also breaking right now at 6:00, a tragic late-night incident in the south bay leaving a baby dead, two others injured. we are live with all of those details on that investigation and the impact on your morning commute. this is "today in the bay." good wednesday morning. thanks for allowing us to be a part of your morning. i'm marcus washington. >> i'm laura garcia. a lot happening overnight. we're going to get to that in just a moment. first, let's talk about the forecast. the sun is up over the bay area. it's still kind of cloud covered, keeping us cooler. >> that will keep temperatures down today. the marine layer that moves in throughout the morning will gradually clear out over the next couple of hours. we have to see what that smoke is in san jose. we'll check on that. let's get a look at temperatures today. we're in the low 60s and we are seeing the clouds and in some spots some fog. we'll be in the low 60s through 8:00 as it really starts to clear out in the south bay. the rest of the day is sunny and temperatures head for the mid-70s at lunchtime.

upper 70s for an afternoon high. and in dublin, expect it to reach the low 80s today with napa in the low 70s. novato reaching 79 degrees. tomorrow look at these temperatures, spiking quite a bit. that's when we start the warming trend, reaching the peak for friday and saturday. it's going to be much hotter with low 90s in the tri-valley, mid-90s for concord and santa rosa reaching 93 degrees, while still nice and cool in san francisco. mike, you're tracking a crash. >> the bay bridge is backed up right here at the toll plaza, not just because of the metering lights but because they've likely been slowed. there's a crash on the span itself reported in a middle lane and there may be a secondary crash as you head toward treasure island. there may be something else going on near fremont street, but traffic is held over the first half of the bridge and that allows folks to do work in san francisco. that will be a major concern if they don't clear it quickly. so far the eastshore freeway and the maze looking fine.

there's an oil spill that will affect folks heading through vallejo from american canyon. then in the south bay, a highway transition ramp that is closed right now, sought 880 to south 280. they're doing structural investigation. i'll follow up on that. we also have slowing on 101 and nearby there was a big crash on surface streets. for that one i'm going to hand it back to you. that sadly is the breaking news we are also following from overnight. the tragic late-night accident that happened in the south bay. three people struck by a car. police say an infant was killed. "today in the bay"'s kris sanchez is live at the scene in east san jose this morning. two of those victims were children, i understand. >> reporter: yeah, you mentioned that the baby was killed by that speeding -- we don't know if it was speeding, we do know there was a baby that was killed in this crash. we know a juvenile, either a child or a teenager was sent to the hospital along with an adult. those two people are expected to survive. but the baby did not.

they were all here on king road near ocala avenue in east san jose about 11:40 last night. san jose police tell us the baby died at the scene. the juvenile and the adult are in the hospital. they have non-life-threatening injuries. though we know that neither of their lives will ever be the same. police tell us the driver remained at the scene and is cooperating with the investigation. one neighbor tells us she's shocked by the loss of life, but not surprised by the crash on the streets she says have gotten more and more dangerous in her 55 years living here. >> people cross these streets every day and cars are always trying to beat the light. everyone is rushing. sometimes there's traffic, especially down the street, and everyone always -- they're always rushing and, like i say, trying to beat the light. then they turn and sometimes they're not even watching if there's people crossing the

streets. it's bad. it's just really bad. >> she's not wrong. vision zero, san jose's program to reduce traffic fatalities, identified ocala avenue as a priority safety corridor and, in fact, the corridor did qualify for a half million dollars for improvements, safety improvements. it's unclear at this point whether or not that has happened. i can tell you that based on the statistics for the city, speed was a factor in about one-third of deadly crashes, so if you can slow down, you might just save a life. the baby, 27th person to die in a traffic fatality in san jose and all of last year 32 pedestrians were killed on city streets. kris sanchez, "today in the bay." >> not good numbers to report there, hearing more and more of it. we've all got to slow down. thank you. we did send out a push alert on this breaking news overnight. you can get updates by downloading our free nbc bay area app.

developing this morning, former president donald trump lashing out at critics after a bombshell announcement saying he's a target into the probe of looking into the january 6th insurrection. drew petrimoulx is live in washington and either way it really seems like this is a big political opportunity for his rivals. >> reporter: yeah, good morning, marcus. the circumstances here are truly extraordinary. a former president facing a barrage of legal action as he remains his party's front-runner for the presidency. donald trump in a town hall on fox news tuesday accusing the department of justice of targeting him for prosecution to keep the farmer president from returning to the white house. >> it's interference with the election. it's election interference. never been done like this in the history of our country and it's a disgrace. >> reporter: trump says he got

official notice from the doj that he's the target of a grand jury investigation into the six riot at the u.s. capitol and efforts to overturn the 2020 election. the letter coming from the office of special counsel jack smith. >> he has made it abundantly clear that donald trump will be charged in connection with january 6th. >> reporter: legal analysts say charges could include in citing an insurrection and conspiracy to defraud the u.s. government. trump already faces charges over his handling of classified documents and hush money paid to adult film actress stormy daniels. a grand jury in georgia is preparing to hear evidence of election interference in that state. >> we can't keep dealing with the negativity. >> reporter: some opponents using the news to step up attacks and others echoing claims of a political prosecution. >> today i think the doj continues to try to find a way to weaponize its powers against a former president.

>> reporter: so far trump's legal woes are not hurting his status for the nomination, setting up the high-stakes jury trials as campaigning kicks into full gear. now, a federal judge in florida will soon decide when the case concerning former president trump's handling of classified documents will go to trial. that case involving hush money payments to stormy daniels is set for trial in new york in october. reporting from washington, drew petrimoulx. back to you. >> a lot to keep up with. thanks for that update. it is 6:07 right now. defense attorneys for the suspect in the violent attack at nancy pelosi's san francisco home are scheduled to argue today for a change of venue in the upcoming federal trial. david depape is accused of breaking into pelosi's pacific heights home last october and striking her husband, paul pelosi, in the head with a hammer. depape pleaded not guilty to federal and state charges. the federal trial is expected to

take place first. that trial is scheduled to start in late october. new this morning, a southern southern california city divided, this in the wake of conservative school board members rejecting curriculum mentioning bay area gay rights pioneer harvey milk. >> excuse me, where is my yellow card? where is my yellow card? you said i would get a warning. >> people on both sides packed last night's chaotic school board meeting. speakers were escorted from the room several times during the lengthy public comment. the controversy playing out in the city of temecula. it surrounds a three paragraph mention of harvey milk in text material for grade school students. >> you guys are trying to exclude curriculum based on an organization that deals with communism. you are well within your authority to exclude this curriculum. >> you want your world view to be the defined world view of our

community. we are a diverse community full of every walk of life, nationality and sexuality in this city. for you to believe in only representing those who voted for you, that's not governing. >> governor gavin newsom recently stepped into the battle. he calls it a case of cancel culture going too far, suggesting the radical conservatives are rejecting text used by hundreds of thousands of students. state attorney general rob bonta is also requesting background on the district's decision. it is 6:09. taking a break from the day's news and a live look outside. looking for someplace cool? why not head to san francisco. kari has a look at our temperatures across the bay and it's actually been a little milder. >> it's been milder and it's all thanks to the fog and the low clouds that we're seeing starting out this morning. as we take a look at santa rosa, it's at 54 degrees right now. nice and cool start to the day. we're going to see that marine layer lifting and clearing out

for the interior valleys, but hanging on to the coastline and san francisco. so we're looking at a trend where temperatures start to warm up by late morning going into the afternoon, and around the bay we're going to see a wide range in temperatures with brentwood hitting 100 degrees again today. in gilroy we're in the upper 80s and it's going to be comfortable in oakland with upper 60s for this afternoon. we'll get a look at hotter valley temperatures in our forecast coming up in a few minutes. mike has a look at where we can find lower gas prices. >> livermore is back amongst the top ten best scores for the state -- scores, i should say prices. $4.09, things are moving around in the rest of the areas. diamond gas and mart we're calling out in livermore, $4.09. solano county it's vallejo, the low is shell on tennessee street at $4.11. in san jose we have $4.19 at express gas and mart on redmond. thank you for reporting through gasbuddy.com. on the roadway we're talking

about the south bay. south 880 the transition ramp reportedly is still on the grid as closed because of an earlier crash that may have involved structure. some inspection work going on. you can still use the alternate, exit south 880 and go past the malls there, take winchester down and around to south 280, then get back on about your way. you should still be able to get through the area. the surface street not totally congested. the bay bridge, look at the hov lanes at the bottom. they are all backed up as well. it's not just the metering lights but an incident on the span that is causing an issue. there's a crash at treasure island and we continue to track that. back to you. 6:12 right now. talk about getting a charge from your electric car. coming up, new technology being tested in california that may one day allow you to get paid for all the excess power in your car battery. your boss telling you you

good wednesday morning. right now at 6:15, as you head out in martinez, it's breezy but all clear. and it's going to be a cool start to the day, really nice through late morning into early in the afternoon. it will be a little warmer today as those highs reach into the low 80s. we're going to have hotter weather in our forecast by the end of the week. i'll show you that in a few minutes. the bay bridge is packed. we have one, possibly two crashes on your way into san francisco out of oakland, across the span, that may send folks toward the san mateo bridge. you do see the traffic is flowing pretty standard for a wednesday. there's flashing lights, a look at that mid span. it's in the service lane and that may be an issue as crews arrive on scene. it's amazing what we see from all of our cameras stationed across the bay area. as we take a live look outside, there's a fire investigation that is going on in san jose.

breaking news we're following, a fire near the intersection of storey road. if you're not familiar with the area, it is close to happy hollow zoo. we do not know what is on fire. crews are on the scene but it seems at this point that it is very small, it's a smoky shot you see. but earlier there was some billowing black smoke. we're going to try to investigate and find out exactly what was burning. but a fire in the san jose area very close to happy hollow park and zoo. well, good morning. very happy wednesday to you. the british government says this morning inflation there has fallen to just under 8%. fallen to 8%. compare that to our headline inflation at 3%. a san francisco company called

tempo is laying off half its staff according to papers filed with the s.e.c. it's trading at 32 cents. so low we had to go to the extra decimal place to find positive gains yesterday. microsoft hit an all-time high as it announced a new subscription service for artificial intelligence. meta, which has been so focused on the metaverse it changed its name from facebook, is jumping on the ai bandwagon, offering its own artificial intelligence programming, open source, available to anyone. that means anyone can reprogram, readapt their ai to their own needs. now, the upside is we can see some really interesting new products. the downside, people worry it could be used by bad guys like spammers to flood your email, your text messages until the systems are useless. meta says its put guardrails in place. there's a new bipartisan effort in the u.s. senate to bar some government workers,

including members of congress, from buying stocks. they would be able to buy index funds and mutual funds. you have no control over those. a recent survey by the university of maryland says 80% of americans support the idea of barring members of congress from buying stock. the biden administration, meantime, has new rules and guidelines for companies that want to buy other companies. these rules tell the ftc when to move to stop a merger. it doesn't mean the ftc is going to be successful in court in their attempts to stop those mergers, in fact, the ftc has kind of a lousy track record recently on that. but setting the new rules gives the companies thinking about buying a rival a heads-up they'll likely be sued. and google is experimenting with a new program cutting employees off from the internet accept for things like email and calendar, the things they need to do their jobs. it's not punishment. it's a way of securing systems from cyberattacks. if the employee isn't connected, he or she cannot be hacked.

it's a trial run, only like 1,000 employees are participating to see. but if you're a programmer or hr or something like that, there would be no particular reason you needed the internet. >> right. >> and lots of jobs you're not supposed to look at the internet. it doesn't mean you don't. >> it goes to the story you were mentioning yesterday, where sometimes the back door, people go in. >> absolutely. and you remember what happened to sony, just destructive, yeah. >> thanks, scott. what about this? imagine getting paid for some of the surplus power from the battery on your electric vehicle. that's exactly what pg&e is now testing through the process known as bidirectional charging. it would allow ev owners to sell some of their car's stored power back to the utility. the eventual goal is to give the grid a boost on high-demand days. pg&e says the technology would help make california more efficient in storing its clean energy sources. >> through the charge management software they can decide how

much and when. it's going to serve almost as a mobile battery. >> we're trying to mimic what the conditions could be and also mimic what driver constraints might be. >> pg&e is testing out the technology with bmw to launch a pilot project later this year. they're hoping to sign up 1,500 homes and 500 businesses. as long as you've got enough power to get around. well, maybe this morning will be someone's last morning not to be incredibly over the top rich. >> if you were hiding under a rock, did you hear this? there's a billion dollars up for grabs in tonight's power ball drawing. tonight's jackpot is the third largest in jackpot history and it follows another miss in last night's mega millions drawing, because no one hit all six numbers. that jackpot will roll over to $720 million for friday's drawing. at the same time, two bay area stores did sell lucky tickets matching all five numbers without last night's mega ball.

morgan hill. we move toward the east bay where we're ranging from 69 in oakland to 86 in martinez. danville hitting 88 degrees and 90 in antioch. then for the coastline, upper 50s this afternoon. san mateo reaches 75 degrees. we'll be in the mid-60s in the mission district in downtown san jose. in the north bay, temperatures reaching 97 in ukiah, novato headed for 82 degrees. a wide range in temperatures here, but there's been extreme heat as a large area of high pressure that has not budged for weeks is causing record high temperatures. phoenix today, 117 degrees. unbearable heat there. and every now and then that heat dome starts to nudge its way back toward california a little bit and causing our temperatures to go up. we're going to see that happen as we head through the end of the week. so we're going from upper 80s to upper 90s by friday and saturday. it's going to be a hot weekend,

but then we come back to more seasonable numbers early next week. and san francisco not seeing a significant warm-up here. we'll be in the low to mid-70s throughout the weekend. mike, you are reading the signs at the bay bridge. >> the hov lanes are starting to move a little better now. we have all of these, according to the metering lights, still slow. but the hov is moving better and the speed sensors showed there may be one crash clearing at treasure island. the disabled vehicle is cleared in san francisco, so we should see some improvement. >> thanks, mike. next, nbc bay area responds. >> a new school year is here and we are determined to help get kids on the right path with the right sool ch

possible, with children safe. also breaking right now, a deadly double shooting overnight in the east bay. new information just confirmed by police. this is "today in the bay." good wednesday morning to you. i'm marcus washington. >> i'm laura garcia. we'll get to the breaking news stories in just a moment. first, let's get a look at that forecast with meteorologist kari hall. she's been monitoring the temperatures for us. >> and it's nice and cool this morning and it's going to be a really mild day across the bay area. still a wide range from the coast through the inland valleys, but in comparison of what's ahead, you'll enjoy it. let's get a look at temperatures as you get ready to step out the door. it's 60 in palo alto and 58 in napa, in gilroy we have some mid-50s right now and there's a few clouds drifting here and there. it's going to clear out quickly. by 10:00 it's all sunny, mid-60s and it will heat up into the upper 80s and low 90s. around the bay area we're seeing

temperatures from 59 in half moon bay to 71 in san mateo and 86 today in concord. mike, you're seeing a tougher drive this morning. >> we've had issues on the span. look over here, the bay bridge backup as you're coming down the berkeley curve. that's a very big backup forming over the last few minutes. very slow across the span. there were a number of incidents on the span itself. the bridge crew was notified about the last one. the speeds are recovering. now with the green from the toll plaza and the metering lights all the way up to the treasure island area, i believe the crashes have cleared and they should speed the metering lights up. there's a build at richmond heading toward san rafael. i've circled west 80 that's unusually slow. oil still in the middle lane approaching westbound 37 and heading toward the carquinez bridge. back to you. we want to start with breaking news for you from overnight. police are investigating a double deadly shooting in east oakland. this happened on 89th avenue

near d street. police are confirming both victims who were shot later died. they're still not saying what led to the shooting or if they're still looking for a possible suspect. also breaking this morning, three young boys safe after the chp issued an overnight amber alert. >> "today in the bay"'s bob redell is live for us at the chp office in vallejo. bob, talk to us about what happened here. >> reporter: good morning to you. law enforcement says that the three boys were abducted by their father at around 7:45 last night here in vallejo. chp issued an amber alert at 2:45 this morning and then a short time later, around 4:00 this morning, the father was taken into custody and they said the boys are safe. there are no details on how they were found. it's not clear if the father and boys were found as a result of that amber alert. chp says the father, his name is

damian castenada. again, no longer is there an amber alert. the father is in custody and three boys are safe. reporting live, bob redell, "today in the bay." >> thank you very much for the latest there. in the meantime, chp is investigating what appears to be the second freeway shooting in oakland in five days. in this case, the victim actually showed up at a nearby hospital without ever calling 911. but that person later told authorities it happened yesterday afternoon on interstate 980 in oakland near 18th street. we drove through that corridor last night after investigators had left. the shooting victim suffered non-life-threatening injuries. again, this is oakland's second freeway shooting investigation in less than a week. an 8-year-old boy is still in critical condition after being struck by a stray bullet last friday on interstate 580. investigators say he was caught in the middle of a gun battle involving people in two other cars.

police are still looking for the shooters. new at 6:00, a new and stronger strain of fentanyl tied to dozens of overdose deaths in san francisco. a medical examiner reporting, and it finds that dozens of overdose deaths last year contained a new street drug called fluorofentanyl and it can be five times as powerful as xylazine. we also found in 15 deaths, so far this year more than 400 people have died in the city have accidental drug overdoses. san francisco transit leaders are urging the state to tap the brakes on plans to expand the number of robotic taxis operating in the city. four companies now have permits to operate in certain locations. four additional companies have permits to test driverless vehicles. the dmv issues the permits and state puc regulators recently

postponed their vote to expand the driverless car services. at last night's meeting mta directors urged the state to collect more data before allowing any expansion of current fleets, questioning the safety of their automated technology. the mta reports more than 90 complaints from driverless cars in san francisco over the recent two-month period between march and april. so it's time to get ready because mayor taylor swift is coming to town. this, after santa clara leaders approved a proclamation to name the superstar honorary mayor and change the name of the city to swiftie clara. it's to honor her for the visitors she's attracting for the two sold-out tours. the tour arrives july 28th for two sold-out shows and surrounding hotels are booked

solid. the owner of santa clara's sterling inn says he gets at least ten calls a day from fans still trying to book a room. >> most of them, they book november and december 2022. that's more than six months. >> levi's is promising increased security at the gates and in the parking lots and they remind everyone tailgating is prohibited and fans without tickets will not be allowed in the stadium lots. now to a live look outside overlooking san jose. kind of a cloudy start to our wednesday morning, midweek. kari has been keeping tabs on the temperatures for us. >> we're midweek, but actually at the bottom of these temperatures before it heats up, leading into the weekend. so this is part of the reason why we're enjoying a nice cooldown for much of the bay area. san francisco seeing clouds and fog. we'll see peeks of sunshine today but that keeps those

temperatures in the low 60s there for today. but there will still be some areas heating up. take a look at the range in temperatures around the bay area. in oakland it will reach into the upper 60s, upper 80s for gilroy and we're back to 100 degrees in brentwood for today. so you can see that it's just really dependent on where you are as to what kind of weather you'll see today. but it's really going to start to heat up tomorrow and we'll talk more about that in a few minutes. mike, you're seeing a positive change at the bay bridge? >> absolutely. the live camera shows us, this is what we're talking about. the hov lanes are all clear now. the other lanes, of course, are backed up. hov, the big advantage, that means the span itself is moving smoothly and it did recover after the earlier crash. i think the last of them is cleared at treasure island. the crash and oil spill cleared for west 80, but that will release more traffic down the eastshore freeway. we'll monitor that closely. counter-commute it is eastbound highway 4 through the construction area which is typically slow anyway. we have another crash at

slow things down just a bit. we're watching the build for 92, recovery for 880 and what's going on for the transition route. a cyclist is dead in the south bay this morning from a freak accident. it happened yesterday afternoon in gilroy on roop road south of coyote lake par where chp is saying a large, falling tree branch landed on top of that cyclist, killing her. her identity has not been released. a live look at sfo and a possible solution to solve the airline industry staffing crunch, raising the retirement rage for pilots. right now it's 65. congress is debating extending it by two years. many of the most experienced pilots say their skills are far more advanced by age 60, but the pilots union opposes the change, arguing younger pilots have fewer health risks. the fact is, there are a lot of

trial on those federal felonies? trump's lawyers argued he's busy running for president but that's not really a legal reason not to have a trial. they also pointed out trump will be on trial in new york in october. both sides are concerned about the amount of evidence they have to comb through. we learned yesterday the prosecution has more than a thousand days of surveillance video from the mar-a-lago cameras. that is three years of video. meantime, the state of michigan has filed charges against 16 people who claimed they were michigan's official electors in order to award the state's electoral votes to trump, even though biden won michigan. >> that was a lie. they weren't the duly elected and qualified electors and each of the defendants knew it. they carried out these actions with the hope and belief that the electoral votes of michigan's 2020 election would be awarded to the candidate of their choosing instead of the candidate that michigan voters

for those upper elevations. we had storms developing yesterday and now things are quieting down. but we've also, because of the storms and the lightning, have seen wildfires being sparked across the region. there's one if particular that's worsening our air quality here in the bay area. it's in southwestern oregon, called the flat fire, and the smoke has been surging directly into the north bay. you may have seen it look a little hazy, especially as you look in the distance toward the hills. and that's the reason why. so near surface smoke conditions to move in for today, even as more people are getting outside to enjoy the milder weather. in cupertino we'll see a high of 84 degrees today and reaching 89 in gilroy. for the east bay it's in the upper 80s, 74 in hayward, nice and comfortable there. and also looking good in redwood as temperatures warm up to 78 degrees, compare that to the 59 in half moon bay. you can see just how a short drive can really change those temperatures. in the mission district today, it will reach 65 degrees and

then for the north bay, santa rosa reaches 83 and ukiah will see a high of 97 degrees. in comparison to the heat we've seen across a large swath of the west, there's a heat dome causing a long stretch of record-high temperatures and it's not budging very much. so phoenix today heading back to 117 degrees. every now and then that heat dome nudges its way a little closer to california, causing our temperatures to go up. we're going to see that happen this weekend, in napa going from uppe 80s today to mis, and then triple digits for friday and saturday. so there will be some really hot s inland and then those temperat start to come back down early next week. a look at our seven-day forecast shows that those temperatures from this point on will be much hotter for the next several days. then next week it is looking a little better, but we have to make thr that wnd. sncisco wil be, once

south bay. >> that's right. san jose police are investigating a tragic late-night accident. we have a live look at the scene at king road near ocala avenue. for a time, nearby streets were closed. they're now back open. but this all happened last night when police say a car struck three people a little before midnight. a baby died at the scene. police say another juvenile and an adult were also struck, but both are expected to survive. we know the driver remained at the scene but police are not revealing more details about the ongoing investigation. breaking overnight, police investigating a deadly double shooting in the east bay. this happened on 89th avenue near d street. police are confirming both victims who were shot later died. they're still not saying what led u to the sing o if they're still looking for possible suspects. three young boys are safe, one man in custody after the chp issued an overnight amberalert. the father, damian castaneda is
