are concerns about dangerous rip currents that already caused some hot spots to close. >> we have it all for you this morning, including dylan dreyer's much anticipated forecast it will be a hot and sunny one for most of you. but tom costello is keeping an eye on the highways outside washington, d.c. tom, good friday to you. >> reporter: guys, just like clock work, it's september 1st, and we've had to pull out the jackets here this morning. 55 degrees or so when we woke up a little bit chilly, but think about the number you just said that means roughly a third of the country, almost a third, is going to be traveling this weekend. yeah, the roads here are packed already. people headed out to the beach domestic travel is up. international travel is up a lot of people headed to canada to get cooler. if we're going to be on the roads or at the airports, they're going to have a lot of company. it's that last big getaway of the summer millions of americans driving into a busy travel weekend ahead.

here on jones beach. here in the new york city area it is not just here in the new york city area it is all along the east coast, massachusetts, new jersey. there are other states experiencing problems as well with rip currents because of other weather systems, including and staying out of the water. if you are in the water an now, there are some safety tips if the risk is high for rip currents, stay out of the water. if you are in the water and get caught in one, the most important thing is to stay calm and not swim into the rip current, but rather into the shore. they will be evaluating the water conditions and determining later on this morning whether or not they will open up the beach. their advice to beach goers is please pay attention to the beach goers and stay safe this holiday weekend. >> absolutely. all right. thank you, steph all right. whether you are marking the holiday weekend at the beach, perhaps the backyard, likely everyone has the same question how is the weather going to be

looking? dylan is in for al this morning. she has the answer >> the weather looks fantastic we have beautiful sunshine across the good portion of the country. there is some monsoonal moisture keep in mind the desert southwest could see rain out of that we have scattered showers across the midwest, back through the plains and most of the west coast will be enjoying a lot of sunshine with no major impacts to the roads here you go. no major impacts at the airports either so if your flight is delayed or canceled, they can't blame the weather because there is really nothing going on across the country. down through the gulf coast, we have this stationary front not a wash-out but when you get stuck in some of these heavier downpours, it could produce a lot of rain in a short period of time that's where we have the grand saturated because of idalia that moved through. so that is going to be really our only trouble spot going through the weekend as we could

get some of that flooding rain down across florida and the gulf coast. craig? >> all right we'll come back to you in a few minutes. new developments in one of the legal cases that surrounds donald trump. >> the former president pled not guilty to election interference charges in georgia what's next in that case laura jarett joins us next now that trump has formally waived an arraignment in person, what are you watching for next in the georgia case? >> the big question is when is the judge going to set the trial date, right? we know at least one of his co-defendants, the architect of that fake electors scheme, he's going to trial in october. we know that for sure. as of right now, he's the only one going to trial in october. and mr. trump obviously does not want this trial to happen in

october. so the big question is when is the judge going to set that date. >> the other big question seems to be the idea this former president wants his case severed from the others. he does not want to stand trial with his co-defendants what do you think about that >> his argument there is his attorney has a conflict. he's busy. he already has a trial you would think when he took this case he already had a trial in september the judge might give him a little leeway, but he may not put it off forever he may say, look, you should be prepared to trial early next year the question here is, we know he's got a pretty crowded trial schedule he's now got four different criminal cases in the midst of a political campaign, right? the question is which will go first? as of right now, it is that one in d.c >> and the judge also confirmed there will also be cameras for all hearings and trials. it will also be live streamed. >> and that's what makes georgia different. remember, this is state court. unlike federal court, you can have cameras it may be part of what factored

>> erin mclaughlin has been following this story for us. she joins us live. good morning to you. >> good morning, guys. it's been over two months since kouri richins court appearance eric's family is said to be optimistic this will move to trial, but it is not clear whether they will be in appearance. >> so my husband passed away unexpectedly last year. >> reporter: this morning a utah life and mother of three, accused of fatally poisoning her husband is due back in court a judge will determine whether or not her case will go to trial. she has been charged with first degree aggravated murder and three counts of possession with intent to distribute a controlled substance, and has not yet entered a plea

more than a year after her husband's death, at the she had been promoting her children's book on coping with grief. >> my kids and i wrote this book on the different emotions and grieving processes that we have experienced last year. >> reporter: according to court documents, last march officers discovered eric unresponsive in the foot of his bed in the early morning hours. that night, richins revealing to police she made him a moscow mule that he drank in bed. autopsy results finding he had fentanyl in his system his family later telling investigators eric believed kouri richins may have tried to poison him more than once. he had been changing his life insurance from his wife to his sister. >> five times the lethal dose is not accidental, your honor. >> reporter: in june, prosecutors painting richins in a new light, revealing new details about the utah mom's alleged internet activity. including searches for luxury prisons for the rich, how long does life insurance take to pay, and can the fbi find deleted

text messages. >> there is nothing to show that she did anything to eric it could have been accidental. >> reporter: a judge ultimately denying bail and a pretrial release. in a case centered on a family's grief, this next hearing may be a turning point towards closure. >> and we're comfortable that the state has put together a good case. >> we have reached out to her attorney for comment, but no response a if convicted, she faces between 25 years to life in prison without parole. prosecutors filed a notice of intent not to seek the death penalty. craig? >> erin, do we know what's expected to happen in that courtroom today? >> reporter: well, craig, a judge is expected to listen to additional testimony and review evidence and then determine if richins is bound for trial if it is determined there is not enough substantial evidence, the case could be dismissed. but the family spokesperson says they're optimistic based on what was presented during that bail hearing back in june

house, it's sirius xm channel 108. many beach goer wills be able to enjoy the sun, sand and ocean breezes. but dangerous rip currents could keep them out of the water stephanie gosk is at popular jones beach on long island stef, good morning. >> reporter: hey, sheinelle. good morning i don't know if you can see over my shoulder. the waves here at jones beach are really big the national weather service says they could get eight feet tall it is also the cause of these rip currents that closed down the beach on thursday and other beaches along the east coast the problem is hurricane franklin, which is off the coast and now projected to make land fall but it is churning up the waters and creating life threatening rip currents all along the east coast. there are also rip current problems in other states, caused by other weather phenomenon in
