97. we're forecasting a high of 101 degrees today. it is going to be brutally hot down south, savannah. >> thank you. now to breaking news out of southern california where two fire fighting helicopters collided in mid-air. the choppers were responding to a brush fire. all three people were killed, including a pilot, as well as two firefighters. >> and although this was a tragic event, we are also thankful today that it wasn't worse. the individuals in the first helicopter were able to land safely without incident and no one else was hurt. >> the crash is being investigated by the national transportation safety board. now to the latest on those legal troubles surrounding donald trump. the special counsel filing a request that seeks to limit any threatening rhetoric, witness tampering, revealing classified information, all of that, of course, tied to the third

criminal indictment. meanwhile, trump's republican rival ron desantis weighing in. we have two report this morning. we will start with kelly o'donnell. good morning to you. >> reporter: former president trump's legal team has until 5:00 this afternoon to respond to that protective order by the prosecution. the special counsel expressed concern about sharing evidence and have a chilling effect on witnesses because of past statements, including this post where mr. trump said, if you go after me, i'm coming after you. whether mr. trump's team said that was in response to special interest groups and the protective order violate mr. trump's first amendment rights and will oppose it. this is one of many expected motions, including a request for a venue change and the recusal of the judge. the legal team is also using the first amendment to argue against the indictment's allegations

that he improperly pressures former vice president mike pence and georgia state officials to overturn the 2020 election results. mr. trump's attorneys saying -- he never said anything bad or inappropriate, while the attorney saying the request of pence was, quote, jazz operationsal. he is speaking out and said he had no right to do what pence asked and pence would be asked to testify if compelled to do so at trial. craig? >> kelly, thank you. we move to trump's main rival in the republican race. ron desantis speaking out in an exclusive interview over the weekend with dasha burns who joins us from the campaign trial in iowa. good morning. >> reporter: look, former president trump is still clearly dominating the headlines and the polls. this latest indictment has done little to soften his edge or his

attacks on his primary rival, florida governor ron desantis. in our wide ranging conversaide ranging conversation, i asked the governor why he's not using that moment to take on the gop front runner more directly >> if the election is referendum on joe biden's policies and the failures that we have seen and we are presenting a positive vision for the future, we will win the presidency and we will have a chance to turn the country around if, on the other hand, the election is not about january 20th, 2025 but january 6th, 2021 or what document was left by the toilet at mar-a-lago, if it is a referendum on that, we are going to lose, and that's just the reality. >> but you know with trump in the race that is largely what it is going to be about and not fighting against joe biden, you are fighting against trump. >> that's not a pathway for success for the republican party. i think a lot of our voters understand that. >> reporter: yes or no, did donald trump lose the 2020 election >> whoever puts their hand on the bible on january 20th every

four years is the winner. >> reporter: okay. but respectfully, you did not clearly answer that question and if you can't give a yes or no whether or not trump lost, then how can -- >> of course he lost >> reporter: trump lost the 2020 election. >> joe biden is the president. but the issue is, i think what people in the media and elsewhere, they want to act like somehow this was just like the perfect election. >> reporter: governor desantis fighting his own battle to convince voters and donors that he has a shot to beat trump. despite lagging poll numbers, a campaign cash crunch, and relentless attacks from his rivals recently, his biggest individual donor threatening to pull back his cash unless desantis takes less extreme positions and shows he can win over moderates. the main concern, the six-week abortion plan in florida an issue democrats have used to run against him and other on the campaign trail the governor has implied the issue should be left to individual states.

so would you veto any sort of federal bill that tries to put a nationwide ban in place? >> we will be a pro-life president and support pro-life policies i will not allow what a lot of the west wants to do, which is to overside pro-life protections in the country all the way up to the moment of birth in some instances, which i think is infanticide. >> reporter: i have to push back on that. that's a misrepresentation of what's happening 1.3% of abortions happen at 23 -- 21 weeks or higher. >> but their view is is that all the way up to that, there should not be any legal indications. -- legal protections >> reporter: there is no indications of democrats pushing for that much of the desantis pitch to voters revolves around being a husband and father, and he's put his family front and center on the campaign trail, whether talking his education policy and highlighting his contrast in age

with his opponents but his wife has become his biggest asset. the former news anchor who grew up in blue-collar ohio brings the charm an charisma critics often claim her husband lacks. what made you both decide to bring casey in in such a big part of this campaign? >> can i answer this for the first one? okay because it is not like anybody said, oh, we need to deploy casey. no this is totally becaus i want to do it. >> reporter: in 2021 she was diagnosed with breast cancer. >> he was there and he was there to pick up my kids when i couldn't and he did it with humility and he did it with love. and i'll tell you what, you can't ask for a better husband than that. >> reporter: how does it feel to hear her say that? i mean -- >> well, look, that's -- you know, in sickness and in health, that's what you sign up for. so, i mean, she's not only my

one of the bay area's largest school districts, well, it returns to class today. here is a live look at oakland's skyline. today 34,000 students will return for the fall term there, along with the 76 other schools in the district. it will be without the threat of labor unrest. you can recall last spring oakland teachers went on strike for more than a week. the new agreement led to higher salaries and so-called common good changes, including a reparations task force, and more say from parents and teachers in school decisions. authorities have not yet identified the person killed in a crash last night along interstate 880 in union city. we do know it happened around 9:30 near the northbound whipple road off-ramp and the chp says that an suv and a sedan collided. we're not clear who was at fault or if anyone else was injured. we've been talking about that first day of school. let's get a look at the weather from meteorologist kari hall. >> it's still going to be hot

sports analyst lori good morning. we were all hoping this would be the simone we saw. were you surprised can you put into perspective how dominant this performance was? >> yeah. classics is a performance we see right at the beginning of the competition year to see simone go out there and win the competition this early on i think is per usual. we can expect great things but it sounds like she's really grounded and really present in her competition. >> over the weekend i saw a clip of it. a lot of folks were talking about when she lands this particular vault it's called the yurchenko double pike she tried it and nailed it back in 2021. put it in perspective, this move and how this typifies what separates simone from the rest of gymnastics. >> the only way i can describe this

vault is seeing someone put on a mask and say, "i'm a vigilante" versus iron man. this is really hard. it is extremely difficult. >> get technical because i think it is so interesting to hear you talk about it. why is it so much harder what is so far above what mere mortals can do >> yeah. so more often than not, we see double folds we see one less flip but two twists involved. simone said, you know what i'm going to add an entire flip before landing you have to be strong to brace for impact you have to be strong to get enough height to add one more flip and then be really smart in the air and have a sense of air awareness that simone is known for having so it's awesome. >> you got, i guess, the u.s. championships next in california then the world championships and she seemed like she was

playing a little coy about going to paris for the olympics. is there any universe in which simone biles does not go to paris next year? >> all i can say is she is an athlete that is so strong and so independent. especially with her post competition interview, she's talked about mental health and going to therapy once a week i think this version of simone in 2023 is someone who, again, wants to be present in the moment and i think an athlete who can connect their mind and body while competing, you can only expect really great things so i can't tell the future, but what i can say is she's phenomenal. >> to hear you talk about it i so valuable because you have been there you, yourself, as a gymnast went through a period of time where you had the twisties, now that we know what that means. >> yeah, it sucks. >> i can imagine it always being in the back of your mind for simone to pull herself together and, you know, have the confidence to do something so daring as that vault or really

at mt. sinai hospital in new york good morning to both of you. >> good morning. >> jill, on the outside you look absolutely beautiful how do you feel on the inside? >> first of all, thank you and it's such an interesting question i feel it. i am -- i grew up and we were just talking about this with my mother saying you never know what's going on with someone on the outside. -- on the inside so i look like myself, but i don't internally -- it's very tough. since i have seen you three weeks ago, which feels like yesterday and a lifetime as i'm sitting next to my superhero but i underwent a double mastectomy and they found i was stage two they found an aggressive tumor that spread into one lymph node. and, so, we removed some lymph nodes around that. so that's the first step and, so, i'm grateful that we caught it. and i'm grateful that there is a treatment plan going forward but it's a long road

and emotionally, and anybody will tell you this, it is earth shattering. >> well, it is life changing you're happy with how the surgery went. >> and it could not have gone better you know, jill went in with the best attitude i have ever seen in terms of we're going to take this and it's, you know, really a collaborative thing with the surgeon. it is such an honor to care for her. the results, the surgery went great and it generates a lot of information in terms of guiding the next step of treatment for her. >> you talked about what you learned with the stage two breast cancer. you still aren't -- you don't know yet what your exact treatment plan is going to be? >> yeah. we'll find out wednesday we took an onca type test which will tell us if chemotherapy treatment will help. correct me if i'm wrong. i took a crash course on this, unfortunately. but we'll learn if chemotherapy -- i most likely will need chemotherapy, but that will solidify it

and be here in the middle. it's not like this is ancient history. this is something you are dealing with right now you're giving this to others the brca gene mutation, you can be tested for it you haven't been tested for it because your mom was negative. you thought i must be negative, too. turns out it was on your father's side. so if people want to -- wh should be tested should everyone get a test >> you know, there is certain red flag situations, savannah, which warrant genetic testing for sure there are also situations where we find out someone is gene positive with no warning, you know, family history of breast cancer, certainly. especially in women at a young age. a combined family history of breast or ovarian cancer there are other cancers, prostate, pancreatic, melanoma also linked to the gene. if you have a family history of that, that should also trigger someone to be evaluated. >> you know, some people have

the brca test. maybe they had it ten years ago. should they retest are the test better now? >> that's a great point. starting in 2013, the test improved dramatically. we also have identified a host of other genes that also screen for breast cancer. we couldn't test for these before 2013. so now we test for a whole panel of genes yes, anyone who was tested -- we generally say pre-2013 should probably consider getting retested. >> male or female. >> male or female. >> first of all, our viewers, i mean, the amount of feedback we have gotten doing this in real-time. but the amount of people that have written they got tested, most with negative results, some with positive results and they're dealing with it with their doctors and a lot of people saying i'm afraid to test. all i'm saying i please go to your doctor and learn about the test because preventatively to do this is so much better than battling cancer
