cooking. it's going to be really nice the next few days and cooler temperatures coming in. as we take a look at the marine layer, those morning clouds covering san jose right now, we're seeing that extending all across the bay area. but when we start out cloudy, we know it's going to be a cooler day and we'll be in the low 60s for the start and continuing to stay in the 60s through about 9:00, then starting to see the sky clearing out as we go into this afternoon. take a look at our afternoon highs. once again, back into the upper 70s and low 80s for much of the south, and for the east bay we're headed for 85 in antioch, oakland will be in the upper 60s. along the coastline, low 60s for half moon bay, with some upper 70s for other parts of the peninsula. so we're going to talk more about this coming up. cinthia is tracking this morning's commute. >> good morning, everyone. off to a pretty good start, already busy over 580 in dublin. we see headlights heading toward us. i'm not looking at any problems

around the bay area. sensors are green. we have the typical backup as people try to make their way out of the tri-valley. into the east bay, i'm noticing this crash coming in around concord. otherwise, our drive times look good. the tri-valley drive times, it will take about 26 minutes to get from grant line to 680, about 11 from 580 to vargas road. we'll keep an eye on how the morning commute develops, but for now back to you, ladies. for the first time in u.s. history, a former president is charged with trying to overturn an election. former president trump is facing a new indictment, and this is the third one. he calls this one fake as well. >> federal prosecutors say former president trump tried multiple strategies to remain president, even after he knew he lost the election. fighting back by comparing prosecutors to nazis as he continues his run for the white house. >> reporter: former president trump indicted on four new charges for what prosecutors say were trump's multi-pronged efforts to remain in the white house after losing the 2020 election. the federal indictment accuses the former president of taking part in three conspiracies, to defraud the united states by trying to stop the counting and processing of votes, to obstruct official proceedings by stopping the certification of votes on january 6th, 2021, and a third broad conspiracy to dis enfranchise voters. >> the attack on our nation's capitol on january 6th, 2021, was an unprecedented assault on the seat of american democracy. >> reporter: this is special counsel jack smith's second indictment of trump, the same prosecutor who charged trump with federal crimes over his handling of classified

month. reporting in washington, drew petrimoulx, "today in the bay." coming up on the "today" show, donald trump's attorney is speaking out on the recent indictment. the interview is coming up at the top of the 7:00 hour. new this morning, bad news for the u.s., the country's credit rating has been downgraded. the rating agency fitch dropped america's credit rating from aaa to aa+. fitch said they had noted a steady deterioration over the last 20 years. investors use credit as a benchmark for how risky it is lending money to the government. covid cases once again rising across the bay area, and doctors say they are seeing more positive tests, along with increased hospitalizations and emergency room visits. so are we once again seeing a summer surge? "today in the bay"'s ginger conejero saab is live for us in san francisco. ginger, how does this recent kind of increase look compared to the other ones we've seen?

>> reporter: well, kris, the numbers show there is an increase in different markers, but it is being characterized as a swell rather than a tsunami, which is a bit reassuring, more reassuring than we've heard in years past when we've heard of an increase in numbers. according to san francisco city's public health website, the current seven-day average of new cases in the city is 38 as of july 24th. now, that average was in the high 20s mid july and it crept up in the third week. infectious disease expert dr. peter chin-hong says in terms of the number of cases we're seeing now, it is far lower than what we saw in the last three years. but omicron and its subvariants are still around. he says carry on with your life and be careful. >> in terms of the pattern over the last few months, we don't expect there to be huge changes,

but rather just very incremental changes, so that the vaccine in september should be a really good match. >> reporter: speaking of vaccines, dr. peter suggests if you are immunocompromised or older, have a conversation with your doctor about whether or not you need to get boosted, have a paxlovid plan and know if you have drug interactions, also carry around a mask and use it when you feel like it's needed. now, a new vaccine will be out in september as dr. peter mentioned. if you are relatively healthy, you can wait until september to get that booster. if you are immunocompromised or older, you may want to consider getting the vaccine that's out now. vaccines are guaranteed to be available, at least until the very end of the year, that's here in california. in san francisco, ginger conejero saab, "today in the bay." >> good to know. thank you so much. oakland police are investigating a dog napping that ended with a teenager shot. it happened monday night at

11:00 on hunter avenue. mercury news reports two men and a 17-year-old had arranged a deal to sell two french bulldogs worth more than $3,000 each. that's when three armed suspects approached the group, stole the dogs and robbed the victims. the suspects then opened fire, hitting the 17-year-old. the victim will be okay. police have not released any information on the wanted suspects. police departments across the bay area gathered for national night out with the community. officers were out in the east bay, peninsula, and the south bay. in antioch organizers say neighbors were most concerned about a rise in crime and the police department's text messaging scandal, which involves a number of officers accused of exchanging racist and homophobic messages. at this event in oakland at an apartment building in the laurel district, police shared crime prevention tips, hoping to raise awareness, along with strengthening relationships within the community. the organizer has been a

national night out participant to help get events going, she says they've become more popular over the years. >> it shows that we care, we want to make sure we're all safe together, not individually. >> law enforcement tells us they tried to have officers stop by as many events as possible without compromising public safety. taking a live look outside at san jose, we can see that little blanket of cloud cover over the city. kari, it's looking nice? >> it does lk nice. it's going to be cooler today and the next couple of days. we can enjoy lower than normal temperatures. let's get a look at your start of the day in gilroy. it's going to be cloudy and staying cloudy for the next few hours all the way up until about 10:00 to 11:00, and then we'll see much more sunshine as we go throughout the day. that blanket of clouds keeps those temperatures from warming up too quickly. as we take a look at our high temperature versus what's average for the second day of

treasury departments say they strongly disagree with the decision. it was lackluster to start the month, the dow rising 71 points and closing off highs. the nasdaq and s&p 500 ended in the red. in focus today, we'll get data on mortgage applications. we just got numbers on hiring in the private sector. adp said they saw 324,000 new jobs last month. earnings from cvs were better than expected, as well as humana. meantime, this story just boggles my mind, tinder is preparing to launch a new high-end membership this fall and a product refreshment aimed at catering better to gen-zers with deep pockets. it was confirmed earlier this year by company executives who dubbed the $500 a month offering of tinder vault as their new

of san anselmo over a land dispute. in may he filed a lawsuit against the heirs of his deceased neighbors and city all to make sure he can keep a driveway. in the lawsuit he says neighbors might have an interest in the land and he wants to continue to use it as a driveway as he has done for 30 years. the town council will decide that matter very soon. i was putting off talking about slime, because who wants to clean up that mess? we are going to see it at the super bowl, though. that is trending this morning. >> nickelodeon will air an alternative telecast for super bowl lviii. when a touchdown is scored, slime will cover the end zone and there will be other special effects throughout the game. it will air at the same time as the regular super bowl on february 11th. >> cinthia, they do that for a lot of the regular games throughout the year, they have a

kid correspondent, they have the slime and all of that stuff. >> what do they do for the halftime show? >> i don't know. you watch the regular halftime show. >> you see rihanna covered in slime. >> maybe a little coverage would be okay. >> it might help. especially for the janet jackson one. >> oh, my gosh. we're going to have some great weather, we'll be talking more about football. we're still in baseball season. as we take a look at oakland right now, it's going to start out in the upper 50s. you'll have a nice, cool start to the day. it's going to be very slow to warm up as we go late morning into the afternoon, and the clouds will linger a lot longer. it will be a little cooler than what we usually see for this time of year. so in los gatos expect it to reach 85 degrees, about the same in east san jose and morgan hill. as you take a look at the seven-day forecast at the bottom of the screen you'll see that this weather will not last. we're headed for 82 in walnut

creek today, while in oakland we'll see highs in the upper 60s, and low 60s for daly city, san mateo reaching 70 degrees, and 76 in redwood city. in san francisco, upper 50s from the marina district to the outer sunset, and then for the mission district, reaching 64 degrees. for the north bay, it will be 80 in sonoma, with low 90s still in clear lake, and then low 60s near the coastline. overall we're still seeing this surge in humidity, but some dryer air is starting to come in. there still will be the chance of that monsoon moisture, but as dryer air comes in, we're going to see rain chances going down just to our south and east. we're also going to see temperatures going up, high pressure will be building, we'll see a change in our weather pattern, and, unfortunately, we'll go from nice and mild to very hot for the weekend. concord reaching 102 degrees

this upcoming sunday, so make sure you put that in your weekend outdoor plans, it's going to be hot in the valleys. we are going to see a big spike in temperatures, but we do see it dipping back for next tuesday. for san francisco, expect temperatures in the mid to upper 60s through friday. saturday is still looking nice and there still will be a wide range in temperatures from the coast to the inland areas. cinthia, you were looking at a couple of issues. what's the update? >> so the latest update we have right here on this crash going westbound, highway 4, so the commute direction for some people, right around the solano way off-ramp, a motorcyclist and a semi did get it. last check, they did call out both the ambulance for the motorcyclist, and they also called out the flatbed to get the motorcycle out of the roadway. we'll see how long that backup lasts. otherwise, the number three lane is blocked there. the rest of your commute times, in coco county, it will take about 30 minutes from antioch

under way to find out what led to a child ending up unresponsive in a pool at a south bay high school. it happened during a summer program at harker school in san jose on monday. a nurse found the student and performed cpr until paramedics arrived. the child is now at the hospital, though his or her condition is unknown. and it's not clear how this happened. the school released a statement reading in part, we continue to send our thoughts and prayers to the family and are focusing on their needs and respecting their privacy. we are providing counseling services for campers, students and staff, and we have canceled summer camp for the rest of the week. former president donald trump is facing a new indictment, all related to alleged efforts to overturn the 2020 election. this is the first time in u.s. history a former president has been charged with trying to win over an election. prosecutors say he tried multiple strategies to remain

president even after he knew he lost the election. >> trump's attorney is speaking with "today" show's savannah guthrie. he argues this is the first time the first amendment has been used to criminalize speech. he says the indictment is about the former president's conduct, not about speech. >> he can speak all day. >> of course, you can take action in the political sphere. for example, let's say somebody opposes a law in congress. do a filibuster. that's political speech, political action. there's nothing wrong with that. what we have, we have something that no one else realizes -- >> there is something wrong with sending fake electors, trying to go around the law. >> these were alternate electors, which john kennedy did in 1960. it was an exact protocol that was followed previously. >> different situation and the indictment alleges that some of these alternative electors weren't even aware, they thought this would only come up if there were a legitimate dispute in court. >> absolutely. and what president trump had was an actual opinion of counsel

last year. the trial is set to start in november. also happening today, mma fighter cain velasquez will be back in court for a trial setting hearing. he's facing attempted murder charges. prosecutors say he shot at a car with a man accused of molesting his relative last year inside. 5:35 now, and a follow-up out of san francisco where firefighters are still investigating an early-morning construction fire in hayes valley. we brought you live breaking coverage of the story yesterday morning. the massive fire started around 6:00 yesterday in the morning, and the flames caused part of that building to collapse. the heat was so intense, it also cracked windows across the street. around 140 firefighters worked to keep the flames from spreading to the rest of the block. eight people, though, are now out of their homes and the cause of the fire is still under investigation. after nearly four months on the picket lines, hollywood writers are seeing some progress in their strike. the movie studios now requesting

a meeting this friday with the writers union to discuss negotiations, and that's the first movement we've seen in a while. the movie studio sent our sister station in l.a. a statement saying they are committed to finding a path forward. happening today, south bay neighborhoods will be treated for west nile virus after mosquitos with the virus were discovered. take a look at this map. vector control will start spraying tonight at 10:00 p.m. it includes san jose in milpitas. tomorrow at 10:00 p.m., there will be spraying in parts of sunnyvale and santa clara. we all know the cable car is certainly a symbol of san francisco. >> happening today, san francisco city leaders are celebrating 150 years of the cable car. the city put the first cable car into operation on this date in 1873, then the inventor had to pull the car from clay street down knob hill using an underground cable. in the 150 years since, those

air-conditioning for a while. take a look at our trend throughout the morning in the tri-valley. upper 60s by late morning and then for the south bay, we'll head for 83 degrees in los gatos and 79 in san jose. we move toward the east bay, temperatures range from 69 in oakland to 82 in walnut creek and 86 in livermore. we're going to see low 60s again along the coastline, half moon bay not going to see much sunshine this afternoon. in redwood city expect it to reach about 76 degrees, and 64 in the mission district. we'll see 80s in parts of the north bay, with sonoma reaching 80 degrees, and some upper 70s for santa rosa. look up in the night sky, we are going to have more of those meteors every now and then. we are now approaching the peak of the meteor shower that doesn't happen until august 11th, but between now and then you may see a little bit of something. we had the supermoon last night and that may dim the view of some of those more faint

meteors, but just a heads-up you may see some meteors over the next couple of weeks. we take a look at concord and our temperature trend that goes from highs in the low 80s to mid-90s on saturday. it is going to be a hot weekend. if you are planning outdoor activities, maybe incorporate some water activities. it's going to be 102 degrees on sunday. we're going to see those triple digits hitting some of our inland areas for the weekend. on monday, it's still hot. that's when a lot of kids are going to be going back to school, and mid-80s for tuesday. we're not going to see as much of a big ramp-up in san francisco. how are things picking up in the east bay? >> they're definitely picking up. let's go into the panole area. a buildup is stretching, westbound 80, right as you approach the appian way off-ramp. we don't have details of how
