ever recorded. we will get to that story in just a moment and the latest on brutal heat affecting some new sports of the united states this morning. >> yeah. but we're going to get started with hunter biden set to appear in court today to plead guilty to two federal misdemeanor counts on failing to pay his taxes. the president's son also facing a separate felony gun possession charge. all of this comes as congress prepares to hear more testimony about the investigation into hunter biden's business practices. ryan nobles is covering all this for us. >> reporter: good morning to you. when the president's son enters this courtroom behind me, his legal team hopes this marks the end of his legal troubles. but republicans are insistent, his troubles are just beginning. hunter biden, the president's son, prepared to enter a delaware courtroom this morning to formally plead guilty to a series of tax charges.

>> mr. biden will take responsibility for failing to timely pay his taxes. >> reporter: the culmination of a five-year investigation that concluded the president's son did not pay taxes in 2017 and 2018 despite owing more than $100,000. biden has since paid back the tax bill with interest. prosecutors will suggest probation, which include a year in jail for each tax offense and up to ten years in jail for the felony gun charge that alleges biden was in possession of a firearm despite being a gun user. the gun charge will be dismissed once he completes a program. republicans not ready to move on. >> was it hunter biden's operation or was joe biden involved? >> they are aggressively pursuing an investigation into hunter biden's business practices and presented two irs agents who claim he was given

preferential treatment by the irs and justice department. >> reporter: the attorney general denied those claims, and the white house says president biden was not involved in his business ventures, but his son's legal issues continue to be a political distraction from the president. today's plea deal comes after hunter biden settled a long-running child support dispute last month with london roberts, the arkansas mother of a child he fathered in 2018. roberts said in a court filing last year that the president and the first family, quote, remain estranged from the child, but hunter biden agreed in 2020 to face some monthly child support. the white house declined to discuss the issue. his political rivals have seized on the opportunity. back in washington, house gop members continue to try to link his business dealings to the president. though, they have yet to produce any concrete evidence, even using the investigations to open the door to potential

impeachment proceedings. >> in the meantime, ryan, there appears to be some last-minute drama in the court. what happened? >> reporter: yeah, that's right, hoda. anything that happens as it relates to this case will get a lot of attention, particularly from hunter biden's political opponents. a republican member of congress informed the court this week they believe a member of hunter biden's legal team called the court attempting to impersonate someone else. it was enough for the judge to ask the biden legal team to explain what happened. they claim that it was all just a misunderstanding. it's ultimately not going to affect what happens in court here today, but it is an example of how every single part of this case is under a great deal of scrutiny, particularly from those who want to see hunter biden and, by extension, joe biden fail. >> ryan nobles for us in the courthouse in wilmington. thank you. that record-shattering heat wave that's been gripping the united states for nearly a month now is expanding to the entire east coast. even a dip in the ocean won't cool you down in florida. the waters there as we mentioned

out cold water to the homeless. >> we let them know, you got to hydrate. >> reporter: while families seek relief lake side. how much does this beach help? >> oh, it helps a whole lot. >> reporter: and as the extreme heat settles into the midwest, doctors say as this heat settles in, they are seeing a rise in cases of heat exhaustion and heat stroke. they are pleading with people to stay hydrated and stay in the air-conditioning as much as possible. we mentioned the power grid at the top. it is holding strong despite soaring demand, also coming up with tips of their own. definitely keep blinds or drapes closed during the day. run ceiling fans counter clockwise to circulate cooler air, and then they say run dishwashers, washing machines and other major appliances with full loads before or after the hottest parts of the day. all of those tips to keep your energy costs down low and keep

your homes as cool as possible in the heat. >> some good tips there. maggie, thank you. as we said, this extreme summer heat is not just impacting us on land. the oceans are now hitting dangerously high record-breaking temperatures. triple digits in some cases. sam brock joins us from miami beach. how impressive is this, sam? >> reporter: we're talking about historically off the charts ocean temperatures to the degree that marine scientists who studied this for decades tell me they have never seen anything like this. right now the water temperatures are running 4 to 8 degrees higher than normal.gher than nol but, hoda, manatee bay, if that sounds familiar, it's here on the map. we're talking about just south of the everglades registered 101.1 degrees this week. that is ideal temperatures for a hot tub. neighboring buoys registered in the 98 to 99 degree level. so that is sounding the alarms right now for experts about

risks to coral reefs here. the coral reef foundation is spending so much time trying to harvest, restore, repopulate these corals recently found a reef off of marathon at 100% mortality rate for the corals. obviously that's not the case across the reef, but deep concerns moves forward. >> if these temperatures continue to stay this way, what is the long-term impact on these coral reefs? >> reporter: about a quarter of all marine life globally is some way connected to these reefs, and on top of the fact they have blunt storm surge during the hurricanes. they prevent hundreds of millions of dollars in property loss knowing that, this is literally a race around the clock right now to go in and take fragments of those corals. they have been plants them for years, right, and tried to preserve them in a gene bank so

they can grow them and try to prevent the coral reefs from extension. that is the level we're at right now. just another level of climate change. >> sam brock for us there in miami. sam, thanks. air is hot water is hot turn to mr. roker. heat alerts once again across the country. >> not just water off florida. the gulf coast, the gulf of mexico, the water is really record setting hot we're talking about heat in the north atlantic and the mediterranean ocean as well. so it is worldwide right now for us 108 million people are under heat advisories, warnings, watches. northeast to the i-95 down to florida, texas all the way down into the southwest here is the deal we are going to see a bit of a change, but depending on where you live, the jet stream and that heat dome is going to start moving to the south, and we will get a bit of a break by early next week for the great lakes and northeast.

trevor reed. the white house worked hard to secure his release, only to see him go back to the region to fight against russia and now they're worried the move could make it more difficult to free other americans in russia you can say one thing about trevor reed, he is determined. the marine veteran from texas was arrested in russia in 2019 while visiting a girlfriend. he was accused of getting into a drunken brawl with police. the u.s. ambassador to moscow at the time called the charges, quote, theater of the absurd after nearly three years, often in solitary confinement, reed with a -- was released in 2022 swapped for a convicted russian cocaine trafficker serving time in the united states the exchange filmed on a tarmac in turkey. back home, reed expressed appreciation to the biden

hear arguments on whether a juvenile suspect accused in a deadly street racing crash should be tried as an adult. the crash happened last november when investigators say the juvenile was driving one of two cars at a high rate of speed down el camino real in redwood city. cameras showed the car plowing into another car, killing a mother and father. their 7-year-old daughters sitting in the back seat survived. the other suspect, 24-year-old kyle harrison, has already entered a not guilty plea. berkeley leaders are giving the green light to a controversial plan adding dozens of automated license plate readers. council members approving the measure last night. the city will use 52 devices in a two-year pilot program at the cost of $250,000. police say the cameras will help capture the license plate images of stolen vehicles and cars connected to other crimes. but some members of the accountability board are questioning the added value at the expense of personal pivacy.

to create doubt he was involved in the crime at all. in a last-minute move to present an alibi, attorneys for bryan kohberger is now suggesting the man accused of killing four students in november may not have been at the crime scene when the killings took place in the court documents, evidenct an evidence other than the king address will be disclosed. while the defense did not provide detail about where he may have been, they say his whereabouts may come to light in the trial through cross examination and expert witness testimony. part of the investigation, the discovery of a white hyundai elantra was seen at the scene the morning of the murders. it is the same he owns and police stopped him in weeks before his arrest. this is just the latest attempt

to cast doubts on the state's case in the investigation after prosecutors said his dna was a statistical match to dna found on a knife sheet at the crime scene. the state's argument assumes the dna on the sheathe was placed there by mr. kohberger and no someone else that spans hundreds of members of law enforcement. >> not guilty of the crime of murder. >> the filing reminiscent of a trial in 1995 when o.j. simpson's defense claimed a blunt stained glove was planted. the jury in that case famously acquitted simpson. in may, a not guilty plea was entered by the judge on bryan kohberger's behalf he faces four counts of murder with his trial set to start in october, the university will wait until then to demolish the house where the quadruple killings occurred. the decision comes after the victims' families asked for the house to be preserved.

>> i don't want somebody in the court case say, well, i really wish we could be in the house right now. >> and this new filing is the latest attempt by his attorneys to outline a potential defense with a gag order in place, we may not know many of the details of a possible alibi or defense strategy until the trial starts in three months. >> thank you let's bring in nbc news legal analyst danny cevallos kohberger's team is saying he may not have been at the house when the crimes were committed we have been talking about this for a long time. why is this just coming to light now? >> because the rules require them, the defense, to file what's called a notice of alibi. the rules say generally a defendant doesn't have to say anything they could just wait for trial when it comes to an alibi defense, this started in the 1920s, people started perceiving

alibis as this last-minute pull it out of your pocket defense. out of fairness, the court started saying, if you are going to say you are somewhere else, give the state advance notice so you can go out and investigate if you say you are at your book club meeting, well, then the state should be able to investigate your claim that you were somewhere else. this is an exception to the rule and a controversial exception to the rule that the defense doesn't need to put on any evidence and the supreme court has said this is okay with the fifth amendment. it doesn't violate the constitution this is an exception where you can require a defense to put in this evidence, a notice of alibi. under the rules in idaho, this was the time they had to do it. >> to be clear, the defense has not offered any evidence or any witness that would support this alibi theory what could the strategy be from a defense perspective? >> the way i read between the lines of their filing is this. this is just my take they're saying, judge, we don't have alibi witnesses yet, but we don't want to give up the
