novato, 93 in santa rosa, and we'll see upper 80s and low 90s for the south bay, reaching 97 in concord. we're looking forward to cooler temperatures and we'll start to see that tomorrow, with highs mostly in the 70s and low 80s. mike, are you seeing any surprises out there? >> no, which does not mean it's a clear bay bridge toll plaza. it means it's filling up. that's the standard flow at 6:02. the metering lights have been on for about 20 minutes. no surprises through the maze. that's great. slower drives down the berkeley curve and highway 37 holding steady, maybe a little lighter than the first burst. slower stretches toward the racetrack. highway 4 continues with the build. no problems in antioch, but pittsburg and bay point. antioch, we have the first day of school and we're looking at a smooth drive but a build in the east bay. i think the crash is cleared from 101. back over to you. developing right now in washington, the clock is ticking for former president trump's

legal team to respond to the justice department. prosecutors are calling for a protective order limiting what trump can say publicly in the federal election probe. trump attorneys have to respond by 2:00 our time. "today in the bay"'s brie jackson is live in washington. brie, this comes as another indictment might be hanging over donald trump's head. >> reporter: that's right. good morning, kris. yeah, we are still waiting to see if there's an indictment coming out of georgia, but when it comes to today's deadline, prosecutors say that former president trump made multiple posts regarding the election interference case and warn that he could use evidence in a way that may cause harm to witnesses. former president donald trump lashing out at special counsel jack smith over the weekend. >> if i wasn't, we wouldn't be under investigation by deranged

jack smith. >> reporter: blasting the judge overseeing his 2020 election interference case, writing, there's no way i can get a fair trial with the judge assigned. that same judge set a 5:00 p.m. deadline for trump's legal team to respond to a request from the special counsel to block him from commenting publicly on parts of the case, all while trump's attorney and his critics speak out. >> the government, the biden administration would have to prove beyond a reasonable doubt that president trump did not believe that he had won the election. they will never be able to do that. >> he tried to steal the entire election and his lawyer is up there saying that's just a matter of him expressing his first amendment rights. that's deranged. >> reporter: trump's former vice president turned 2024 gop rival, mike pence, says he has no plans to testify against him, but is not ruling it out. >> they were asking me to overturn the election. i had no right to overturn the

election. i know we did our duty that day. >> reporter: other republican presidential candidates are also weighing in. >> of course he lost. >> trump lost the 2020 election? >> of course. joe biden is the president. >> reporter: the next hearing in the election case is set for august 28th. and back in june a federal judge issued a protective order barring former president trump from disclosing on social media or keeping evidence that the federal government is set to turn over to him in the classified documents case. >> thank you very much, brie. we'll be watching for that. even with all the legal troubles, trump is still far and away the leading gop candidate in early polling. but one fellow candidate, florida governor ron desantis, tells the "today" show there's still plenty of time to turn things around. >> if the election is a referendum on joe biden's policies and the failures that we've seen and we are presenting a positive vision for the

future, we will win the presidency and we will have a chance to turn the country around. if, on the other hand, the election is not about january 20th, 2025, but january 6th, 2021, or what document was left by the toilet at mar-a-lago, if it's a referendum on that, we are going to lose. >> next on "today," watch the entire exclusive interview with ron desantis. that will happen at 7:00 a.m. after "today in the bay." one east bay leader is now calling for a widespread investigation into all contra costa county spas without licenses in connection with an outbreak of deadly legionnaires disease. the spa in question is richmond's zen day spa, now shut down. health leaders say they won't know test results for another few days, however a hot tub there is being tied to two recent deaths of people infected with legionnaires' disease. investigators say both victims recently used the same jacuzzi

and a third person was infected but recovered. county supervisor says the spa operated its jacuzzi without a county health permit and was never inspected. we're going to device a strategy to look at how to investigate these types of massage parlors and spas that are out there that may not have a county health permit, because there's no way to know unless you actually go into the facility and inspect it. >> health experts say legionnaires' disease is rarely transmitted person to person. most commonly people get it when the bacteria is in the water, which is then inhaled by people. the chp still providing few details about the latest apparent freeway shooting in the east bay. investigators say the targeted car pulled into san leandro's police department parking lot, where officers discovered an occupant had been hit by gunfire. it all unfolded yesterday a little after 2:00 p.m.

investigators now believe the shooting happened on eastbound interstate 580 near grand. there is no update on the victim's condition. we want to look live at san jose city hall. this is where today workers may announce plans for a three-day strike. unions representing some 4,500 san jose employees last week held a strike authorization vote. the results they will announce later this morning. employees include folks who work in emergency dispatch, at the san jose airport, happy hollow park and zoo. they're all trying to negotiate a contract after the last contract expired at the end of june. if a three-day strike is authorized, it's not clear yet when it would happen. a new breakthrough for scientists at lawrence livermore lab in their quest to create surplus energy through nuclear fusion. the lab yesterday announced following several near misses, teams last week again triggered a reaction producing more energy than what it took to create.

this time the process also produced a greater amount of surplus energy. now, the first time it happened was last december, the lab used nearly 200 lasers to produce nuclear fusion. at the time the energy department called it a major achievement in developing a new clean power source on an industrial scale. oakland unified school district is the biggest district heading back to school today, and it's going to be a new school environment for both parents and kids. "today in the bay"'s sam brock is taking a look at how inflation and heat are creating new back-to-school challenges, and he has tips for how kids can handle the new classroom environment. >> reporter: good morning. i know many parents are waking up across the country this morning with the realization that the time has already arrived to send your kids back to school. now, you have a couple yourself, and there's a rude reality awaiting many folks, record-breaking temperatures and inflation that has driven up the

cost of school supplies. the increase is about 24% just in the last couple of years. the average family is spending almost $900 for kids between elementary school and high school just to get them back to school. we're going to take you to texas, among other places, where communities are really stepping up with back-to-school block parties and really assisting kids with free stuff from supplies to photos and everything in between. also, with respect to the temperatures, you really do need to be careful, because from southern california, the temperatures are 110 to 115, new orleans, atlanta, a lot of classrooms are going to be potentially approaching dangerous temperatures if their ac units don't work properly. we'll have tips on how to keep your kids safe coming up on the "today" show. back to you. >> thank you very much. the oak grove school district was just posting on instagram they got new hvac systems, so that's good news. >> we're thinking about that. a lot of bay area schools don't have air-conditioning, but we

definitely may have to incorporate that into the budget as temperatures get warmer with climb change. >> and unpredictable. it's been hot over the weekend, and for the first day of school it's going to be another hot day. the good thing is we have cool mornings, but of course that doesn't last all day. right now we're at 65 in san jose, 60 in napa and 59 in santa rosa. first day of school for oakland unified, it will be a mild 61 as you're heading out the door. it's going to be a really comfortable day as we are picking up the kids in the pickup line. you can roll the windows down. it will be 77 degrees. take a look at the range in temperatures we'll see across the bay area, reaching 96 in livermore this afternoon. we'll talk about a cooldown coming our way in a few minutes. you might need to fill up the gas tank before work or school. we don't want to slow anybody getting to school. starting in the south bay, spartan in san jose, $4.39 on east taylor street.

look at our temperature trend in brentwood. a warm start to the day. it is 77 degrees right now. it's been so hot over the weekend, it's going to be another hot day, as we already reach into the low 90s at noon. we'll get a look at cooler weather in our microclimate forecast and our first day of school forecast for antioch in a few minutes. san jose's drive, north 101, things are not as heavy as we typically see, even on a monday. there's not a lot of slowing on 101 through san jose. some folks may be prepping schedule changes for the start of the school year. farther north at ralston, the incident has cleared from the freeway. good morning. very happy monday to you. wall street still digesting friday's jobs report, wondering what it means for inflation. we do get new inflation numbers on thursday. both amazon and san francisco's cloud flare are contributing money and effort to a new program that dr. jill

bay, and we'll see in santa rosa today the high reaching 93 degrees. compare that to the 71 in san francisco and 77 in san mateo. but tomorrow we all get a cooldown. we're going to have a breezy wind kicking up that ocean breeze and the natural air-conditioning will be back. san jose will hit a high of 80 degrees. there's going to be a huge drop in temperatures as we see the shift in the wind direction, and a lot more fog and drizzle near the coastline. we're going to see 60s in san francisco, wednesday also looking really nice and comfortable. the high pressure that's causing the heat is moving away for a little while. it's going to be coming back in for the end of the weekend into early next week. you can probably already see those changes in the seven-day forecast at the bottom of the screen. let me show you the ten-day forecast for santa rosa. hot today, but only in the mid-70s tomorrow, and we're going to see some temperatures in the 70s throughout the week. it will get a boost in those high temperatures but that will

be a little more normal for this time of year, with some mid to upper 80s. so we see the changes ahead. breezy winds. our inland temperatures taking a big dip in some spots by about 10 degrees or more, thanks to that ocean breeze. and a lot of the low clouds and fog we'll see returning to san francisco may also produce some drizzle and that will linger throughout the morning. temperatures only reaching the low 60s there. mike, you were checking in on the commute through contra costa county. >> it looks great. we're focusing on 680 south as they make the split to 680 and 24 going this way. this area usually sees a heavier volume but right now easy drive. smooth flow of traffic at the interchange. there's the feed off of highway 4, but no surprises, and highway 37 a little build out of richmond, and of course the bay bridge with the metering lights on. we may see a different pattern for a lot of places because schools are coming back online. we talked about antioch and oakland later this week. a number of schools on wednesday

temperatures again this arch, especially for those east bay valleys and see clouds returning starting tomorrow with cooler temperatures. we may be watching some tropical clouds overhead, higher humidity and showers to our south. so a lot of changes this week. we are still going to have some of that heat we had over the weekend, but instead of triple digits, how about some upper 90s? we'll see that in concord this afternoon, 97, and some low 90s in santa rosa, and san francisco in the low 70s. we'll talk more about the cooler weather. mike, you've been watching a crash. >> i don't like this crash. the good news is this crash, we don't really think there are any injuries, southbound 680. tough space, right around mission boulevard. the vehicles got to the shoulder, but you see slowing. they're going to wait for chp to arrive, so that will be a distraction as the commute builds, south 680 heading past mission into sunol and fremont. we're watching that build. everything else is looking a little lighter, a little better

than we often see on a monday. of course the toll plaza does show the backup, but we have a loosely packed toll plaza. back to you. >> tough commute there. moving you forward on the return to school and one of the bay area's largest districts is starting class today. >> we're talking about oakland unified. 34,000 students will be back in their classrooms, and "today in the bay"'s bob redell is live outside skyline high school. bob, this is a very different picture from what we saw at the end of the year. no messy contract scrabbles. >> reporter: correct, and this should be their first semester since last semester that would be theoretically uninterrupted. you'll recall last may in the spring that teachers with the oakland unified school district, about 3,000 of them, went on strike for over a week, which meant students were out of class during that time until they finally did come to an agreement with the district. they agreed on higher salaries for educators and so-called

common good changes that includes a reparations task force for students. today those 34,000 students will return to skyline high behind me and the district's 76 other schools. back to school, of course, can be a bummer, but you can help ease your kids back into the daily grind by coming up with a family plan. we talked about a child psychologist who suggests getting organized from school supplies to school clothes, just to help limit the chaos. also establish a routine so your kids know what to expect in the morning, when they get home from school and through bedtime. and start easing into that routine a few days before school resumes. schedule family time, especially when it comes to time forer >> reading books give you different character, how to express your feelings, how to engage with others, life skills. all these things, if they learn at home, then it will be easier when they go to school.

>> reporter: that child psychologist we spoke with also adds another point, communicate with your kids' teachers. if you do have a middle or high schooler, make sure your child knows you're talking to their teacher. reporting live, bob redell, "today in the bay." >> thanks a lot, bob. >> welcome to parenting advice. >> exactly. authorities have not yet identified the person who died in a crash last night along interstate 880. this happened around 9:30 near the northbound whipple road off-ramp in union city. chp says an suv and a sedan collided. at this point it's not clear who was at fault or if anyone else was injured. 6:35 now. antioch leaders this morning are considering new action in response to a chaotic late-night weekend sideshow that critically injured one innocent bystander. it happened early yesterday morning at antioch marina and the nearby parking lot. police say when officers arrived, a driver took off with

no lights on and crashed into a hydrant on 9th and g street. a woman in her 50s suffered serious injuries. now, officers later arrested the suspected driver a few blocks away. several others were also injured in two other crashes. in one case, a car became submerged in the san joaquin river and one council member says leaders are looking at potential solution to say make sure the same thing never happens at the marina again. >> an option of bringing in some raised parking delineators, for lack of a better term, but rubberized, raised pieces that will be placed in the marina. they're looking at the feasibility, what the cost would be. >> city leaders point out the police department is currently dealing with staffing issues tied to the ongoing police texting scandal.

we want to take a live look at san francisco this morning, where happening today immigrants rights supporters will finish a 40-mile march to protest what they call 40 years of government inaction on immigration reform. two groups started marching over the weekend to the federal building in san francisco, one started from petaluma, the other from san jose. organizers are calling on lawmakers to update a 1929 law called the registry bill, which they say would give 8 million immigrants a new pathway to legal residency. if that passes, it would be considered the most significant immigration-related legislation since 1986. san francisco cabbies plan to protest the possible expansion of self-driving taxis. organizers last night tried to get the word out to taxi drivers at sfo. california public utilities commission will meet starting this morning to consider approval new applications for cruise and weymo.

supporters say it would be a big boost for ai technology applied in the real world, but drivers are concerned about the threat the vehicles pose, not just to public safety. >> it's a real threat to the livelihood of the driver, not only taxi drivers, certainly uber and lyft drivers, eventually, i think, bus drivers. >> those new applications were put on the back burner earlier this summer after san francisco's fire and police departments raised concerns. first responders say malfunctioning robotaxis have led to unexpected road blocks and traffic hazards. the commission is expected to hold a final vote this thursday. taking a live look at walnut creek this morning, where the sun has risen nicely and we may see more cars on the roadway at some point as people take the kids back to school. kari, you're watching the forecast. i was asking my girls, do you

good monday morning. it is 6:44. let's get you started in hayward with a look at your east bay forecast. it is 63 degrees, a little warmer than where we usually start. we're going to have some of the hot weather from the weekend continue today. we're going from 63 now to 80 at noon. we will have a cooldown in our forecast. i'll show you that in a few minutes. these folks have left hayward. we're looking at westbound, away from us, toward the peninsula, where things are moving smoothly through foster city. 101 starting to see build, especially in san jose. no surprises for the folks on the peninsula. a little slowing in the east bay and one crash as well. president biden wraps up his vacation, as many of us have. he will be back on the campaign trail today. scott mcgrew, he's starting out in the state that made a mark

trump elections interference case has given trump's lawyers until 2:00 this afternoon california time to respond to a request from the prosecution to bar trump from posting about the upcoming trial. over the weekend, trump posted, if you go after me, i'm coming after you, which could be interpreted as a threat to prosecutors, witnesses and prospective members of the jury. about an hour ago, trump went back online to call the judge who will be making today's decision unfair, and the prosecutors deranged thugs. here is one of trump's lawyers yesterday on nbc's "meet the press." >> mr. trump had every right to petition government and enforce his first amendment rights. that's why this indictment is an attack on the first amendment. the government, the biden administration, would have to prove beyond a reasonable doubt that president trump did not believe that he had won the election. they will never be able to do

and there will be showers around southern california. we'll be following that. here today, first day of school for our oakland kids, and as you get ready to head out at drop-off time, it's at 62 degrees. nice and comfortable, sunshine throughout the day. with we're headed for the mid-70s and you can roll the windows down and enjoy the sunshine. after school may not be a good time for some people in the inland valleys to take your dog out for a walk. think about this. when the air temperature is 87, the asphalt is 143 degrees. we saw people out over the weekend walking in the middle of the day with their pets, and if you wouldn't take off your shoes and walk barefoot, do not take your dog out and walk on hot asphalt. it's going to be another hot one. 97 in concord today, and it's going to be in the upper 80s for much of the north bay, still mild in san francisco.

tomorrow we all get a cooldown and our high temperatures will be in the 70s and low 80s. san jose reaching 80 degrees tomorrow. for san francisco, that means it's going to be chilly and we're going to see a change even for our inland areas. take a look at concord. looking out ten days, we will have a break from the heat, but it will start to get a little hotter in time for the weekend. not seeing any extreme temperatures ahead, but it will be nice to get some nice average temperatures and even cooler than normal in some spots, especially near the coastline. mike, you're seeing changes for the crash in fremont. >> the speed sensors are changing and chp says they have someone on scene, i believe they've been able to possibly clear this crash which was on the shoulder. there's still the build through pleasanton. no surprises, this crash on the shoulder for the nimitz. we see more traffic heading across the san mateo bridge. same thing for the bay bridge, as well as the south bay coming out of san martin. >> thanks, mike.

welcome back. we're moving you forward with a look at our top stories here on "today in the bay," and one of the bay area's largest school districts returns to class today. >> we're taking a live look now at oakland's skyline high school. today 34,000 students will return for the fall term there and the 76 other schools in the district. now, it will be without the threat of labor unrest. you can recall last spring oakland teachers went on strike for more than a week. the new agreement led to higher salaries and so-called common good changes, including a reparations task force and more say from parents and teachers in school decisions. one east bay leader is calling for a widespread investigation into all unlicensed contra costa county spas in connection with an apparent outbreak of the deadly legionnaires' disease. the spa in question, zen day spa, a san pablo avenue is shut
