it's going to be nice all around. we take a live look outside in san jose and we're going to start out with clouds and see it clearing out, but our temperatures are remaining lower than much of the week. in san francisco, mostly cloudy, temperatures in the upper 60s. in oakland it's going to reach up to 75 degrees and 85 in martinez. in fremont, look for a high of 80 degrees today and mid-80s for livermore. tomorrow it does get slightly warmer as you make your way farther to the inland valleys, with morgan hill hitting 90 degrees, and 87 in santa rosa. but overall not too bad. we're going to talk about what else is going on. we're expecting light traffic right now? >> granted. bay bridge both directions moving smoothly, a beautiful view of the city from emeryville. the traffic flow, an earlier crash has cleared heading away from the carquinez bridge toward vallejo. a little slowing, just a little bit, we've seen clearing and the crew as you're approaching bailey, it looks like they're

done right on schedule, no problem right now out of antioch through pittsburg and bay point. vasco road moves smoothly off of highway 4 and we're looking at the dublin interchange with no build. just a little slowing out of the altamont pass. right back to you. >> thank you very much. 5:02 right now. developing at this hour, for the first time in history a former u.s. president has a mugshot. donald trump surrendered to authorities in georgia yesterday, facing felony charges for trying to reverse that state's 2020 presidential election results. "today in the bay"'s drew petrimoulx takes a closer look at the short but historic proceedings, and this morning's fallout. >> reporter: with a wave and a thumbs up, former president trump boarding his private plane, after a historic day in atlanta that produced the first-ever presidential mugshot. >> what has taken place here is a travesty of justice, we did nothing wrong, i did nothing wrong, and everybody knows it. >> reporter: the former president surrendering himself

to state police at the notorious fulton county jail, being processed on 13 felony charges surrounding his alleged efforts to overturn the 2020 election results in georgia. inside the jail, in addition to the mugshot, trump was read his rights. >> the process was largely over and donald trump returned to his car and his motorcade left. it was a short proceeding and a fairly undramatic one, but for the fact that it even happened at all. >> reporter: outside the jail, supporters and detractors adding to the circus-like atmosphere. >> donald trump is a rat. calling him a rat. >> reporter: chanting and parading signs in front of the media. >> what is happening here in fulton county is totally illegal, it's a travesty. >> will you vote for him? >> absolutely, 100%. >> even with the legal challenges? >> absolutely, yeah, because they're phony. >> reporter: trump's grip on the republican party remains strong, while polls show a majority of americans believe criminal charges against trump are warranted, they also show his

lead in the republican primary is sizable and a hypothetical rematch about president biden is neck in neck. drew petrimoulx, nbc news, washington. >> stay with us for the latest developments on air and online. right now it's the top story on our website. head to nbcbayarea.com to read more about the case and updates on the co-defendants. a small sliver of encouraging news from the island of maui, that's where the number of people still unaccounted for after that firestorm is far lower this morning than it was this time yesterday. maui county has released an updated list of people missing, that number now less than 400. now, at one point this week the number exceeded 1,000. so far, 115 deaths are confirmed. the latest list also including the names of missing, with the hope people can help identify those who are still alive. the county is now also taking legal action against the island's power company, citing

that the failure to shut off power, despite repeated warnings of fire risks. they're named in about a dozen legal claims tied to the fires. it says in a statement, in part, quote, very disappointed that maui county chose this litigious path while the investigation is still unfolding. one east bay neighborhood is on edge after a mail carrier was held at gunpoint amidst concerns, it's not an isolated incident. this is the fourth time this month robbers have targeted mail carriers in contra costa county. the latest happening yesterday on salem drive. u.s. postal inspectors say what makes this robbery different from the others is the suspects only stole the carrier's mail and not their mail keys. surveillance video in the area shows a white truck leaving the scene shortly after the theft. the mail carrier was not hurt. >> the investigation is preliminary. we have a description that we're looking for multiple subjects

and the postal inspectors are investigating, the police department is investigating. >> authorities are offering a $50,000 award for anyone providing information that leads to an arrest. a crash involving a cruise driverless car in san francisco happened around 9:20 last night. witnesses say that a cruise car and the construction backhoe were driving on gough street near geary. the cruise car was in the middle lane when it crashed into a backhoe. no one was in the cruise car at the time and the driver of the backhoe was not hurt. we reached out to cruise and sfpd and have not heard back. last week state regulators ordered cruise to cut its fleet in half in the wake of recent crashes and traffic backups. under the new guidelines, only 50 cruise cars can operate during daytime hours. and later today, women will take over the xfinity u.s. gymnastics championship in san jose.

that's where america's top gymnasts are competing through sunday. >> this follows preliminary events in men's gymnastic's. kris sanchez is live with a closer look at two young gymnasts not only competing on the national stage, but in front of this hometown crowd. i love it. >> reporter: can you imagine, one of them is really young and she is competing on the same equipment that some of the greats are, simone biles, suni lee, jordan chiles. so it's really exciting. the men did pretty well for themselves yesterday. there is one bay area native competing, he's on the cal team, he's here, but there's a whole slew of stanford athletes and they are absolutely dominating. you can see in the video, this is day one, it is in the books, leading the back, asher hong, in fourth place coy young on the pommel horse there, rounding out

the top six, colt walker. keep in mind, they still have one more day of competition, but things are looking pretty good. the top six all-around athletes will earn a spot on the national team and then represent the u.s. at the world competition. tomorrow -- rather today, it is all about the ladies. simone biles, jordan chiles, suni lee will hit the mat, as long as with several of our bay area gymnasts. we caught up with two of them. they are among the six who are from the bay area and don't just train here. ali and tyler of san mateo gymnastics, they train there, one of them is in the junior competition, ali is from san mateo, tyler turner is from san jose, and they are excited -- i'm sorry, they are excited to be competing at this level. >> it's cool to be competing against all these amazing athletes and olympians. >> i think it's going to be exciting and it will be kind of a motivational boost to try and,

all week, since monday. i promise i will not talk about this stock tomorrow. donald trump did a lot of things yesterday, one of them, he posted to the social network now known as x for the first time since he was kicked off following the attack on the capitol. when elon musk took over twitter, musk decided to let trump back on, but trump never posted, choosing, instead, to post on truth social. his reach is much bigger on x than it is on truth social. 86 million followers on the former twitter, compared to around 6 million on truth social. the blog the information is reporting amazon is in talks with espn to create a streaming version of the sports network. it would cost between $25 and $35 a month, making it the most expensive streaming service in the u.s. fed chair jay powell will speak at 7:00 a.m. our time at the fed symposium at jackson

hole. they call this the super bowl of bankers. powell often speaks, but it's this event where he tends to make the most news with big announcements. all the fed's actions to fight inflation have led to mortgage rates just enormously higher. their highest point now in decades, 7.23%. that, in turn, is pushing home sales down. they're down 17% year-over-year, according to the national association of realtors. we have had this discussion before, but people often ask me, when will mortgage rates return to normal? they think of normal as being 3%. we had 3% mortgage rates because we had a decade of slow growth followed by a pandemic. so normal is not that. >> and think of what our parents had. >> oh, yeah, 17%. >> 15%, 17%. >> i remember when we were in the midst of the 2% and 3%

morning, great start to our day as we are looking forward to cooler temperatures. let's get you a live look outside in oakland. it's already a busy start to our friday and we are going to see temperatures coming down. take a look at our highs for today, with milpitas and san jose reaching 80 degrees, 85 in los gatos. as you move down to morgan hill, a little warmer with upper 80s there. for the inland east bay we'll see upper 80s, with antioch reaching 89 degrees, 87 in danville. hayward coming down out of those mid-80s into the upper 70s today. along the coastline it's going to be only in the 60s. you head over to san mateo, where we'll get a lot more sunshine. it will be in the upper 70s for a high, and san francisco coming back to our usual temperatures as we see the return of fogust, a lot of fog over the city and mist and drizzle. for the north bay, the warmest temperature will be in ukiah, reaching 89. mostly upper 70s and low 80s for

the interior parts of the north bay. let's get an update on the drought monitor. we know that most of california was taken out of a drought, but there was a small area under a moderate drought across southern california. now that we've had tropical storm hilary, they've even taken more of southern california out of a drought. so there's this little sliver of the state that's in a drought right now, but overall things have improved significantly. and so now as we take a look at what's happening with our ten-day forecast, it's going to be nice and mild, lots of events going on this weekend, including the gymnastics, as well as the pride festival and the parade this weekend. it's going to be in the mid-80s, but it will be heating up for the middle of next week, so we are going to see temperatures heading upward for wednesday and then coming back down. overall, nice, quiet forecast. normal temperatures and cool in san francisco, with 60s and 70s over the next few days. mike says right now it is friday light. >> it is. it's calm right now, good stuff.

protecting a gift card starts at the rack in the store, because that's where many criminals start. before you buy a card, look for tampering. some scammers mess with the bar code. >> you can feel the sticker has a little bit of a ridge on it. >> former police officer spotted a tampered card and made a viral video on tiktok. the bar code sticker is for a different gift card that the thief has. so any money you load onto that card would actually land on the thief's card. so look for a sticker. >> take that extra 20 seconds and visually inspect it. >> you can choose a gift card with extra security. some of them let you set up a pin, especially those use anywhere kind. that might make it tougher for the bad guys to drain your balance. after you get a gift card, use it asap, because other criminals are simply hacking to try to drain your balance. >> there are groups out there that this is all they do. >> so use your gift card as soon

this controversy. donald trump is out on bond after posting bail. we'll have the very latest, including the mug shot seen around the world. also, new data raising alarms in oakland over the recent number of student suspensions. the new findings from consultants hired by the district and recommendations about possible changes. this is "today in the bay." good morning to you, and thanks for joining us. i'm laura garcia. >> i'm marcus washington. let's get a look at that forecast this morning. meteorologist kari hall is tracking what we can expect as we head into the weekend and the first day of school for some folks. >> first day of school on a friday. i love it. >> ease into it. >> i want to start work that way, too. we're going to start out with our temperatures in portola valley at 60 degrees, a cloudy start but a really comfortable day. at pick-up time, sunshine and 74 degrees. our temperatures around the bay area are coming down from the high heat we had midweek, and

this will be the coolest day we'll see in quite a while, only reaching 80 in fremont and san jose, 88 in san martin, about the same in concord and napa reaching 80 degrees. we'll talk about who changes ahead. mike, you're tracking a big slow down. >> most of it is typical traffic, this disabled vehicle is in the roadway, and you know how critical that spot on 580 is. that big build is traditional out of the altamont pass and no process for vasco. we zoom out, you see from top to bottom this shot of the bay is moving nicely. the toll plaza does not have a backup. we are seeing a good build in volume over the last couple of minutes. those metering lights, even on a friday, should be on in the next 15. it looks like a good volume building right now. back to you. 5:32. former president trump out on bail after his arrest in atlanta. >> trump turned himself into the fulton county jail and made history as a first former

president to get a mug shot taken. scott mcgrew is here with us now. we're still awaiting a few people to surrender. >> that's right, overnight we got word that robert cheeley was booked in. there are two others, steven lee and trevian coody that have yet to show up. you've likely never heard those three names, but of course the whole world watched as this man arrived in atlanta. he stepped off the airplane with his signature blue suit and too long red tie. donald trump became the first former president to have his mug shot taken. law enforcement had not taken one up until now because donald trump is one of the most recognized people in the world, making a mug shot largely unnecessary. but local law in georgia requires it. former president trump is out on $200,000 bond, though he only posted 10%. he did it through a bail

bondsman who says he's confident trump will not skip out on bail. >> i think this is probably the most secured bond i've ever executed in my entire career. >> former trump chief of staff mark meadows surrendered earlier in the day. there are 19 defendants in all. these are the suspects we have mugshots for so far. all face racketeering charges. trump and giuliani face the most charges at 13 each. former president trump denies wrongdoing, saying it's his right to question the election results, but of course it's the actions, not the questioning, that led the prosecutor to file those charges. trump called into a right wing news network shortly after his release. >> terrible experience. i came in, i was treated very nicely, but it is what it is. i took a mug shot, which i never heard the word mug shot, they

didn't teach me that at the school of finance. >> four felony cases, more than 90 felony charges do not seem to have damaged trump's approval numbers. he still leads in iowa, the first test for republican candidates. back when trump ran for president the first time, he made a lot of noise over investigations into hillary clinton, though those never got as far as criminal charges. but trump warned us all, a candidate facing investigation would not make a good president. her current scandals and controversies will continue throughout her presidency, he warned. it's going to be virtually impossible for her to govern. and then he added, if she were to win, it would create an unprecedented constitutional crisis. laura? >> thank you very much, scott. 5:35 right now. happening today, antioch police officers ensnared in the recent racist texting scandal are expected to testify at the contra costa county courthouse in martinez.

nearly half of all antioch police officers are now suspended in connection to the probe. around 20 of them have been named. a few were issued subpoenas by defense attorneys representing alleged gang members. today's testimony is tied to the defense attempt to have those cases dismissed. no cops allowed. that's the policy san francisco police officers union claims is being upheld by one mission district bakery. now, the union leaders are showing us an email they say proves what they believe is a bigoted policy. >> "today in the bay"'s ginger conejero saab joins us from the newsroom this morning. this would not be the first time police have been singled out in the bay area. what are they saying in this case? >> reporter: earlier this year, pizza squared fired an employee for asking officers to leave. that happened in san francisco. hilda and jessie, also in san francisco, faced backlash in 2021 after refusing service to three police officers. this morning, you're seeing

reactions about this controversy from both sides. some calling this business suicide for the restaurant. now, on their instagram page a week ago, reem's california said they are temporarily closing their doors at the mission street location to regroup, recenter, and reconcept, and that they will be open through sunday. that sunday was a day after this incident allegedly happened that san francisco police officers association are saying one officer encountered anti-police bigotry and was refused service when he tried to get a cup of coffee on saturday. we have reached out to reem's to get their side to this, but have not yet heard back. the poa sharing an email response they received on august 23rd, when they reached out to confirm this policy. now, it reads, quote, at reem's, we do have a policy not to serve anyone that is armed and in uniform. the president of the poa saying they want establishments to clearly post their policy. >> he was told by one of the

workers there that they had a policy where they didn't serve people in uniform who were armed. here we go again, you know, with this crap, basically. hey, if that's your policy, post it for everyone to see, right? we don't have to play these games. >> reporter: the officer involved issued a statement saying he was, quote, shocked and disappointed. he says, quote, i politely left because i believe that police officers and community members should spend more time listening to each other than shouting at each other, but you can't do that when your presence isn't wanted and your money is no good. now, the poa was asked, why make this public? and the president of the poa says they want people to know because the policy says anyone in uniform and police officers aren't the only ones who wear uniform. >> thank you so much, ginger. new this morning, oakland unified just received a new report on how to improve

services to schools. there's staggering new data on the number of suspensions died to violence. the firm public works llc analyzed disciplinary data and found the year before the pandemic, the number of suspensions at elementary schools was more than 200, for both middle and high schools it was more than 500. and in 2021 high school suspensions numbered more than 800. this year, the numbers are higher, but only for elementary and middle schools. analysts also looked at suspensions for violence and weapons. in 2018 there were more than 200 elementary and middle school suspensions, high schools it's around 400. last year, the number went up for middle and high schools, now there's only one that went down, high schools, but it's still close to 600 suspensions. the report recommends a stronger intervention and prevention program in all schools. let's take a live look at

talking about an event at levi's stadium. the niners game is tonight at 7:00 p.m., there would be crowds, it's a preseason game. go niners. now, in addition to that, we also have the gymnastics continuing with the championships over at s.a.p. center and that's a pretty good distance away. remember, the gymnastics goes through sunday, pride festival saturday and sunday. sunday is the pride parade as well. lots of activity downtown san jose, looking well ahead toward the weekend. tonight, at levi's stadium the event does cause the ace train to alter the shuttle pattern. they are going to leave the p.m. shuttles 20 minutes earlier to account for crowds and possible issues, and then moving toward the weekend, saturday and sunday we have both b.a.r.t. and caltrain work going on, so check the respective websites for changes that you might have to make. they have bus bridges in place. that might be a factor if you're taking caltrain into the city.

what are you trying to tell people who have never rescued a dog? i've rescued animals. what do you tell someone who has never rescued an animal about what the experience is like? >> right now our shelters are packed full across the state of california with dogs especially, and a lot of times people think that animals end up in shelters because there's something wrong with them. so you're taking on a problem. that's really not true. the animals that end up in shelters are there because of human issues, like maybe they were evicted or couldn't find housing. those issues actually lead to really amazing animals like these three in our shelters. >> is it a turnkey, when you show up you pay the fee and you walk away with the dog? they've already been spayed or neutered? >> at valley humane society we believe stronger in people and we want to trust them, and so what we do is we go through a small application process just to get to know you, and then we really want to help you find the perfect match. so, yes, there is a small fee,
