the backpack. i'm doing that as well. >> your kids are going back to school today. >> yeah, my mom is doing all that. >> the parents are looking at the roads and, of course, a very important forecast. it's still going to be hot today, the same heat like we had over the weekend will continue. it's just coming down a few degrees. as we get a live look outside in fremont, it is a mild 64 degrees. that's definitely warmer than where we usually start our mornings, and it is mostly clear. so our temperatures in the low to mid-60s for the next few hours. we won't see much in the way of that marine layer for the inland east bay because it's going to be another hot one. temperatures headed for 80 in oakland today, first day of school. it's going to be in the mid-90s for livermore, 93 in santa rosa and 91 in san martin. we'll talk about what's ahead coming up. mike, let's check in on the weekend freeway closure. >> we had the closure and we're

talking about antioch schools as well, where we often see signs of slowing on highway 4. that might be delayed as some parents see their kids off for the first day of school. the weekend closure, that did open up two lanes about 2:30 in the morning. since then, we've been seeing slowing, alternating green and yellow as they continue to move crews through the area. i believe the last of the crews has cleared the area. there was a little slowing heading toward the bridge. but everything looks smooth through that portion of the bay now. south bay along the peninsula as well, no delays. we'll track changes. back to you. the clock is ticking for former president donald trump's legal team to respond to the justice department. it is asking for a protective order against trump limiting what he can say publicly in the election probe case. trump's team now has until 2:00 today. "today in the bay"'s brie jackson says in the meantime, the fulton county courthouse prepares for another indictment coming out of georgia.

>> reporter: former president donald trump lashing out at special counsel jack smith over the weekend. >> if i wasn't, we wouldn't be under investigation by deranged jack smith. >> reporter: blasting the judge overseeing his 2020 election interference case, writing, there's no way i can get a fair trial with the judge assigned. that same judge set a 5:00 p.m. deadline for trump's legal team to respond to a request from the special counsel to block him from commenting publicly on parts of the case. all while trump's attorney and his critics speak out. >> the government, the biden administration would have to prove beyond a reasonable doubt that president trump did not believe that he had won the election. they will never be able to do that. >> he tried to steal the entire election and his lawyers up there are saying, oh, that's just a matter of him expressing his first amendment rights. that's deranged.

seen, we will win the presidency and have a chance to turn the country around. if, on the other hand, the election is not about january 20th, 2025, but january 6th, 2021, or what document was left by the toilet at mar-a-lago, if it's a referendum on that, we are going to lose. >> coming up next, watch the whole exclusive interview with ron desantis. we're taking a live look at san jose city hall, where happening today workers may announce plans for a three-day strike. unions representing about 4,500 san jose employees last week held a strike authorization vote. the results of which they will announce later this morning. these employees include people like emergency dispatchers, the folks who work at the san jose airport, and happy hollow park and zoo workers. they are trying to negotiate a new contract after the last contract expired at the end of june. now, if the three-day strike is authorized, it's not clear when it would happen. the chp this morning still

providing few details about the latest apparent freeway shooting in the east bay. investigators say the targeted car pulled into san leandro's police department parking lot where officers discovered an occupant had been hit by gunfire. now, it all unfolded yesterday a little after 2:00 p.m. investigators now believe the shooting happened on eastbound interstate 580 near grand avenue. there is still no update on the victim's condition. one east bay leader is now calling for a widespread investigation into all unlicensed contra costa county spas in connection with an apparent deadly legionnaires outbreak. the spa in question is zen day spa, which is now shut down. health leaders may not know the test results for a few days, but a hottub there is being tied to to recent deaths of people affected with legionnaires' disease. investigators say both victims recently used the jacuzzi.

a third person later became infected but later recovered. the supervisor says the spa operated its jacuzzi without a county health permit and was never inspected. >> we're going to devices a strategy to look at how to investigate these types of massage parlors and spas that are out there that may not have a county health permit, because there's no way to know unless you actually go into the facility and inspect it. >> health experts say legionnaires is rarely transmitted person to person. most commonly people get it when the bacteria is in the water and inhailed. a new breakthrough as lawrence lab to create energy through nuclear fusion. the lab announced teams last week again triggered a reaction producing more energy than what it took to create. this time, the process also produced a greater amount of surplus energy.

the first time it happened was last december. the lab used nearly 200 lasers to produce the first-ever instance of nuclear fusion. at that time the energy department called it a major achievement in developing a new clean power source on an industrial scale. a step forward healing for indigenous people in rohnert park. u.s. secretary of the interior met with people yesterday as part of her road to healing tour. this is a series of meetings that allows indigenous survivors of the federal indian boarding school system and their descendants a chance to share stories. the goal is to create an oral history of the trauma the policies created across the country. california had 12 such boarding schools, some of which were open all the way until the 1970s. >> my ancestors and many of yours endured the horrors of the boarding school a simulation policies carried out by the same department that i now lead. this is the first time in history that a united states

do to change for the school year. so when we take a look at our temperatures, it's going to be another hot day. the east bay valleys headed again into the 90s and we'll have the clouds returning starting tomorrow, cooler temperatures, and we may have some tropical clouds moving in. we'll talk more about that. let's get you started for the first day of school. in antioch it's shorts weather for today as you're thinking about what the kids will wear because at drop-off time it's already mild at 73 degrees, but headed for the mid-90s today. it's going to be hot in the inland east bay. it's still going to be pretty warm in the north bay, reaching 93 in santa rosa. san francisco, low 70s, and 93 in los gatos and morgan hill. tomorrow, temperatures in many spots drop by almost 10 degrees and we're going to have the mild weather into the middle of the week as the high pressure that caused the high heat starts to move away. but then it comes right back by the end of the weekend into early next week. so take a look at concord, where

we are going to have a fairly mild week ahead, after today's hot temperatures. and then for saturday and sunday you start to see the trend heading back upward and we're going to see more clouds moving in, more humidity and there will be a tropical system to the south that could spread clouds our way and make it feel more muggy by thursday into friday. i'll have more details on that as we get a little closer. mike, you were looking at the bay bridge? >> in fact, i want to show folks a different view. this is from san francisco, you're looking at the commute coming into the city, around the bend and making the final approach. it's a steady stream of headlights. everything is moving nicely coming off of the toll plaza. no slowing on the incline just yet. it's 5:21 now. we should see a little build coming through the east bay. with school starting in antioch, we're still seeing highway 4 show that build, but sometimes we see areas like antioch and oakland see a little bit of a lag for the first week of school

where we usually start, after such a hot weekend. and that heat continues today. we're only coming down a few degrees compared to those weekend high temperatures. we're still headed for 97 in concord today, oakland reaching 80 degrees and low 90s for novato, san francisco reaching 71. we'll talk about the cooling trend that will come our way over the next few days. mike, you've been talking a lot about the weekend closure. has it cleared? >> yeah, a fist bump. thumbs up. i was worried about the heat. the pavement did cure right on schedule and they reopened just about 3:30 a couple lanes, i believe the last of those crews are cleared from the area heading north as you cross the bridge toward the carquinez in the north bay. a little slowing in vallejo, highway 37, and highway 4 through pittsburg and bay point, typical patterns. no surprises. there's another angle of the bay

bridge. the metering lights should be turned on in the next six or seven minutes. the entire bay is starting to wake up with no major problems. we have some kids concerned about what today is. back to you. >> thanks a lot. well, today is one of the days that the bay area's largest school district returns to class. around 34,000 students will be in the classroom for that first bell in just a few hours. >> "today in the bay"'s bob redell joins us live from outside skyline high school in oakland. the fall semester not expected to be interrupted like it was in the spring. >> reporter: correct. good morning to you, kris and ginger. you'll recall that last may in the spring oakland unified teachers went on strike for over a week, so students were out of class during that time. the teachers and district, of course, finally came to an agreement on higher salaries and so-called common good changes that includes a reparations task force for black students.

so today those 34,000 students will return to skyline high school behind me and the district's 76 other schools. now, back to school means the end of summer, which can be a bummer, because you know what it's like. you want to stay home if you're a kid. but you can help ease your family back to school by coming up with a plan. we talked about a child psychologist who suggests getting organized, from school supplies to school clothes, to limit and minimize the chaos, establish a routine so kids know what to expect in the morning, when they get home from school through bedtime and start easing into it a few days before school resumes. schedule family time, especially time to read together. >> reading books give you different character, how to express your feeling, how to engage with others, life skills. so all these things, if they learn at home, then it will be easier for them when they go to

school. >> reporter: that was a child psychologist who also recommends you communicate with your kids' teachers, if you have middle or high schoolers, make sure they're in the loop about those communications. reporting live in oakland, bob redell, "today in the bay." >> you don't want to spring it on them, i got in touch with your teachers. they don't appreciate that, the teenagers. authorities have not identified the person killed in a crash last night along interstate 880 and it happened around 9:30 last night near the northbound whipple road off-ramp. the chp says an suv and a sedan collided, though it's not clear who was at fault or if anyone else was injured. antioch leaders this morning are considering a new action in response to a chaotic late-night weekend sideshow that critically injured one innocent bystanders. it happened at antioch marina and the nearby parking lot. police say when officers arrived a driver took off with no lights

and crashed into a hide rant. a woman in her 50s suffered serious injuries. officers arrested a suspected driver a few blocks away. several others were injured in two other crashes. in one case, a car became submerged in the san joaquin river. leaders are now looking at potential solutions to make sure the same thing never happens at the marina again. >> an option of bringing in some raised parking delineators, for lack of a better term, but rubberized raised pieces that will actually be placed in the marina. they're looking at the feasibility, what the cost would be. >> city leaders also point out the police department is currently dealing with staffing issues tied to the ongoing police texting scandal. 5:36 right now. we are looking live at san francisco, where happening today migrants and immigration

advocates are set to finish their 40-mile march. they are protesting 40 years of government inaction on immigration reform, they say. the two groups left over the weekend, one from petaluma, one from san jose, and they will alive together at the federal building in san francisco. organizers are calling on lawmakers to update a 1929 law called the registry bill that would give 8 million immigrants a pathway to legal residency. if this is passed, it would be the most significant immigration related legislation since 1986. also today, san francisco cabbies plan to protest the expansion of self-driving taxis. organizers last night tried to get the word out to taxi drivers at sfo. california public utilities commission will meet starting this morning to consider approving new applications for cruise and waymo now operating in the city.

supporters say it would be a boost for ai technology. but drivers are concerned about the threat the vehicles pose not just to public safety. >> it's a real threat to the livelihood of the driver, not only taxi drivers, certainly uber and lyft drivers. eventually, i think, bus drivers. >> those new applications were put on the back burner earlier this summer after san francisco's fire and police departments raised concerns. first responders say malfunctioning robotaxis have led to unexpected road blocks and traffic hazards. 5:37 now. and looking live at the golden gate bridge where we can see the kind of conditions that are cool at this time of the day. kari, it's not going to be cool for everybody. >> right. it's going to be our microclimates again and wide-ranging temperatures from the coast to the inland areas. we're headed for the 90s again

for much of the south bay. gilroy hitting 95 degrees today. as we move toward the east bay, antioch 99, so we're very close to 100 degrees. it's going to be warm for fremont, reaching the upper 80s. in san mateo, expect a high of 77 while palo alto will reach a high of 87. in san francisco, upper 60s for the downtown and mission district areas and reaching 90 in sonoma and 100 in clear lake. a few triple digits. tomorrow we'll head for cooler temperatures and we'll talk more about that in a few minutes. mike, you saw something new on the peninsula. >> it popped up as we were giving the last report. it's here on highway 101. the note is that is one lane blocked. the slow lane is possibly blocked from the latest report just as you're traveling past whipple, shy of 92. there's no slowing over the last few. we'll track that. also, not far from here, woodside we have one-way traffic control for highway 84,

though he can't convince americans that unemployment is at lows we haven't seen since the '60s, inflation down to a third of what it was. but a recent cnn poll shows 68% of americans think economic conditions are actually getting worse, just 32% say it's getting better. other news, they're blocking off traffic at a fulton county courthouse in atlanta, preparing for something big. judges have been asked to cut back on their schedule and no one has said specifically what's happening, but we presume it's going to be the state of georgia indicting former president trump on charges of election interference. the united states, of course, indicted trump on similar charges last week. since that indictment, trump has gone online to post, if you go after me, i'm coming after you, which could be interpreted as a threat to prosecutors, witnesses and prospective members of the jury. after the prosecution asked that trump be barred from making

we're headed back to the low to mid-90s in the inland east bay. and it's always like during the middle of the day when you see people out walking and you're just, like, hey, that pavement is hot. think about to take your dogs out walking and the time of day. now, if the air temperature is at 87, the asphalt is at 143 degrees. so it can burn those pets' paws. be mindful of that as you're making plans for your day. try to get the outdoor walk out early in the morning. we're headed back to the 90s for the inland valleys, but we do have some cooler temperatures ahead. take a look at tomorrow. much lower. we're going from 60s near the coast to low 80s for the inland east bay down to the south county. wednesday will also be another mild day. the high pressure that caused the weekend's heat is moving away, but we will see it returning by the end of the weekend into early next week. so we will get several days of a break. take a look at santa rosa and

what to expect. once again, hot today. still reaching into the low 90s. we'll be in the 70s from tomorrow through the end of the week. that's going to be a nice break. then heating up a little more for the weekend but still not too bad. we are going to see some spots in the inland areas reaching into the low 90s. today we're headed for the mid-90s. then looking at san francisco, it's going to be nice and cool. we may not see as much in the way of the fog today, but it will return tomorrow, bringing those temperatures down. we'll start out the day with mist and drizzle, reaching into the mid to upper 60s the rest of the week. mike, you're seeing a backup at the bay bridge. >> which is not a surprise. we are looking at that because last time we saw the metering lights hadn't really affected our view. it's a standard flow, hov lanes indicating that everything should be moving smoothly past the toll plaza. along the incline things start to slow down.

♪♪ ♪ everybody's gone surfing ♪ welcome back. trending this morning, as we hit the dog days of summer, it looks like literally everybody has gone surfing, including those furry friends, hanging 20 in pacifica over the weekend. that's where the world dog surfing championship returned saturday to linda mar beach. thousands of people gathered to watch those four-legged surf stars hit the waves. among the winners was rosy, a pooch from santa cruz that's been surfing since she was 9 months old. her owner says she go out at
