expect perhaps to see from mr. trump as well? >> reporter: i certainly think so, craig. meadows is arguing that because he was acting as a federal capacity as the white house chief of staff that this is something that should be tried in federal court it is very likely we could see the same argument from the president. if that were to happen, the da fani willis would still try the case, but the trial itself would be subject to the rules of the federal court. one, cameras would not be allowed inside as they would here in superior court and the second is the jury pool would come from a much wider group. instead of fulton county, it would be taken from the entire northern district of georgia which includes a lot of red counties craig? >> thank you. also this morning north korea has made its first public comments on the u.s. soldier who has been detained there since he bolted across the border last

month. janis mackey frayer joins us from beijing. >> reporter: good morning. this is the first we heard from north korea that travis king was in custody after he willingly ran across the border into one of the most hostile countries in the world with tension at a high, no lines of communication and little certainty about what happens next this morning for the first time, north korea confirming custody of travis king, the american soldier who did a cross border dash last month into north korean territory now claiming private second class king, who is 23, wants to seek refuge there or in a third country. a statement saying he confessed to illegal entering to escape, quote, maltreatment and racial discrimination within the u.s. army, adding he was disillusioned with the unequal american society.

francisco unified and more than 20 other bay area districts. there is, though, a tragic reminder for drivers to slow down and pay attention. last night a 4-year-old little girl in a stroller and her father were hit by an suv at a crosswalk near oracle park. the little girl died. it happened last night on 4th and king streets. we are still working on an update on the father's condition, but we do know he was taken to the hospital with life-threatening injuries. the driver is cooperating with the investigation. alameda county's district attorney pamela price has only been in office for eight months, but the effort to recall her is moving forward. last night alameda county officially accepted a petition aimed at removing her from office. this is being spearheaded by community members that call themselves save alameda county for everybody. price officially has ten days to respond to that recall notice. after that, the group will have to gather 90,000 signatures more

nbc's kaylee heartung joins us with an update >> good morning, guys. michael oher says the people he considered parents cheated him out of money they say they're heart broken. while, they also claim this isn't the first time oher has tried to shake them down for money. the family at the center of the oscar-winning film "the blind side" now on defense. >> do you have any place to stay tonight? don't you dare lie to me come on. >> reporter: after former nfl player michael oher filed a lawsuit against them claiming he was lied to and exploited for their financial gain but the tuohy family is flipping the script in a statement to nbc news their attorney alleges oher threatened them in a shakedown saying he would plant a negative story about him in the press unless they paid him $15 million. in an interview monday promoting his new book, oher did not discuss the lawsuit but expressed frustration with how he was portrayed.

let's bring in nbc's legal correspondent, laura jarrett first of all, this is an all-around kind of sad bummer of a story. let's talk about what the tuohys said their only choice was to have a conservatorship because he was too old to adopt. >> under tennessee law that makes sense. usually a conservatorship, everyone remembers this with the debacle with britney spears, it is either someone who is underage or if you know sort of impaired in some way now, it is not clear that at 37 years old he needs to still have the conservatorship. if they're not contesting it, the judge will probably let them out of it. the issue is whether he should be entitled to backpay or money because he's saying they made a lot of money off his likeness and using his image. again, it is not clear he will be able to get any remedy from that. >> laura, what about this idea that michael oher, his claim that he didn't even know he was part of this conservatorship for 20 years
