very good wednesday morning to you. 6:00 right now. thanks for starting your day with us. i'm laura garcia. >> i'm kris sanchez. marcus washington has the week off. we get a ladies' night in the morning. good to have you with us this morning. >> that's right. we'll have more on a lot of news going on right now. first, let's check the forecast with kari. a mild day today? >> yeah, we've been talking about how it cools down for the middle of the week. we are going to see temperatures dipping today. looking at novato as you get ready to head out. it's in the upper 50s. temperatures will remain about the same. as we go around the bay and take a look at what we're expecting for today and what's average for this time of year, santa rosa today will reach a high of 78 degrees, but we normally on the second day of august hit about 83 degrees. you can see that we are going to be lower than what we usually

see, but we're going to try to take it in because we have high heat ahead in our weekend forecast. we'll talk more about that in a few minutes. cinthia, you've been tracking a couple of crashes. >> this one is still going on, came up about ten minutes ago in the east bay, as people are making their way over westbound 80 around pinole. so you have trader joe's right here, pinole valley high school. we're seeing the backup extend into parts of rodeo. this crash, not sure how many people have been involved at this hour, if there are any injuries. but it's right in the area as you get off into the appian way off-ramp. we're going to check on details and check what's going on in the rest of the bay in a few minutes. for the first time in u.s. history, a former president is charged with trying to overturn an election. former president donald trump facing a new indictment. this is his third, and he's calling it fake. federal prosecutors say trump tried multiple strategies to remain president, even after he knew he lost the election.

"today in the bay"'s drew petrimoulx joins us live from washington. drew, trump is certainly fighting back here. he's been comparing prosecutors to nazis as he really tries to continue even his run for the white house. >> reporter: yeah, he certainly is, and these allegations are truly extraordinary. federal prosecutors say former president trump tried multiple strategies after an election he knew he had lost. trump, as you said, fighting back, comparing the prosecution to nazi, germany, as he continues his push to return to the presidency. former president trump indicted on four new charges for what prosecutors say were trump's multi-pronged efforts to remain in the white house after losing the 2020 election. the federal indictment accuses the former president of taking part in three conspiracies, to defraud the united states by trying to stop the counting and processing of votes, to obstruct official proceedings by stopping the certification of votes on

january 6th, 2021, and a third broad conspiracy to disenfranchise voters. >> the attack on our nation's capitol on january 6th, 2021, was an unprecedented assault on the seat of american democracy. >> attorney general merrick garland appointed smith and says smith is acting independently. >> mr. smith and his team of experienced, principled career agents and prosecutors have followed the facts and the law wherever they lead. >> reporter: but trump and his defenders say the prosecution is politically motivated. >> this is the first time that the first amendment has been criminalized, it's the first time that a sitting president is attacking a political opponent on first amendment grounds and basically making it criminal to state your position. >> reporter: trump taking to social media, writing, why didn't they bring this ridiculous case two and a half years ago? they wanted it right in the middle of my campaign, that's why.

former vice president mike pence had a different take. in a statement responding to the indictment, he says anyone who puts themself over the constitution should never be president of the united states. a sharp rebuke from the man who was once trump's running mate. >> amid all this legal trouble, trump is still campaigning for the 2024 election. california republican party announced donald trump will be its keynote speaker at its convention later this month. that convention happens september 29th to october 1st in anaheim. more bay area tech companies are cutting jobs, and this time it's thermo fisher scientific and jabil. thermo fisher scientific makes analytical instruments and is laying off employees in pleasanton and south san francisco. jabil is a global manufacturing company and is cutting jobs both in livermore and in fremont. also this morning, covid cases are rising across the bay

area and doctors say they are seeing more positive tests, along with more serious cases, leading to hospitalizations and emergency room visits. so is this another summer surge? "today in the bay"'s ginger conejero saab is live in san francisco for us. good morning, ginger. how does this surge compare to the ones we've seen before? >> reporter: good morning to you, kris. now, we are seeing these numbers increase, with the differently markers, but it is being categorized as more of a swell rather than a tsunami, which is much more reassuring than it has been when we've heard of increasing numbers in past years. now, according to the city and county of san francisco's public health website, the current seven-day average of new cases here in the city is 38 as of july 24th. that average was in the high 20s mid july, and it crept up in the third week of the month. now, infectious disease expert dr. peter chin-hong says in

terms of the number of cases we're seeing now, it is far lower than what we saw in the last three years, but omicron and its subvariants are still around. he says carry on with your life and be careful. >> in terms of the pattern over the last few months, we don't expect there to be very huge changes, but rather just very incremental changes, so that the vaccine in september should be a really good match. >> reporter: and speaking of those vaccines, dr. peter suggests that if you are immunocompromised or older, have a conversation wour doctor about whether or not you need to get boosted now or wait until september. have a paxlovid plan, if you know -- so that you know whether or not you have drug interactions with paxlovid, and usthen you feel it's k still and needed. the new vaccine that is set to come out in september, if you are healthy, you can go ahead

and wait for that new booster, dr. peter says, and if you are immunocompromised you may want to think of getting the vaccine that's out now. vaccines will be available, guaranteed available, at least until the end of the year here in california. in san francisco, ginger conejero saab, "today in the bay." >> we were just talking about that with the family, is there going to be another vaccine. thanks for answering the question, ginger. 6:07 right now. oakland police are investigating a dognapping that ended with a teenager shot. it happened monday night at 11:00 on hunter avenue. mercury news reports two men and a 17-year-old had arranged a de toell two french bulldogs worth more than $3,000 each. that's when three armed suspects approached the group, stole the dogs and robbed the victims. the suspects opened fire, hitting the 17-year-old. the victim will be okay. police have not released any information on the wanted suspects. police departments across the bay area gathered with community members for national night out last night.

officers were out in the east bay on the peninsula and in the south bay, and organizers say neighbors were most concerned about a rise in crime they say they're seeing, and the police department's text messaging scandal, which involved a number of officers accused of exchanging racist and homophobic messages in antioch. at this event at an oakland apartment building in the laurel district, police shared crime prevention tips, they helped to raise awareness and strengthen relationships with the community. the organizer, sylvia san miguel, has been a national night organizer for years. she says they're getting more popular. >> it shows that we care, that we want to make sure we're all safe together, not individually. >> law enforcement tells us they did try to have officers stop by as many events as possible without compromising public safety, of course. it's 6:09 on your wednesday morning.

halfway through that workweek. the second day of august already, and look at that. not as hot as we thought it would be. there's something for everyone and that's going to come over the weekend. if you like the cooler weather, you're enjoying that now. if you want the warmer weather, that's coming this weekend. so we take a look at a big range in temperatures. we're getting started this morning in fremont with clouds and temperatures in the low 60s. it's going to stay in the 60s throughout much of the morning and only reach into the low 70s this afternoon. take a look at our south bay highs, with cupertino reaching 81 degrees. it's going to be lower than we usually see for this date. and reaching the low 80s for east san jose and also low 80s for much of the inland east bay. hayward will reach a high of 70 and only low 60s for half moon bay. breezy wind, and a lot of clouds and fog. the ocean breeze is also making temperatures up and down the peninsula only reach into the

out pretty mild. upper 50s there. it's also breezy and we're going to see those gusty winds continue today, as that strong ocean breeze keeps our temperatures cooler than normal. we will have big changes ahead as we approach the weekend. i'll have a look at that forecast in a few minutes. and let's go over to the north bay, taking a look at southbound and northbound of 101 in san rafael. the commute looks good going from santa rosa, petaluma, down into san rafael. we'll take a look at what's going on in the east bay in just a few minutes. a quarter after 6:00 right now. wall street is set to open lower as markets react to the credit rating of the u.s. dropping. the rating agency fitch dropped america's credit rating from aaa to aa+. fitch citing several fiscal challenges that weren't addressed by congress and the white house following the debt ceiling showdown earlier this year. the white house and treasury department say they strongly disagree with the decision. also in focus today, for

investors, data on mortgage applications and hiring in the private sector, plus earnings from cvs health, yum brands and humana. users on the social media formerly known as twitter can now hide the once sought after blue checkmark. doing so will hide the checkmark on the profile and post, but the icon may appear in some places. according to the help center, this development comes months after 'x' rolled out its paid subscription. users of the subscription service pay $8 a month. before elon musk's takeover, the blue checkmark used to signify a user was verified. a nasa rocket launched last night and the spacecraft is carrying more than 8,200 pounds of science cargo, mostly experiments to be conducted on the space station. it is set to arrive at the iss this friday. and george lucas is suing

the town of san anselmo over a land dispute. lucas owns more than 6,000 acres and in may he filed a lawsuit to the heirs of his deceased neighbors over a road he and guests have been using as a driveway since the 1990s. the town council will decide the matter. a mother and son travelled thousands of miles to l.a. to see taylor swift, but the swifties almost didn't make it to the concert, they almost didn't come back from the wild. >> they are from the uk and made the long trip to los angeles to go to the eras tour, and on their week-long trip they decided let's go for a hike in the angeles national forest. they realized they were lost and had no cell service. thanks to the emergency feature, they were able to get a message out to rescuers. the family remained calm but

the early afternoon. it's going to be a cool day with peeks of sunshine, and we'll see a few of those clouds overhead as we go throughout the day. eventually we'll make it up to 81 in cupertino and 79 in san jose, with some low 80s for gilroy, reaching 82 degrees there. you've probably already seen the seven-day forecast at the bottom of the screen. big changes ahead for the weekend. enjoy the mild weather for now, with livermore reaching 86 degrees, but you compare that to the 69 in oakland and 70 today in hayward. we'll see daly city's high temperature reaching 60 degrees, redwood city headed for 76 degrees, and mostly low 60s from downtown to the mission district, down to the ingleside district, clear lake will reach 91 this afternoon. still hot there, but it's going to be much milder for napa, as well as santa rosa, reaching into the upper 70s. we've had a surge in monsoon

moisture. it still may trigger showers and thunderstorms for the sierra. but by tomorrow we see some dryer air coming in, and it's still going to be mild. we still will have an ocean breeze. but then after that, that's going to cut off, high pressure moves in and temperatures will ramp up. so take a look at the changes ahead. our inland areas going from low 80s to upper 80s friday, upper 90s saturday, 101 degrees on sunday. so, yes, it's going to be hot this weekend. san francisco is still going to provide that full range of microclimates, where we go from mid to upper 60s to mid-70s for the weekend. cinthia, you've been watching the roads and a couple of issues. >> a couple of issues on the roadways have since cleared within the last couple of minutes. let's check on what the bridges look like this morning. metering lights were turned on almost an hour ago and we can see the buildup as you make your way around emeryville and oakland. the san mateo bridge, all of these taillights heading into

the peninsula. let's check on our bridge drive times. richmond bridge, getting from richmond into san rafael will take you under ten minutes. the bay bridge is a little heavy as you make your way onto fremont street, about an 11-minute commute. the san mateo bridge just under 15 minutes as people make their way into the peninsula. as far as our south bay drive times go, sensors are looking good right now, about a 20-minute commute as you make your way from san jose to mountain view, and from highway 101 to highway 85 it will be just under ten minutes. >> thank you so much. next on "today in the bay," nbc bay area responds. >> some online job ads are simply too good to be true. job scams are exploding. job scams are exploding. i'm consumer investigator introducucing togo's's new frech dip p sandwicheses.

our consumer crew recently exposed how job scams are spreading fast. >> consumer investigator chris chmura's team made a video to show you how to spot bogus job postings. >> here is the scam in ten seconds. a crook creates a counterfeit website that copies a real company, they post job openings, people apply and hand over personal information, which the crooks use to steal people's identities. tons of people are taking the bait.

costing them millions. let's look for five tell-tale signs a job posting is a trap. we always show the scammers wearing hoodies and sunglasses, but that's not how you spot them. the first clue is in your browser's address bar. when scammers spoof companies, the address is often off by one letter. say they were posing as acme anvil company. they might use two es. trick two, a recruiter tells you to buy a new phone or laptop before you start your job. >> i would be cautious about purchasing any equipment. >> hr pro amber clayton says you're probably giving a fraudster your money. clue three, you only talk to the recruiter. hr folks told us real jobs, especially professional jobs, will require multiple interviews by video or in person. clue four a job is a hoax, a recruiter in a hurry. legit hr people won't rush you. clue five, your recruiter is a ghost. if a basic web search turns up nothing about your recruiter, you're likely dealing with scammer just trying to steal your identity.

>> i'm kris sanchez in for marcus washington this week. we want to get a look at the forecast because it's so darn lovely. >> it's going to be great to have cooler weather for a little while. we take a look at spots like walnut creek that do typically tend to heat up for early august, but take a look at what we're expecting today. a lot of clouds to start, temperatures going from upper 50s to mid-70s. make plans to get outside and take this in. for a lot of kids, it's the last week before school starts. so we look at our temperatures, we are going to have some upper 70s in santa rosa today, while the normal high temperature for august 2nd is 83 degrees. we'll be 83 in concord, but that's below their average high temperature. eventually it's going to be heating up, so i'll have more on that in just a few minutes. and right now, cinthia, you've been tracking some buildups that are not looking too bad. >> so far, staying relatively calm this morning. as you were mentioning with school right around the corner, things could start to pick up.

let's go over and see what's going on on 101 in palo alto, traffic there is flowing smoothly this morning both north and southbound. in fremont, we did have an earlier crash, it wasn't on 880, just off the road on fremont boulevard, right around where you see that big rig at the moment. otherwise, things have cleared. let's stay in the east bay and check on drive times. castro valley to the bay bridge and also whether you take 580 or 880, it will take you under 20 minutes, and right around 20 minutes to get you from highway 4 over to the bay bridge. ladies? >> thank you, cinthia. some very sad news this morning, a student was found unresponsive in a hot profile school in silicon valley. "today in the bay"'s bob redell joins us from outside harker school in san jose. do we know what happened at this point? >> reporter: we're not 100% sure. good morning, kris. we know a child did drown or

almost drowned at the pool at harker school behind me here on saratoga avenue not far from 280 in south san jose. the child was a student in the summer program school, yesterday someone found the student unresponsive in the pool on campus. a nurse performed cpr until paramedics arrived. the child was taken to the hospital. his or her condition unknown. not yet clear how this happened. the head of the school says the entire community is heartbroken, the school released a statement that reads, in part, we continue to send our thoughts and prayers to the family and are focusing on their needs and respecting their privacy. we are providing counseling services for campers, students and staff, and we have canceled summer camp for the rest of the week. if you're not familiar, the harker school is a nonprofit k-12 school that was founded back in 1893, and according to its website harker is the largest independent school of its kind in california.

attorneys for the man accused of attacking paul pelosi are asking for access to the pelosi home. lawyers for david depape filed a motion to have an investigator gain brief access to the pelosi home for an inspection. the hearing is coming up at 11:30 this morning and it comes after a federal judge refused to move the trial from san francisco to eureka. you will remember depape is accused of attacking paul pelosi with a hammer in his san francisco home last year. that trial is set to start in november. also happening today, mma fighter cain velasquez will be back in court this afternoon for a trial setting hearing. velasquez is facing attempted murder charges. prosecutors say he shot at a car carrying a man accused of molesting a velasquez relative last year. after nearly four months on the picket lines, hollywood writers are seeing some progress in their strike.

the movie studios requesting a meeting this friday with the union to discuss negotiations. this is the first time we have seen movement in a while. the movie studio sent our sister station in l.a. a statement saying they are committed to finding a path forward. an empty piece of land in the east bay may soon become new housing for people trying to make it in the bay. a new bill signed by governor newsom means a part of alameda's waterfront may soon become new housing and parks development. the city wants to turn the 42-acre site along the estuary into housing units and retail space. it would have nearly 600 units, retail shops, a new marina and four acres of waterfront parks. happening today, some south bay neighborhoods will be treated for west nile virus, after mosquitos with the virus were discovered. in fact, take a look at this map. vector control will start

spraying tonight at 10:00 p.m., it includes san jose in milpitas. then tomorrow at 10:00 p.m. they will be spraying in parts of sunnyvale and santa clara. the cable car we know is a symbol of san francisco history. >> yeah, happening today san francisco city leaders are celebrating 150 years since the first one took off. the city first put the cable car into operation on this day in 1873. then the inventor, back then the inventor had to pull the car from clay street down knob hill using an underground cable. in the 150 years since then, cars have grown to be a symbol of san francisco, and, of course, a huge tourist attraction. celebrating today is mayor london breed, hosting an anniversary event starting at 10:30. >> they're so cool. >> it doesn't get old. >> it does, but not really.

people make their way to the giants game tonight versus the arizona diamondbacks. first pitch is at 6:45. of course you'll see some local traffic around the ballpark, people hopping on or off of 80 toward the bay bridge, and people coming up from maybe the peninsula, the south bay through 280. so that will be going on this afternoon. something i wanted to let you know about that's going on this weekend will be in the east bay. eastbound 80 at highway 4, this will be closed starting friday night through monday morning. so what can we do to avoid this? we can hop on and take 4, immediately going east, and then come back to cummings skyway and go through the carquinez bridge. you can take, of course, the very long route and go up 680 through martinez and make your way into the north bay. they have one more weekend to go of this in about two weeks. they have been working on getting some of the road fixed through hercules, so just

to treat cancer. they believe they've found a way to treat cancer by turning it against itself. the head of the research team, dr. gerald crabtree, says he came up with the idea while walking the redwoods near his home. >> it occurred to me over the past 40 years one of the major accomplishments in cancer research was the identification of cancer drivers. these genes that when mutated drive the cancer proliferation. >> dr. crabtree does warn the treatments are a long way from being used widely. if developed, they have the potential to treat many kinds of cancer. new this morning, with bay area schools set to start in the next couple of weeks, sleep experts are warning that now is the best time to get kids back on a regular schedule. it is not uncommon for kids on summer break to stretch those boundaries of bedtime, but scientists have found about one week out is the ideal time to

start getting the kids back to a normal routine. one sleep doctor said the best way to get the right amount of sleep is that routine. >> it really should be a time that we put screens away, where we brush our teeth, we wash our face, we do a bath if we need to, then book, and then bed. sometimes it can be coloring, reading, depending upon the age of the child, puzzles. just something to really put a buffer between active day and now dimming the lights. >> studies have found that sleep deprived children tend to be more hyper and tend to have bigger emotional outbursts. while there are no magic numbers, a doctor we talked about recommends that teens get nine and a half hours of sleep, while younger kids should get as much as 11. >> wow, that's a lot of sleep. that's several days for me. trending this morning, you have another chance to be a billion dollars richer because nobody matched all six numbers

it's about 60 degrees and it will be a cloudy morning. we'll see that across the bay area. as we go toward late morning into the afternoon, a slow warming trend as we get a little bit more sunshine. let's zoom into the south bay with a look at our high temperatures this afternoon. we'll reach up to about 79 in milpitas and downtown san jose, 82 in gilroy, a breezy wind continues. sunny fhefternoon in mos concord, reaching so 83 in pleasanton and fnt. now, nea the coastt'sng to stay mostly dy, then you head to palo alto and it will be partly cloudy and 78 degrees. in san francisco we're back to some of the same temperatures we've seen recently, gusty winds up to about 18 miles per hour, and for the north bay we're going to see temperatures ranging from 67 in mill valley to 79 in novato and 91 in clear lake. so we are still enjoying some cooler than normal weather up until this high pressure starts to come our way a little bit

more. that's going to heat up the inland valleys and that will happen throughout the weekend, and into early next week. so let's take a look at concord and the changes we'll see. we're going from highs reaching 81 degrees to seeing those highs up to 101 degrees for the weekend. yes, it's going to be hot there, we'll see that widespread for the inland east bay to the south county, and also a hot start to next week. then tuesday it starts to come down just a little while san francisco still providing that wide range in microclimates. we'll be in the low 70s for the weekend and we should get a little bit more sunshine. cinthia, it looks like so far the commute is flowing well, but there's just a lot of people. >> yeah, there's a lot of people. this is definitely packed as you make your way from hayward into foster city, making your way to the peninsula. no major issues on the chp log for crossing the san mateo

federal prosecutors say former president trump tried multiple strategies to remain president, even after he knew he had lost the election. there are six other co-conspirators mentioned in the indictment that have not been indicted themselves. in an interview with "today" show's savannah guthrie, trump's attorney argues this is the first time the first amendment has been used to criminalize speech. savannah says the indictment says this is about the former president's conduct, not speech. you can watch the full interview with savannah guthrie coming up in just a few minutes on the "today" show. defense attorneys for the man accused of attacking paul pelosi are asking for access to the pelosi home. lawyers for david depape filed a motion to give an investigator brief access to the pelosi home for an inspection. the hearing is set for 11:30 this morning and it comes after a federal judge refused to move the trial from san francisco to eureka. depape is accused of attacking

paul pelosi with a hammer in his san francisco home last year. the trial is now set to start in november. a devastating incident under investigation this morning at a high-profile silicon valley school. a student in the summer program at harker school was found unresponsive in a swimming pool monday. the head of schools says the entire community is heart broken. a nurse found the student and performed cpr until paramedics arrived. the student is in the hospital. his or her condition is unknown. it's not clear how it happened. we are not done with covid yet and covid is not done with us. cases are on the rise in san francisco, but there is another booster to fight it. according to the city's public health website, the current seven-day average of new cases in san francisco is 38 as of july 24th. that is far lower than we saw in the last three years. but doctors remind us that the omicron and its subvariants are still around. some tips to keep you safe, have
