with kari. it's going to be nice in san francisco. we'll see temperatures that will be slightly warmer for the inland areas. as we take a live look out there, starting out with just a little bit of fog this morning, we may see a little more as we head into the next few hours. as you get ready to step out the door, temperatures ranging from 55 in san francisco to 56 in oakland and it is 62 in san jose, 62 now in concord. as we zoom into the south bay, we can see our high temperature for this afternoon going up several degrees compared to yesterday, so san jose in the upper 80s, mid-90s for the south county, and we'll also see mid-90s for the enter your parts of the east bay. we'll get a look at what's ahead with cooler air in our forecast in a few minutes. mike, you were looking at a clear view of the bay bridge. >> that's right, so the opponents can stare each other down, the bay bridge series will be tonight and tomorrow. we're looking at a smooth drive right now. clear view here, maybe a little different at golden gate bridge

where crews are moving northbound as well as some fog rolling in. i do have one issue showing up on the chp report and it may show up on your roadway, north 680, reports of about a half a dozen flares. i'm not sure why. there's no incident. they should burn out, but it will at least be a distraction. i'll monitor just in case more information does show up heading north toward the walnut creek interchange. the rest of the bay is looking pretty calm right now. developing this morning, the u.s. border battle with texas escalates after the justice department sues texas over the floating barrier installed to deter migrants from crossing illegally. >> brie jackson is live in washington with the latest. the two sides, what are they saying today? >> reporter: good morning. well, the biden administration is demanding that texas remove the buoys, calling them unlawful and dangerous. meanwhile, a defiant texas governor greg abbott is vowing to keep them in place.

the justice department suing texas over this floating barrier at the u.s.-mexico border, asking a federal judge to force the state to remove the buoys at its own expense, after republican governor greg abbott refused to commit to doing so. >> he continues to do this really cruel, unjust, inhumane, with a system that has been broken for decades. >> reporter: governor abbott firing back at the biden administration, writing texas will use its constitutional authority to deal with the crisis you have caused. texas will see you in court, mr. president. >> the buoys are a deterrent and i think it's a positive deterrent, but it's one, once again, a quarter of a mile out of over 1,000 miles of border. so it's really the shiny object. >> reporter: republicans insist the white house is not doing enough to protect the border, even though crossings are down.

structures. everyone inside the outside made it out safely. a former north bay pastor is in custody in connection with a decades old cold case murder in pennsylvania. 83-year-old david zandstra was served at a church in fairfield and he's now confessed to a 1975 unsolved killing after being shown new evidence. he's being charged in the kidnapping and murder of 8-year-old gretchen harrington, last seen walking to bible camp. investigators say zandstra offered her a ride and later killed her. from 1990 to 2005, zandstra was the pastor of fairfield's christian reform church according to the church website. the church has released a statement saying we recognize we live in a broken and sinful world where violence can happen anywhere, even within our churches, and by those we hold to the highest standards. happening today in san francisco, a homeless man accused of a violent beating in april is scheduled to be arraigned. garret doty is accused of

beating don carmignani with a metal pipe. the judge ruled there's sufficient evidence for the case to move to trial. doty's attorney called it a case of self dense saying carmignani has a history of using bear spray on people which his attorney denies. the push to crackdown on open air drug markets is paying off. police announced what they called a million dollar drug bust and it came from a police investigation after a surge in drug activity in west san jose. officers found drugs, including 1,000 fentanyl pills, cocaine, meth and adderall and guns. mayor matt mahan calls it a great first step, but there's still a lot to do. >> we need more staffing levels to do more community policing, more investigations that can

lead to these kinds of busts, more follow-up investigations. >> police released booking photos of the two suspects that were arrested in that bust. it's a 24-year-old and 19-year-old, both of san jose. they are being held on $5 million bail. happening today, health workers across california start four days of picketing outside various kaiser facilities, they're planning outside san jose, richmond, antioch, san leandro and vacaville, protesting what they call unsafe staffing levels, impacting patient care as contract talks continue. medical services will not be impacted. in a statement, kaiser says in part, we are currently bargaining with kaiser unions, given where we are in the process, it's clear the picketing by the coalition isn't about drawing attention to new issues but an attempt to create bargaining leverage. it adds, we will reach a great agreement. we want to take a live look

outside, san francisco, a nice little blanket of fog there. hopefully keeping things cool. we need a break. >> san francisco has had nothing but a break, we haven't seen much sunshine there for warm weather but it's been hot in the valleys and we've seen temperatures spreading out across our microclimates. today will be another warm one for san jose, and looking at our high temperatures, we're going to be in the mid-80s for the south bay, the tri-valley reaching into the low to mid-90s, the peninsula will be in the upper 70s, and san francisco will stay in the 60s today, while the north bay heads for the upper 80s, east bay is going to be up to about 80 degrees. so we'll talk about a cooling trend in our forecast in a few minutes. mike has a look at where we can find lower gas prices. >> yeah, the low is kind of rising like the tide. the prices are going up. south bay, we'll call out the best price in cupertino, $4.25, cupertino car wash on north de

salaries at google, it shows they make a lot of money. median pay $280,000. let's talk about the s&p 500. this is within a few hundred points of erasing all the losses caused by high interest rates and fears of recession. the stock market has boomed in the last year or so. the fed meets today, starting a two-day interest rate meeting. you probably knew that nearly all brands of sunglasses are made by the same company. a new lawsuit in san francisco federal court accuses ray-ban and oakley of scheming with competitors to artificially inflate prices. the company has not responded. plaintiffs are hoping the judge will make it a class action. it has a long list of brands, armani, chanel, all made by the same company, coach, michael kors, ralph lauren.

other news, san francisco police temporarily stopped twitter from taking down the twitter sign. twitter didn't have a permit and didn't block off the sidewalk to prevent anyone getting hurt by falling debris. remember, they're changing the company to x, just x. tweets will be called xs, according to elon musk. no more tweets or little blue bird. jack dorsey x'd that he was okay with the end of the bird. he said it carries a lot of baggage but all that matters is the utility it provides. elon musk, the new owner of twitter, says he want to evolve this app into the everything app like wechat in china. the chinese use it to pay for mass transit, schedule a doctor, text their friends. musk envisions twitter, x, as that kind of online wallet. the big question, though, would you trust a company with your money that has done things like this? take a look.

going to clear out fairly quickly today and definitely in time for the game tonight, as we head over to martinez we're going to start out with a few clouds, temperatures in the mid-60s. as we go throughout the day, we'll go from mid-60s to 70 degrees at 10:00, once the sky clears it's going to be nice throughout much of the morning. then we'll head for the upper 70s at noon. as we zoom into the south bay, san jose will be hotter today compared to yesterday, reaching 87 degrees. now, we head down to morgan hill, 94 for this afternoon, and the seven-day forecast is already up at the bottom of the screen as we take a look at some cooler temperatures coming our way after today. we're going to reach up to 93 in pleasanton this afternoon, vallejo reaching 85, and we'll see low 60s for half moon bay, while redwood city will reach 85 degrees. so you can see over a short distance temperatures change drastically, and so you do want to be prepared with a jacket,

shorts, sunglasses, sunscreen, just depending on where you are. temperatures head for 95 in ukiah, much of the north bay will reach into the low to mid-90s and then we see the high pressure that's causing the high heat, it's going to start to move off toward the east a little more and we'll see a trough moving into the pacific northwest. that's going to bring in a stronger ocean breeze and cooler temperatures. our seven-day forecast shows we'll reach into the low 90s today but the rest of the week we're in the upper 80s, so it comes down a few degrees. in san francisco, we're staying mostly in the 60s throughout the week, although it looks like we'll see the clouds clearing out a little more quickly for today. mike, you're checking out the early commute. >> is early commute looks standard, kari, coming out of the altamont pass a little slowing off 580. 205 sees more traffic when it's joined in by 580, which looks light. it clears up once again after

5:24 now. nbc bay area responds to a grandma who paid a four-figure bill twice. >> she asked consumer investigator chris chmura's team to help straighten it out. >> this is betty in vacaville. she is 91 years old and has a macy's account. she tells us she goes to the store in person to pay. betty says she paid her $5,246 balance with this check. here is the thing, she says macy's cashed that check, then

hear about the hotter forecast. >> well, then maybe it will be a little cooler if you head to the coast. let's start out with a look at the forecast. meteorologist kari hall is tracking everything we can expect. >> it's going to be a nice day for some, for other areas it will be hotter this afternoon. walnut creek is one of those places that's going to be warmer compared to yesterday. we're starting out clear here and we head over to antioch where it is 70 degrees to start out your morning. also breezy. and we're going to see winds picking up. as we head toward noon, it will be in the mid-80s. i think any outdoor activities you want to try to get done early but it will depend on where you are because temperatures spread out from 93 in the tri-valley to the mid-80s in the south bay, and we'll see upper 60s in san francisco, the east bay reaching about 80 degrees. we'll get a look at all of our microclimates and talk about cooler air ahead. mike, you're checking out oakland. >> this is my job right now in the morning as things ramp up,

you just look at the cameras. beautiful view. let's look at the speeds through oakland. no major issues. travel times are listed at the bottom. there are no major delays. oakland, the nimitz, the freeway on the bottom, the eastshore freeway coming down, that's 16 minutes. the lowest number we typically see through that stretch is 14 minutes. i did notice there's a little slowing through richmond. it might be a little early for the commute to start building there, but nothing is impossible on the eastshore freeway. we'll track that. no reports for west 80. san jose shows a little blip for 101 north. back to you. developing this morning, alameda county's embattled district attorney is defending herself from new criticism this time from the livermore police chief. >> "today in the bay"'s pete suratos joins us in the newsroom. this dispute surrounds one particular case, correct? >> reporter: that's right. good morning to you. the livermore police chief says he's not pleased with the current charges by the da for

this case and he made this very clear in a letter that he wrote to the da. according to livermore police, they say that 21-year-old colby berry robbed two women at gunpoint and violently attacked one of them for more than 30 seconds before stealing their purses. berry was on parole when this took place. they say his court-ordered ankle monitor showed he was at the scene of these robberies. livermore police eventually arrested berry at his parole office in oakland and the police chief wants the da to add special enhancements for specifically use ago firearm and being a repeat offender. here is chief young talking about the need for enhancements, as well as a video statement by da price explaining her objection to these enhancements. >> if you have a record of committing violent crimes and you do it again, then there's more of a consequence. >> overusing enhancements has led to alameda county having the

fifth largest county jail in the world. >> reporter: so you have the da's office saying berry is facing criminal charges that could result in 13 years behind bars and if they follow the chief's advice, it could result in 50 years to life. berry still is in custody with bail set at $360,000. the da did mention they plan to meet with the police chief next month. >> thank you, pete. san rafael police and the department there are the subject of a new civil rights lawsuit alleging excessive force. it stems from an incident last summer involving two san rafael officers who marin prosecutors recently charged. body camera video shows the officers take down julio jimenez lopez, who was holding a can of beer. he ended up bloody and was taken to the hospital. prosecutors later dropped the

charges. attorneys claim the officers beat their client unnecessarily. >> he's taking it a step further to fully press his rights under federal civil rights laws to be compensated for his traumatic brain injury, his shoulder injury, the surgery he's had, his posttraumatic stress disorder he's been living with. >> last month prosecutors filed criminal charges against the officers, including unlawful assault and making false statements. they're scheduled to appear in court next month. san rafael's police chief says his department is cooperating with the da's office. a new warning for e-scooter owners after a fire ripped through a san francisco apartment. it happened yesterday morning in the tenderloin. the two people inside that apartment managed to escape through a window, but firefighters say one of them did suffer burns. firefighters now believe it was a lithium-ion battery that started the fire which ignited while being charged on the scooter. >> there could have been better

placement and safety precautions, but it's obvious that these two individuals had an escape plan and had practiced that plan. >> the owners say they were charging the battery near their front door, which firefighters advise against. they also say not to leave the scooter or any other battery like that unattended. happening today, elon musk is promising to virtually appear in the first-ever pg&e innovation summit. the summit takes place at the road house conference center in san marrone. pg&e is bringing together entrepreneurs, policymakers, thought leaders and leaders in national research labs and agencies to talk about the new climate resilient energy systems of tomorrow. the conference kicks off at 9:00 a.m. another battle of the bay is happening tonight with the san francisco giants hosting oakland a's at oracle park. >> but the battle in this series is off to kind of a bittersweet start as we know it could be the last one. ginger conejero saab is live in san francisco, and this year some a's fans are also hoping to

deliver a desperate message. >> reporter: that's right. try to imagine this scenario, whether you're a giants fan or an a's fan, try to put yourself in a position of being a baseball fan who is about to lose their home team, that's on the brink of losing their home team. that's the pitch from a's fans, who are trying to unite bay area baseball fans in this move to -- in this move -- in this move to ask for some help. a's fans are asking their counterparts across the bridge to help them unite the bay in protest against a's owner john fisher who plans to relocate the team to vegas. >> it's something that's really important to baseball, important to the bay area, so along with the oakland 68s and the last dive bar, we're planning a unite the bay where fans come out to

oracle park, have a good time and voice frustration about a's ownership and their decision to and attempt to relocate the team. >> reporter: it's been quite the saga. you remember back in june the nevada state legislature approved hundreds of millions of dollars to help fund the new a's stadium in vegas. over all-star weekend, which happened earlier this month, oakland mayor sheng thao tweeted she secretly met with the mlb commissioner to talk about the relocation of the a's. while this relocation is set to be poised to happen, fans say they're not losing hope in their pitch to have other fans join them, they say they're going to keep pushing and fighting until shovels are in the ground. tonight's game will be similar to the reverse boycott game at the coliseum back in june as well. they'll be giving out sell t-shirts, but this time in black. there are also going to be posters with instructions on

we're starting out with fog and that's going to clear out for sunshine for the rest of the day. take a look at this gorgeous shot as we're starting out our tuesday morning. this will lead us into a really comfortable day. we'll be at 64 degrees at first pitch and then this evening dropping into the upper 50s. it's also going to be windy. if you're out there, make sure you have on lots of layers because it's going to be very chilly in oracle park. but then as we compare that to what we'll see around the bay area, the tri-valley headed for 93 degrees for today, while the south bay will reach into the mid-80s. up and down the peninsula in the upper 70s and we'll see upper 80s for the north bay, the east bay will be mild with a high of about 80 degrees. we'll be even cooler for the valleys over the next few days. we'll talk more about that in a few minutes. mike, you're seeing slowing in the south bay. >> typical spot. so this stretch of 101, a little more than yesterday, of course, the build and the traffic should be more than yesterday and perhaps reaching a peak for the week on wednesday, tomorrow.

we're looking at no surprises. what's ahead, more traffic coming out of san martin, north 101 shows the slower sensors and that means more traffic is building heading toward silicon valley. as we look out a little farther, that's tonight, we have those closures and pavement work going on and there will be road work for one or two lanes through this area of san leandro, east 14th or state route 185. we haven't seen any problems, just locals through the area need to know that between 580 and 880. and over here, this will be the bay bridge series tonight and tomorrow, so there will be crowds throughout oracle park and lots of fans for both teams supporting the locals, the giants as well. but i say they host because it's the a's/giants game and that will mean more traffic back and forth across the bay bridge. but right now we have a little build and holding steady for richmond. back to you. coming up on "today in the bay," a lot of american families have trouble finding mental

good morning. it's going to be warming up in the inland valleys today, especially for the east bay and south county, but at least we do have our cool start. in the low 60s for the next couple of hours and then we'll head for 80 degrees at lunchtime and 90 degrees at 4:00 today. you can see the warm-up, but we'll also have cooler temperatures in the rest of the forecast. a look at that in a few minutes. i like the cool start, i like the easy start as well for the san mateo bridge and that's what we're seeing. we're also starting to see more cars on the road that will mean brake tapping and slowing. i'll show you where there's a backup forming coming up. thank you so much. president biden will turn his attention to the nation's mental health today. >> scott, there are already laws in place to force insurance companies to help families, but that's not always happening. >> it's not always happening. good morning to you. that is certainly the white house's contention.

the biden administration gives the example of an insurance company that covers dieting classes for diabetics but doesn't cover a nutrition class for somebody with anorexia. one is physical health, one is mental health, but the law says these should be treated equally. president biden is going to sign an order demanding insurance companies keep track of what they pay for so they'll be more aware of when they break the law and fix it. the white house also points to two moms in california who recently went public with their struggles to get mental health care for their children. you may have experienced this yourself. you call your medical provider, you need some help, and they schedule you for your first visit in november. the president will sign a proclamation turning three sites into national monuments for emmet till, the young man murdered by two white men in mississippi back in 1955, after he allegedly flirted with a white woman at a store. the men were found not guilty by an all white jury and afterwards

will definitely be warmer for palo alto, reaching 88 degrees. it will be 68 in downtown san francisco and we are still seeing a big range in our microclimates around the bay area. santa rosa, napa today reaching 90 degrees. so we're seeing the high pressure, it's going to be with us and causing our inland valleys to really ramp up for today, but then backing off for tomorrow into the next several days, as an area of low pressure slides down the coast. it's going to bring back some more seasonable weather. we take a look at morgan hill. that will be hot today, but then we'll bring it back to upper 80s, which is about normal for this time of year, slightly cooler as we start out the month of august. so take a look at our seven-day forecast. it will be in the low 90s today and upper 80s for much of the rest of the week. and then san francisco will stay in the 60s, so not seeing a significant change here or along the coastline. mike, you're seeing backups

building. >> surprise, the bay bridge toll plaza, the metering lights turned on right on schedule. no big deal. the backup is coming off of the maze and off the eastshore freeway a bit. coming off the nimitz everything is moving smoothly, but that, of course, will build. we see that for the eastshore freeway coming down westbound 80, through the maze no delays for 24, 580 or 880, but 37 and highway 4 show that traditional pattern. remember, tonight's game will mean for cross-town and cross-bridge traffic because they're playing at oracle. we're looking at the south bay and the east bay with typical slow spots just building. back to you. happening now, san francisco police are still searching for the five people who walked away from a wild crash near mission delores park. video of that crash is now viral. it happened saturday when the car plunged down the sanchez street steps onto 19th street.
