17th, 2023. >> call for accountability as a failed response to the maui fires. we're starting to learn the identities of some of the victims. breaking news, bracing for impact, california is preparing for a rare and dangerous hurricane. when hilary is expected to hit and how powerful it could be. not cool, school districts across the country struggling to keep their classrooms comfortable in this record-breaking heat. and added to the cart, why now is the time to do your back-to-school shopping and how you can score some free supplies. we begin with the aftermath of the maui wildfires. >> frustration is mounting over the response as the number of victims keep growing.

no official cause for these fires. but the focus has been on the electric company and downed power lines. state lawmakers are calling for an independent investigation to get answer and president biden is sending a message to the people of maui ahead of his planned visit on monday. >> as you seek to heal from a loss of family and friends, homes and businesses, we'll be with you as long as it takes. /fwrooms you. nbc news correspondent dana griffin, you're wearing the mask, air quality, talk to us about the conditions where you are. >> air quality is such a major concern here, officials have told us about some hazardous chemicals and things in the air like benzene and people are being encouraged to wear masks.

we also know that the hawaii department of transportation is planning to install a dust screens acting as a screen for the air, it will make sure that the dust particles don't reach the opposite side of the town. i want to show you behind me, first time we're able to see lahaina since we've been reporting here on the ground, some access here, looking down into the town, look at this, you can see some of the homes here, many are missing roofs, one looks like it was under construction, and as we pan over to this palm tree, a row of cars, this is parking lot, the burnt-out shells of these vehicles, this scene doesn't look real, it looks like something out of a movie, this was the horror that people underwent escaping this town.

>> tell us more about what residents are saying and nbc news has been told possibly when people were fleeing lahaina utility trucks were blocking the roads if. >> reporter: we're hearing from several residents in the afternoon around 4:00, there was a lane of highway the main road out of lahaina, they said hawaii electric had utility trucks in the opposite lane of traffic in trying to install poles as people were trying to flee, we understand we don't want to drive over live wires they didn't have to install poles according to these witnesses they should have moved out of the way, they were yelling at them to move out of the way and the utility workers just waved them off. they're looking into that claim to see if utility workers may have been why there was such a

traffic jam. obviously a lot to look into, part of the investigation, hawaiian electric already facing four lawsuits. hawaiian electric is not commenting on that litigation and it's important to note a cause of the fire hasn't officially been determined. back to you. >> dana, the devastation, in the background, that beautiful pacific ocean, we're hearing conflicting reports about people saying tourists please stay away but others, no, please come back, there are parts of maui that need the influx of funds. what are you hearing from people there? >> reporter: when we first got here, people were saying leave maui we don't need you here right now. to preserve the resources for those who were hardest hit. the issue with getting hotel rooms isn't much of an issue,

they realize, some people, they need the tourism industry to help fuel this economy, so, maybe don't come to maui or the west side of maui as they're trying to rebuild but there are so many islands or other parts of maui that are open and they're encouraging tourists to come. >> dana, thank you to you and your team for bringing us these stories. if you want to help the maui fire victims, visit the maui food bank, the red cross. we turn now to some breaking news, hilary is picking up steam, officially a hurricane. >> it formed wednesday off mexico's west coast and it's headed toward southern california, hurricane hilary is expected to bring intense rain and wind to the west coast, an area which rarely sees this sort of storm. bill karins is tracking it all, when and where is it expected to

hit. >> this weekend, there's growing overall, everyone agrees this is the next significant weather event to hit our country, maybe a billion-dollar weather disaster, rapid intensification, it's over warm water, feasting on that, the only thing i don't like this is large storm, too, not just a small storm, heading north wards, it should peak in intensity on saturday. heading towards southern california, again the timing of that looks to be about saturday, sunday night into monday morning, these lines, our different computer models as far east as toward the arizona/california border but we have a tight clustering now right over the top of los angeles and san diego, that would be as far as damage go. >> bill, thank you for this

early warning. new twist in the legal battle over the abortion pill mifepristone. >> limits some access to the pill. but the pill is still available right now. the justice department said it does plan to appeal this decision. joining us now is chloe atkins as well michelle goodwin. chloe, let's start with you, what exactly is being restricted at this point when it comes to access to the pill? >> yesterday's ruling has no impact on the availability of mifepristone, so the status quo applies. the states where it's legal, liberal-leaning coastal states, but after the overturning of roe

v. wade southeastern states moved in the opposite direction and abortion is banned there which means medication abortion is banned there with very few or narrow exceptions. yesterday's ruling from the 5th circuit they essentially nixed the fda's changes to mifepristone which extended the ruling. it would dial back the number of weeks that patients have to access the drug, also require them to go into the doctor's office several times rather than once and also do away with telehealth. this is going to have an immense impact on patients around the country especially in states where abortion is legal. >> it could be other drugs, is that their concern? >> if this upheld this could undo the fda's authority as it

relates to medications, it could undo a lot of, you know, its standing and can really undo things and we saw the doj really signal they're going to appeal to the supreme court and we'll see what they're going to do down the line. >> michelle, how is this playing out in the courts, how did the appeals court explain its decision and what does it mean for the future of this pill? >> what it does it expands who can have standing and bring a case before the united states any u.s. court, federal court,ened that's what's troubling here which is to say any of the not hundreds or dozens but thousands of drugs on the marketplace, anybody who finds them offensive or claim they're somehow affected or agrieved by those drugs being on the market they could potentially have standing before a court that's extreme.

some terrifying mid-air moments this week for passengers aboard two separate flights. one caught on cam rat the airport in houston. southwest plane in flames. steven romo joins us now. let's start with houston, what happened there? >> reporter: yes, scary situation here for sure, vicky, that southwest incident in houston imagine being one of the passengers on that plane, flames shooting out of one of the engines, caused by a mechanical issue. that flight took off at 7:00 p.m. heading for cancun, it was forced to turn back to houston. once it was back in houston it made a successful landing at houston's hoby airport. >> the pilots are trained specifically and frequently to deal with such a situation, so it's terrifying for the

passengers, but it's something that pilots deal with on a regular basis in training and the passengers' lives were not in imminent risk. this is an abnormal situation. but it's one we're train for. >> reporter: that plane has been taken out of service according to the airline and a different airplane came to finish the flight. the faa is investigating. >> you hear the air traffic controllers. what about this other case, the flight from miami to chile, forced to make an emergency landing. a tragic ending for that one. >> reporter: another terrifying incident here, a pilot aboard the flight to chile died mid-flight after leaving miami. thankfully there were two pilots onboard. they were able to divert that plane to panama, and passengers

onboard that flight applaud the crew for landing. they were given hotel rooms for that unexpected layover, before they went on their way. the airline tells nbc news assistance was given to that pilot who was suffering from some type of medical emergency, protocols were followed to save his life. he sadly was pronounced dead. >> all right, steven romo with the updates there for us. the drama involving the family at the center of the blind side continues. kaylee hartung has more. >> i hear mrs. tuohy, i look

over my shoulder for my mother-in-law. call me leigh ann or mama or almost anything else. >> reporter: the family whose story inspired the hit movie "the blind side" is fighting back against what they call the outlandish claims that michael oher made against them. >> these people are truly devastated. i mean, this was their son. >> reporter: after the former nfl player filed a lawsuit that he only learned six months ago that the tuohys hadn't adopted him in 2004 and instead established a conservatorship that he now wants to terminate. the tuohy family's attorneys are using oher's own words against him, pointing to his book "i beat the odds," which in 2011 he wrote, sean and leann would be named as my legal conservators. honestly, i didn't care what it was called. i was just happy that no one could argue that we weren't legally what we already knew was real, we were a family. the tuohys now say they are willing to terminate the conservatorship and maintain its purpose was to help oher in the college football scholarship process. >> we're talking about a family trying to help someone in need. the tuohys did not control any of mr. oher's finances.

nbcbayarea.com. also happening now, legal proceedings under way after several officers were taken into custody earlier this morning. bob rid del is in the studio with what we know about this raid. >> some officers schedule to be in federal court. we are awaiting word from jodi hernandez. we're learning about the fbi roundup from the on the i don't care and pittsburgh police department. this is after a 18-month investigation into an alleged criminal network. we reached out to the fbi in san francisco. they told us they'd provide information at a press conference at 3:30 in the afternoon in the city. jodi did speak to one of the attorneys of the offers who was arrested. he says it was a forceful arrest for his client. he says the fbi used flash bangs and bull horns. calls that, quote, completely unnecessary. says his client would have

surrendered if asked. in the fbi investigation over the past year and a half, the feds seized the officer's cell phones and stumbled upon the racist and homophobic texts between officers. they're trying to figure out if it violates the racial justice act as far as the judge is concerned. a homicide could be jeopardized by those questionable officers. the police chief who was a target of a meme resigned. quote, today is a dark day in our city's history as people trusted to uphold the law breached that trust and were arrested by the fbi. as our city absorbs this tragic news we must come together as one. today's actions are the beginning of the end of a long and arduous process. to those that have accused me and others of being anti-police

feared dead after a boat was capsized off the coast of west africa. the boat was found, only 38 survivors onboard according to officials. gender-affirming medical treatments for transgender youth are now banned in north carolina after the republican-led general assembly over-rode democratic governor cooper's veto on the ban. north carolina is the 22nd state to restrict or ban care. bruce springs steen has postponed two shows in philadelphia, the boss has taken ill. new dates haven't been announced

yet. all right, a texas woman is facing criminal charges after allegedly making racist remarks and violently threatening a federal judge presiding over one of former president trump's criminal cases. the former president has publicly criticized this judge chutkan. we want to bring in ken dilanian. what more are we learning about these particular charges and have we heard anything from judge chutkan. >> reporter: judge chutkan. hasn't spoken publicly about these threats but she has a security detail. these are very serious charges, the judge ordered the defendant in this case, 43 years old from a town south of houston, the judge order her detained for 30 days until another bond hearing can be held, there were no

conditions he could set that wouldn't be pose a danger to the community, she has four other cases where it's alleged she made threats. she has a history of doing this. he said she has a history of substance abuse. there's a climate in this country where some people are taking what they hear and see on social media very literally and it's also important to note that donald trump hasn't said a word about this case to condemn or comment on it. >> not just judges and prosecutors tied to these investigations, members of grand jury, regular residents of georgia, they've come under attack as well. what are you hearing from law enforcement sources? >> reporter: deeply concerning, probably georgia officials may be rethinking on the policy of naming grand jurors as they don't do in other states, people are able to look up the

addresses of these grand jurors, posted them on the web, on fringe websites, deep concerns for families and people involved and for law enforcement. in this threat case how serious law enforcement are taking these threats. >> they are heightened alert. >> as they should be. ken, thank you. california's senator dianne feinstein is suing the trustees of her late husband's estate. it accuses the trustees of failing to pay out millions of dollars, this comes after recent health concerns involving the 90-year-old senator, in february feinstein announced she would not seek re-election and nbc news senior legal reporter joins

us, what are the legal -- >> quite an extraordinary lawsuit filed by the senator's daughter taking issue with the way trustees of feinstein's late husband have handled the estate. they alleged financial elder abuse. presumably the elder being abused is the 90-year-old senator, dianne feinstein, they accuse the trustees of withholding funds that are owed to her as part of a marital trust as well as income distributions that are due directly to her. seek a court order removing the trustees and also seeks monetary damages saying these actions are intended to benefit the daughter separate from the marriage of dianne feinstein.

feinstein's senate office is declining to comment on this calling a private legal matter. >> have we heard anything from the trustees? >> reporter: yes, we have, some remarkable pushback from the trustees. let's post a statement from a lawyer for the trustees. quote, this filing is unconscionable. this has nothing to do with her needs and everything to do with her daughter's -- just another word for greed. >> thank you. ellison, persistent record-setting heat has schools across the country scrambling to keep kids cool. some schools are making that process but others are really struggling. teachers in one florida district they're so fed up they're taking legal action. maggie vespa reports.

>> this morning, as kids coast-to-coast start heading back to class, a puzzling new equation -- >> we are looking at unprecedented heat into august. >> another day of triple digits. >> temperatures anywhere from 95 degrees to 107 degrees. >> reporter: -- is leaving many schools stumped. >> how difficult is it to air-condition a building this old? >> it's a real challenge. >> reporter: the problem even plaguing places like st. paul, minnesota, famously frigid, now grappling with the extreme heat waves made more common amid our climate crisis. >> reporter: the conversation has changed locally and nationally. >> reporter: is it safe to say the district is working as fast as it can to air-condition these schools? >> absolutely. >> reporter: that race playing out nationwide. according to one study, more than 40% of american districts report needing to update their hvac system. one roadblock, experts note, the average school building is 50 years old. some far older. st. paul's randolph heights elementary was built in 1916 with thick masonry walls and no concept of hvac systems of the future.

>> it's expensive to get systems that perform to modern expectations. >> reporter: similar struggles have districts across the country desperate. in salem, oregon, photos show classrooms without ac now shrouded by heat-reducing window film while in polk county, florida -- >> my second grader said it's disgusting. >> reporter: parents' anger boiling over after the teachers' union filed a class action grievance over systemic ac issues. that grievance now covering ac-related complaints at close to 60 schools in the district. >> it should have been handled over the months where kids weren't in there. >> reporter: school administrators telling tampa bay nbc affiliate wfla crews worked through the weekend to address the complaints prioritizing ac repairs as they come in and installing portable systems in affected schools. back in minnesota -- >> oh, it feels much cooler in here. >> yep. >> reporter: buildings suited to modern hvac units like johnson high school are getting them.

>> these have been running less than a month. like two weeks? >> absolutely. >> reporter: administrators allocating massive chunks of funding, including $24 million in federal arp covid grants for the upgrade. in the last five years, the districts installed state of the art computer-automated programs in 13 st. paul public schools and counting. >> we're trying to take and making sure that these buildings are relevant in supporting our kids for where education is going. >> reporter: a lesson about living on a warming planet amid a man-made crisis that's testing american's tools. schools. >> reporter: desserted stores, empty officers buildings. san francisco is seeing the first signs of what economists call a doom loop. city leaders see a way out of it. jay ward has more on their play.

>> reporter: when the pandemic hit and the surrounding office buildings empty out so did his place. how far did you get in rent? >> over two years? $48,000. >> reporter: in tend, buried under back rent he got the equivalent of a do-over, evicted but now he's back under new terms. >> every month i do a monthly sales report and based off my sales report they charge me a percentage of my rent. >> reporter: san francisco needs a do-over w commercial vacancies above 31% the high nest the nation, and fears a doom loop could kill off the city's downtown. this is the $2.2 billion sales force transit center, but on a busy friday the only people we've seen in here are a couple of tourists. a group represents some of the city's biggest tenants, paid sky-high rents during the boom, then the pandemic arrived and

with it working from home. >> 90% collapse in office utilization, unprecedented in a major urban city in america. >> reporter: at that point, landlords here went into denial here. >> denying that something really existential happened. >> reporter: san francisco has reborn so many times. mark took a 1970s officer tower left empty during the 2008 recession and converted it. >> you can do it in a number of buildings. the elevator being in the right place, a bonus you could work around it. >> reporter: because offices make for long narrow apartments he had to get creative. the city under the mayor is doing what it can, offering small loans.
