new indictment for former president donald trump in classified documents case and what he is accused of as another member of his staff is indicted. kidnapping hoax, and the alabama woman who faked her own disappearance is facing jail time, and the announcement that the authorities have announced. and the truck driver who was stopped by officers and then bitten by a dog. and the wife of skier bow di miller says that three of their young kids were hospitalized and what they were doing outside of their home that she wants to warn young parents about. we begin this hour with the growing legal troubles of former president donald trump. >> he is now receiving more charges from thecial counsel jack smith.

this is whats new. in an updated indictment, trump was hit with one additional count of willful retention of national defense information and two additional counts of conspiracy to obstruct justice. >> the special counsel asked staffers to delete surveillance video at mar-a-lago, and a maintenance supervisor carlos de oliveira was asked to delete the surveillance video, and he was not sure what to do, but tonight, trump is going to be in iowa for a campaign event, and he calls the charges ridiculous. we are joined by garrett haake on set, and what we see is part of the new indictment is the surveillance video, and can you walk us through the time line

here? >> yes, it is a narrative that started last june when the fbi went to collect the first classified documents last june, and they noticed the surveillance cameras, and they wanted to send subpoena for that footage. that sets off a conversation between trump, walt nauta and carlos de oliveira and ends with them talking about the security meras, and another employee described as employee four who says, look, the boss wants the material deleted, and the person pushes back, but it appears that none of the video is deleted or destroyed, because it is showing up for the fbi's application to end up in a search for raid that bursts into the public consciousness, but the sheer amount of information of text

something that is a sensitive document related to iran that they allege now that they have, and they will be able to prove that it is the document shown. i imagine that the way they meet the burden of proof to call the people in the room to come in to testify if they were close enough to see the document, and other than that, i cannot imagine other ways to have someone who had eyes on it other than to prove that it was in the possession of trump, but to connect it to the audio and him waving it around, they would need some eyewitness testimony or surveillance video. >> and other than he said/she said. >> yes, they have to prove each and every allegation, and if they are going to be adding the new allegations or counts in a superseding indictment, you can believe they are extra certain of them, because they made a very important decision to supersede the indictment, and add the additional facts. >> and garrett, the president is the first to talk about the

indictment charges, and have we heard anything from him about the new charges? >> yes, ellison, this new indictment is something that he has commented about several times on the radio program this afternoon, and that they are political, and that you have prosecutors going after the low level people at his organization as a way to get to him. and he is talking about the idea of the tapes, the surveillance tapes being handed over from a radio interview this morning, and take a listen to what he said about this. >> these are my tapes that we gave to them, and then they say that is not enough. i don't think that we would have had to give it to them. these are security tapes and we handed them over to them. i don't know if we had to fight them, we would have had to give them. >> i don't know where he was going, because the tapes were handed over due to a subpoena, and not handing them over would have caused more problems for the former president and not

fewer. >> and danny, the trial in this case is to begin in may of next year, and could this indictment change that? >> when the government wanted a trial date in december of this year, i said it is not going to happen. when the judge said it in may of next year, i said it is not going to happen. this is my exhibit a, we are two months out from the original indictment, and in that time, it took an extra month to get walt nauta arraigned and now before any motions have een filed or anything else, they are already superseding the dime, and adding a new defendant, and counts and so that is two months out, and that is a ground to at least delay the case. we know that the government is going to be say, it is not going to change anything, and we should move forward in may. and we know that because they are the only ones in the known

universe they would have been seeking a superseding indictment, and they were investigating the third defendant and ts video footage issues, and the government want it to go forward in may, and i say not a chance we are going to trial in may. >> so we keep an eye on this, danny, and stay with us for a moment, because we are following the breaking news this hour in a story we have been following. yes, an alabama woman who claimed to be kidnapped. and priscilla thompson has been following thisnd all of this has been broken a few moments ago, and what do we know? >> yes, zinhle. we know that she is accused of two misdemeanors. these are class a misdemeanors that carry a year in jail, and

also a $6,000 fine, and she has been pros cessed an release on bond. what we have known is that it is opening up wounds for people who have family members who are missing and never came home, but it created fear throughout the community that there is a kidnapper on the loose. i wanted to listen to police chief here. >> her actions caused panic for the citizens of the city and across the nation, that a kidnapper on the loose using a small child as bait. >> reporter: and he was talking about the hours of resources that were used to search for her, and he went on the say that actions have consequences. so we have a digital reporter reaching out to her attorney,

and while these are and they are awaiting a court date to figure out the fullest extent of the law, and if there are 59 dissional charges, and what they do intend to charge. >> and the severity of the charges, and some people hear misdemeanors and they would say not serious? >> well, i would put them in the middle of the seriousness categories. and anything that you can be charge with, and in the criminal spectrum, it is in the misdi mee nor end, and not all the way. the way i would appear this, i don't believe it is going to

a controversial new chapter is happening in texas that has teachers up in arms. in houston, it is transforming the libraries and eliminating the librarians at the schools.

it is coming as the superintendent is concerned over to reading levels of the students. steven romo is following this story. what is happening with the libraries and librarians, and why? >> yes, zinhle, a librarian is going to be the thing of the past. and more school libraries are under the microscope there. the district was taken over by the state of texas citing problems with the school board and poor performance with some school boards. and now just last month, the state appointed a president and so the employees will be shifted to new jobs according to the district, but there are 57 schools with libraries that are still being reassessed and the

libraies will be used for other things such as detention center for misbehaving children, and some campuses, need the library areas to be turned i teams services. now, a student whose behavior causes them to be removed to class, it will be sending them to these areas to maximize and students can check out books in an honor system. >> this is interesting in the time of the book bans, and the trouble of our students. and how big of an impact is this going to be from the librarians? >> there is a number of motivation here, because houston

is blue area, and texas is red. but the librarians who have refired and this is going to be upsetting because of the less fortunate students are in the areas where these libraries will be taken. >> it is frustrate, because many of them lives in reading deserts, and they don't have access to the reading and they don't have choice of the reading material that they are given to read. >> reporter: we have also heard from one of the superintendents who said that libraries changed his own life, and a number of strong feelings on this, zinhle, and so it is yet to be resolved.

maggie, ethan crumbley has plead guilty already, and what are we hearing from? >> zinhle, this is a miller hearing which says that no state across the country, cannot sentence a minor to prison without parole unless you have a hearing like this. yesterday, we heard the graphic and emotional testimony from to a teacher who was shot, and the first responders who saw the carnage, and today, we heard from the students, and basically the survivors, and we will play a sound bite, and this is graphic detail of what the student said. you will hear the student, but not the face, because that is per court order. >> at the same time i thought, there is no way. it was very quiet, and there was no screaming or nothing, but the

gunshots. i dropped down, because that is just my reaction. >> what did you do when you dropped down? >> i just prayed. i covered my head. i didn't know if those were my last moments. >> that is crumbley there with the head down and we have seen that a lot in the hearing as the statements are read, and others are testifying. he has plead guilty to multiple counts of murder, and terrorism charges, and attorneys say that he was dealing with mental illness and came from a violent home, and he deserves the possibility of parole at some point, and he can be rehabilitated and so it is not a possibility of life in prison, but a chance for parole eventually is what is being decided here, zinhle. >> and maggie, how much longer

is this hearing to be lasting and when will this judge make a decision of sentencing? >> well, it is interesting, because the prosecutors thought that it would stretch on until tuesday, but the judge wants to wrap it up today, and we are at a faster pace now, and the defense mode, and they are calling the witnesses, and he is not going to issue a ruling or sentence today, and he is going to be issuing a sentence not today, but it will be several weeks now before we get an actual decision. maggie vespa. >> we have two high profile senators who had alarming moments this week that raised questions about health and age. the 81-year-old senator mitch mcconnell froze and stopped talking for 19 seconds in a press conference, and he was escorted away before returning to the podium, and telling reporters that he was fine. yesterday, 90-year-old dianne
