>> the special counsel overseeing the case, he plans to indict hunter by the end of the month. the specific charges, we still don't know that. it come after a misdemeanor tax crime and a separate felony gun charge, that plea deal collapsed in july. ryan nobles joins us from capitol hill. so the special counsel revealed his plans to indict hunter biden in a court filing yesterday. why now and how is hunter biden's legal team responding? >> reporter: well, part of it is the timing of everything. there is a statute of limitations here. and at the same time, hunter biden is entitled to a satisfied thatty resolution of any criminal potential charges in front of him. that's part of why you saw the special counsel move to action. his attorneys believe this is part of a pressure campaign that is put on by republicans who insist there is a link between hunter biden's business dealings and that of the president himself. that has not to our knowledge been any part of the special

counsel's investigation into hunter biden. in fact, what it appears this is more about is his efforts to avoid paying taxes in a different part of his life and the potential of a gun charge, using a gun while -- using drugs at the same time which is illegal. if you look at the court filing, it explain why they're moving forward with something at the end of the month. it requires the government intends the return by the end of september. they plan to seek an indictment before that date. so now hunter biden's legal team is in a wait and see period to see when the indictments come down and what they will be for once the charges are filed. >> so house republicans have been investigating hunter biden's business dealings for quite a while. months on end. what has been the reaction to this news on capitol hill? >> reporter: well, it's interesting. as we speak, allison, i'm sitting outside a hearing room

right now warehouse republicans are interviewing one of the fbi investigators involved in the early stages of the hunter biden investigation. this comes out of that whistleblower testimony that took place by the irs whistleblowers that suggested they thought from their perspective that hunter biden and his legal team were given special treatment by the irs and the fbi. republicans for the most part, the ones we talked to today are not impressed. they believe that this is just an attempt by the department of justice to try to shield hunter biden. his legal team feels much differently. they feel their client is in serious legal jeopardy and they believe it is because of the legal pressure put on the special counsel. >> thank you. in pennsylvania, authorities are intensifying their urgent manhunt for an escaped inmate. >> the search for danelo cavalcante is stretching into its eighth day. yesterday they released the stunning video showing how cavalcante got out of chester county prison. you can see the five foot

fugitive crab-walking between two walls in the prison exercise yard. after that, he was able to get to the roof and that's when he was able to escape. >> live outside the princess where he escaped from, walk us through some of what authorities are doing differently today to try to catch him. >> reporter: as we are speaking, a news conference is playing out. pennsylvania state police at the helm of that news conference. they've been leading the investigation while hundreds of other law enforcement officers on the ground here at all levels from the federal level to the local level, including the fbi, the cdp, and we're hearing from the pennsylvania state police, that they did just have a recent sighting of cavalcante earlier today so they're exploring that. we continue to see the perimeter. search zone expand. it is no longer including a number of school so some students are able to return to

the classrooms. as we've been talking to residents, we are on the eighth day of this massive manhunt for cavalcante who escaped in a stunning manner. his hands on one wall. his feet on the other. he pushed through multiple barriers of razor wire. residents acknowledge, this has been disruptive not just because of the road closures and the immense amount of areas in the search zone but also because it is emotionally taxing. many people taking matters into their own hands and implementing security measures at home. take a look. >> i have installed i.r. lights all around my home so at night, if someone were to walk through my location, then the lights would go. on no one wants to be caught in the light. >> reporter: and the reward for critical information leading to cavalcante's recapture is now up to $20,000. >> it's kind of remarkable to think about that video of the inmate escaping because another

inmate escaped that same facility using a similar technique. he was only gone about five minutes before his recapture. what is the prison saying with the changes they'll make to address an obvious security flaw here. >> absolutely. that's a great question. in may they added additional razor wiring and now they are ramping up security including a number of security cameras on the premises, they're going to rearrange the placement of officers outside and then probably most importantly, they are completely enclosing the exercise area which is where both the inmates had escaped from, climbing on the wall and then the roof and then escaping. >> all right. live from pennsylvania, thank you, emily. breaking news this hour. a judge has just sentenced former "that 70s show" danny masterson to 30 years in prison. he was convicted of raping two women in the early 2000s. throughout the trial, prosecutors argued the church of

scientology helped cover up the assault which the organization has repeatedly denied. masterson's accusers did testify at today's hearing. they asked the judge to sentence him to life behind bars. students at san diego state university in california are on high alert after two shocking incidents of sexual assault. >> two female students were attacked and in both cases, they had gotten into cars that they thought were ride shares. maya england has been following this story for us. >> hey, san diego police and state university officials are warning the community today of two similar crimes that have targeted female students on campus. the first incident was reported on august 27th. a student said they got into a car they thought was a ride share near campus. the student says they were sexually assaulted in the car, driven around for a period of time, and then dropped off. the second case was reported on tuesday this week. the victim told police, she and a friend got into a car they also believed was a ride share vehicle around 2:00 a.m. the driver then allegedly

sexually assaulted one of the friends before dropping them off a few blocks south of campus. several students have complained about the lack of street lights near campus and other safety concerns. take a listen to what one student said about what happened. >> i find it personally really scary knowing that especially involved with a ride share, knowing that could have happened to any of my friends or even if it did happen to people. i can't imagine them having to live through that. >> while there are many similarities between these two cases including the description of a suspect of medium build and aaccent, they have not been linked yet. based on the fact they aren't able to tell fuss this was a legitimate uber driver or an imposter. >> that really begs the question. we have heard so many instances like this where people are getting into the wrong car. what can people do to make sure

they are safe? >> for people using a ride share app, make sure the license plate number shown to you on the app matches the car. you can also ask the driver who they're picking up rather than right away. there is a setting where you can set up a pin system. you turn that on and uber will give you a unique number before your trip. you can find it by going to the setting tab on the uber app. you can turn the feature on for free. >> that is such great advice. you use that feature. >> i love that feature. i would come home late a lot of time at the airport. i felt more comfortable having that extra check and i think it is so great. it is tricky to find so i'm so thankful you showed us exactly where it is. >> and i should mention tomorrow. i'll have an exclusive report on

first images of him inside the cavern. you can see the scientist mark dickey here in the red jacket. he felt ill about three days ago. he delivered this message to friends and family. they really want to see him home. >> i want to thank everyone down here,a the response of the kaying community. it is a really tight-knit group and it is amazing to see how many people have responded on the surface. we're still waiting for communications to reach down here. so rate now it is a day to get communication back and forth. i don't quite know what happened but i do know the quick responses of the turkish government to get the medical supplies that i needed might have saved may life. >> dickey is a scientists but he is one who specifically studies caves. he's an experienced cavist. now multiple team from multiple

countries are slowly working to bring him back up to the surface. talk to us about how much progress has been made to get him out. >> reporter: you can really see how difficult the conditions are in that cave. it's cold, it's dark, it's wet. you can see mark dickey's breath. the temperatures are between 38 and 42 degrees in there. in some chambers, the water is knee-deep. rescuers will have to squeeze through. they spent the last day or so slowly descending into the cave, attaching rope lines. there will be part of the evacuation for dickey. it is an excruciatingly slow process. rescuers have to rappel down 3,000 feet which normally takes

about 15 hours. it can take shorter than that if someone is very experienced. on top of it all, they're having to assemble this evacuation line. we can actually show you a line of the morca cave in turkey. it gives you the idea of how far they have to go. there are some base camps along the way. that has helped with communications. there's a long delay in communications. it takes about six or seven hours for a runner to go from where dickey is up to a place where there is a communication line and then communicate the message to the surface. tough to know how far they have progressed because of the time delay but it could take four days, possibly longer, to get to the surface. >> thank you. we are following an unbelievable story out of california. liberty to this. a driver just rescued after being stranded for five days.

he was found near his red truck 100 feet in a ravine. he is in the hospital recovering but thankfully alive. miguel almaguer joins us now. you actually talked to the person who found this driver. what did he tell you? >> reporter: well, first he said he couldn't believe he was hearing a cry for help. then he was shocked to see the crumpled truck at the bottom of a ravine. corey was dirt biking in the mountains a few miles outside los angeles in a remote back country area. he was able to climb down the hill and reach the 68-year-old victim. calvin smith was desperate for water, some shade and also help after spending nearly five days at the bottom of a ravine. first responders say he careened off a cliff and plummeted about 100 feet down. he was life-flighted to the hospital where he is making a recovery today. here's what corey told us a short time ago.

[ laughter ] why is that funny? hi, everyone. happy thursday. this is "the fast forward." i'm janelle wang. police are investigating a deadly officer-involved shooting. it happened just before 10:00 last night. it's not clear what led up to the shooting. we are expecting new information from police in a news conference later today. we will bring you an update at 3:00 this afternoon, also online at nbcbayarea.com. students are back on campus at skyline high school after a shooting earlier this week. bob redell spoke with students and parents as they returned to campus. >> reporter: oakland unified

said they would have counselors on campus here today for students or staff who wanted to talk about the shooting that happened this past tuesday. by the way, no one was hurt. it was a very frightening experience for some of the people who were here. as you can see in the video, oakland police assigned an officer in a squad car to stay on campus and monitor the students as they arrive for class. that officer left campus around 9:45 this morning after classes had begun. parents yelled at us as they drove by that they thought the school needs to do more to protect their children. some parents have suggestioned metal detectors on campus. this was the scene here at skyline late tuesday morning, earlier this week. there was a large police response. the school was put on lockdown after someone fired a gun on campus. students tell us the shooting happened near the theater, in between classes. they say the shooter was at least one fellow teenager. nobody was hurt. opd did arrest two teenagers.

parents say there's been too much violence on campus, including a stabbing last year. at least one other report of a gun on campus along with several fights. any concerns? >> i feel safe. i feel like it was a freak event. >> reporter: did your parents talk to you about this? >> my dad talked to me about this. they weren't worried about it. it wasn't as bad as some of the events happened similar to this. >> this situation was handled well. i'm not too worried. >> it's happening too much across the nation. we all need to come together as a community and work at the root causes so that we can stop some of the violence. >> reporter: earlier this week, oakland unified said they are reviewing their security measures. the district did close school yesterday to allow police to finish up their investigation and to give students time to process what happened on

tuesday. bob redell, nbc bay area news. >> thank you for the update. walgreens will pay customers more than $44 million in a class action lawsuit over flawed theranos blood tests. the money will go to people who bought the tests in arizona and in california. customers filed the lawsuit claiming the company entered into a partnership with theranos, even though they knew it knew the blood test didn't work. theranos is the blood testing company started by elizabeth holmes. last year a jury convicted her of defrauding customers. she's serving an 11-year sentence. the company's former president was also convicted of fraud and is currently serving a 13-year sentence. as we inch toward the weekend, the weather will remain sunny and mild. here is kari hall with an update. >> our temperatures for the south bay will reach into the mid to upper 80s. not much of a change from the

storm with forecasters predicting that it really intensified into a category 5 storm with the sustained winds of over 165 miles an hour. lee is just offshore of puerto rico and cuba before making a northward turn out to sea. the exact forecast remains uncertain. a manhunt is in its second day after a homicide suspect escaped from a sh with a d.c. area hospital yesterday afternoon. police said it was not clear how 30-year-old christopher haines managed to escape but he was spotted late wednesday with black handcuffs dangling from his wrists. and students at george washington university were told to shelter in place. the roads were also closed. the fbi is offering a $10,000 reward for any information that leads to his capture. four rare and remarkably well preserved roman swords were discovered in a hidden cave near the dead sea on wednesday. >> this is crazy. a team of experts were visiting the cave to inspect a hebrew

encryption when they scum bled upon the nearly 2,000-year-old weapons. experts said they believe the swords could have been stolen by jewish rebels and hidden around 135 a.d. >> that's a long time ago. a federal judge is giving texas eight days to remove buoys from the rio grande river. they were put in place as a way to prevent migrants from crossing into the u.s. from mexico. the biden administration sued over the buoys but greg abbott is pushing back today on x, formerly known as twitter, that the fight ain't over yet. now from miami, what exactly did the judge say in his ruling? are we potentially possibly going to see this heading to the supreme court? >> so the judge has ordered texas to raf those buoys, indicating that is an area that should be the jurisdiction. federal government. and texas never had a right to

install these buoys. the judge indicated that in order for texas to install the buoys, they should have gotten permission from the army corps of engineers. we should keep in mind that mexico's federal government opposed the buoys, indicating some of them were in mexican territory. we know the decision has been made and texas has to remove these buoys. the judge also said that texas is not allowed to place other objects in the water. so for now as we saw governor abbott has responded indicating that they will continue with this fight. of course, he's talking about taking this to a court of appeal and he says he's willing to try to go to the supreme court if that's necessary. >> all right. live from miami for us, thank you. the border crisis also front and center in new york city. officials say more than 10,000 migrants are arriving each month and today the city welcomed more than 19,000 of their children for the first day of school. many of the kids do not speak

english yet. now the city is scrambling to hire bilingual students. some schools had to turn away some of the children of asylum seekers today. mayor eric adams has repeatedly asked the administration to step in and help with this crisis, citing a lack of shelter and funding. he warned that the issue will, quote, destroy the city. tennis fever is spreading across new york city ahead of the u.s. open semifinals. with three young u.s. starts still fighting for the championship, americans have an extra reason to hope for the tournament. it is not just the stars. it is about growing future stars. noah is back from arthur ashe stadium and has more for us. break this down. how does this year's tournament relate to the future of tennis in the united states? >> more than 900,000 fans are expected to attend the

back in 2004. joining us now, someone who knows a thing or two about winning the big game. hall of fame head coach and nbc sports football analyst, tony dungy. the chiefs, they still have super star patrick mahomes. they have their home andy reid. a lot of fans are hoping the super bowl is theirs to lose this time around. what is your take? >> well, it is so tough to repeat. you're right. they do have those two elements. they've got some issues. they lost seven of the starters from last year's team because other teams came in and paid them a little bit more. so they have a contract situation with their best defensive player, chris jones, and their second best offensive player, travis kelce is injured. we don't know if he'll play tonight. those are some things that the defending champion have to deal with. you're right. they have patrick mahomes and andy reid and they have a culture and attitude of winning.

>> that mahomes-kelce energy. we know they've gotten at love attention in the tri-state area especially. how do you think the jets will do? what are the other team you're keeping your eye on this season? >> i think the jets will do really well if they can protect aaron rodgers. he's a force. and we had them in the hall of fame game. and the players, the the coaches, everybody talked about the difference he has made. so the jets are looking up in my opinion. i look at the packers and the bears in the nfc. people thought they wouldn't be as good but they have young quarterbacks who could be coming on. and i love the jacksonville jaguars. they were on the way last year. they've got a young quarterback in trevor lawrence. and i think they're a force to be reckoned with. >> on the opposite end for fans who maybe their team isn't

looking so hot. who are you looking at and saying your guys will be in for a rocky road? >> well, three teams that drafted quarterbacks very high. they'll play them. carolina panthers will play bryce young. the texan there's play cj stroud and the indianapolis colts will play anthony richson. first-year quarterbacks struggle in the nfl. and i think it could be a tough year for those three teams. i think those quarterbacks will get the experience they need and in the future, year two, year three down the road, they'll be really good. it could be tough. >> keep looking in your crystal ball for us. give us your prediction. who is a player on a household name by the end of the year that we might not be expecting? >> i think people can be on the lookout for garrett wilson, wide receiver for the jets. he has a great quarterback. he was rookie of the year last area. so he obviously has talent. i think he can go off the charts

with the exposure he'll have with airplane rodgers. >> can i ask you, given your history, your absolute love and experience of the game. i did not grow up in a home that watched a lot of nfl football. we were an sec house hole. what is it about this game? >> it is a team game. you get everyone involved. i think the great thing about the nfl is you can go from worst to first. you get a good trade. thing come along. we're watching the detroit lions. i've been a lions fan. i'm 67 years old. they were 2 years old the last time they won a championship. the town is on fire. i'm walking around kansas city today and there are lions fans here. they're excited about their team. so everyone has hope in the nfl. that's the great thing. >> we love it. thank you for your time this afternoon.

attempted book bans in the united states last year. this according to the americans library association. in today's daily health, a new survey from the jenlts testing company finds there is widespread confusion and misconceptions about ovarian cancer screenings. >> 71% of women incorrectly believe annual pap smears include testing for ovarian cancer. according to the cdc, the only gynecologic cancer it screen for is cervical cancer. >> dr. shepherd, great to have you with us this afternoon. let talk about this. there isn't a standard test for ovarian cancer? how is it diagnosed? >> that is a great question. i think where we should start is, looking at that percentage, 71% truly believed that a pap smear screen for ovarian cancer. to knock that out of the way, a

pap screen test is just for cervical cancer. that's the lower part of uterus. this is what we have seen since the advent of the test, a significant decrease in deaths from cervical cancer. now coming back to you are why question, ovarian cancer, it is the second most common gynecologic cancer in the u.s. again, it causes more deaths than any other cancer in the reproductive system. so yes, it has a very high mortality rate. we don't have a screening test for it. this is something we've seen in the medical community and we've wanted to establish for years. we haven't quite found how to use that, whether it is a blood test or imaging. what will give as you screen tool. not diagnostic but screening for it because of the 13,000 women that die a year from ovarian cancer. >> i want to look at a couple other number from the survey as well that stood out to us. 47% of women believe they're being proactive when it comes to

ovarian health. only 38% say they actually visited an obgyn in the past year. how regularly should women be visiting their gynecologists in terms ovarian cancer? what sort of symptoms should people be looking out for? >> yeah. two great questions. i truly believe the relationship that you have with an obgyn doesn't necessarily have to be for a screening test. we have recommendations for the pap test, we know that can be three to 5 years, depending on what the result is. now, typically you should still see your obgyn every year because there are other things outof screenings. now going to ovarian cancer and what those symptoms are and what you might experience from ovarian cancer, the caveat to this is usually when we talk about finding symptoms of ovarian cancer is when someone is a little more late stage. that's when they start to have some of the systemic sighted effects such as abdominal bloating, or they might have back pain or kind of a fullness
