the rule of law. according to the indictment, pence took contemporaneous notes of his conversations with trump in the run-up to january 6th. those notes now in the special counsel's possession. and the judge overseeing this case will be tanya chutkan. she has become known for handing down sentences harder than what prosecutors have asked for. >> earlier this morning we had a chance to speak to one of trump's defense attorneys. we started with the timing of the trial. the special counsel said yesterday he would like to see a speedy trial. that is 70 days from now. are you ready to go? would you like to see a speedy trial? >> a speedy trial is the defendant's right. we are entitled to understand

what the charges are. we are entitled to do our own investigation. the special counsel or the justice department, the biden justice department, has had three years to investigate this. to take president trump to trial in 90 days, of course, is absurd. the question is why do they want to do that? if you want to seek justice, then you need to offer president trump an opportunity to get a hold of all the evidence and understand what the facts are. >> well, i assume you are confident you can win this case. >> absolutely. we're going to win. >> would you, at a minimum, say you would like to see this resolved before the election. >> i want to get to all the evidence. i want a chance to present our case to the jury. this is the first time the first amendment has been criminalized. it is the first time a sitting president is attacking a political opponent on first amendment grounds and basically making it criminal to state your position to to engage on political -- >> i have to give you a little time-out on that. >> yes. we have never seen that before. >> it says the president has a first amendment right to speech and the right to lie. this is criminalizing conduct, not speech. >> no. no, it's criminalizing speech for this reason.

what the president saw in this 2020 election was all these irregularities going on, affidavits, sworn testimony, examples of instances where the rules were changed in the middle of the game. he had every right to comment on that and act politically. in a criminal case, what they would have to show is all of that speech was not entitled to first amendment speech. they won't be able to do it. >> it's very explicit. jack smith saw this very argument coming. it says he is being indicted for conduct using unlawful means of discounting legitimate votes and subverting the election results. he says he can speak all day, but you can't engage in this conduct. >> for example, let's say somebody opposes a law in congress. do a filibuster, right? that's political speech. that's political action. there's nothing wrong with that, but what we have, we have something -- >> there is nothing wrong with a filibuster. there is something wrong sending fake electors. >> these are not fake electors. these are alternate electors.

of the arguments. let's finish this first amendment thing because we're hearing this a lot. oh, this is criticizing free speech. where are we going in this country if you can't speak your mind. is that a valid argument? >> if he had done what he said, i think this would be a different case. the prosecutors made it crystal clear here he is not being charged for his speech. he is being charged for the means that he used to try to subvert the will of the people, by putting forth fraudulent electors and, therefore, defrauding the u.s. government. it is not about calling the election rigged. it is not about saying that he's actually won. it is about the means he used to do that. the best example i can give you is if you look at your bank account today and it looks like a bunch of money is missing. you get to challenge that. you get to go on tv and say, i think that's my money. what you don't get to do is rob

that bank. >> another issue that's come up with the lawyers interviews and we can see this happening is an argument that president trump sincerely believed that the election was stolen and, therefore, you can never prove that he had a corrupt intent to defraud the american people. is that a valid argument? >> well, that will be for the jury to decide. the issue here, though, is there is a whole bunch of evidence -- and this is just in the indictment. this is not everything they have. in the indictment, they lay out chapter and verse all the times that mr. trump was told by everyone and their mother that the election fraud claims were bogus and that he had lost and he was aware of it and he acknowledged it. now, the jury will decide whether that amounts to corrupt intent, but that's the evidence they had. the evidence they had was that he was told and he just didn't want to hear it. >> let's turn for a moment to kristin welker on the political

side of this. we had a big discussion with the lawyers about when this trial might take place. it is really important because if this runs past the election, there is a world in which donald trump could be re-elected and has the potential of pardoning himself or ordering his justice department to drop the case. when is this trial going to happen? very interesting and very important. >> very important, savannah because it speaks to the strategy here. are the president and his legal team effectively trying to run out the clock so that the election is held before these cases go to court? in the meantime, he is trying to build momentum based off of this. from his first indictment to his third indictment, savannah, he's only gotten politically stronger. recent polls show 71% of gop voters do not think he committed a crime. one poll shows him with a 37-point lead over his nearest rival, ron desantis. look, this cuts both ways, und-raising.se he's seen a spike

the judge will take that into account, too. >> it is a fascinating indictment that goes to the heart of the matter whether or not this election was stolen. we will continue to cover it. thank you. it's a historic day. let's move to some chaotic moments in mid-town manhattan yesterday. a driver that was running from police and struc police and struck a group of pedestrians. it started when police tried to pull over a driver of a stolen vehicle, but the car sped off, slammed into cars. a cyclist and people just talking on the sidewalk. 10 people were hurt. thankfully, nobody suffered life threatening injuries the 20-year-old suspect was eventually taken into custody and now facing a whole list of charges. >> craig joins us now. >> yeah. good morning to you. the suspected gilgo beach serial killer appeared in court yesterday as prosecutors revealed some new evidence for the first time stephanie gosk has been following the story. joins us now with more details. >> reporter: good morning.

the head of the school says the entire community is heartbroken. a nurse found the student and performed cpr until paramedics arrived. the child is in the hospital. his or her condition is unknown. it's not yet clear how it happened. we are not yet done with covid. cases are on the rise in san francisco, but there is another booster coming to help fight it. according to the city's public health website, the current seven-day average of new cases in san francisco is 38 as of july 24th. of course, that's far lower than what we saw in the last three years. but it is a reminder, doctors say, that the omicron and its subvariants are still around, so keep yourself safe, make sure you have a paxlovid plan, know if you are taking any drugs that might interfere with paxlovid, and carry a mask in case you're in a risky situation. there will be a new booster coming next month. let's get a look at our forecast for this wednesday morning with kari. >> we're starting out with clouds around the bay area. that's going to keep those
