and this is tuesday morning, the team all assembled, ready to get you started with the day. i'm marcus washington. >> i'm laura garcia. we're going to check that morning commute and see if things are picking up in a moment. let's talk about the forecast right now with meteorologist kari hall. things are finally going to start warming up. >> warming up just a little bit. not a major warm-up here. we're mostly going to feel that in the inland areas. as we take a live look outside in oakland, starting out cloudy and we are in the upper 50s and we'll see a mix of sun and clouds, headed for the mid-60s at 1:00 today and eventually reaching the upper 60s for a high this afternoon. novato will see a high of 73 degrees there, a lot of these temperatures right at or slightly below what's normal for this time of year. and we are going to once again trend just slightly warmer for the inland areas with a few low 80s. livermore reaching 80 degrees tomorrow afternoon, while napa will see a high of 75. by the end of the week we're seeing a few low 80s as well.

we'll talk about what's ahead for the weekend. mike, you can see the commute heading into san jose. >> and i'm not talking about traffic cameras, i'm talking about traffic sensors showing the activity for these cars slowing down north 101 from 280 all the way up toward sjc. we'll see 237 build off of 880 as well. we're looking at the feed coming in off 101 out of san martin and through morgan hill. there's your usual build, starting once again, that will feed the south bay with more slowing probably hitting 87, 85 in the next hour. over here we don't have much of a slowdown but it is at the castro valley y and the bay bridge toll plaza where the metering lights have been on since about 5:35 this morning. there's movement, that's good. but there's still a wait. back to you. >> thanks, mike. we are following some breaking news this morning out of denver, where police are investigating an overnight shooting where at least nine people are injured. we're being told this started with some type of fight in the downtown area of denver, as thousands of nugget fans

celebrated the nba championship win. the nuggets beat miami beat in the ball arena, miles away from where the incident happened. three people are in critical condition and the other victims are expected to be okay. officers took a suspect into custody who had also been shot. 6:02 right now. a historic day today as former president donald trump will be arraigned in a federal courthouse in miami. we have a live look this morning. the former president is the first former president to face federal charges. security is being intensified ahead of his court appearance. "today in the bay"'s brie jackson joins us live in washington this morning. brie, it will be interesting to see how all of this will affect trump's 2024 presidential campaign. >> reporter: it certainly will be. good morning, laura. so this federal case has legal, as well as political implications for former president donald trump, who

currently remains the current gop front-runner. former president trump airing his grievances about the 37-count indictment he's expected to plead not guilty to in federal court today. >> there's no criminality here. it's ridiculous. these people, look, they are using it as election interference. >> reporter: the special counsel's investigation alleges that trump knowingly mishandled classified documents after leaving office. mr. trump claims the case is an attempt to interfere with his chances of winning the 2024 presidential election. his gop challengers weighed in. >> i'm convinced if he goes back to the white house that the next four years will be about him settling scores. >> if this indictment is true, if what it says is actually the case, president trump was incredibly reckless with our national security. >> this case is a serious case

with serious allegations, but in america you're still innocent until proven guilty. >> reporter: on capitol hill, even some republicans are blasting the former president's actions, while others defend him. >> why is the country going to have to go through all this angst and tumult? why didn't he just turn the documents in? >> i think president trump has not been treated equally like everybody else in this process. >> this case must be allowed to play out through the legal process. >> reporter: today marks the second time the twice impeached former president faces a judge on criminal charges. and after his arraignment today, former president trump is scheduled to return to new jersey and deliver his remarks at an event at his golf club later tonight. >> it will be interesting to see what he has to say. the former president has really turned this indictment into a campaign windfall of sorts. >> that's right. so actually the event he's having tonight originally was

in a series of what they're calling hate crimes. santa rosa police say the businesses were covered with stickers which contained hateful rhetoric. officers were notified about the incidents on sunday. we're told most of those businesses are owned by members or supporters of the lgbtq+ community. so far, no arrests have been made. well, a's fans are fighting back trying to keep their beloved baseball team in oakland. later tonight they're hosting a boycott of sorts as the team is proposing a new ballpark on the las vegas strip. bob redell is joining us now. bob, talk to us about the plans the fans have here. >> reporter: good morning. the oakland a's fan group called rooted in oakland are calling for a reverse boycott of tonight's game against the tampa bay rays. the goal is to fill the coliseum tonight to send a message to the owner and managers of the team, sell the team to someone who wants to keep the a's in

oakland. now, the team has announced plans to move to a new stadium that would be built on the las vegas strip. right now lawmakers in nevada are considering a bill that would provide $380 million in taxpayer money to help pay for the new ballpark. the oakland 68, the fan booster club, have raised $35,000 to give away free t-shirts at tonight's game with the word "sell" printed on them, a direct message to the a's owner, john fisher. >> john fisher is not going to wake up wednesday morning, slap himself in the head and say, what was i thinking, we're committing to oakland. we know that's not going to happen. all we want to do is raise awareness that there are a's fans. >> it breaks my heart and it's not right. the owners, they own the team, i guess, but they don't own the community of oakland a's fans. >> reporter: the oakland's have refused to comment on tonight's

reverse boycott. they're trying to get as many fans to show up as possible. it should be noted that the a's average attendance is under 16,000. the lowest in major league baseball. >> this is like looking at a relationship of a couple that you love to see together, but one party is fighting for this relationship and the other one is off dating someone else. >> and they're going to vegas. >> this played out a little more than i thought. there you go. we'll see. thanks so much, bob. >> goodness gracious. happening today, alameda county supervisors will introduce a new ordinance aiming to crack down on side shows as we continue to see an increase in illegal side shows across the bay area. the proposal would punish people who come to watch side shows and street races. if approved, violators would face up to a $1,000 fine and six months in jail. this comes after the city of oakland recently passed a

similar ordinance last month. 6:09 right now. we'll take a live look outside in san francisco. getting started with the morning. the sun is trying to peek through but low-lying clouds are saying, no, not right now. meteorologist kari hall has a look at what we can expect from the forecast. hoping the sun makes an appearance later there. >> suddenly we'll see the sun peeking out later today. it is all clear in palo alto. parts of the bay area are able to see the sunrise this morning and we're starting out with temperatures in the upper 50s. the wind is calm and we're also going to see increasing sunshine across the bay area as we go into later this morning into the afternoon. but, yeah, in san francisco that june gloom continues and that keeps those temperatures down, as we only make it up to about 66 degrees there. 71 with more sunshine in san mateo, and in hayward reaching 71 degrees. mid to upper 70s from the inland east bay to the north bay, and down to the south county as well. we'll get a look ahead coming up in a few minutes. mike has a look at where you

good tuesday morning. the time is 6:14. let's head to walnut creek. it is a cloudy start here. eventually we'll start to see the sun peeking out between 8:00 to 9:00, and then we're clear the rest of the day and afternoon, going from upper 50s to upper 70s for highs today. another really nice one. we'll take a look ahead to the weekend coming up. the traffic in the background was moving nicely for 680. 92, this is nice as well. the volume has built but not a big deal. no brake light tapping. we'll watch. over the next half hour, we should see more brake light tapping. we'll show you the peninsula to

the east bay. good morning. very happy tuesday to you. the federal trade commission is asking a judge to immediately stop microsoft from buying the video game maker activision while it works on a more detailed case against the merger. apple hit all-time highs again yesterday. that bay area company now worth nearly $3 trillion. apple stock has helped push the nasdaq and the s&p 500 higher. s&p 500 now back in a bull market. more good news, inflation continues to slow. headline inflation up 4% annually, the smallest number in two years. at one point it was 9%. keep in mind, there are hundreds of categories. prices of cars and trucks continue to fall. they've been falling for months. gas prices are way, way down. that's a big factor in the headline inflation overall. airfare down about 9% from a year ago. eggs slightly lower after a big

dip last month. electronics continue to fall as well. prices up 4%. the fed is looking for 2%. but this is still good news that may convince the fed to ease up on interest rate hikes. the federal open markets committee starts its two-day interest rate meeting today, announces its decision around 11:00 a.m. our time home. >> the hold foreign press association that puts on the golden globes is shutting down. it was a controversial group, getting into trouble for lack of diversity, sometimes odd choices about who wins. the show will go on, the award show was sold to dick clark productions, which has been producing the show for years now. >> and fox news has demanded tucker carlson stop publishing his "tucker on twitter" videos. this according to a source close to the company. you remember fox fired carlson back in april. carlson's lawyer says he won't be silenced by anyone. there is a new episode due out

this morning. fox says carlson signed an agreement limiting his ability to appear on other platforms. carlson joins twitter at just about the time when twitter is falling out of the national conversation. it's just not something that we cover that much anymore, that people are making news on. we'll see where it goes. but it's a little like some of the old stuff that has fallen out of fashion. >> we'll be watching. thanks, scott. new developments this morning in the long saga of a beloved mural that bounced around san francisco really for decades. renowned artist diego rivera painted for the exhibition on treasure island. recently it was moved to the museum of modern art where it's on display right now. eventually the mural will return to city college for its new permanent home. it will sit in the lobby of the san diego rivera theatre which has been in the works for years now but slowed down by funding

delays. the "chronicle" just received the first renderings of how the mural will look in the theatre lobby, thanks to that new funding the opening could happen in early 2027. any one glass of alcohol a day could help keep the heart doctor away. this is all according to a new study done by researchers at massachusetts general hospital. so they found that drinking alcohol in a light to moderate manner could reduce the risk of cardiovascular issues. researchers studied 50,000 people and found that drinking a little bit can actually decrease stress levels, which decreases your risk of major heart problems. experts say for women that means having one glass a day, while for men that can mean having one to two glasses. >> we all have stress in our lives. it's how you respond to it. in this case, the alcohol is helping your brain moderate that response. >> when your friends say, hey, you drink too much, no, i can

have one glass a day. doctors say that drinking isn't a solution to fixing stress and said there are other healthier ways to eliminate that stress. we're talking about exercise and meditation, even pets can help reduce stress. >> they said pets can lower your heart rate. got to have the newsroom dog. >> or a glass of wine. somebody could be allergic. >> right. this is trending this morning. if you are a fan of cheese, you may be able to make a career out of this. the university of wisconsin madison is hiring a cheese taster. >> this is from the university center for dairy research. the job listing calls for people passionate about all types of cheesy foods, particularly pizza. the university says you should be prepared to try 12 pizzas and 24 cheese samples a week. tasters will offer insight through a panel discussion discussing the positive attributes of each type and scoring it through a rubric. the job pays about $15 an hour.

>> you can have your cheese and wine, the italian theme just keeps going. >> that's a lot of cheese. i like cheese, but that's a lot of cheese. >> my son is a junior and i think i might have found a college to suggest. >> no kidding. >> that would be great. >> just as long as he's not lactose intolerant. >> need not apply. let's get started this morning. we've got to pay the bills and get ready to head out for work. let's get a look at our temperatures and it's going to be a day where you want to take the lunch outside, maybe enjoy dinner out there, too. because our temperatures in the south bay will head for the upper 70s, east san jose reaching 79, 76 for a high in milpitas, and for the east bay we're mostly looking at mid to upper 70s with antioch hitting 79 degrees. compare that to the 71 we'll see in hayward and some mid-70s for palo alto, while daly city will reach a high of 64 degrees. the seven-day forecast is coming up at the bottom of the screen.

it is going to be another mostly cloudy start to the day in san francisco, with peeks of sunshine, especially downtown and in the mission district where temperatures will be slightly warmer. we're headed up for 68 in mill valley and a little more sunshine in santa rosa this afternoon as well, with a high of 73. let's head to the sierra where we've seen a huge amount of sierra snow still left in the upper elevations, so the southern sierra is nearly 500% of its normal amount for this date. want to know how much snow has melted? about half. and there's still a lot more to go as we are still seeing a pretty decent snowpack there and our reservoirs are filling up. some of those larger reservoirs are already near or at capacity. take a look at lake oroville, where we are at 100% of capacity, but trinity lake, which also fills up with sierra snowmelt is still at 66%, so on average we're still seeing some of the numbers running fairly

low. but looking at our temperatures, it's going to be warming up, more sierra snowmelt and warmth for the bay area with our inland temperatures reaching into the low to mid-80s. by the weekend we do see a drop in temperatures between saturday and sunday. the winds will pick up, we'll also get more sunshine, while san francisco will only see some modest warming there, as we are going to see the marine layer, the june gloom still linger for the next several days. mike, you're going to take us back to the crash on highway 4, rite? >> i am because that's typically where we see a busy slowdown anyway, but this is distributed differently. just past railroad we do have a crash just before you get to bailey. so you see the dramatic slowing there coming out of antioch and port pittsburg. the crash is registered on the chp record. that makes things at the concord area, 242, lighter. that will be a slower drive. overall it's looking like a lighter volume all around contra

with us. i'm laura garcia. >> i'm marcus washington. much to get to this morning. first we want to start with a look at the forecast. what can we expect? meteorologist kari hall has been working hard on that. already sunshine in san jose. kind of our usual start, we'll see a mix of sun and clouds as we go into the rest of today. and slightly warmer temperatures in some spots. let's get a look at morgan hill where it is now 57 degrees. we have a light wind and we'll see a partly cloudy start to the morning, and then sunny from 10:00 on into the afternoon, as our temperatures head for the upper 70s. that will be one of the warmer spots compared to the low 70s in hayward, 71 for a high today in san mateo, and some low 70s as well for much of the north bay. so still feeling nice out there. we'll get a look ahead to slight warming coming up. mike, we see a lot of slowing. >> and slower recovery. west 580 traveling toward the dublin interchange.

there were three or four weeks involved in a crash just shy of the interchange itself and just behind those trees. still a distraction, still some slowing for that distraction. speeds are quickly improving. a lighter volume overall. slowing as you head south through pleasanton. highway 4 holding steady with a crash approaching bailey, slow through pittsburg. a lighter volume keeps things manageable. you can take the railroad toward kirker pass. concord and walnut creek looking good. bay bridge toll plaza full. slowing for hayward as well as san jose. back to you. >> thanks, mike. we are following breaking news out of san francisco where police are investigating an apparent deadly shooting in the tenderloin right in the area of mid market. it happened about five hours ago on turk street. police told our photographer on the scene one man was shot and died at the scene. so far there's no official

confirmation or information on any arrests. that overnight shooting just a few blocks away from westfield mall, and safety is among many of the reasons that a lot of retailers have been pulling out of the city and westfield is just the latest departure. "today in the bay"'s ginger conejero saab is live for us in san francisco with more on yet another shakeup for those shoppers and businesses out there. >> reporter: that's right. it's not news that shoppers or people who are in that downtown area really want to get, but some are keeping a positive outlook saying this could be a new beginning for downtown san francisco. but a lot of others saying this is yet another sign that there's a crisis in the downtown area. in a statement, westfield mall saying it pointed to the city's challenging operating conditions as the reason behind a decline in sales, occupancy, foot traffic, and their decision to transfer management of the shopping center to the lender. sales at the san francisco

location dropped from $455 million in 2019 to just under $300 million last year. while in the south bay, the retailer says westfield valley fair saw a 66% increase in sales. westfield's announcement adding to a list of stores abandoning ship downtown, including old navy, coco republic that opened less than a year ago, and most recently nordstrom. mayor london breed said the move has been in the works for some time and mentioned in statement that with new management they'll have the opportunity to pursue a new vision for the space that focuses on what the future of downtown san francisco can be. now, she added she has had numerous talks with westfield about the future of the site and, quote, it's been clear that they did not have a long-term commitment to san francisco as they looked to withdraw entirely from the united states market. but supervisor matt dorsey says the city needs to address the bigger problem first. >> there's also factors that we can control, and they include things like street conditions,

homelessness, public drug use, drug dealing. there's things that san francisco has to do a better job of addressing and i think the only way we're going to be able to do that is with a fully staffed police department. >> reporter: now, a lot of people are asking what's next. mayor london breed said this might be an opportunity for educational institutions to expand, speaking about that space. the stores in that mall will remain open despite the shift in management. so that's one thing to note for shoppers who are still interested in going into that area. but, guys, at least two dozen retailers have left the downtown area since 2020, so instead of what's next, a lot of people are asking, who is next? marcus and laura. >> that is the question we keep asking because it seems like we hear more and more next of who is leaving. >> it's just sad to see. it really is. >> ginger, thank you.

6:36 right now. for the second time in just a little more than two months, former president donald trump is making his first appearance in court to answer to criminal charges. >> scott mcgrew is joining us this morning and these federal charges we're looking at, definitely more serious charges than the ones we saw in manhattan. >> state charges in manhattan. this case is a lot stronger as well. in their federal indictment, prosecutors say they have trump on tape talking about the things that they're alleging, that trump had critical classified documents that he wasn't supposed to have, he knew they were classified, yet he showed them to people who should not have seen them. he'll make his first appearance in miami later this morning. today's appearance will be different than the one in april in manhattan, where trump faces separate criminal charges over hush money payments. first there will be no pictures inside the courtroom like there were here. federal court does not allow it. secondly, we may see a different

kind of crowd outside the courthouse. in manhattan, the crowd seemed to be mostly just curious bystanders. there was a contingent of trump supporters, but florida may see more of them. from a legal standpoint, this is trump's first appearance. in other cases there would not be a plea. just an explanation of the charges. but trump has seen the charges. so this may be an arraignment as well where he says guilty, not guilty. the big question will be what the legal team is going to look like. he's had lawyers quit on him recently and other lawyers apparently are testifying against him. the case has been assigned to judge aileen cannon, the same judge who made so many legal decisions in trump's favor back in the early days of the case. she's not expected to handle today's first appearance. that's generally handled by a magistrate. trump faces 37 felony counts related to the documents. the feds allege he willfully

held onto documents he was not supposed to have, he lied about having them, hid them when feds asked for them back, both nicely and then with a subpoena, and then ultimately the fbi had to go in and get documents that trump and his lawyers said they didn't have. trump critic and republican presidential candidate chris christie was on cnn last night as part of a pre-scheduled town hall, and christie, who, remember, is a former u.s. attorney himself, a federal prosecutor, summed up the case like this. >> it is a very tight, very detailed evidence-laden indictment, and the conduct is awful. put aside taking the documents in the first place, but then when you start getting asked, anderson, in may of '21, nicely with a letter from the archivists saying could you please give it back, and you ignore it, ignore it, then they come with a grand jury subpoena, and then according to the

nurses taking part in a nationwide day of action. at least four hospitals in the bay area will hold demonstrations today. this is a live look, in fact, outside of good samaritan hospital in san jose where many nurses are taking part. two kaiser medical centers and ucsf benioff childrens' hospital will also hold demonstrations, hoping to bring attention to what they call a staffing crisis. we've reached out to the hospitals for comment but have not heard back. walnut creek in the east bay, you can see low-lying clouds blocking the sunshine. it's sticking around in some places. meteorologist kari hall has been monitoring what we can expect weather-wise. you say no rain for us today. >> no rain today. even though we did see some spotty showers moving through yesterday morning at this time. and we are also going to continue to see that june gloom to start out with each morning for the next several days. here is a look at the temperatures you're feeling as you're stepping out the door,

mainly in the mid to upper 50s, and then as we go throughout the day it's going to start to warm up, going from upper 50s to mid-60s at 11:00, and then your lunch hour is 68 degrees in the east bay. as we get more sunshine and make it toward the upper 70s for today. san jose will reach back up to 77 degrees, about what it was yesterday. but it should be clearer than it was yesterday afternoon. mike, you're seeing something different for the commute through san jose. >> down here. 87 and 101, they typically show the build. 85 was all red just for a couple of seconds and then it started to smooth out. there's an incident going on, maybe someone stalled or some debris, maybe someone got a speeding ticket. that's when everybody will tap their brakes. the crash marked on the map on 101 not an issue. no injuries and it's typical slowing by sjc. a few scattered incidents on both sides of the bay. here in hayward, south 880, i'm waiting for a report to come in

to slightly warmer temperatures coming up. the san mateo bridge out of hayward, 880 at 92, i did see an incident pop up. it looks like it's northbound, everything is off the shoulder. we'll see you how things are shaking up in that general area coming up. happening today, the man accused of stabbing former tech executive bob lee will return to court. the i.t. consultant is charged with murder. momeni is due in court for a hearing and it will be the first time he appears with his new attorney. momeni recently decided to part ways with his defense attorney and has hired a miami-based attorney instead. meanwhile, the case involving the attack of former fire commissioner continues today. dan carmignani appears in court to testify against garret doty. doty is accused of attacking

carmignani back in april with some kind of metal object. a lawyer for doty says that it was actually a case of self-defense here and he's accusing carmignani of having a history of spraying unhoused people with mace. carmignani denies the accusations. governor gavin newsom says he has a plan to address homelessness in california. he spoke to fox news' sean hannity last night. california's homelessness crisis spiked a big conversation, as of right now more than 171,000 are unhoused in california. in some cities, that number is growing quickly. in san diego county, the percentage of people who are unhoused jumped 22% from last year, a record high for that county. newsom says he's dedicated to finding a solution. >> this state has not made progress in the last two decades as it relates to homelessness. >> why? >> because housing costs are too

high, our regulatory thickets are too problematic. localism has been impactful, meaning people locally are pushing back against new housing starts and construction. >> newsom says he wants to sue cities that don't have enough affordable housing and the state is planning to deliver 1,200 tiny homes to large cities with some heading to san diego. 6:48 this morning. when it comes to making it in the bay, home prices are up as inventory plunges to its lowest level in decade. this is according to a new report by compass. it shows that in san mateo county, the median home price is edging close to $2 million. this is the highest in the bay area. median prices on the peninsula were $1.93 million back in may and the prices are up for san francisco, where the homes are going for about $1.63. as local real estate agents john and jodie foster explain to us, the market is slow at the moment. >> interest rates are a little

in los gatos, expect a high of 79 degrees and 77 in san jose. for the east bay, we're headed for 78 degrees in danville, livermore reaching 77, and oakland today reaching 69 degrees, overall nice and cool near the coastline. daly city headed for 64, while redwood city will reach up to about 72. in san francisco, we should see a little bit more sunshine downtown and in the mission district. so we're reaching into the mid-60s. for the north bay we're reaching 75 in sonoma. ukiah up to 84 degrees today. so definitely warmer farther to the north. so speaking of warmth, here is a look at the current sierra snowpack. it continues to melt and we're still at nearly 500% of its normal amount for this day in the southern sierra. so how much more is there to melt? we're about halfway there, so there still may be several more weeks left of at least seeing the snow in the distance once you visit the sierra, looking at the upper elevations.

it's filling those larger reservoirs that are still at or even close to capacity. we're seeing those reservoirs continuing to fill up due to all of that sierra snowmelt. and we have more warm weather and dry conditions headed our way as high pressure builds and brings in more of a northerly wind. for the inland areas temperatures go up slightly. you may not notice much of a difference near the coast. cooler weather will be returning sunday into next week. so the spike in temperatures is only for about three or four days and we'll see that by the end of the week into saturday as we get more sunshine here. how is the south bay commute sorting out? >> sorting out to normal, which just means normal. 87 sees a little more traffic because of that big backup on 85, which has cleared. as things calm down the ripple will happen. you lose the impact of the earlier issue on 85. north 880 at 92, the crash is off to the shoulder. very little impact, lighter volume of traffic for the
