're going totart out with a tuy morning. forecas for this meteorologist kari hall has bee tracking what we can expect. it's going to be much cooler today, big drop in temperatures coming after yesterday morning, starting out all clear in san francisco, we can see the fog is back. at times we may see this cloud

deck lowering and some mist and drizzle in the forecast throughout the morning. for gilroy, that means we'll start out with clouds and we'll see them linger through 7:00 to 8:00 before it starts to clear, and we'll be in for sunshine the rest of the day. but a slow warming trend, going from mid-50s to upper 60s, and eventually reaching up to 80 in san jose. some spots will see a 10 to 15 degree drop compared to yesterday. this is going to make a huge difference with a breezy wind and a lot of clouds throughout the morning. but it will be a very pleasant afternoon. livermore heads to 82 degrees. that will be one of the warmer spots across the bay area. we'll talk more about the changes ahead, also give you a look at how the roads are moving in a few minutes. >> we'll check back with you. thank you. developing new, travelers stuck and stranded. this is a live look at sfo. a major storm in the southeast is causing headaches right here in the bay area. right now there are 33 flights

delayed, seven flights canceled. yesterday sfo reported 180 delays and over a dozen cancellations. the storm itself is sweeping through eastern tennessee and north carolina, all the way up to upstate new york. thousands are without power in philadelphia, after a tree took down a power line and sparked a truck fire. in west virginia, heavy rain and strong winds sent trees crashing into homes. nationwide, thousands of flights have been delayed and more than a thousand have been canceled just because of this weather. there are new developments in the text messaging scandal engulfing the antioch police department. civil rights lawyers have sent this letter to the department of justice and california's u.s. attorney's office requesting they investigate allegations of civil rights violations. this comes after at least 45 officers are accused of exchanging racist and homophobic text messages. some of the texts described

police beating suspects and making up evidence. john burr is, one of the attorneys, says he expects the doj to issue key recommendations. >> there's a particular federal statute that says that the department of justice can come into a department and investigate it if they have reason to believe a discriminatory practice has taken place based on race, gender. in this case we have not only race, we have homophobic. >> the california attorney general's office, the fbi and the contra costa da's office are already investigating the police department. dozens of officers have been suspended and at least one has been fired. thousands of san jose city workers will walk off the job in a week, and while they fight for better pay, some residents in need of city services may be caught in the middle. >> "today in the bay"'s kris sanchez joins us with who will be impacted the most and how

close these two sides are to reaching an agreement. >> right now the two sides, the city of san jose and the two unions representing those 4,500 workers are far enough apart that those workers are planning to walk off the job next tuesday, wednesday and thursday. today the san jose city council will meet in closed session to talk about those wage negotiations. the south bay labor council voted last night to sanction that strike hours after this rally at san jose city hall. workers from the airport, libraries, the planning department, animal shelters, happy hollow park and zoo, all joined in solidarity with engineers and emergency dispatchers outside city hall. the head of the south bay labor council says the mayor is not doing enough to avert a strike, although the mayor says it comes down to higher wages or services for residents. >> you cannot generate revenue without a functioning planning department, you cannot keep libraries and parks open without

employees, and you cannot keep people safe without sufficient emergency personnel. >> the numbers are what they are, and now we're at a point where we're saying we can do a 5% raise, 3% of paid parental leave, and if we go any further, we're going to have to identify cuts and those are not going to be popular. >> the union wants 7%, 6%, 5% raise over the next three years. you heard the mayor talking about that 5% raise, moving on to 4%, 3% the two years following. the negotiations also include talks about extended paid family leave and also better retirement. when the workers hit the picket outsid sane city , the e of them airport, librarieommunity ces and t mlk library downtown. many of them will also be at the city council meeting tonight to really try to get the council to avert a strike. if you have business with the city, if you need a permit or

you want to take care of some other business, you're going to want to do that before tuesday. you may see workers picketing outside san jose's police department. we want to make clear, police and firefighters, also emergency dispatchers cannot strike because of their contract agreement. we'll continue to follow this, ginger. >> thanks a lot, kris. new developments in the latest case against former president trump. a federal judge has ordered a hearing to settle a dispute over the handling of evidence. now, trump's lawyers are pushing back on the justice department's request to limit what trump can share regarding evidence tied to charges he tried to overturn the 2020 presidential election. "today in the bay"'s drew petrimoulx has the latest in washington. >> reporter: in the late-night filing monday the judge overseeing the prosecution of former president trump over his alleged efforts to overturn the 2020 election calling for a hearing before the end of the week. the move comes after a series of tit-for-tat motions by special

he's heading west to announce new measures to protect land around the grand canyon and tout green energy jobs, at each stop fundraising for his re-election campaign. the judge is moving quickly to resolve these issues over the handling of evidence. in her order she calls for a hearing on the matter before the end of the week. drew petrimoulx, nbc news, washington. with students across california now starting to return to the classroom, fewer teachers are heading back this year. one recent study finds the state's teacher shortage is getting worse. for the first time in seven years, schools last year ended with 16% fewer teachers. those struggles extend across the nation. schools are finding it more difficult to hire teachers due to low pay, safety concerns and politics tied to certain curriculums. one former english teacher tells "today" she made the difficult decision to walk away. >> i have 150 kids every year, those are my kids.

and it killed me to leave them. to leave them behind and to say, i'm sorry, i cannot be here for you next year. >> last may alone, more than 50,000 teachers quit the profession nationally. as a result, insiders say more and more replacements are coming from outside typical teaching backgrounds with emergency-style permits. we're taking a live look now outside in san francisco, where i know yesterday, kari, you said it was very nice and pleasant in san francisco. i felt it as soon as i walked out the door this morning, definitely a little more windy. >> yes. >> what's our outlook? we've got a stronger ocean breeze coming in and we can see low clouds and fog back this morning. we're also seeing the cloudy start in san rafael this morning. temperatures are still pretty mild, but as we go throughout the day, the clouds will be slow to clear and we see our temperatures that will head for the mid-70s in novato today, 71

good tuesday morning to you. the time is 5:13. as you head out the door in oakland, it's going to be cool, cloudy and breezy. temperatures in the upper 50s. it will be slow to warm up and we'll only see peeks of sunshine throughout much of the morning. definitely a cooler day compared to what we've had, and it's going to stay cool for the next few days. i'll have more on that in the microclimate forecast. as you get out the door this morning, we are going to see a smooth flow of traffic across much of the bay area. i am seeing a few problems for the tri-valley, so we'll head over that way, we'll talk about what's going on in traffic in a few minutes. good morning. very happy tuesday to you. big day on the markets on monday. here is a company you probably have not heard of out of san

francisco, that stock was up 676% on news a drug they make that fights social anxiety seems to work. tesla, one of the few down arrows, otherwise a big rally in every other stock. the chief financial officer at tesla has quit and that news comes just ahead of the rollout of the cyber truck, already two years behind planned schedule. ceo elon musk says he may need surgery for some back and neck issues. the tesla stock fell about 2%. we get important price data on thursday and friday, consumer price thursday, producer prices friday. one of the interesting things to watch is going to be airline ticket prices. i'm sure it doesn't feel like it, but airline prices are actually down quite a bit. 19% from this time last year. we saw record prices in the summer of 2022. in fact, airline tickets are now, believe it or not, cheaper than before the pandemic. a little less than 2% less,

according to government price data, which averages out all the ticket prices. that may be why many of us do not feel like prices are coming down. wherever you want to fly, your favorite route, that one is still expensive. i present to you the most boring video of the morning. a guy opening and closing and opening and closing a samsung foldable phone. samsung releases the samsung z flip 5 later this week. a youtuber got an early release of the phone and he's been showing volunteers testing how many times you can do it. they're at 400,000 times, which is way more times than you would ever flip your phone open. >> exactly. >> ginger, you used to have a motorola? >> i had the older samsung

the park. we're starting out at 60 degrees in san jose. it's going to be a cool morning. we'll see a few high clouds moving in. overall, sunshine as we see the warming trend heading into the afternoon. let's zoom into the south bay. it is going to be breezy now that we're seeing a westerly and northwesterly wind coming in. for a lot of us the temperatures will be about 10, maybe even 12, 15 degrees cooler than it was yesterday. gilroy headed for 77 this afternoon. we'll see low 80s for milpitas and san jose, 80 for pleasanton, martinez reaching 77, and oakland today reaching 71 degrees. we'll see some low 70s for san mateo and upper 70s for palo alto. in san francisco those temperatures staying cool, but it's going to be windy and we may not see much sunshine here today. in the downtown area it will reach 63 degrees. for the north bay it will be 79 in santa rosa. ukiah was close to 100

yesterday. it's still going to be pretty hot, with a high of 92. we're seeing that extreme heat backing off and we'll also see a surge of monsoon moisture. as we go into the weekend, those temperatures start to ramp up once again for the inland areas. let's take a look at concord and our ten-day temperature trend. we'll see the highs in the low 80s, which is cooler than normal, through at least friday. saturday it's starting to heat up, reaching 90 degrees. we'll see low 90s into the start of next week. as we take a look at our seven-day forecast, we are going to see temperatures feeling very nice, and as more kids head back to school, may need a jacket for the start of the day. it's going to be comfortable as they're getting out of school. you might want to enjoy time on the playground. saturday and sunday, back to cool weather for a lot of the inland areas. for san francisco, it will continue to be in the mid to upper 60s. not seeing many changes as we go through the next several days.

on the roads this morning, let's get a look at the flow of traffic in dublin on 580. this has been a problem spot. we can see there's a lot of people out there. there's also a lot of traffic coming through the altamont pass and some construction going on. so there's a big backup there. even the people who are taking 84 are seeing a backup trying to get around the 580/680 split. we can see that's a little slower and it is taking a while to get on 580. that may be slowing down the traffic coming into the bay area. the peninsula drive times are all green, meaning that everyone is flowing at speed. i'll have another update in just a few minutes. >> sounds good. we'll check back with you. next on "today in the bay," nbc bay area responds. >> a free ride for college this fall, for just about everyone.

overall it's going to be a really nice day with a high of 78 degrees. 68 degrees in napa and santa rosa reaching 79 degrees. now, tomorrow we continue with this very cool weather for this first day of school for a lot of kids, and maybe the last day of school today -- last day of summer today for a lot of kids as well. as you get ready to head out on the roads, here is a look at the bay bridge toll plaza. it is flowing very well. as of now, the metering lights have not been turned on, but that will likely happen very soon. around the bay area we've had fairly quiet conditions except for a report of a fire at the storey road on-ramp by 680, as well as 101. it looks like crews are getting a handle on that fairly quickly. we're also seeing the typical slowdown through highway 4 coming through the delta. so i'll keep an eye on what's going on for weather and traffic.

another update in a few minutes. >> we'll check back with you. thank you. alameda county district attorney is facing new backlash this morning, this because she reportedly chose yet again to reduce charges against two murder defendants. >> "today in the bay"'s bob redell is live in alameda county. this is adding new fuel to the fire of outrage among some in local asian communities. >> reporter: according to people we have spoken to, yes, that is correct. good morning to you, ginger and laura. "the mercury news" reports that ameda count district attorney pamela price has dropped special circumstance allegations that, upon conviction, would have meant longer prison terms for two men accused of murdering an elderly asian man. a 28-year-old teaunte bailey and 59-year-old demetrius britton are charged with the robbery and killing of 75-year-old pak ho back in march of 2021 in

oakland. both defendants have long criminal records, but those who have followed price of the years, especially during her successful campaign for d.a., say we should not be surprised by this recent decision given her remarks in this earlier interview. >> the problems with mass incarceration, enhancements are at the heart of mass incarceration and those who have studied understand that the use of enhancements has devastated black and brown communities. >> in this case we're saying that it is very concerning if they will be paroled and coming out and hurting people again. i think for many of us, and especially for the elderly, when they're looking at a video, they may be thinking, like, could that be me? could that be anyone that i know? >> reporter: that was carl chan, an activist in the asian

community. in another case, d.a. price removed special circumstances against two suspects charged with a 2021 murder in the 880 shooting death of jasper wu. price also removed special circumstance enhancements for david mish in a 1988 killing. with the enhancements dropped, the two defendants in the ho case could still face life in prison, but with a possibility of parole. both men have pled not guilty. reporting live in alameda county, bob redell, "today in the bay." >> thank you, bob. one man is critically injured after a stabbing on san francisco's market street near the embarcadero. this is video posted on citizen app that shows the aftermath as police investigated outside a mcdonald's. now, it happened at market near 2nd street a little before 4:00 p.m. yesterday. police are only saying one man suffered life-threatening injuries and that the attacker got away.

anyone with information should contact sfpd. san jose police are asking people in one neighborhood to check the video of their security cameras after the violent deaths of a young boy and his great grandmother. someone stabbed them last friday in their apartment on parkmoor avenue near 280. in a news conference yesterday police provided new information, investigators now say the attack happened in the early morning hours and the boy was just 6 years old. the names of the victims have not been released and police are not revealing if they've been identified or perhaps if they've already arrested a suspect. new this morning, a new bay area twist in the disturbing case of a new york city doctor accused of preying on women he drugged. the doctor identified as c. allen cheng was first accused of drugging and sexually assaulting two women. investigators say the

gastroenterologist filmed the assaults. now he's accused in at least five additional attacks, all of which were also filmed, some of which took place at queens hospital where he once worked. prosecutors also believe more victims may be out there. >> these victims, we know the videos were taken not only one of them in the hospital as well, but also in las vegas, in san francisco, in thailand. so it's important that people reach out to us so that we can make the identifications. >> dr. cheng is being held without bond and has pleaded not guilty. the hospital tells our new york sister station it is fully cooperating with law enforcement and the doctor was fired last year shortly after the first allegations surfaced. still no confirmation this morning from contra costa county health leaders in the deadly legionnaires outbreak being tied to a richmond spa. the zen day spa remains closed as the county awaits test

results. investigators believe the deaths of two people may be tied to a jacuzzi there which was operating without permit. we've learned one of the victims is a father of five. his widow says that she visited the spa with him on july 19th and he was later admitted to a hospital, where he died one week ago today. she was never infected. as more bay area kids return to school, authorities are trying to remind everyone about the importance of school bus safety. the chp warns everyone, if you're driving near or behind a school bus, keep your distance because school buses can make many unanticipated stops, including at all railroad crossings, as required by law, or picking up and dropping off children in unmarked locations. they say always assume that children are onboard, and remember yellow flashing lights mean a bus is preparing to stop, while red lights require you to stop. >> those lights are not a suggestion. when the lights are flashing with the extendible arm, they are required to stop.

that is true for traffic that is traveling in the opposing direction as well, unless we're talking about a divided highway or the lanes of travels, there are two or more lanes of travel in each direction. >> the national highway traffic safety administration recommends parents accompany their kids to the bus stops on the first day of school, show them how to wait at least ten feet from the curb and remind them to never board until the bus comes to a complete stop and when the door opens and that the driver says it's okay. i think it's really important that we have all these reminders, because we haven't seen buses on the road for a while. you see a lot of people, they don't stop. >> keep your distance from that, right? happening tonight, imagine the possibilities if luck is truly on your side. you can buy a fleet of buses. >> a lot of space in your front yard there. that's what a lot of people are probably doing right now, imagining the possibilities, because the third largest

caused by record glacier melting. new video shows the weekend chaos of an alabama boardwalk after people became enraged in a dispute over a docking berth. it happened saturday night in montgomery, alabama. witnesses say this altercation just exploded when a pontoon boat blocked a reserved docking spot for a city river boat. you can see the fight escalated rather quickly with so many people involved. right now police are saying several arrests have been made and they are still combing through surveillance video. they say there are at least four outstanding arrest warrants. boy, take a breath, people. all eyes today on ohio and a vote that is at least indirectly about abortion. >> scott mcgrew, the abortion issue has driven so many people to the polls. >> so many. many of them, probably a majority of them, democrats who tend to vote less often and less reliably unless there is a big issue on the ballot.

now, today's vote in ohio is indirectly about abortion. today's ohioans will vote on what they call issue 1, which would raise the percentage of votes needed to change the ohio constitution from 50% to 60%. then, no matter how today's vote turns out, ohioans will go back to the polls in the fall to vote on whether abortion rights should be protected under the ohio constitution. depending on today's vote, either 50% or 60% of ohioans would then have to vote yes to change the constitution. we had a similar vote in california, 67% yes, 33% no. president biden is in arizona, later today he'll designate part of the area near the grand canyon as a national monument, which will limit mining in the area. then he's off to new mexico for a campaign e swrent and then to utah. before he left, the houston

fairfield, coming off of those triple digits and back to some milder weather, of course, with some gusty winds with that delta breeze. tomorrow we're going to see more of the same, maybe a little cooler in some spots, and we keep that trend at least through thursday into friday, before it heats up again. but eventually the heat is going to be coming back for the weekend after the high pressure that's given us the really hot temperatures moves away. it will start and nudge its way back into the bay area, causing our valleys to heat up. let's head to livermore with a look at our ten-day temperature trend. nice and mild through friday with highs in the low 80s. if you have outdoor plans on saturday, just keep in mind it's going to be about 10 degrees hotter, and you'll need to take breaks and maybe include some water activities on sunday. that heat continues into next week as well. overall, our temperatures will be nice and comfortable for the inland areas, heat again later on in the forecast, while san

francisco is going to stay very cool, maybe be misting and drizzling at some times. on the roads this morning, here is a live look outside in oakland. it is a busy start to the morning and it is starting to slow down coming through contra costa county from highway 4 to 680, from pittsburg to walnut week, about 31 minutes. either way you take kirker pass, it's going to be slowing down, on the benicia bridge it is looking good, but elsewhere things are nice and quiet. let's hope it stays that way. happening now, santa clara county is preparing to cut the ribbon on a new inpatient treatment center for people with mental illnesses. the 28-bed facility is located in san jose. it will serve people with serious mental illnesses who are transitioning back to independent living. this is all part of the county's effort to increase care for those with behavioral health needs. the ribbon cutting takes place today at 10:00 a.m.

welcome back. you're watching "today in the bay." and now to our climate in crisis, does hopping on an electric train sound great to you? well, soon you'll be able to do that on caltrain. starting in the fall, the agency will roll out their new fleet of electric trains that will eliminate reliance on diesel. they're said to be quieter, faster and more sustainable for our commute and will help improve the air quality. for communities, especially along the tracks, we'll have better air to breathe. >> the big plus about these new trains -- really, there's a lot of pluses about these trains. but as far as scheduling, these trains are faster to accelerate and decelerate. with the current fleet there's
