documents. and over alleged hush-money payments made in 2016 campaign. >> today marks two weeks since trump publically announced that he was the target of this probe. >> we're also keeping an eye on the fulton county, georgia, district attorney, preparing to present her case to a grand jury in the investigation of alleged election interference in that battleground state. former president trump has denied all wrongdoing. a lot to unpack. let's begin with garrett haake. where do things stand right now on the possibility of another indictment? >> reporter: well, kate, this is sort of their standard procedure, they're in for big

chunks of the day on tuesday and thursday, they're perilousy close to the end of their investigation based on the target letter that donald trump received is special counsel more t two weeks ago telling him as much. his attorneys came to washington late last week to meet with the special counsel's office and have one last conversation trying to fore stall an indictment. whether a decision has been made is something that we won't privy to until the indictment is handed up to the magistrate judge. we could find out right then or like we did with the classified documents case if and when donald trump's attorneys are informed that he's going to be charged. >> let's bring a former t. prosecutor, kristen, good to see you, if there's an indictment

here, what would the next steps look like? >> well, if there's an indictment we'll probably see the same type of process that we saw with donald trump in florida, post-indictment arraigned, formally presented with the actual charges and he'll be asked to enter a plea. he'll mostly likely enter into a not guilty plea and a trial date will be safe, they'll have to discuss how documents will be presented to the defense for discovery purposes but then, you know, they would set the bail and if it's anything we've seen in florida he'll be released on his own cognizant. >> you talk about history repeating itself, this is trump's third indictment, any difference from a prosecution or defense standpoint is that's the case? >> they all operate independent the existence of multiple indictments and investigations

can absolutely influence the strategy from both sides, because from the prosecution's standpoint this cases can bolster one another by accomplishing that m.o. which can used to argue criminal intent or this is politically motivated. each of these cases are distinct, they involve different jurisdictions, different charges. one other strategy is whether or not the e defendant actually wi testify, if he testifies in one proceeding, again, i don't expect him to testify, a question that will have to be considered with regard to the defense strategy. >> let's turn over to nbc news senior washington correspondent hallie jackson, a "the new york times"/siena college that asked registered voters if the 2024

presidential election now who would get your vote. it's kind of a dead heat between president biden and donald trump. some people in there who don't say either right now and when they asked them biden gets the slight edge, i'm wondering, does that say that maybe some voters in the middle, undecided, aren't sure how to read all of these potential indictments or already indictments in. >> if you pull back up that graphic, what it says to us, the numbers on the very end as it relates to independents donald trump's grip on independents 42 percent would break for biden and 37% would break for donald trump. his grip on the united states isn't as strong on the republicans. based on the same polling, seven in ten likely republican voters believe that the republican party should get behind donald

trump. tose investigations against ates hithat's a big number, 70% and that echoes what we have seen all along from the months after the riot at the capitol and january 6th wouldn't down, you saw donald trump have a hold on the gop that hasn't gone away at least not for right now, the question is what about the political middle, other polls show about half of independents do believe that donald trump did something really problematic or did something illegally, that may not be an issue for donald trump in the primary, he has to get through the primary to get to the general election. but it's going to be a huge question mark come next february or march, when we know who the republican nominee will be if it's donald trump, that's where the question mark comes into play and some of these issues that he has legally could come to a head and if we see trials

right around that time. >> hallie jackson, garrett haake, great panel for us. hallie, don't miss her show, hallie jackson now, coming up at 5:00 p.m. eastern, streaming live on nbc news now. gilgo beach serial killer rex heuermann was in a courtroom today. >> he's pleaded not guilty in their murders. heuermann the lead suspect in the murder of a fourth woman. let's bring in ron allen who joins us outside the courthouse in riverhead, new york, what's happening right now? >> reporter: well the hearing just ended. heuermann, some still photographs that show him in a khaki pants, blue shirt. looked over at the prosecution as the prosecution was talking about the massive amount of

evidence they say they have in this case. that's what this was mostly about, called discovery and how the prosecution is going to get this information to the defense in the coming weeks and months. the next hearing date was set for late september, the 27th of september, but a lot of the discussion as we understand it between the judge and the attorneys not in court but on side bars and forth was about the logistics to get this information to the defense, 2500 pages of photos, documents, surveillance video, photographs from the crime scene, 13 years worth of investigative material is how the d.a. described it afterwards. they insist their case is extremely strong. so that's kind of where we are now. very brief appearance by the defendant. by the suspect.

about t shingrix t today. >> in the hayes valley area went up in flames this morning. neighbors are lucky the damage wasn't worse. >> the four-alarm fire is now contained with no injuries. you can see what is left of that residential building that was under construction behind us now. chief nicholson told reporters this morning the hayes valley neighborhood could have been severely impacted by this fire. luckily, it was not. but this morning many woke up frightened, ready to evacuate. people are displaced, fire and water damage and a mess in traffic because of the fire's location. these are the flames that woke unpeople this morning.

four-alarm fire from ma ask believed it to have been a residential building under construction on oak and octavia streets here in san francisco. the fire started before 6:00 this morning and quickly grew to a two-alarm fire before extending to four alarms as spread to five nearby buildings. those buildings on hickory and oak streets both have fire and water damage. residents have been evacuated and at this time there are eight people now displaced. they will receive aid from city services as well as red cross norcal. now, another building across the street has shattered windows. there is broken glass on the sidewalk that is still closed off. firefighters believe that damage was caused from the radiant heat from the fire. something fire chief nicholson says she experienced as soon as she arrived on scene. the fire chief said the damage could have been worse given the building under construction was completely vulnerable to fire risk. >> this particularly so because it's open walls, studs. there is no sheetrock. there is no fire blocking.

there is no sprinkles. it's just wood. waiting to go up. and so that's really what happened here. >> reporter: the scaffolding is still under threat of collapsing and that's why roads around this area remain closed. the scaffolding on top of the building, that burn needs to be taken town before the streets can be reopened. depending how long that takes, that can mean a messy commute for people using these major streets in san francisco. now, i did reach out to the construction company who is responsible for the building. i spoke to a gentleman that identified himself as one of the engineers to this building. he did not give much of a comment, quickly hung up the phone. the cause of the fire is still being investigated. we will await word for the latest on that investigation. in san francisco, bay area news. today is national night out. it's a day where many cities
