kristen, as one of the moderators put it last night, the big elephant not in the room, donald trump. we'll get to him in just a moment, but let's talk about the folks who were on the stage last night. who stood out most to you? what surprised you most? >> i think what surprised me most is that this is not the debate we were expecting we were expecting governor ron desantis who's number two in the polls to former president trump to really be in the spotlight. instead, it was newcomer, vivek ramaswamy, who was really front and center last night. you saw all of these heated exchanges with former vice president mike pence, with u.n. ambassador nikki haley and i think that that undoubtedly increased his name recognition i think more people know his name today the question is, does it cut both ways? he was also on the receiving end of some pretty serious attacks pence called him a rookie. you had nikki haley say that basically he has no foreign policy experience, and it shows.

and christie saying he sounds like chatgpt so how will republican voters respond? that remains to be seen. ron desantis walked away from this pretty unscathed. so to some extent, it's a bit of a win for him. and also, i thought it was notable that former president trump -- yes, there were questions about him. the majority of the candidates standing on that stage said they would support him, even if he's convicted of crimes, but really, this was a debate about policy >> speaking of policy, it was interesting to hear the candidates talk about the war in ukraine and how they would handle that differently. it was a little -- to also hear them talk about president trump when they finally got to him about an hour into the debate. in terms of the policy divisions that were laid bare last night, how do you think that affects the campaigns going forward? what story lines do you see emerging going forward >> i think ukraine, as you say, craig, is going to be a big issue. we really saw this divide within the republican party you saw the traditional conservative strong on foreign

policy position from candidates like nikki haley, mike pence, governor chris christie. on the other hand you saw th isolationist swing of the party in ron desantis and vivek ramaswamy, who said, we don't think we should be putting more money towards defending ukraine. we think it should be going towards the southern border. that's a popular position with gop primary voters if you look at the polls the other big issue was abortion you had pence and a lot of the other candidates endorsing a national ban nikki haley really trying to cast herself as a pragmatist saying there weren't the votes for that in congress, highlighting how complicated this, and the majority of americans are opposed to roe v. wade being overturned. >> kristen welker, great to have you here. >> great to be here, thanks. as we mentioned, former president trump was not on that debate stage but he will be in georgia later today. he's expected to turn himself in at an atlanta jail mr. trump is facing racketeering and conspiracy charges for his alleged efforts to overturn the results of the 2020 presidential

election in georgia. nbc's blayne alexander is right there in georgia with what to expect hey, blayne. >> reporter: hoda, good morning to you when the former president comes here to the jail to surrender later this evening, he will use this entrance. now, once inside, he will be fingerprinted. he will possibly have a mug shot taken before being released on $200,000 bond. facing legal battles on four different fronts, this morning, former president trump is defiantly blasting them all. >> i got indicted four times, all trivia, nonsense [ bleep ]. it's all [ bleep ] it's horrible when you look and you look at what they're doing >> reporter: speaking with former fox news host tucker carlson in a pre-taped interview released on social media, trump slammed his latest criminal indictment in georgia and the district attorney who charged him with allegedly trying to overturn the state's 2020 presidential election.

>> basically, she's saying, trump doesn't have the right to -- to criticize an election >> reporter: trump and carlson also discussed the aftermath of the election and january 6th, with carlson asking this - >> so do you think it's possible that there's open conflict >> i don't know. i don't know there's a level of passion that i've never seen. there's a level of hatred that i've never seen, and that's probably a bad combination >> reporter: the interview aired just hours before the one-time reality tv star will hold a prime-time surrender, traveling to atlanta to be booked and processed at the fulton county jail later tonight it comes as lawyers for trump's co-defendants negotiated their bond >> sir, can you tell us anything about your conversations in the d.a.'s office tonight? >> i cannot. >> reporter: at least nine of the 18 other defendants have already surrendered and been released, including rudy giuliani >> i am being indicted because i'm a lawyer >> reporter: as he left the jail, giuliani told reporters

that he spoke with the former president before turning himself in >> i wish him well i have every confidence in him what they are doing to him is an assault on the american constitution >> reporter: now, guys, we don't know how long the former president will actually spend inside the building. giuliani was there for less than an hour. another co-defendant for about 90 minutes and this morning, we're also getting news about another co-defendant former white house chief of staff, mark meadows. he had an emergency request to block his arrest denied by a judge. of course, he made the move as he's trying to move his case to federal court. the d.a. here has made it clear that she will issue arrest warrants for anyone who does not surrender by tomorrow at noon. hoda >> blayne alexander for us, thank you. we'll get some perspective on all of this from nbc's senior legal correspondent and "weekend today" co-anchor host laura jarrett. laura, good to see you so trump is going to turn himself in that's going to happen today he's had other indictments this one's different this is at a county jail >> this is the fourth time he's surrendered, but a county jail is very different than a federal courthouse, which is the first

two times. and then the third time was of course in manhattan, again, at the d.a.'s office. this is a county jail that is under federal investigation for how they treat inmates, the conditions at the jail of course, everyone wants to know whether he's going to get the mug shot, but even the idea that the former of the president of the united states has to wait there. someone was there for 90 minutes because there are other people there being processed at the same time. >> so they kind of keep business as usual, and just say, who's next former president trump, step up. >> you have to that's why you see some people going in the dead of night at 3:00 in the morning because they want to try to get through fast. >> there are 19 co-defendants. some want a change of venue, some want a speedy trial. some want to go to court what was the d.a.'s idea the idea was to try them altogether, bring them altogether in a courtroom. that seems totally not likely. >> given how many defendants you have, it shows how unwieldy this case could be. and perhaps the hope originally, you could charge 19 people and some people could flip, but all of this motion practice shows

how hard this will be to wrap this up by the election. >> let's go to the mar-a-lago case for a second. trump is accused of possessing classified documents and obstructing justice. there's an a head of i.t. guy who was represented by one of trump's attorneys, he said, i don't want you to rep me anymore, i'm going to have a public defender, and in fact he's changed his story what does that do? >> it shows you all the conflicts of interest. when you have people who are representing a cooperator and someone charged in a case, at least one federal judge said, do you want to speak to a different lawyer? and the moment he gets a new public defender, he changes his story and he flips. and to be able to have that testimony at trial will be invaluable for prosecutors. >> for the head of i.t., as well. laura jarrett, thank you so much. good to see you. now to that breaking news overnight in california. a mass shooting inside a well-known biker bar. this morning, we're hearing about the frightening scene as police reveal new details about the suspected shooter.

nbc's national correspondent miguel almaguer is live in los angeles with details on this one. miguel, good morning. >> reporter: craig, good morning. the deadly shooting took place at the historic bar cook's corner. it's been in business for almost a hundred years and is a popular spot in orange county, california. police revealing overnight the suspect may have worked in law enforcement. overnight, police responding to a mass shooting at this famous biker bar in orange county, california. >> eight shots were fired. white male, plaid shirt and jeans, still shooting. possibly active shooter at cook's corner. >> reporter: police say the first shots rang out at cook's corner wednesday night as the live band started playing at the bar's weekly spaghetti night. chaos erupting as people inside rushed to get out of harm's way. knbc speaking to a witness who says she was sitting next to the shooter's estranged wife. >> then he turns around and then he starts shooting at me and

marie, his wife. he had two guns. and he was just going, bang, bang, bang, bang, bang. and i just felt them going by me. >> reporter: ryan was on the patio with his 7-month-old baby. >> you started seeing people screaming and running. >> reporter: police arrived on scene minutes after the first 911 calls were made and immediately confronted the suspect. >> two or three deputies roll up and without hesitation, started unloading on them. >> reporter: police say the gunman was shot and killed by responding officers. >> and we have been made aware that the suspect may be retired law enforcement. we are working to confirm that information as we speak. >> reporter: that witness who says she was next to the alleged shooter's wife told our partners, knbc, the wife was shot and her condition remains unknown. three law enforcement officers tell nbc news that she may have been the target of the attack. craig? >> our national correspondent, miguel almaguer. thank you. let's move now to a mysterious plane crash in russia.

the head of a mercenary group that challenged vladimir putin's reign is presumed dead. he was believed to be onboard a private jet that crashed shortly after taking off from moscow. nbc's chief foreign correspondent richard engel has the very latest on this. hey, richard, good morning. >> reporter: good morning, hoda. so far, the kremlin is staying silent. they have not issued any official statement about the alleged death of yevgeny prigozhin, but many of vladimir putin's enemies have met violent ends, either been poisoned or pushed out of windows, and some russia watchers thought that his death was just a matter of time. was this putin's revenge? russian aviation officials say a corporate jet fell from the sky wednesday and that putin's one-time aide turned enemy yevgeny prigozhin was among the ten people killed. everything about this crash is suspicious. the flight took off from moscow,

reached 28,000 feet, then disappeared from radar, dropping quickly and uncontrollably, suggesting the plane was hit by a missile or there was a bomb onboard. witnesses describe hearing an explosion and seeing the plane break into pieces. [ speaking in a non-english language ] i heard a big bang, said this man. a wing flew off in one direction, and the fuselage went like that. and then it glided down on one wing. the timing is also suspicious. two months to the day after prigozhin, the leader of the wagner mercenary group, launched a mutiny against the kremlin, sending a convoy through moscow, challenging putin's grip on tower. prigozhin stopped after reaching a deal with putin for amnesty that few believed was genuine. a wagner member this morning said the group will continue to operate under new management. [ speaking in a non-english language ] we have other commanders we obey and we will operate further.

an oakland homeless encampment happened around 580 and telegraph avenue. police are saying one person was killed. we reached out to police for more information and we are waiting onward about a motive or if anybody was arrested. and then adam schiff is visiting with voters on the peninsula. he will start his day in half moon bay, and he will speak with farm workers in the wake of last year's mushroom farm shooting. then he heads to pacifica to speak with voters about climate change. city leaders including district attorney, brook jenkins, will be there to layout a new plan, and the news conference starts at 10:30.

and it's time to get a look at the forecast. >> it's going to be hot for the inland areas, but it's starting to feel better as the temperatures drop about five to seven degrees across many of the inland valleys. concord today reaching 93. martinez will see a high of 89. in san mateo, expect the temperature to top out at about 80 degrees. it cools down more tomorrow for the coastline and parts of the peninsula. the valleys are still going to reach into the upper 80s and low 90s, and saturday is looking mild. as we go through the forecast, temperatures heat up again for the middle of next week. the

school >> that's fantastic. >> happy back-to-school to all of you returning lots to get here in terms of the news, including new developments in that dispute between the central characters in "the blind side" film former nfl player michael oher filing a new legal motion with some new accusations against the family he long considered his adoptive parents nbc's emilie ikeda is here in the studio with more on this one. good morning to you. >> reporter: good morning to you guys the big-screen drama has now become a courtroom draw. michael oher is accusing leigh ann tuohy and her husband of withholding nearly two decades of financial information from him. now he's asking the court to force the tuohys to provide answers. this morning, michael oher accusing sean and league ann tuohy of enriching themselves at his expense. >> are you going to protect the family, michael? >> yes, ma'am. >> reporter: in a new legal motion, oher claims he has no knowledge of the income generated from the tuohy's use of his name, likeness and image, and that the touhys have falsely claimed that he's their adopted

son as part of their marketing and business adventures. >> we would like to know if you would like to become part of this family. >> kind of thought i already was. >> reporter: the document is the latest filing in the legal battle between oher and the touhys michael oher who played eight seasons in the nfl claims he only learned six months ago that the touhys became his conservators back in 2004, instead of adopting like he originally thought >> a conservatorship is based on the notion that the person for whom a conservator is being sought has some sort of disability >> reporter: in an interview last week with "the daily memphian," sean tuohy said it was a way for michael oher to live with them and play for ole miss tuohy said lawyers told them, we couldn't adopt over the age of 18 the only thing we could do is have a conservatorship

but in tennessee, adult adoption is legal and was at that time. "the blindside" film earned more than $300 million at box offices worldwide. a source close to the film tells nbc news the touhys received approximately $700,000 to be evenly split among the family. but in court filings, oher says he's been kept in the dark about his portion of those proceeds. oher is asking for a full accounting and for the conservatorship, which he acknowledged in a 2011 memoir, to now be terminated the touhys have not commented on the recent motion, but in a previous statement, their lawyer said in part, they will never oppose terminating the conservatorship and the touhys have given mr. oher an equal cut of every penny received from "the blind side. as for michael oher, he's been seen in recent days on tour for his latest book, meeting fans, but not addressing the lawsuit and michael oher and his lawyers have not responded for our request on the motion. he has previously said that he will let the lawsuit speak for himself. >> such a sad story all around what happens next?
