a terrific tuesday to you this morning. i'm marcus washington. >> i'm laura garcia. we'll check that morning commute and see if anything is rolling out there with mike in just a bit. another cooler day on tap for us today. >> it will be nice to have cooler temperatures, which we don't always get during the month of august. we're starting out with temperatures in the upper 50s and low 60s and it's a bit of a milder start. i think it will be cooler the next several mornings. santa rosa now the coolest spot at 51 degrees, but it is 60 in san jose. then we take a look around the bay and our high temperatures expected for this afternoon, in petaluma expect it to be a pleasant 75 degrees, a mix of sun and clouds, breezy winds and warm temperatures. brentwood reaching 86 and the upper 70s for san jose. mike, you have a couple of concerns for the east bay. one of them continues with the yellow arrow. folks are familiar coming off the 880 over-crossing, as you're

approaching the bay bridge you can choose to swing to the right. there's a bus express lane. you can swing to the right oftentimes it's a smoother drive off of that approach in the right lanes. right now there's something going on in the mini toll plaza. stick to these lanes just off to your left as you're approaching the toll plaza and the split because that's moving more smoothly. no incidents reported, but there must be going on perhaps with regard to the toll lanes themselves. we're watching that. meanwhile, the rest of the bay's approach toward the maze moves smoothly. there's one more issue for oakland, a closure from eastbound 980 getting off at 17th. you can't exit because of a police investigation. for the latest, we'll hand it over to you. we are tracking that death investigation along that small stretch of roadway in oakland. this follows a vegetation fire along westbound i-980 near the 17th off-ramp. it started around 1:30 with chp

saying they saw a man setting the fire. first responders located a deceased burn victim who investigators say suffered head trauma. no word on if the person who set the fire was, or if this is also involving anyone else. there have been no arrests or the identity of that victim so far. the eastbound 17th street off-ramp remains closed as that investigation continues. today the man accused of killing tech executive bob lee is going to be back in court. yesterday new testimony and possible defense strategies were unveiled in the first day of nima momeni's preliminary hearing. "today in the bay"'s ginger conejero saab was in the courtroom yesterday, and is in san francisco now awaiting day two of the hearing. ginger, there was a surprising twist in one of the testimonies yesterday. >> reporter: that's right, laura. specifically questions on cross-examination to one of the testimonies that happened yesterday. four san francisco police department investigators

testified on the stand to an almost full courtroom, including the family of nima momeni and supporters of cashapp founder bob lee. it's the testimony from the last investigator who spoke about details about the party that happened on the final night of bob lee's life. surprisingly, momeni's attorney asked questions indicating that momeni did not seem to have ill will against bob lee. the defense brought up another person's name. lead investigator sfpd sergeant brent dittmer, one of the witnesses yesterday, said this other man is the one who momeni seemed to voice anger about because he allegedly had been giving momeni's sister drugs and he may have had a romantic relationship with her. >> all the articles i read prior to me coming on indicated that they believed thatyent had maliinst bob lee for drugging and sexy assaulting or whatever it was, however you guys put it, his sister.

and that's not the case. that's not the evidence. >> reporter: now, other sfpd investigators took the stand, including one officer who testified to the stab wounds that bob lee had when he arrived on the scene. he was one of the officers that rendered aid. day two of the preliminary hearing will start later this morning at 9:00 at the hall of justice. giviou updacovering it and ginger conejsaab, "today in the bay. a lot to cover. interesting as it all unfolds. thank you. more legal troubles may be on the horizon for former president donald trump. within the last 24 hours a new defendant made an appearance in a miami courthouse in connection to the classified document case. meet this week, former president trump could be in for more legal trouble, this time over his actionness the aftermath of the 2020 election. trump is already facing numerous charges over his handling of classified documents at mar-a-lago. >> these are ridiculous indictments and all they're doing is hoping for massive election interference. that's all they want to do. >> reporter: the newest defendant in the classified documents case arraigned in a miami courtroom, free on $100,000 bond on charges he sought to delete surveillance video. the employee allegedly telling another mar-a-lago staffer the boss wanted the video deleted. meanwhile, barricades are up in front of a courthouse in atlanta where a district attorney is investigating trump's efforts to overturn results in georgia. the d.a. says charges could come this month. >> the work is accomplished. we've been working for two and a half years. >> reporter: trump's gop rivals are trying to convince voters to give them a look. >> to clarify, you don't believe that former president trump

would win a general election against joe biden? >> i don't think so, because i think there's too many voters who just aren't going to vote for him going forward. >> reporter: polls show trump with a demanding lead in the republican primary, just weeks before the first gop debate. drew petrimoulx, nbc news, washington. a family is in mourning after an east bay father of four tragically died at lake tahoe. bill siu from concord drowned on saturday after a jet skiing accident on the east shore of lake tahoe. his wife tells us she and her husband were on the water when the weather took a bad turn. a wave knocked her husband off the jet ski and into the water. a nearby boat and first responders attempted to save him, but he didn't make it. his wife says he was her soulmate, along with a disney enthusiast, who loved bringing magic home for his kids. >> so much he loved them. and the fact that they're able

to feel the love that he's given to people and it's returning back to us, it helps. >> most recently he coached the clayton valley eagles, a team where his son played football. the team won the league's championship in 2022. close to 500 people have donated $41,000 to a gofundme fundraiser for that family. happening today, san jose city employees will vote on whether or not to strike. many city employees say they want to bring attention to the city's recruitment problems, as well as pay. employees at city libraries and the airport are part of that union. voting will run through friday and the strike could come as soon as next week. the city has offered a 5% pay raise in 2024 and we've reached out for a comment from the city. we've not heard back. city leaders are also set to have a special closed session meeting tonight to decide what

comes next. speaking of tonight, it is national night out, and it's a day marked with a citywide block party, bringing community members and police together. >> in cities like oakland today's celebration comes at a critical time when crime is surging. last week oakland's naacp asked city leaders to declare a state of emergency. in that letter, the group said the problem comes from failed leadership at the city level. the president of oakland's police officers association says understaffing is to blame and city leaders need to do more. >> they are really overstretched and they're really trying. what we really need is a dialogue of all the stakeholders, those in the criminal justice system and the leaders of our city. and from a lot of them all we've heard is silence. >> many advocates in oakland are calling for the appointment of a permanent police chief. speaking of tonight, i know a lot of people are going to be out. the weather should be nice. >> absolutely. it's going to be cooler.

make sure you have a jacket because temperatures will cool off quickly as we go into the late afternoon into the evening. take a look at oakland and our forecast. we start out at 59 degrees and we will still have a mix of sun and clouds throughout today. it won't be all clear and sunny and it will turn mostly cloudy as we go into this evening as well, as our high temperatures only reach into the upper 60s with breezy winds. looking at our high temperatures for the south bay, expect it to reach 79 degrees and a mix of sun and clouds as well. the peninsula, a mild 73, and a very comfortable 81 in the tri-valley. san francisco is going to stay cool today with mid-60s and the north bay reaching the low 80s with those high clouds filtering the sunshine. mike has a look at where we can find lower gas prices. >> best in the state twice, it's vallejo, $4.11, point gas on tennessee and costco on plaza. everything else is getting higher around the area. in the top ten twice, $4.19 in

sunnyvale, costco on lawrence station and great gas on north matilda. meanwhile in marin county, $4.35 is the lowest, lucky service, sir francis drake. thank you for reporting these. on the roadways we'll talk about the traffic flowing pretty smoothly around most of the bay. a new incident westbound 80 approaching the carquinez bridge. there is a crash and that's adding to the slowdown. it's at the 29 off-ramp, but i believe the off-ramp is still open and accessible. a drive out of vallejo and highway 4 into concord show the typical build. the bay bridge toll plaza has an unusual pattern. the metering lights are turned on and we have the hov lanes also slowing down. something is going on between the metering lights and toll plaza itself. there are no reports at chp for problems.

right now at 6:14, let's get a look at our morning trend for antioch. it is 64 degrees now and mostly clear. we will see some high clouds filtering the sunshine today, but temperatures stay nice and fairly comfortable, reaching into the low 80s by early in the afternoon. we'll reach into the upper 80s for an afternoon high here. we will see cooler weather for the next few days before it heats up. we'll talk more about that in the microclimate forecast. and we continue to talk about this, the unusual pattern, the hov lanes at the bottom of your screen should not be slow at all unless there's something going on between the toll plaza and the metering lights. it looks like that's what's happening. we'll track this, as well as a new crash -- or a disabled vehicle, some kind of hazard in the sunol area. we'll talk about 680 coming up.

partly cloudy to start, 60 degrees. at 11:00 it's 69 degrees and reaching into the upper 70s. there will interesting cloudmationshead, so yon enj tha as well. with our high temperature in east san jose reaching 82 degrees, it will be about the same in gilroy. you can see at the bottom of the screen with our seven-day forecast, today's weather will not stick around. in hayward, we're headed for 70 degrees, and in oakland reaching into the mid-70s for today. 78 in palo alto and 62 in the outer sunset. the north bay reaching 79 in sonoma and 76 in napa. if you have the chance, early in the morning, look up. we have, unfortunately, a supermoon, not unfortunately, it's really cool to see that, but that may block the view of some of the meteors. the peak of the meteor showers

not until august 11th and 12th, so we've got plenty of time. we're also seeing high clouds subtropical moisture.rge o some all of that green shows where we had the amount of moisture in the atmosphere. that will be pushing toward the sierra and may fire up thunderstorms. we're seeing high clouds and that will continue for today. tomorrow highs in the upper 70s, it will be nice in the middle of the week. take a look at your weekend plans and the weather. it will be in the 90s and hitting 100 degrees inland. it won't be that hot in san francisco. here we're talking about low to mid-70s. mike, you're looking at a couple of bridges. >> the bay bridge, a concern for everyone heading out of oak and into san francisco. the hov lanes are starting to move better. if they are backed up, that means the flow is not clear past the metering lights. everything else is holding

takem those whodt theg most thelay assis thousandre fg. this is "t in the bay. a very good tuesday morning to you. 6:30 right now. thanks for starting your day with us. i'm laura garcia. >> i'm marcus washington. time to get a look at the forecast before you head out. meteorologist kari hall is tracking that. a lot of folks are going to be out today with national night out. >> it's going to be great weather and much cooler than we usually see to start out the month of august. we're starting out in the upper 50s in palo alto, it's 59 degrees. we will see a slow warming trend throughout the morning and it will only be about 70 degrees at 1:00 this afternoon. around the bay, expect it to mostly be in the 70s and 80s, some of our warmest spots inland reach up to 86 in brentwood, san jose upper 70s and petaluma at a comfortable 75 degrees. the weather won't stay like this for long. we're going to have some changes. we'll talk about that ahead. mike, you've been tracking a couple of incidents on the

roads. >> the south bay is slower, we had an earlier crash that created backups. no big concerns, this is about the time we expect metering lights with traffic continuing to feed in out of san martin and morgan hill. back at speed by the time you pass by cochran in the northbound direction. approaching the carquinez bridge, still slow. the earlier crash did clear around highway 29 and there's a ripple effect and maybe some activity on the shoulder. everything else looks pretty calm. the bay bridge toll plaza has an unusual backup for the hov lanes. i want to zoom into san francisco where we have reports of a fire not far from the freeway. you guys have the latest news. we have breaking news we're following this tuesday, a fire in san francisco's hayes valley. police got a call about a structure fire about 30 minutes ago. look at the blaze and how it really took off. it happened on oak street and octavia. you can see from the video a few floors of the building just

completely engulfed in flames. it appears to be actually a building under construction. the nearby homes had to be evacuated. we reached out to the san francisco fire department. they are there at the scene. we don't know what caused the fire. our own ginger conejero saab is heading to the scene as well. she'll join us with a live report. quite the inferno that is burning right now in san francisco. criminals have broken into tens of thousands of cars over the past year, really throughout the bay area. but we're now finding out a number of those break-ins aren't as random as you might think. >> bob redell is joining us. sometimes thieves are specifically targeting specific vehicles. >> reporter: you are correct. many of these thieves are looking for your high tek devices. and even if they're out of sight, hidden or locked in a trunk, our laptop, smartphones and tablets continue to emit a signal. rob enderle says criminals now

know how to track that signal. >> just as easy as picking up a smartphone and look for a bluetooth signal, and if they see it, they can try figure out approximately where it is. >> i think that's good to know, to be aware, especially here. >> reporter: more sophisticated signal detectors like this one on your screen can better locate the source of the signal from your electronic device. these detectors are actually intended to locate surveillance equipment. experts suggest you turn off your device to terminate the signal, or just take the device with you when you leave the vehicle. reporting live, bob redell, "today in the bay." >> bob, thank you. u.s. postal workers are asking for more help. this is after a carrier was robbed. the robbery happened in san francisco's richmond district on friday in broad daylight. officials say the thieves were not going after letters or

packages, but the master keys or zip codes mailboxes. neighbors say the thieves having access to those boxes is worse than losing mail. >> we don't have a whole lot here, but still we get checks, we get credit cards by mail, all kinds of things, just like everybody else. obviously that will be a concern. >> there was a string of robberies in antioch earlier this year where thieves also went after the master key. so far, people in that neighborhood say the postal service has not issued any warnings or alerts. meanwhile, postal carriers say that they really want help from police, who say officers are still working on the antioch robberies. 6:35. and happening today, the man who was arrested in connection with a cold case happened 26 years ago is expected to be in court today to make a plea. richard jeffrey martinez is accused of sexually assaulting a 7-year-old in sunnyvale. the alleged assault happened back in 1996.

police cracked the case earlier this year using a public database. for years sunnyvale investigators were unable to use dna evidence they recovered from the scene because it never matched anyone in that national criminal database. new at 6:00, sonoma county leaders are committing to hiring more people to prevent thieves from stealing calfresh or benefits from those who need it most. they estimate since june, more than $625,000 in benefits have been stolen. this is just in sonoma county. now, the majority of the theft is happening through electronic fraud. at the same time t county warns residents are seeing increased wait time. the human services department says they really hope to hire more than 30 people by the end of october to shorten the wait time. happening tonight, get those telescopes ready, the first of that'sn the moon's orbit is

at its closest point to the earth. supermoons aren't too unusual. they happen a tim a year. 's rare is tve two in a single. iredasaronomer says it won't happen again until 2036. if you miss tonight's supermoon, the other is happening on august 30th. so the beginning and end of the month. >> so much fun to see that, if you can. >> it's very bright, but at the same time we do have the meteor shower happening. when you have a supermoon and a meteor shower, you may not see some of the faint meteor streaking across the sky. you may be enjoying the super moon and then you see a meteor. so that's going to be something cool to enjoy duringhe night sky. the peak of the met shower will actually happen when we don't have a full moon, so that's good news. that's august 11th through the 12th, where you can see 150 to 200 meteors if you're patient. now we're going to see today

another rare sight, cooler than normal temperatures in the peninsula, expected to reach the low 70s. it will be mild, breezy with a mix of sun and clouds. the south bay reaching the upper 70s. in the tri-valley, the low 80s and in the north bay expect it to reach about 83 today, while san francisco stays in the mid-60s. and, mike, you've been concerned about what you see at the bay bridge. >> not the volume itself, but notice the volume is about mid parking lot, that's fine, great for a tuesday. it's these lanes, the hov lanes, they're backed up well past the over-crossing. that basically never happens unless there's an incident going on just past the toll plaza, but shy of the metering lights. i believe that's what's going on. those lanes also showed a backup early, too. so we're checking the sources. i can show you what we see at oll plaza. mi lanes are doing the best. over here doing better, westbound 80 approaching the

this is a four-alarm fire now. it has grown so quickly in size. it's on oakland street and octavia. you can see from the video a few floors of the building completely were engulfed and believed to have collapsed. it appears to be a building under construction. we reached out to san francisco fire department, who are on the scene right now. so far they just tweeted out information that there are no injuries so far. we know that they had to evacuate people in surrounding areas there. we do have our reporter ginger conejero saab heading to the scene. she'll join us with a live report as soon as she arrives. a brand new poll from "the new york times" puts a biden/trump presidential race at about even. >> scott mcgrew joins us. former president trump faces a number of criminal charges but that's not really affecting his popularity. >> good morning to you. more charges might be around the corner. we'll get to that in a little bit. as for "the new york times" poll, it shows a tight race in

the theoretical matchup and shows strengthening report for biden among democrats. at first democrats didn't want biden to run again, citing his age. truthfully, that probably hasn't changed but democrats are now accepting he's running. "the times" poll shows biden and trump tied at 43%. 43% of potential voters favor biden, 43% of potential voters favor trump. there's a 3.7% margin of error. something to remember any time some reporter gives you percentages like that, 43/43, remind yourself, we don't elect presidents that way, we elect them state by state. when you look at the race to 270, 270 being the number that you've got to get in the electoral college to win the presidency, then the percentages are less important. it comes down to arizona and pennsylvania and georgia and a few other states. three republican lawmakers

say they'll launch an investigation into the plea deal between the trump prosecutor and hunter biden. the plea deal rejected by a judge. now, it's not clear what deal they're going to investigate because the two sides are busy rewriting that document to get it back in front of a judge. separately, a house oversight committee said it heard testimony from one of hunter biden's business associates who said hunter biden would get his father on speaker phone to impress business clients. as many as 20 times over ten years. but that the older biden never discussed business. we're waiting on transcripts. it's been two weeks since former president trump was informed he was the target of a federal investigation into election interference. five days since his lawyers talked to those prosecutors. we simply do not know if or when an indictment might come. we're also waiting on the grand jury in georgia. that's a state criminal case investigating election

the low 80s, danville reaching 80 degrees, 79 in martinez, and in oakland 74 degrees. low 60s near the coastline and in daly city 62 degrees. we're seeing low 60s in san francisco for the most part. mission district reaching 65 and 69 in mill valley, with the north bay, most of those areas in the upper 70s. still reaching the low 90s in ukiah and clear lake. as you've probably seen at the bottom of the screen the seven-day forecast shows hotter temperatures ahead. right now we're getting a surge of monsoon moisture that could cause thunderstorms to develop. we're seeing these high clouds moving in, that gives us a very interesting look to the sky. we'll see that continue today, but dryer air coming in tomorrow. livermore will see temperatures in the upper 70s through the next couple of days, but then take a look at the weekend ahead. 97 for the high temperature on

6:56. welcome back. we're moving you forward with a look at our top stories on "today in the bay." >> we are following breaking news right now out of san francisco, a fire burning in hayes valley. take a look at this. police got a call around 4:00 this morning of the four-alarm fire. it was about 50 minutes ago, i should say. this is at oak street and octavia street, there are around 140 firefighters trying to battle those flames. a few of the floors of the building are engulfed in flames. parts of that building collapsing. it appears to be a building under construction. san francisco fire department is asking people to avoid that area and not drive over the water hose as they try to put out those flames. we do not know the cause of this fire just yet. so far, no reports of any injuries. we did send out an alert on our free nbc bay area news app.

we're going to keep you updated on the status of this fire. make sure you download our app, that way you can get alerts sent straight to your phone. we are also tracking a death investigation along a small stretch of roadway in oakland following a vegetation fire along 980 near the 17th street off-ramp. it started around 1:30 this morning. fire crews saw a man setting the fire. eventually first responders located a deceased burn victim who investigators say suffered some sort of head trauma. no word on if this was the person who they believe set the fire. no word of any arrests or the identity of the victim so far. eastbound 17th street off-ramp remains closed as that investigation continues. today is day two of a preliminary hearing for the suspect accused of stabbing tech executive bob lee back in april. during yesterday's hearing the defense tried to make a case the suspect, nima momeni, did not

have any malice toward the victim, bob lee. instead, momeni was angry at another man. the prosecutors reportedly also showed video of the night lee was murdered, including momeni spending time with lee half an hour before lee's murder. later today san jose city employees will vote on whether or not to strike. many city employees say they want to bring attention to the city's recruitment problems, as well as pay. there are more than 4,500 employees in the union. voting will run through friday and a strike could come as soon as next week. the city has offered a 5% pay raise in 2024. we've reached out to the city for comment. we have not yet heard back. time to get a look at that forecast. not a bad day today. >> not a bad day. it's going to be really nice, especially for the inland valleys. we take a break from the heat and we'll see that continue through thursday. but the heat will ramp back up again in time for the weekend. you guys showed the active fire. i want to show folks wherehat is. it's just off octavia and oak, that is a busy area right now,
