happens, can a man still run for president if that's the case >> there's never been a situation like this. this is extraordinary.

this has never happened before there is nothing that stops him from running for president while he is under federal indictment. >> and top advisers to former president trump say that he will only dig in with each indictment but the question is if there are more indictments, does that chip away at his support around the edges? we'll see. >> thank you guys so much. now a story that has a lot of folks talking on friday morning, the wildfires i canada blanketing u.s. cities in an unhealthy haze. it's forced schools and businesses to shut down, impacting thousands of flights nationwide but this morning there are some signs, at least in some areas, that things are beginning to ease al is tracking the smoke and the impact on our weekend. first emilie ikeda joins us from philadelphia how is it looking this morning from there >> reporter: the good news is the days of that apocalyptic orange appear to be behind us.

we're not out of the haze yet. schools in philadelphia and new york move to on line as that toxic air presses on this morning, millions of americans set to suffer through a fourth day of a persistent haze. >> it is like there is a fire, like a consistent fire. >> reporter: the monstrous smoke clouds produced by raging canadian wildfires continues to darken skies as it goe further down the coast. >> it's scary. it really is. >> reporter: the smoke now engulfing the great lakes and mid-atlantic philadelphia maxing out the air quality index with a hazardous 444 rating on thursday achieving the worst air quality. our nation's capital the city skyline shrouded in smoke. postponing a nationals game and event at the white house d.c. facin its first code purple air quality advisory. >> when they told me it was code purple, i thought it was getting better so we're not even used to this language to deal with this type of air quality.

b.a.r.t. board includes raising fares 11% for the first two years. the average fare of $4.20 would go up to $4.43. for parking, the daily fee would vary, increasing from about $3 to $6.30 per day. there's still no decision on the proposed oak a's ballpark on the las vegas strip. this comes after the nevada legislature adjourned their special session last night. the plan now is in limbo at least until monday. the proposal calls for $380 million in public funds to help pay for the $1.5 billion stadium. the senators are questioning why a billion dollar team needs hundreds of millions of dollars that could be spent on services like education and health care. let's get a look at our forecast for this friday morning. kari has been monitoring it for us. >> we're starting out cloudy and we'll see a lot of clouds throughout the day. we can see the clouds will linger and keep temperatures down, so we're only headed up for 62 degrees today along the

the arraignment that once seemed so elusive is about to become a reality. joran van der sloot is accused of asking the holloway family a quarter of a million dollars to provide information about their daughter's whereabouts, only to come up with nothing, charges his attorney in peru has denied. in a surreal moment 20 years in the making, joran van der sloot on u.s. soil for the first time guided by a team of federal agents at a tarmac at an alabama airport and then whisked away by a motorcade. the jail 20 minutes out birmingham where he'll face justice in an american courtroom. van der sloot has never been charged with natalee local way's murder although he was the last to see her alive in aruba they will face federal charges of extortion and wire fraud that's tied to a sting operation in 2010 where van der sloot is accused of accepting $25,000, promising to tell the family how she died and

where to find her remains. john q. kelly, the holloways' longtime attorney, met with van der sloot in aruba >> he took me to a location where he said she was buried a week later, he indicated it was a hoax, which was his m.o., get the money and say it's a hoax to avoid criminal prosecution. >> reporter: the person whose office issued the indictment against van der sloot former u.s. attorney in the northern district of alabama and current nbc news legal analyst, joyce vance. this was an opportunity to hol him accountable without pursuing something more serious. >> that's right. originally this looked like something that you would characterize as being awful but lawful but as the team began to dig deeper, they found there is a prosecutable federal crime here. >> reporter: last month, they prove app government where he had been serving time for the killing of another woman set into motion this wild scene

at the airport in lima where his cuffs were removed and he was handed over to u.s. attorneys. now all eyes turn to the courtroom where the family hopes the truth will come out. natalee's mother beth holloway releasing a new statement, "as a mother who has tirelessl pursued justice for the murder of my precious daughter, i stand before you today with a heart heavy by sorrow and yet lifted by a glimmer of hope." beth holloway is expected to be in court for the arraignment later today, and joran van der sloot also expected to plead not guilty to each of the charges. would carry up to 20 years in prison if convicted. >> sam, thank you. we're joined now by john q. kelly, the family's long-time attorney thanks for being here. you spent some time last night talking to natalee's mom beth. how was she? what did she say about all this? >> she's basically overwhelmed by the whole situation she has the whole spectrum of emotions

on the one hand, she was ecstatic that van der sloot was on u.s. soil, u.s. authorities, u.s. justice system, but it is still like pulling a scab off an old wound. there's always that pain there, and he's a painful reminder of what she's been through. >> you were with the room twice with van der sloot, as i understand it, during that alleged extortion plot what was that like what was he like >> big guy, kind of an ominous presence all business about money that's all he cares about. that's all he wants to talk about. and just cold and heartless and has absolutely no sympathy, no empathy, no feelings whatsoever for beth or family or what they have been through. >> he just wanted the money? >> he just wants money. >> help me understand this because according to some of the evidence that's been presented

so far, aruban authorities and u.s. authorities were actually watching the second exchange, but he was able to leave with the $25,000. why didn't they just snatch him up then? >> good question, craig. they had everything they needed after i was done for the day everything was videotaped. everything was audiotaped. it was all memorialized. i think the aruban autho authoauthorities -- he managed to slip away almost sur someone tipped him off as to what happened and told him to get away as quickly as he could, and he did. >> do you expect to testify in the case >> i sure do. >> and you have already started preparing, i gather, with the attorneys. >> not yet but i got to sort of get the rust off from 13 years ago. >> john, really quickly before i let you go, is there a universe in which we ever find natalee holloway's remains her body

delay the case about a month ago, the special counsel's office began secretly bringing evidence to a grand jury in this courthouse behind me which would return that sealeded indictment yesterday what this means is that president trump has one less avenue to challenge this prosecution, and it may even mean the trial goes faster some judges in south florida they move things along they run a so-called rocket docket but it means a jury pool that includes far more trump supporters than you would find in washington, d.c. >> the former president's lawyer says he will appear in person on tuesday. what do we know about how the arraignment will play out there? >> reporter: if mr. trump is treated like any other federal defendant, he will have to surrender and he will be processed. that means a mug shot will be taken. although it won't be released. he will be fingerprinted his passport will be taken from him. and then he will go into court for a first appearance and
