still not out. part of our breaking news last night, the explosion and smoke can be seen from miles. >> when in 24 hours later, firefighters are still on the scene looking for hotspots one person is in custody and the question remains was it arson? >> joining us with some of those answers for us. robert. >> they just turned the water off on these hotspots. they moved a couple minutes ago you can see why investigators are having a pretty tough time. it took a long time to clear out enough of the hotspots to get a closer look at the damage they were able to but crews are wrapping it up. they are walking around that rubble. >> reporter: arson investigators are being cautious as they look for a cause in a huge pile of twisted

of the fire whether it was the initial thing that started the fire or there was a fire of another origin. >> reporter: there was a fire station and 70 firefighters were here quickly, they will have it burn nonstop overnight. and has minor damage, mainly from water. they took a person of interest. this was possibly the work of an arsonist, made them even more sad. >> i can think of doing something like that, it's not right. >> even as crews wrap up, they are trying to determine what role if any the person played that will be part of the ongoing investigation.

it used to be a very sports minded town. >> reporter: now that the bill assigned there was two major steps left. he needs to show he can find the rest of the funding for $1.2 billion project. calling the move a significant step forward. the statement went on to say they are excited about some of the dynamic sports and we look forward to becoming a valued community member. new details in the controversy around the l.a. dodgers pride night and the lgbtq group a catholic group is expecting thousands of people to show up to protest tomorrow night's game where the dodgers host the giants. the dodgers plan to get san francisco a perpetual indulgence of community.

after complaints from religious groups the backlash from the lgbtq groups left the dodgers to re-invite them. the group called catholics for catholics are now organizing what it called a prayer possession outside of dodger stadium tomorrow evening. >> is pride month continues we have a story of discrimination and bullying for some students in san jose parents, teachers and students are rallying at the school board meeting demanding change. the meeting happening as we speak. joining us for the unified district. >> reporter: parents and teachers i spoke with only want to see the school district and with so many other school districts already have and programming them to better

support lgbtq+ students. what are they asking for? they have the advisory committee. they can report to the board, they are asking for lgbtq students and lgbtq liaison on every campus. gender training for all employees and an updated policy for lgbtq+ students. later tonight the board is set up to pass a resolution recognizing pride month. something that parents and staff say is not enough. just minutes ago we heard back that might not be the case anymore. that's it. >> they didn't say. we're going to update our policy and we will form an advisory committee. all of the many easy next steps they can take, they won't commit to that. >> i don't believe this should be in our schools.

i can understand everyone has a platform everyone wants to be heard, i don't like the way they are going about it though it's kind of wrong. it's being pushed. >> reporter: not everyone agrees, some parents believe teachers are forcing their beliefs and morals on students and any programs should be voted on by parents. the district said that they already have a lgbtq+ policy in place and they provided training for certified staff. later on today we will be hearing from parents who say they have children who are concerned about bullying and the support there is for their peers. in san jose, nbc bay area news. tonight we know the punishment handed down by the fire department over that so- called fire truck incident. you remember that? it started with a sell phone video last fall which is a woman who appears to be wearing nothing more than a bikini getting out of a fire truck.

she walks right into the pink poodle strip club. she apologized and said disciplinary action was being taken. now we learned a fire captain has been demoted. another fire captain from san jose wants to know why it took so long for this information to become public. >> it's still very vague. it's a shame. because those men and women do a great job every day. >> it doesn't make it look good it's a real shame. i'm sorry it took so long. >> the city did confirm know whether disciplinary action was taken. the former fire captain violated public trust. it turned out to be a deadly vacation carbon monoxide poisoning was likely killing a california couple in mexico. hotel staff found the orange county couple unresponsive in a hotel room in the baja

peninsula about an hour north of cabo san lucas. police believe the cause of death was inhalation of gas. the family has since posted a gofundme page they say they were told it was in proper venting of carbon monoxide gas and we see miguel spoke with the family. >> that's the hardest part, it is just -- >> the general manager of that hotel issued a statement offering condolences to the family and said there was no other threat to guest safety. here is a reminder. a fire forcing some evacuations north of sacramento. it broke out about four hours ago. it burns 50 acres in the area you can see there was a steady plume of smoke that could just be seen for miles.

a remarkable break. sunnydale detective made an arrest in a cold case from 1997. a man is facing charges of sexual assault on a seven-year- old girl investigators say dna evidence and creative police work including an undercover busboy, led to the arrest. here is nbc. >> reporter: on monday a team of officers from sunnyvale police descended on this apartment complex one at a residence, 59-year-old richard jeffrey martinez was arrested on four counts of child sexual assault. the kind they accuse him of committing 27 years ago when he was 32 years old. according to court documents the victim was seven years old police collected evidence in

that case but the dna sample they had never matched up with anyone in the national criminal database. investigators turned to a new resource they submitted the dna to a public site to build a family tree. >> genealogy has been a real game changer in terms of trying to identify people who aren't in the database. >> reporter: they actually narrowed their search to three brothers. hutchinson was able to rule out two of them by connecting dna samples from discarded garbage and other legal means of collecting dna. jeffrey martinez in the 1996 case, he got creative. through social media, detective hutchinson learned that martinez always went to the same pub to celebrate st. patrick's day he got a court order to allow him to go undercover for the whole day and collect dna samples from martinez which turned out to be half eaten hot wings. >> it was a long day.

i joked with folks that my feet hurt and my back hurt and it is pretty physically exhausting. >> he froze the hot wings and he handled it how you would handle evidence. he's very well trained and he preserved the evidence. he sent that stuff off to the lab. >> this is not the first cold case they have worked on. last august, hutchinson arrested 75-year-old gary for the 1982 murder of carry smith in february 2021, he arrested thomas in the 1979 murderer. after monday's arrest of martinez for assault, two more victims came forward. he said he's happy the first victim is helped in this case. >> i hope she's proud of the fact that she allowed other victims to come forward. >> reporter: in sunnyvale, nbc

bay area news. union members have voted in favor to authorize the strike the contract going expiring on june 25th. the issue? unfair labor practices and understaffing. it could affect more than 12,000 county employees that work at the three hospitals. 911 communication centers and the park too. >> management needs to be able to hear from those on the front line. >> during the next session of negotiations the union's bargaining team will decide when to strike if necessary. we did reach out to the county but so far have not heard back. >> for thousands of kids it's summertime, a rite of passage taking a bus with your friends to camp but a popular girl scout camp is in jeopardy

because the due new ordinance. other camps are worried for the exact same reason. >> reporter: you are looking at teenagers from summercamp the annual girl scout camp. and has been going on for decades here but now, a hitch. a new ordinance means the bus that drives the growth to camp, is too long. >> a lot of our parents rely on that transportation to get them to camp. >> reporter: her daughter goes to girl scout camp and michelle also went to the same camp she says they just found out about the ordinance banning buses longer than 35 feet for certain roads, including the road 100 park. the campers -- 39 feet long. >> this impacts all of the youth

that accesses the park we've been there for 75 years but were not the only camp that operates. >> parents are getting involved, worried the bus and could mean their kids could not get to go to camp. >> there so many cans who can go throughout their entire lives with access to camp if they don't have the buses. they're frustrated they weren't told ahead of time about the ordinance and worry because camp starts in a month. >> i was so excited to pass that on to my daughter too. she is a little go-getter and i was so excited for her to experience the outdoors like i got too. >> reporter: we reached out to what side which tells us the promise to work with the girl scout to make sure they can get to their camp on time via the bus. meanwhile, there is a town hall meeting scheduled for the 27th of this month. girl scouts say, they will be

friday morning forecast, it does not look super widespread. we see low clouds here also, some of that near the bay. of course the immediate coast through the afternoon we keep the coastline but we will keep the sunny skies and wind. if a decent forecast for us. temperatures starting off in the 50s. southbay, 57. san francisco and the northbay right here. daytime highs for tomorrow in the south bay it's going to bring us to the upper 70s and low 80s. 80 degrees with 79. for the east bay over to oakland, 71. 80 in walnut creek. out here towards livermore, we will be right back at 84. the peninsula headed to the beach, a classic chilly day out here for us.

the group including eight kids arrived unannounced at a downtown l.a. church yesterday afternoon. texas has transported more than 20,000 migrants. the sanctuary cities across the country. yesterday he did tweet small texas border towns are being overrun and overwhelmed because of president biden refuses to secure the border. migrants seek to go and the leaders approved to a self- declared sanctuary. the governor's office responded in part saying instead of demonizing asylum-seekers, let's work on the community to support and humanely welcome people. together we will make sure children and families to arrive are safe and lock him. earlier this month florida governor also ordered nearly 40 migrants to sacramento. he set they all consented ahead of time.

to those operations for the organization. >> he initially pulled over a vehicle for not displaying license plates and it seems fairly civil in the beginning. after doing background checks on both individuals he discovers the passenger has an outstanding felony warrant. explaining to him he has a warrant. at this point, we say the suspect was resisting arrest. however, using a series of punches, kicks and knee strikes that led to a internal investigation. an investigation prompted by sergeant josh. evans is one of the officers now at the center of the racist text messaging scandal and the body cam video. he seemed surprised it tells him he used force to arrest the suspect.

and internal investigation determined that he had violated use of force policy including unreasonable force, failure to de-escalate and use of alternative tactics he was eventually fired in april of this year. >> that was a prime example of being more accountable. i think he's responsible. >> reporter: the district attorney is charged with misdemeanor assault for his actions. she says she'll the police chief has continued to hold officers more accountable but there still a lot of work to do and feels the d.a. charges don't go far enough. >> the arraignment of one officer isn't a victory. it was the right thing to do, it took too long and we can't count it as a win.

francisco this saturday for a panel discussion on how to prevent abuse in the church and support survivors who have been victimized. >> going to be moderating the event. >> that panel is called the sanctuary the aim is to discuss what religious leaders can and should be doing with abuse and protecting the congregation more than half of women reported suffering some type of sexual violence in their lifetime. that according to surveys conducted and that kind of abuse impacts about one in three men. they reported extensively about church abuse claims across the bay area. disclosing how often that happens. >> we call our church building sanctuaries with healing, safety and well-being in the community. >> nicole first witness the
