he was maui's top emergency response official. he failed to respond the emergency alarm, doing so by choice it comes as the search and rescue continues and families demand answers this morning, ten days after the deadliest wildfire in a century, the administrator fo maui's emergency agency has resigned his job, to head the department responsible for responding to disaster, citing health reasons. the move comes amid increased scrutiny over his qualifications and the decision to not sound emergency sirens as the fire broke out. >> if you want to talk, come up here. >> reporter: at a contentious press conference adaya defended the decision, noted the sirens are primarily used for tsunamis and may have led people towards the danger >> do you regret not sounding the sirens >> i do not. had we sounded the siren that night, we're afraid people

san lucas. 145 miles per hour winds, moving northwest at 13. this thing has already doubled what we go as far as the definition for rapid intensification. so by sunday evening, late evening, we are looking at land fall somewhere in the southern california area as a tropical storm. but because this thing has rapidly intensified so strongly, it may make it as a hurricane. we will have to wait and see, but no matter what happens, whether it's a hurricane, tropical storm or remnants, we've got 24 million people impacted by flash flood watches and warnings right now all the way into parts of the southwest. and we've got a high flash flood risk from san diego up to three inches per hour. we're talking about rain fall amounts in the mountains of southern california up to 10 inches 5 to 8 locally and we may see isolated tornadoes as well as this comes inland, so we will be watching this very closely over the next

charged with threatening tonya chutkan, the judge charged with overseeing trump's federal election case in washington, d.c. officials say the woman left the judge a threatening voice message filled with racist rhetoric he recently reposted criticism and thursday said this about this week's indictment in fulton county, georgia. >> i think they're sick people they have no idea the anger they cause. >> reporter: there the sheriffs office announced new safety measures saying in a statement, it's aware that the personal information of the grand jurors who returned that indictment is being shared on various online platforms. it comes after nbc news first reported that the grand jurors names and home addresses had been posted online on a fringe web site, with one user writing, these jurors have signed their death warrant. unlike federal court, and most other states, in georgia, grand jurors' names but no personal information are listed in the indictment, which once

hospitalizations nationwide. the biggest spikes down south, in mississippi, alabama and louisiana. let's bring in nbc news medical correspondent dr. natalie azar we're talking about a spike. how significant is this spike and how concerned should people be about it? >> let's put this into perspective. we have always expected a seasonality to covid, kind of similar to flu that we will see this ebb and flow of cases i think it is important to reinforce to the viewers and everybody out there that the absolute number is much much lower than at various different peaks throughout the year. but the trend is important this rise in cases that's being driven by strains that maybe have a transmission advantage over its predecessors, some waning immunity, but we're in a different place now. we have vaccines we have an anti-viral that works well. >> how do they know that cases are on the rise. a lot of people just don't even test anymore >> right case counts are no longer being used we know cases are being under reported as a proxy, the cdc is using hospitalizations as well as icu

admissions and also waste water. we know that over half of the samples across the country are showing a spike in cases >> what do you mean waste water? >> they test for the virus in the sewage and that's a sure fire way of knowing. >> i was worried that's what it meant. >> you had an inkling. you had an idea. never ask the question you don't want the answer to >> so if you want to protect yourself, we recommend the booster. should people get the booster coming up now? >> what we have said from the very beginning is keep an eye in your area on hospitalizations and icu admissions so you know what the amount of covid in your environment is always do that risk assessment you want to see what's my risk i'm sure everybody out there may know somebody with long covid, too. you may want to be more likely to get that vaccine or protect yourself to prevent long covid you might want to mask more or curtail your activity. regarding the booster, we know it will be available probably in the second or third week of

police tell us it started about 3:30 in the morning when officers were responding to a burglary at the velvet cannabis and weed dispensary. there was a crash involving suspects. police have not given us the circumstances that led to the police shooting or if a suspect was hit, but we do know that no officers were hurt. sunrise is still closed at this hour. students are returning to class at james lick high school in san jose this morning after two students were stabbed on a campus yesterday. both are expected to survive. this is video shared to nbc showing altercations that led to that stabbing. witnesses tell us they believe one student was stabbed in the back, the other in the arm. so far, no arrests. east union high school district sent out a letter to families informing them of the incident, and offering mental health services. time to get a check of the forecast on this friday morning. how are we looking? >> it looks nice for the start of the weekend with our temperatures coming down slightly. we've been talking a lot about

this morning, his lawyers set to spar with the state of idaho over a number of critical issues as the prosecution pushes for a clear trial schedule, accusing the defense of stalling for time given that this is a death penalty case, do you think this trial will move forward on october 2nd? >> i think we'll get a real good answer from the court during these hearings >> the victims' families yearning for their clarity in a statement to nbc news, the family of kaylee goncalves saying they're hoping the judge will make some decisive and necessary decisions in order to keep this case on track for trial in october especially since the defendant has not waived his speedy trial rights >> i want our community to stand together, look at the evidence, come together, make a decision and then hold that person accountable. >> the defense is pushing the state to disclose more details about the dna found on the knifn

sheathe it alleges led them to kohberger. while the prosecution wants the defense to offer up more information about bryan kohberger's potential alibi. earlier this month, his lawyers allege he was out driving alone the morning the murders took place. >> the defense's alibi so far is pretty much indicating they don't have much of an alibi yet. and if they do present an alibi defense, it is probably only going to come from the mouth of their client whether or not they call him to the stand, that's the million-dollar question. >> reporter: and we expect to see some of the goncalves family in the court today others may be watching on the zoom the judge will be allowing families of the victims and the defendant to follow the proceedings virtually. savannah >> thank you we want to turn to our senior legal correspondent, laura jarrett. let's talk about this hearing today. what is the significance of it >> this could be critical. it will decide whether this trial happens at all

and if it does, whether it is ready to go by october of course, the defense wants to put this off for a little bit. they say they need more discovery. they say the entire process was flawed the grand jury wasn't instructed properly i think that's not a winning argument on the law. it seems pretty clear there. the prosecution has a strong case but i don't know that this can go by october. it's a death penalty case. there's a lot of discovery that has to be traded between both sides. his lawyers say they need more evidence on how they zeroed in on him with the dna. i think october could be pushing it for this case but they're not going to be able to delay forever. >> no. it may get pushed off more, but it is headed to trial, it appears. >> yes. >> what about this notice of alibi. but the alibi that they identify is him driving around alone. >> that's not an alibi >> i didn't think that was an al alibi because it's not provable. >> an alibi is i was in a different place. here's the receipts. not just i happened to be driving around that's what the state will be

arguing today. we need a little more specificity. of course, it is our burden of proof here as the state, they're going to say that if you have an alibi, give us the witnesses so we can talk to them. >> is there a chance there could be a change of venue obviously this is a small town everybody knows about this case. could the defense say there is no way to get a fair trial here? >> absolutely. we might see that. it's interesting we haven't seen it so far. again, there is a little bit of time left here they could say there's no way i could possibly given a fair trial given what's happened here, given all the attention, but we haven't seen that from the defense. >> if they say, okay, let's do a change of venue. it would be a change of venue in idaho. it's not going to be across the country. >> really this is a national case now it's gotten so much attention. many people have heard of it even outside of this small town. >> all right we have a lot more ahead, including why beatles fans can thank dolly parton for getting

good morning, everyone. 8:56. streets are still closed in martinez as police investigate a burglary that led to a chase and an officer-involved shooting. police say it started around 3:30 this morning on sunrise drive in martinez. officers responding to a burglary at the velvet cannabis and weed dispensary. there was a crash involving the suspects. police have not given us the circumstances that led to the shooting or if the suspect was hit, but we do know no police officers were hurt. happening now, hurricane hillary headed for a category 4, the storm headed toward southern california, remnants expected to come to the bay area. we'll have the latest impact at midday. our flight's about to board, where's grandma? and dog?
