right now at 5:00, tracking a risk of fire danger. the potential of lightning in the bay area causing concerns for wildfires. we're timing out your hour-by-hour forecast straight ahead. plus -- >> the dogs and animals are dead. everybody is dead. there's dead people in the water. new developments out of hawaii this morning. nearly 100 people now confirmed dead, following historic wildfires. the new grim milestone the devastating situation is making as residents whose homes were destroyed are opening up about their incredible loss. plus, another possible indictment on the horizon for former president donald trump. the action prosecutors in georgia are expected to take today. this is "today in the bay." good monday morning to you. 5:00 right now. thanks for starting your morning with us. i'm laura garcia. >> i'm marcus washington. before we get started with the day, i want to welcome alameda unified back to school. big day for those students, the teachers and parents. first day of school. yay! >> were you like that as a kid?
5:02 am
>> i was, because you had the outfit laid out on the bed, ready to get it started. then the second day -- >> whole different story. we are concerned with potential wildfires here in the bay area this morning because we're tracking this possibility of lightning. we have a monsoon of moisture that came in yesterday evening that helped to spark off a few isolated showers. we saw a lot of the rain fizzled out and dried up before it got here. there's still the risk that lightning strikes could increase our risk of thunderstorms and increasing that wildfire danger as we go throughout today. so we're still watching out for that. as of now it's just spotty showers moving through and we're seeing that mostly in the north bay right now, turning to lightning once it gets off the coast. as far as what we've seen over land, so far, so good. the humidity lingers and we'll have a chance that we could possibly see as these temperatures heat up more energy
5:03 am
and potential of more dry lightning as we go throughout the day. we'll talk about that possibility coming up. mike, we saw flashing lights. is there a problem on the san mateo bridge? >> there was, but i think the flashing lights were the crew that was headed across the westbound commute direction. we saw a little bunching up at the bottom of the high-rise and then i was able to see cars slow and now completely clear. the disabled vehicle, i believe has been cleared from 92. there may be a new incident, perhaps two, north 101 around berryessa there may be a crash. turning to the tragic devastation and destruction on maui, as firefighters make progress containing the flames, people are getting a clearer picture of the rebuilding to come in historic lahaina. search and rescue efforts are going on as residents grapple with the loss of loved ones and their homes. the fires destroyed over $6 billion worth of important.
5:04 am
hawaii governor green says the historic town of lahaina is almost completely gone. at least 96 people have died in the fires on maui, and, sadly, that number is expected to rise. this is now the deadliest wildfire in modern u.s. history. >> we will build back together, we will find out what we could have done to prevent such loss of life to the best of our ability. >> four people who lost their homes, the governor's office has set up hotels for them to stay in. airbnb is offering up hundreds of rentals for victims as well. >> while we know the fire was driven by winds, the utility is getting heat for its response in the first hours of the disaster. kris sanchez is joining us from the newsroom. we're talking about a class action lawsuit. there is no official cause for the fire that decimated that historic town of lahaina, but there is already that class action lawsuit you mentioned and it's against the utility,
5:05 am
hawaiian electric. the suit claims that hawaiian electric should have shut off the power before the fire when the weather service warned of high winds and extreme fire danger. a statement to nbc news says that hawaiian electric does not have a former power shutoff program, but it did follow its typical protocols. the lawsuit claims there was a downed power line near the site of the initial fire. for many residents, there's enough blame to go around. >> try to get us out and evacuate us, no. we're mad, we're mad. we didn't just lose our homes, we lost our town, we lost history. our kids are traumatized. you guys messed up real bad. >> reporter: another utility may be facing questions at some point as well, as firefighters say that as they responded to the lahaina fire, the hydrants were running dry, according to
5:06 am
reporting by "the new york times." the lahaina water system comes from creek and groundwater, but with the power out, pumping water has been an issue both then and now. we want to make clear the official cause of the fire is still under investigation. >> kris, thank you. new this morning, in the wake of those fires, so many people have stepped up to support the maui community. among them, oprah. the media mogul sunday made her third visit to the maui war memorial gymnasium bringing towels, sheets, water, and more for those who survived the fires. oprah says the disaster has left her feeling helpless and she felt compelled to do what she can. >> we all know that in a week or two all the cameras will be gone and the rest of the world is going to move on with their lives, and we're all still going to be here trying to figure out what is the best way to rebuild.
5:07 am
and so i consider myself a resident, i have my rainbow driver's license. my biggest concern is who is in charge and how does that money get directly to the people. >> oprah is one of maui's biggest private land owners. she has more than 1,000 acres. and a lot of people have been wondering, how can i help the people of maui? well, we posted a list of verified organizations collecting donations on our website. all you have to do is go to nbcbayarea.com. once you get there, click on the how to help maui in our trending bar. 5:06 right now. we are tracking a developing story, former president trump could be facing a fourth indictment, this time out of georgia. the fulton county district attorney is expected to present evidence to a grand jury today. they've been investigating the former president's efforts to overturn his election loss in georgia. that news comes as trump is on the campaign trail in iowa, and
5:08 am
maintains his innocence. >> is there any chance you take a plea deal in georgia? >> we did nothing wrong. >> this comes as the justice department appointed a special counsel to investigate hunter biden. the president's allies worry this could put a wrench in his re-election campaign. 5:07 this morning, as we take a live look out in san jose. getting started with the day and the first day of school for the franklin mckinney union school district in san jose. i know those students are excited. their final sleep-in for summer is over. >> i'm sure they're really excited about that. kari, it should be a nice day. cool start to the morning. >> it's a little warmer than we typically see because of the high humidity. so instead of mid-50s, it's right now 68 degrees in san jose. so it feels muggy and mild out there as we get started, and it's going to be a hot day. let's head to alameda with a look at their school district
5:09 am
forecast for the first day. it's going to be 62 degrees by the time you're dropping them off and staying partly to mostly cloudy with temperatures headed to the mid-70s. we're watching out for spotty rain chances and possibly some lightning. i'll have more on that in a few minutes. mike has a look at where you can find lower gas prices. >> we're trying. san jose is one of the lowest in the state at $4.39. nearly all of the reports in that county are around $4.50 over there. alameda county, $4.49, diamond gas and mart on south front road. in solano county, families in vallejo, maybe looking for a back-to-school fill-up, $4.69 at grand station on springs road there. so watch for that price. thank you for watching on gasbuddy.com. on the roadways we're watching the south bay where we

we've seen some very strange weather, but this is actually not all that unusual, seeing that we occasionally get the remnants of hurricanes and tropical storms moving in and we are getting that surge of moisture. it feels muggy, but it's coming at the same time we're getting high heat. so today the valleys will once again reach into the 90s and over 100 degrees, from today through at least thursday. so it's going to be really hot for a prolong period of time, and there will also be a high fire danger, higher fire danger because of the potential of some lightning as those thunderstorms over the sierra start to move into the bay area. so we saw that yesterday evening with a couple of spots getting some spotty showers, as far as the lightning a lot of the lightning potential really died out as it moved into the bay area, once it hit that marine layer. we're also seeing some of those lightning strikes really developing off the coast, but moving away from us. so we're still watching all of
5:19 am
this energy streaming through, especially for the north bay, with another chance of some rain and possibly some lightning by late morning in the north bay, and then more rounds of some spotty showers into the afternoon as well as later this evening. so we're looking hour-by-hour at that possibility of some rain here. we can see it moving through, by about 2:00 to 3:00, mostly in the north bay. we'll be watching the tri-valley and east bay as well. but it's going to be very hot. temperatures reaching into the mid-90s in the valleys, and we're going to, once again, see a few spots hitting the triple digits. a slight chance of rain and storms, but we'll also have hot temperatures over the next several days. now, as we approach the weekend, that is when it cools off and it looks like it's going to be a really nice weekend ahead. we just have to make it through the upper 90s and triple digits from today through at least thursday. mike says so far it's a smooth drive across the bay area. >> i know it's early, but we'll

and we still have showers that are lingering in parts of the north bay as you get ready to head out. as we get a closer look over the past couple of hours, quick-moving rain moved through and the lightning is off the coast and moving away from us. but we have enough energy in the atmosphere today where we could see another round of rain and not enough to really help us out if there is some lightning and it sparks a fire. so we do have an elevated fire danger for today, as we continue to see the surge of this rain and possibly thunderstorms due to some monsoon moisture moving into the bay area. it's also going to be very hot. we'll talk about the heat in a few minutes. mike, we have such a great shot of the bay bridge commute. >> we had a little bit of low clouds in the area before, but look at these spark ling lights. i'm focusing into the headlights moving into the city. top of the screen, eastshore freeway from left to right, that's your commute westbound toward the bay bridge. it's moving well.
