temperature, and clearing out and really getting hot for the inland areas, the tri-valley reaching 93 and parts of the north bay in the upper 80s, while san francisco will be in the upper 60s for today and about 80 for the east bay. we'll get a look at some cooler temperatures for all of our microclimates coming up. mike says so far it's tuesday light? >> tuesday regular. actually, a little lighter because of the movement. over here at the bay bridge toll plaza we have the build i promised. over here, 880 off the over-crossing and the nimitz, all routes toward the bay bridge are filling in with traffic. no changes as far as the distribution for the slower sensor reads at the yellow, orange and -- there's no red right now. we're looking toward the tri-valley where there is red coming out of the altamont pass. that is typical slowing off of 205 where it merges with 580. 580 is actually lighter out of tracie, so we're close to a half

hour, 27, 28 minutes from marsh creek down to 580, the major commute route. developing this morning, the u.s. border battle with texas is escalating after the justice department sued texas over the floating barrier installed to deter migrants from crossing undocumented. "today in the bay"'s brie jackson is live in washington with the latest developments. brie, the two sides, what are they saying this morning? >> reporter: good morning, kris. so the biden administration is demanding that texas remove the buoys, calling them unlawful and dangerous. meanwhile, the governor of texas, greg abbott, the vowing to keep them in place. the justice department suing texas over this floating barrier at the u.s.-mexico border, asking a federal judge to force the state to remove the buoys at its own expense, after republican governor greg abbott refused to commit to doing so.

>> he continues to do this really cruel, unjust, inhumane ways of moving forward with a system that has been broken for decades. >> reporter: governor abbott firing back at the biden administration, writing, texas will fully utilize its constitutional authority to deal with the crisis you have caused. texas will see you in court, mr. president. >> the buoys are a deterrent and i think it's a positive deterrent, but it's one, once again, a quarter of a mile out of over 1,000 miles of border. so it's really the shiny object. >> reporter: republicans insist the white house is not doing enough to protect the border, even though crossings are down. >> it's just bad politics and somebody trying to appeal to a very narrow sliver of his right wing base. >> reporter: despite the dangers of making the trek, some are still taking their chances. >> translator: we are going to try to cross because, honestly, in venezuela we can't find a

safe future and we want something for our family, something good. >> reporter: as the legal fight ramps up, the fate of the buoys hang in the balance. and the justice department's lawsuit also alleges that governor abbott failed to obtain a proper permit before installing the buoys into the river, something that is required by federal law. >> it's a waterway separating two countries. thank you very much. 6:04. a former north bay pastor is now in custody in connection with a decades-old cold case murder in pennsylvania. 83-year-old david zandstra once served at a church in fairfield. authorities say he has now confessed to a 1975 unsolved killing after being shown new evidence. he's being charged in the kidnapping and murder of 8-year-old gretchen harrington, last seen walking to bible camp. investigators say zandstra offered her a ride and later killed her.

from 1990 to 2005, zandstra was the pastor at fairfield's christian reform church according to the church website. the church has released a statement saying, quote, we recognize that we live in a broken and sinful world where violence can happen anywhere, even within our churches, and by those we hold to the highest standards. san jose leaders say the recent push to crackdown on open-air drug markets is paying off. police yesterday announce what they called a million dollar drug bust from a sting operation after police noticed a surge in drug activity. officers found drugs, including 1,000 fentanyl pills, cocaine and adderall, and found three guns after serving a search warrant at a home on rubino drive. mayor mahan says it's a good first step. >> we need more staff levels for

more investigations that can lead to these kinds of busts, more follow-up investigations. >> police released booking photos of the two suspects arrested in that bust. 24-year-old omar box on the left and the 19-year-old, santos, both of san jose, are being held on $5 million bail. happening today in san francisco, a homeless ban accused in a violent beating in april is scheduled to be arraigned. garret doty is accused of beating don carmignani with a metal pipe with an altercation caught on camera in the marina district. the judge ruled there is sufficient evidence for the case to move to trial. doty's attorney called it a case of self-defense saying carmignani has a history of spraying bear stray on homeless people, which his attorney denies. health care workers began four days of picketing outside various kaiser permanente facilities. workers are planning protests outside kaiser locations in san

jose, richmond, antioch, san leandro, as well as vacaville. they are protesting what they call unsafe staffing levels impacting patient care as their contract talks continue. medical services, they say, will not be impacted. in a statement, kaiser says in part, we are currently bargaining with kaiser unions. given where we are in the bargaining process, it's clear the picketing by the coalition isn't about drawing attention to new issues, but rather an attempt to create bargaining leverage. it adds, we will reach a great agreement. new at 6:00 this morning, people are getting too close to the wildlife in santa cruz all to get a look at that sea otter stealing surfboards. the otter 841 has become a viral sensation known for getting pretty close to surfers, biting or stealing their boards. but now with all the attention, people are getting too close to other otters in their natural habitat. just last week leaders say one local photographer documented people breaking up a group of

about ten otters with some people getting within just a few feet of the animals. >> it's really important to be able to give otters their space and these photos show evidence that people were not following those rules. >> we're the ones that have invaded their homes and i think they should be left to be comfortable. >> wildlife leaders say getting too close can raise the otters' stress levels, giving them food is a terrible idea. if an otter notices you, you're too close. >> they're so cute, but stay away. let's check the forecast with meteorologist kari hall. it's nice because in the bay area if you need a cool spot you can certainly find it. >> definitely. especially with this round of the higher temperatures we've had recently. sometimes it heats up everywhere, but that hasn't been the case so far this summer. we take a look at gilroy where temperatures are cool to start,

in the upper 50s as you head out the door and try to get in those morning activities early before temperatures get hotter. by early in the afternoon it's going to start to feel a lot more uncomfortable. but we are keeping the fog and cooler weather near the coastline and san francisco will be at about 56 at 8:00. at noon it's 64 degrees, and reaching into the upper 60s for today. there will be still a big range in temperatures across the bay area, but it will be nice to get a cooldown for the inland valleys. so i'll have more on that in the forecast. it's coming up in a few minutes. hopefully you're seeing prices go down in your department, mike. wishful thinking. just like i wish the temperatures would go down. the south bay, these numbers holding steady, maybe going up a little more, unfortunately. south bay we're going to call out the best price in cupertino, $4.25 at the cupertino car wash on north de anza boulevard.

let's talk about the s&p 500. it's within a few hundred points of erasing all the losses caused by high interest rates and fears of recession. the stock market has really boomed in the last year or so. the fed meets today, a two-day meeting on interest rates. you probably know that nearly all brands of sunglasses are made by the same company. a new lawsuit in san francisco federal court accuses ray-ban and oakley, both made by luxottica, of scheming with competitors to artificially inflate prices. the plaintiffs are hoping it will be a class act. there's a long list of brands, armani and chanel, all made by the same company, coach, michael kors, ralph lauren, tiffany, all the same company, luxottica. san francisco police temporarily stopped twitter from taking down the twitter sign. twitter didn't have a permit, didn't block the sidewalk to

about 15%, with fewer homeowners looking to upgrade. one insider says first-time buyers are being squeezed the most. >> i'm finding that homes in the first-time buyer lower price ranges are more affected by interest rates, and when you get more into the luxury market of santa clara county, you find that people are paying a lot more in cash. >> while sales are much slower, median prices are still about the same. in june sales in santa clara county averaged about $1.8 million, a 0.3% decline year-over-year. move over power ball. the latest mega millions jackpot is starting to approach record territory. the jackpot for tonight's drawing will be $820 million and that will make it the game's fifth largest ever grand prize. a one-time cash payment will amount to $422 million. >> that will buy you a lot of

county in the low to mid-90s this afternoon. we're headed for 92 in danville while vallejo will reach a high of 85 and 77 in oakland. along the coastline no change for you. we're going to see low 60s in daly city and for san francisco headed for the upper 60s downtown. great for the game for tonight and the north bay will be hotter, mostly low 90s for the inland valleys, with sonoma reaching 93 degrees. the heat is here today and it's been pretty extensive across the region, all across the southwest, due to this high pressure. but we are going to see that moving away from us just a bit, just enough to bring back our ocean breeze and more seasonable temperatures around the bay area. take a look at morgan hill. it's not often that we see a prolonged period of temperatures that are right at normal for this time of year. we're going to see upper 80s starting tomorrow and continuing through the weekend. even lower 80s as we become in the month of august. so that's going to be a nice

>> this is betty in vacaville. she is 91 years old and has a macy's account. she tells us she goes to the store in person to pay. betty says she paid her $5,246 balance with this check. here is the thing, she says macy's cashed that check, then later told her they didn't get paid. so betty says she sent them a copy of the cashed check and thought she was done. fast forward four years, betty went to buy a home. her credit report showed a big macy's charge-off, a charge-off usually means a company didn't get paid, charged off the balance due, and flagged a customer's credit report. that's what betty was facing here. she said macy's charged off $6,409, including interest and late fees from not recording that check years ago. to close her new home loan, she had to pay $6,409 out of pocket. betty's granddaughter reached out to us. we contacted macy's. it said its credit and customer services team communicated directly with betty's granddaughter to resolve her concern.

and this is also tuesday morning. thanks for starting your day with us. i'm laura garcia. >> i'm kris sanchez. marcus washington is off this morning. we want in check in with kari for the forecast because we're trying to squeeze in summer plans. >> we were just talking about how school starts soon. >> no, no, let's not talk about that just yet. >> we've got these last couple weeks of summer before school starts and it's going to be anywhere from 90s in the bay area to 60s along the coast. so you pick your weather based on what you want today. as we take a live look outside in san rafael, it will be a warmer day. at 50 degrees right now and a few clouds here and there that will clear out quickly, going from 50 to 82 at 1:00 today. as we take a look at the range in temperatures around the bay area, we'll reach into the mid-80s in the south bay. for parts of the peninsula, in the upper 70s, low 90s in the tri-valley while san francisco will stay in the 60s.

i'll have more on the forecast in a few minutes. >> thank you. 6:32 right now. developing this morning, alameda county's embattled district attorney is defending herself from new criticism this time from livermore's police chief. "today in the bay"'s pete suratos joins us this morning. this dispute surrounds just one particular case, right? >> reporter: yeah, it does. the livermore police chief said he's not pleased with the current charges and he made this clear in a letter he wrote. according to livermore police, 21-year-old colby berry robbed two women at gunpoint, they say he violently attacked one of them for more than 30 seconds before stealing their purses. berry was on parole at the time for a shooting at a home in 2021. they say his court-ordered ankle monitor showed he was at the scene of these robberies. police eventually arrested berry at his parole office in oakland and now the police chief wants the da to add special enhancements for using a firearm and being a repeat offender.

here is chief young talking about the need for enhancements in this case, as well as a recent video statement by da price explaining her objection to enhancements. >> so if you have a record of committing violent crimes and you do it again, then there's more of a consequence. >> overusing enhancements has led to alameda county having the fifth largest county jail in the world. >> reporter: the da's office says berry is facing six criminal charges that could result in 13 years behind bars and if they follow the chief's advice, it could result in 50 years to life. berry is still in custody at the santa rita county jail with bail set. the da mentioned they plan to meet with the chief next month. >> thanks for the latest, pete. san rafael is its police department are the subject of a new civil rights lawsuit alleging excessive force that stems from an incident last summer involving two san rafael officers who marin prosecutors

recently charged. video shows the officers take down julio jimenez lopez, who was holding a can of beer. he ended up bloodied and was taken to the hospital. attorneys claim the officers beat their client unnecessarily. >> he is taking it now a step further to fully caress his rights under federal civil rights laws to be compensated for his traumatic brain injury, his shoulder injury, the surgery he's had, his posttraumatic stress disorder he's been living with. >> last month prosecutors filed criminal charges against the officers.

people inside the unit did manage to escape from a window but firefighters say one of them suffered burns. firefighters believe a lithium-ion battery started the fire which ignited while being charged. >> there could have been better placement and precautions, but it's obvious that these two individuals had an escape plan and had practiced that plan. >> you heard him talking about the placement. the owners say they were charging the battery near their front door. that's the placement that the firefighters advise against. firefighters also say don't leave your devices unattended as they are charging, and only use chargers which are approved by your e-scooter company. happening today, elon musk is promising to virtually appear in the first-ever pg&e innovation summit. it takes place at the conference center in san ramon. pg&e is bringing together entrepreneurs, policymakers, research leaders to talk about the new climate resilient energy systems of tomorrow. that conference will kick off at

we've seen recently in san francisco. we're going to start out with temperatures in the mid-60s and breezy winds today. also looking at some winds gusting out there at oracle park, so make sure you have something nice and warm to wear. it's going to drop into the upper 50s by the end of the game. and a mostly clear evening, after hitting a high of about 66 degrees, 71 in san mateo, also about the same in oakland. in the south bay, we're in the low 80s, but heating up to the low 90s for some of our inland valleys. a little hotter than yesterday, but we'll bring those temperatures down several degrees in a few spots for tomorrow as well as on thursday. so we are looking much better for the end of the week. we'll talk more about that in a few minutes. >>mike, the sateo bri is bog down. >> it's sti slower than many people wouldlike, especially folks onhe be. but it really jammed u as i'm scanning the reports and the other sources, it starts to move better. that's good news. look at that volume.

1-year-olds most commonly develop food allergies and asthma, and just after 2 environmental allergies like hay fever most often show up, just before 3 is when the esophagitis develops. >> the reason it's important is because you want to look for these, the earlier you treat them, the easier they are to treat and the less the child suffers with these type of allergy symptoms. so it's important to pay attention and make sure that you're actually seeing the child, if you notice a rash when they're 4 months old and it doesn't go away in a couple of days, get it looked at. >> you can see the full interview on "today" right after "today in the bay." president biden will turn his attention to the nation's mental health crisis today. >> scott mcgrew joins us now. there are already laws in place forcing insurance companies to cover mental health, but they're really not always followed.

>> they aren't. that's certainly the white house's position. good morning. the biden administration gives an example of an insurance company that covers dieting classes for diabetics but doesn't cover nutrition classes for somebody with anorexia. so one is physical health, the other is mental health. and the law says those two things should be treated equally. president biden is going to sign an order demanding insurance companies keep track of what they pay for so they'll be more aware if they break the law and fix it. the white house also points to two moms in california who recently went public with their struggles to get mental health care for their children. you may have experienced this yourself. you call your medical provider because you need some help and they schedule you for a first visit in november. the president will also sign a proclamation turning three sites into national monuments for emmet till, the young man murdered by two white men in mississippi back in 1955 after he allegedly flirted with a white woman in a store.

hotter. we're up to 94 today in morgan hill and milpitas will see a high of 85 today. we move over toward 93 and walnut creek, while oakland will hit a high of 77 degrees, and 80 in fremont. the seven-day forecast is at the bottom of the screen showing slightly warmer temperatures. in palo alto expect it to reach 88 degrees, but only 63 in half moon bay. ingleside will reach 84 this afternoon, 90 in santa rosa and about the same in napa. we'll see the high pressure that's still giving parts of the southwest a prolonged heat wave. that's going to be moving away from us and we'll have more of an influence from this area of low pressure that will be dipping into the pacific northwest and we know the wind coming off of the ocean tends to cool things down, while the valleys will still be warm. as we take a look at morgan hill going from mid-90s today to

upper 80s in the rest of the forecast, and even some low 80s, which is what we typically see for early august. in santa rosa, it's also going to be warm but a nice, significant cooldown for many of those inland spots over the next few days. but the sunshine continues and we'll see temperatures ranging from 60s in san francisco near the coast to mostly upper 80s and low 90s for the next couple of days. mike has a look at the bay bridge. >> it's looking pretty standard, but it's actually movement is good, we welcome movement in the middle lanes. we used to call them cash lanes. the hov lanes are moving well also. the issue is not the westbound commute. that's the standard commute. it's eastbound where a disabled vehicle is reported right here in the treasure island tunnel. we don't see any additional slowing on the sensors. we're looking at westbound across the bridge from richmond. everything else moves smoothly
