that could have workers walking off the job very soon. also, preventing crime in local neighborhoods. today marking national night out and tens of thousands of people from all over the country and right here in the bay area are coming together to help connect. the reason oakland leaders say this year's event is very critical for the city. this is "today in the bay." good morning to you. thanks so much for starting your day with us. i'm laura garcia. >> i'm marcus washington. we're going to check with mike for driving conditions in just a bit. first, meteorologist kari hall has a look at the forecast. how is it looking? it looks great today. it's going to be cooler and especially for the inland valleys, that's going to make a huge difference. let's get a live look outside in san rafael, a few clouds overhead, but it is a nice, cool 52 degrees. as we get a look at our trend throughout the morning, clouds will linger a little longer, but that's going to keep temperatures down and keep us from warming up too quickly.
5:02 am
at lunchtime we're approaching 70 degrees. as we take a look at our south bay high temperatures for today, in los gatos, expect it to reach 82 degrees, and also 82 in east san jose. we move toward the east bay with some mainly low 80s. all of this is cooler than we typically see for this time of year. oakland reaching 74 and 75 in redwood city. only low 60s for much of the coast and in san francisco, and for the north bay it will range from 69 in mill valley to 93 in ukiah. so still seeing some spots warming up. we'll talk about this and what's ahead in a few minutes. mike, you have two reports out of oakland. >> i'm tracking two. despite those two incidents, pretty much everything around the bay is moving smoothly. now, over here this is south bay 880, where the coliseum is behind me, we're looking south toward 98. there's still a little bit of flashing lights going on. there was a lot of activity until just a few minutes ago, southbound 808 around 98.
5:03 am
so there was a lot of slowing that started to move, much better now there's just one incident and one set of flashing lights. it's off of the roadway, so a smoother drive for the nimitz over the last few. in oakland itself, we do have this, ongoing, it's off of eastbound 980. the 17th street exit is blocked right now. you cannot use that exit. you'll use mlk or 51st. there's an investigation going on. for what happened, we hand it over to you. >> thank you so much for that. what mike was talking about, we're tracking a death investigation along the small stretch of roadway in oakland and it follows a vegetation fire along westbound i-980 near the 17th street off-ramp. we know it started around 1:30 this morning, this is what chp is saying that fire crews saw a man setting that fire. eventually first responders located a deceased man, who investigators say suffered head trauma. no word on if that person is the
5:04 am
one who set the fire. there's also no word of any arrests or the identity of the victim. the eastbound 17th street off-ramp remains closed as that investigation continues. and today the man accused of killing tech executive bob lee is going to be back in court. so yesterday new testimony and possible new defense strategies were unveiled in the first day of nima momeni's preliminary hearing. >> "today in the bay"'s ginger conejero saab was in the courtroom yesterday and is in san francisco now waiting for day two of the hearing. ginger, there was a surprising twist in one of the testimonies yesterday. >> reporter: that's right, laura. good morning to you and marcus. now, four sfpd investigators took the stand yesterday to an almost full courtroom. nima momeni's family was there, supporters of cashapp founder bob lee were present. no cameras were allowed in the courtroom. now, it's one of the testimonies from an sfpd investigator that
5:05 am
had some eyebrows raised. the last investigator to speak had details about the party that seemed to kick off the final night of bob lee's life, and surprisingly, momeni's attorney asked questions indicating that momeni didn't seem to have ill will against bob lee. the defense brought up another person's name. lead investigator sfpd sergeant ditmer, one of the witnesses, said this is the man that momeni seemed to voice anger about because he allegedly had been giving momeni's sister drugs and may have had a romantic relationship with her. >> all the articles i read prior to me coming on indicated that they believed that my client had malice against bob lee for drugging and sexually assaulting or whatever it was, however you guys put it, his sister, and that's not the case, that's not
5:06 am
the evidence. >> reporter: there are other investigators that took the stand, including one officer who testified to the stab wounds that bob lee had when he arrived on the scene, he was one of the officers that rendered aid to mr. bob lee. now, day two of the hearing resumes this morning at san francisco's hall of justice. we will be there to covering it and give you updates in our later newscasts. in san francisco, ginger conejero saab, "today in the bay." >> ginger, thank you. a family is in mourning after an east bay father of four tragically died at lake tahoe. bill siu from concord drowned on saturday after a jet ski accident on the east shore of lake tahoe. his wife tells us she and her husband were on the water when the weather took a bad turn, a wave knocked her husband off the jet ski and into the water. a nearby boat and first responders attempted to save him, but he didn't make it. his wife says he was her soul mate, along with a disney
5:07 am
enthusiast, who loved bringing the magic home for his kids. >> so much he loved them, and the fact that they're able to feel the love that he's given to people and it's returning back to us, it helps. >> most recently, siu coached the clayton valley eagles, a team where his son played. the team won the league's championship in 2022. more than 483 people have donated over $400,000 to a gofundme for the family. more legal troubles may be on the horizon for former president trump. within the last 24 hours a new defendant made an appearance in a miami courtroom in connection to the classified documents case. >> as "today in the bay"'s drew petrimoulx explains, more charges could be looming in his alleged efforts to overturn the election and for the january 6th insurrection. >> reporter: with the grand jury
5:08 am
in washington, d.c. expected to meet this week, former president trump could be in for more legal trouble. this time over his actions in the aftermath of the 2020 election. trump is already facing numerous charges over his handling of classified documents at mar-a-lago. >> these are ridiculous indictments, and all the do is hoping for massive elon interference. that's all they wa to do. >>ter: the newest defendant in the classified ments case arraigned, free on a $100,000 bond on charges he sought to delete surveillance video. the employee allegedly telling another staffer the boss wanted the video deleted. barricades are up in front of a courthouse in atlanta where a district attorney is investigating trump's efforts to overturn election results in georgia. the d.a. says charges could come this month. >> the work is accomplished. we've been working for two and a half years. >> reporter: trump's gop rivals are trying to convince voters to give them a look amid the legal drama.
5:09 am
>> to clarify, you don't believe that former president trump could win a general election against joe biden. >> i don't think so, because i think there's too many voters who just aren't going to vote for him going forward. >> reporter: but polls show trump with a commanding lead in the republican primary just weeks before the first gop debate. drew petrimoulx, nbc news, washington. san jose city employees will vote on whether or not to strike. many city employees say they want to bring attention to the city's recruitment problems, as well as pay. employees at city libraries and airport are part of the union. voting will run through friday and a strike could come as soon as next week. the city has offered a 5% raise in 2024. we've reached out to the city for comment, have not heard back yet. city leaders are set to have a special closed session meeting tonight to decide what comes next. 5:09 right now, and today is national night out. this is a day when we see citywide block parties bringing community members together along with police officers. in cities like oakland, today
5:10 am
the celebration comes at a critical time. this is when crime is really surging. so last week oakland's naacp asking city leaders to declare a state of emergency. the group said the problem comes from failed leadership at the city level. the president of oakland's police association says that understaffing is to blame and city leaders need to do more. >> they are really overstretched and they're really trying. what we really need is a dialogue of all the stakeholders, those in the criminal justice system and the leaders of our city, and from a lot of them all we've heard is silence. >> many advocates in oakland are calling for the appointment of a permanent police chief. it will be a nice evening for national night out as we take a live look right now before the sun's arrival overlooking san francisco. kari, we're going to have cooler temperatures? >> yes, you will need the jacket this evening as temperatures
5:11 am
quickly drop, especially around 5:00 when the breeze kicks in. as we take a live look outside in dublin, starting out nice and cool. temperatures in the upper 50s. it is mostly clear, but we will see a mix of some sun and clouds throughout today, the high clouds coming in, giving us filtered sunshine and keeping those temperatures much lower, as we also see those winds picking up. so san jose will reach into the upper 70s, petaluma reaching 75 and brentwood today reaching 86 degrees. we'll talk about what's ahead in a few minutes. mike, you're tracking one crash out there. how is it looking? >> this just reported for san jose, northbound 101 at about oakland road. it's not a major crash, i don't think there's any major injuries, and it should get off quickly to the shoulder. but it is at a critical time when we first start to see a build. we'll track that. surface street slowing did pop up. there are no incidents and not all my sources talk about the slowing. i'll continue to follow that and report any incidents. nothing you need to worry about right now for the local commute.
5:12 am
a smooth drive out of the altamont pass. it's a pleasant drive for a tuesday. we're looking at no delays for vasco out of brentwood, byron and discoverybay. a memorable anniversary for millennials. coming up next "today in the bay," what was once one of the worl most par websites turning 20. a look at what made this site unique from others we see today. and marriage is kind of a social network, one-on-one. have you ever heard of marriage pact? we'll take a look coming up. a billion dollars up for grabs, the incredible jackpot grabs, the incredible jackpot you can win in (warehououse a

good tuesday morning to you. it is now 5:14, and as you make plans for the day in the north bay, it does start out mostly cloudy in napa, and it will be 56 degrees at 8:00. as you take a look at the trend throughout the day, it's going to be really nice and comfortable, only reaching into the upper 70s with a mostly sunny afternoon. there will be some more changes in our forecast as we approach the weekend. we'll talk about that coming up in a few minutes. hello, berkeley curve. already seeing a lot of folks making their way with taillights heading toward the bay bridge toll plaza. we should see the metering lights on in about 20 minutes. we're looking at no problems, but a good volume build coming down the eastshore freeway.
5:16 am
good morning, happy tuesday. also the 1st of august. a lot of companies opening up their balance sheets for investors, apple, amazon, starbucks, uber. the san francisco company new relic is going to leave the stock market and go private, $6 billion all cash deal. apple, a new report from bloomberg says the next apple iphone will have a usb-c charger. most devices these days use usb-c, amazon kindles, android phones. the idea being if there's just one kind of charging port, you don't have to carry as many cords and it's better for the environment. a lot going on with the company formerly known as twitter. they've taken down that giant x on top of their market street building. they're suing a nonprofit that tracks hate speech as well. then there's a push by users to create tweetless tuesdays. don't tweet today or x or whatever they call it now to show the company they need

people to post to make things interesting. on our podcast this week, we talk about something called marriage pact. have you heard of it? tens of thousands of college students take a quiz each year and find their soulmate. >> a few weeks ago a marriage pact survey was sent out to, like, every student at uva and i took it and i'm looking to see if they can match me with my perfect soulmate or at least a cool friend. who can say? let's find out. >> more than 300,000 college students have taken the quiz. 90% at stanford have done it. this week we talk to one of the biggest investors, who says sometimes finding the next big thing involves sinking millions of dollars into something you're not sure will succeed. >> the nature of venture is that you want to back people who are taking big swings, so if some of them don't fail, i think that's a sign you're not taking enough risk. >> there's a thing on the corner of the tech museum in san jose that says -- and i wish i could
5:18 am
remember who said it. i want to say it was one of the intel founders. it says, if you're not failing, you're not trying hard enough. if your kid is getting all as in school, they're not taking the right classes. >> i'm pretty happy when they get as. they're working pretty hard. >> yes, they are. >> all right. >> thanks, scott. talk about a throwback tuesday story, pioneering social media website myspace made its debut 20 years ago today. some of the features, being able to select your top eight friends, also personalize your profile to include t current songs were liso. it may have paved the way for the recent feature added to instagram, it unveiled a notes feature allowing users to add songs to their shared thoughts. myspace is actually still around, but mainly a smaller music website today.
5:19 am
happening tonight, the mega millions jackpot has crossed $1 billion. >> this is not something you see every day. this is the fifth time that game has actually been -- or the prize has been that big in the game's history. so the exact amount at stake tonight, $1.05 billion, or $597 million if you take that cash option. now, the draws happen at 8:00 tonight but financial advisers want to warn you, don't get too excited. once you win, you are in the nation's highest tax bracket, which would force you to pay close to $388 million in taxes. >> i'll pay that, though. >> you'll still have a few millions. >> if that's your biggest problem. >> oh, i paid too much in taxes. >> then you learn all the loopholes. >> i want that adviser to tell me how to get around that. let's check the forecast. we're all winners in that category. >> yes, it's been nice. we're starting out august with
5:20 am
cooler than normal temperatures, while we still talk about headlines elsewhere that it is sizzling across much of the rest of the country. take a look at gilroy's morning commute and the temperatures we'll see, starting out with some mid-50s, a cloudy morning, but we'll start to see the sun peeking out and there will still be a mix of sun and clouds throughout the day. it won't totally clear out but it will still be sah morgill rg 82. in milpitas we're headed for 77 degrees, los gatos reaching 82. you can probably see at the bottom of the screen this kind of weather will not last long. enjoy, not hg to blasthe in and air-conditng wit concord reachi 7 82, a oakland 'll a high of 78 in palo , daly city reaching 62. also 62 in the outer sunset, downtown san franc reaching 64 degrees, andh of the north bay in thepper 70s. so reaching 79. it's still going to be hot in
5:21 am
ukiah, but we're not talking about upper 90s or triple digits. we're headed for 93 today. there's going to be a surge in humidity. the green we're seeing there may spark off some thunderstorms in the mountains, so that will continue today. but we're also going to see those high clouds, the ice crystals that will continue for today. so we are going to see clouds here and there. overall we're watching out for this, the perseid meteor shower. unfortunately, the supermoon we're having tonight may dim the view of those faint meteors streaking across the sky. if you're patient, you could probably see at least a few. the peak is not until early august. so we'll see the meteor shower continuing and have more opportunities. and definitely this weekend we know as temperatures heat up we will have a lack of cloud cover, so we are going to have a hot weekend ahead. you saw triple digits on sunday. san francisco will still be
5:22 am
fairly mild, looking at some low to mid-70s there. mike, what's the update in the east bay? >> we're checking on the bay bridge because we should see the volume building shortly. we're looking at a smooth, easy drive and nothing unexpected approaching the bay bridge or the maze or off the eastshore freeway. we're still looking pretty much at speed westbound. highway 37, no slowing out of vallejo just yet. highway 4, it does start to see those sensors tip a little bit, brakes tapping coming into bay point and pittsburg. a smooth flow of traffic through the north bay, down the 101. on the peninsula side, no problems, there is a crash south 880 at 98. off of eastbound 980 we have the 17th off-ramp closed for the investigation going on for a while now. you'll use mlk. this crash north 880 at the transition to 101, that should be cleared in the next couple of minutes. i'll continue to follow that. back to you. >> thanks, mike. coming up next on "today in the bay," nbc bay area responds.
5:23 am
>> uncle sam is eyeing auto renew charges, but california is way ahead. i'm consumer investigator chris chmura. we'll show you how to exercise your rights next. before we head to break, we want to show you this. this is video kari was posting on instagram over the week looks like she really enjoyed a beautifulkend in the city. make sure to keep up with kari and find out what she's got going on.
5:26 am
welcome back. 5:25 this morning. our consumer team sees a fight over and over, people who battle over an auto renewal subscription. >> consumer investigator chris chmura says you have rights. >> let's look at the case of one student, sherry moyer rents digital textbooks, with one online service she signed up for a one-month rental, paid 20 bucks. the company then billed her another 20 bucks the following month. >> i didn't purchase, like, a renewed subscription. so i actually called them to get a refund and they told me they had a zero refund policy. >> in washington, the federal trade commission is currently looking to toughen federal rules that govern auto renewals, but it's settled in california. sherry has rights and so do you. you can either ask a d.a. to
5:27 am
investigate or you can sue. tonight at 11:00, we'll explain what route sherry took and 's next. we'll also show you the red flags that some lawyers say to looko figure out whether an auto renewing subscription is against state law. if you need backup in an auto renew battle, perhaps we can plead your case. scan qr code on your screen right now to fill out our consumer complaint form. i'll join you tonight again at 11:00. >> thanks, chris. next the top stories we're following. a look at a 20-year unsolved sexual assault case. the man accused in the decades-old case back in court. the charges he's facing and how police were able to connect him to the crime. it turns out many car break-ins in the bay area are not random. the technology thieves are

5:31 am
>> good morning to you on this tuesday. i'm marcus washington. >> i'm laura garcia. good to have you back. it's 5:30 right now. let's check in with kari with a look at our forecast for this tuesday. >> it will be great to have cooler weather, especially in the inland valleys that are going to see temperatures dipping today. let's head to santa rosa, where we start out at 52 degrees. it is partly to mostly cloudy right now and we will continue to see some clouds, with high clouds moving in throughout the day it will give us filtered sunshine. it still looks pretty nice out there. you'll see the cloud formations like you saw yesterday afternoon. in cupertino expect it to reach 80 degrees and still low 80s for much of the east bay. we're going to bring it down several degrees and the cooling trend sticks around for a little while until we head into the weekend. back in the 60s for san francisco, and the north bay anywhere from 60 in bodega bay
5:32 am
to 93 in ukiah. we'll get a look ahead in a few minutes. mike, you're still tracking that crash in san jose? >> it's the transition from 101 to 880. there's a motorcycle involved, no major injuries. there's slowing because this is the same time we would normally see the volume build. there's activity at the transition ramp, so there's more slowing than we might expect at 5:30 in the morning. usually it doesn't kick in until 5:40. the rest of the bay, predictable pattern for everyone outside of the south bay. we still have the closure off of eastbound 980, the 17th street exit is closed for that investigation. so far, everything else looks standard on the freeways in commute directions. you've probably heard about this. criminals have broken into tens of thousands of cars over the past year throughout the bay area. but we're finding out that a number of those break-ins weren't random. >> bob redell is joining us
5:33 am
live. sometimes those thieves are targeting specific vehicles. >> you are correct. good morning to you. many of these thieves are looking for your high-tech devices, even if they are out of sight, hidden or locked in a trunk. your laptops, smartphones and tablets continue to emit a signal. bob enderle says criminals now know how to track that signal. >> it's just as easy as picking up a smartphone and looking for bluetooth signals. if they see it, they can triangulate approximately where it is. >> we've been trying to take things in with us every night. but i think that's good to know to be aware, especially here. >> more sophisticated signal detectors like this one, they can better locate the source of the signal from your electronic device. these detectors are actually intended to locate surveillance equipment planted in buildings and vehicles. experts suggest you turn off your device to terminate the signal it is emitting, or just take the device with you when you leave your vehicle.
5:34 am
reporting live, bob redell, "today in the bay." >> good advice there. thank you so much. 5:33 right now. happening today, the man who was arrested in connection with a cold case that happened 26 years ago is expected to be in court today to make a plea. richard jeffrey martinez is accused of sexually assaulting a 7-year-old in sunnyvale. the alleged assault happened back in 1996. sunnyvale police cracked the case earlier this year using a public genealogical database. for years investigators were unable to use dna evidence because it never matched anyone in the national criminal database. u.s. postal workers are asking for more help, after a carrier was robbed. now, that robbery happened in san francisco's richmond district on friday in broad daylight. officials are saying thieves were not going for letters or packages, but master keys. this is for zip code mailboxes.
5:35 am
neighbors are saying those thieves having access to their boxes is worse than losing the mail. >> still, it's not -- we get checks, we get credit cards by mail, all kinds of things, just like everybody else. so obviously that will be a concern. >> it is frightening. now, there was a string of robberies in antioch earlier this year where thieves also went after the master key. so far people in that neighborhood say the postal service has not issued any warnings or alerts. meanwhile, postal carriers say they want help from police, who say that officers are still working on the antioch robberies. a worrying algae bloom is spreading along the east bay shoreline called a red tide and it's already been spotted along the shores of emeryville, berkeley and albany. high levels of nitrogen and phosphorous are fueling the bloom. pollution from wastewater
5:36 am
treatment plants help feed it. a similar bloom killed thousands of fish last summer. >> a microscopic organism that was responsible for the big red tide last summer about the same time, we're hoping it doesn't escalate into a similar magnitude event. but we're trying to prepare for the worst. >> scientists say it's still too soon to tell whether we'll see a lot of dead fish again and there's not much that can be done to stop a fish die-off. the bloom isn't harmful to people but experts say you should be careful when going into rust-colored water. happening tonight, get your telescopes ready because the first of two supermoons makes its debut. supermoons happen a few times a year, but it's rare to have two in a single month. now, a retired nasa astronaut estimates that it won't happen again until 2037.
5:37 am
so you definitely need to make sure you get things ready. if you miss tonight's supermoon, the other one happens on august 30th. meteorologist kari hall is joining us right now. it's cool it's happening not once, but twice. >> so it's coming at the same time as the meteor shower. so when you have a supermoon it's super bright. some of the faint meteor streaking across the sky may not be as visible. it's not the best time to check out the meteor shower, but the good thing is it extends for several weeks. the peak is not until august 11th and 12th, where we could see 150 to 200 meteors per hour and we won't have the supermoon. so a lot of things to have you looking up in the night sky. we're also at times seeing clouds moving by, and looking around the bay at our high temperatures for today petaluma will reach 75 degrees. brentwood will reach 86 degrees and san jose in the upper 70s.
5:38 am
also cooler temperatures in our forecast as we are going to have this lasting for a few days, and then we're going to see some hot temperatures in time for the weekend. so i'll be tracking that in the full microclimate forecast. mike, you've been tracking crash. >> we still have this in san jose and that's augmenting the slowdown we would typically see right about now. it's been going on for ten minutes and it's a longer slowdown, bigger slowdown than we might expect. the crash going on in the northbound direction, your commute direction just past oakland road. again, a motorcycle involved. no major injuries. no major impact for the rest of the commute. easy drive out of the altamont. a little build for hayward and out of san leandro. we still have this going on for the day. remember, this evening we have crowds that may be going on around the oakland arena. alicia keys has a concert tonight, but the crowd may be a
5:39 am
different flow than folks expect, because this is an 8:00 concert. on the other side of the bay, we're looking at the giants playing at 6:45 at oracle park. both activities are too late for me to stay up on a week night. we're looking at a smooth drive on a weekday where traffic builds, highway 4, typical build just after 5:30. the metering lights should be turned on any second. westbound, your commute direction, not a problem. we see an early blip forming heading toward the richmond toll plaza. we'll see if that means an early backup. back to you. >> thanks, mike. summer fun going high-tech. coming up this morning on "today in the bay," the new summer program that works to help kids from allkgrounds get a head and a new political p shows decision 2024, w we pick for president looks pretty even, laura. also the cost of back-to-school supplies expected to hit a record high. coming up, we're going to break

5:43 am
lunchtime and reaching into the upper 70s for today. you'll notice it's going to be cooler for today and tomorrow, but then it will heat up. we'll get a look at that in the full microclimate forecast in a few minutes. we're taking a look at the bay bridge toll plaza. notice this backup forming. some slowing getting toward the lanes off to the right, coming off the 880 over-crossing, and the hov lanes look like they might be affected on the bridge as well. there may be changes in the next few, so we'll track this closely. 5:42 right now. brand new poll from "the new york times" puts biden and trump just about even. >> scott mcgrew joining us now. the former president facing a number of criminal charges but that's not affecting him at the polls at all. >> not at all. more charges may be right around ner. for this "new york times" poll, it shows a tight race in that theoretical matchup. the poll shows strengthening
5:44 am
support for biden among democrats. at first many democrats did not want biden to run, citing his age. that probably hasn't changed, but democrats accept that he's running and they're behind him. "the times" poll shows biden and trump tied at 43%, potential voters favor biden, 43% favor trump. there's a 3.7% margin of error. now, any time some reporter gives you percentages like that, 43%, 43%, remind yourself we don't elect presidents that way, we elect them state by state. when you look at the race to 270, 270 being the number of electoral college votes you need to win, then it really just comes down to arizona, pennsylvania, georgia and a few other states. president biden says space command will stay in colorado. president trump had ordered it moved to alabama in the final days of his presidency.
5:45 am
space command is different than space force. if you look closely, those are air force uniforms. three republican lawmakers say they'll launch an investigation into the plea deal between the trump-appointed prosecutor and hunter biden. the plea deal that was thrown out in court. not clear what they're going to investigate. the two sides are busy rewriting the document to get it back in front of the judge. separately, a house oversight committee said it heard testimony from one of hunter biden's business associates who said hunter biden would get his father on the speaker phone to impress clients but that the older biden never discussed business. we're waiting on transcripts. it's been two weeks since fo pdent trump was ined he was the target of a federal investigation into election interference, five days since his lawyers talked to those prosecutors. we simply do not know if or when an indictment m . trump already faces fives, the t will be inoctober, that's a business fraud trial
