in a case surrounding four criminal defendants. we're live this morning with a look at what may play out in the courtroom. pushing for a new deal. south bay teachers take their case to the streets. their demands as talks reach a standstill. also, the frantic race to rescue an american trapped in a turkish cave. where efforts stand this morning. this is "today in the bay." >> good morning to you. friday, 5:00 right now. thanks for starting your morning with us. i'm laura garcia. >> i'm marcus washington. we'll get a look at what's going on with the commute in just a bit, but first the friday forecast. meteorologist kari hall has been tracking that. >> it looks good today and we're going to start out with low clouds and fog in san francisco and today will be a mild day and just slightly warmer for the weekend. we've been watching the tropics, a little moisture moves to our south on saturday, and there will be a chance of showers just

south of the bay area, mainly from the central coast on into parts of southern california. so we look at our temperatures that are, as we go through the weekend, going to go up a degree or two, but stay mild with upper 80s and lower 90s for the hottest spots inland. mike, you've been eyeing some slowing. >> we see sensors not where we often see the first slowing, it's on highway 4 out of antioch and toward pittsburg, around bailey. the crew that's there overnight is scheduled to be cleared from the lanes. the freeway itself is open, we just see slowing. they're probably doing traffic breaks to pick up the cones. everything south of there looks really good. a little blip for 84, just a shift over approaching the 680 merge. out of the altamont pass there's a little slowing where you would expect, but not a big deal. it's friday, it's lighter, back to you. >> thank you very much. to our continuing coverage of the racist text message scandal rocking antioch's police

department, a recent administration by contra costa county process my impact the current cases. >> we learn the impact on the cases. ginger conejero saab is live for us this morning. this case is bringing out emotions on both sides, even outside of the courtroom. >> reporter: that is correct, marcus and laura. that's exactly what happened at last month's hearing. there were those who were protesting against the racist text message scandal involving antioch police officers. there was a concession from the district attorney's office saying that engaging -- or the officers that engaged in text messages did violate the racial justice act, and there were also family members from the victim, the man who was murdered, his accused, who are now standing trial, and a mother who says this is about justice for her son's death. >> this is about the murder of

my son. >> say his name. >> marcel hawkins. and if you guys let him out of jail, there's going to be a war. >> we know this may release people on the streets charged with serious crimes. but all the fault of that is on the police hands for their racism in their policing. if they would have acted appropriately, the charges would stick. >> reporter: those are the two sides at the heart of this morning's hearing, and to be clear, it's not the police officers who are involved in the scandal who are on trial or who have a hearing. it's the four men accused of murder who were the subject of racist text messages from antioch police during their investigation of this case. the big question this morning, will that be enough to reduce charges on this case? >> we want the court to exercise the full extent of its authority to try to restore some integrity to the policing from the antioch

police department. >> reporter: last month's hearing, judge david goldstein ruled the subpoenaed officers did not have to testify because of that da's concession that the text messages violated the racial justice act. the judge said because this is the remediation process, he cannot outright dismiss the charges, but he can reduce enhancements or take those away and reduce charges. so there's a lot to go through this morning, a lot of eyes will be watching the courthouse over in contra costa county in martinez. that hearing is scheduled to begin at 8:30 this morning. marcus and laura? >> we'll continue to cover. thanks for the details and breaking it down, ginger. sending a message to board members, a new coalition from james licht high school attended last night's meeting for the high school district. the parents, students and teachers say they're fed up with the violence, including the fight caught on video last month resulting in the stabbing of two

students who are now recovering. the school district has added more security, but students want to see more than that. >> i think a police officer walking around the campus, but one that's like a social worker that can connect with the students so they aren't afraid to speak with them about any issues. >> the district has set up more security around the campus perimeter and hired extra patrol officers. police are still investigating the stabbing incident. elsewhere in the south bay, teachers locked in a labor dispute are taking their message to the streets. >> a fair contract is a right. >> that is why we have to fight. >> dozens of gilroy teachers marched to last night's school board meeting. they are pushing for what they call a fair and respectful contract, saying talks are at an impasse. >> we're fighting for effective learning conditions, we're fighting to improve our ability to recruit and retain in gilroy unified, fully qualified teachers, and we're fighting for

greater access to mental health supports for our students as well. >> some teachers say they're paid 50,000 a year and that's not enough to make a living in the bay area. the district gave us a statement saying, in part, by march of 2023 the district offered a total compensation increase of 11.25%. this is the highest single year increase ever offered in the district. the district added it hopes to reach a new deal soon. new this morning, california governor gavin newsom opening up about his future in an exclusive sit-down with chuck todd from nbc's "meet the press." todd will host his final show this sunday. the interview covers a wide range of topics, including the possible run for president. >> filing deadlines haven't passed. if president biden doesn't run, why shouldn't we consider you? >> i think the vice president is naturally lined up and the filing deadlines are quickly coming to pass and i think we need to move past this notion that he's not going to run.

president biden is going to run and i'm looking forward to him getting re-elected. i think there's been so much wallowing in the last few months, but we're gearing up for the campaign and looking forward to it. >> governor newsom goes on to say that he would fully support vice president kamala harris i she decides to run and he will not run against her. don't forget, thatview is part of chuck todd's final "meet the press" telecast airing this sunday at 8:00 in the morning. that's right after "today in the bay" on the weekend. developing at this hour in turkey, rescuers are rushing in to rescue an american man trapped inside a cave about 3,000 feet down. the man, named mark dickey, suffered gastrointestinal bleeding while exploring the cave, leaving him unable to eat for three days. it's way too hard for him to climb out, but since then an international rescue team has delivered blood and administered

transfusions. his friends say other factors are complicating the rescue efforts. >> the quick response to the government to get to the medical supplies that i needed in my opinion saved my life. as you can see, i'm up, i'm alert, i'm talking, but i'm not healed on the inside yet. so i'm going to need a lot of help to get out of here. >> crews say his return to the surface may still take days. that's because the cave is so deep and narrow. it's also still unclear if he will be able to leave on his own or have to be carried out on a stretcher. forecasters right now are keeping a close eye on two brewing hurricanes. one on the pacific ocean, the other on the atlantic. hurricane lee, now a category 5 hurricane, approaching the caribbean, and its path toward the united states. now, still far from certain. hurricane jova is a category 4 near baja peninsula. this one, there's still hope that it will turn away from the

coast. but parts of southern california may feel the weather impacts there. meteorologist kari hall, of course, has been tracking the path of both of those storms. talk to us about how it's looking this morning. when we see this, to a layman, this looks really bad. >> yeah, but it has continued to weaken. it was a category 5, right now it's a category 2. as expected, it does continue to weaken. we're not going to see this maintain that category 5 intensity. it is going to fade out over the next couple of days and it's going to stay out over the open pacific as it does continue to move out and not affect any land. the only impacts we're expecting will be along the coastline, there may be higher waves. there's a beach hazard statement in effect anywhere from santa cruz all the way down to close to santa barbara area and then there's a high surf advisory in effect for the l.a. coastline. we're going to see some of that moisture coming in as the tropical moisture moves to the north. we typically see high clouds and feel the humidity, but we're not

going to have a major impact. here is hurricane lee that is a category 5 hurricane. this is going to garner a lot more attention as it could possibly affect more land. but this is also expected to maintain that intensity as it moves over some very warm water just north of the caribbean and around hispaniola, and then it does continue to have an impact on the waves on the atlantic coast as it is expected to make a turn to the north. we'll be watching that happen as we go through next week. so a lot to keep an eye on here and the tropics remain very active with some extremely warm water out there to give it a lot of energy. we'll talk about what to expect here in the bay area with our forecast coming up in a few minutes. mike has been keeping an eye on how that may affect some of the gas prices. >> of course we're listening for scott to give us the updates of the ripple effect. oftentimes prices go up faster than they come down. mountain view in the south bay, $4.59 has been holding steady,

good friday morning. right now at 5:14, as you head out in brentwood, nice, clear, easy commute, as we are seeing comfortable temperature, right at 60 degrees. heading through the morning, lots of sunshine and it's going to be a nice day. heating up once again as we already hit 79 degrees at noon. we're headed for about 90 this

afternoon. there still will be a wide range in our microclimates. we'll take a look at that in the weekend forecast coming up. traffic is moving smoothly. san jose, headlights heading north from 280, 680, up towards santa clara, an easy drive right now. we'll show you how things are shaping up in the east bay. i've got my eyes on a couple of slower spots and things should start to transition right now. good morning. happy friday to you. i hope you had a good week. apple did not have a good week. the company's stock fell 6% this week and this week is not over. apple is measured on the dow, so it's pulled that index lower as well. apple has got a couple of challenges ahead of it. some chinese government officials apparently are banning the use of apple iphones in government work there. apple's competitor huawei is out with a new phone with a new chip that manages to be pretty good, despite american restrictions on chips. apple announces new iphones early next week. now, a warning this morning that

there is a vulnerability in iphones and ipads, and apple is urging you to upgrade your operating system with the latest patch. you plug your phone into power, go to settings, and then general, and look for the software update. it will be red if you haven't got the new patch. you click on that and install now, and you're good to go. the fight between charter cable and disney continues leaving disney-owned channels blacked out on charter's spectrum system. for many people the most important channel is espn. the fight is over money and streaming. here is a map, customers in morgan hill, san martin, gilroy, then over to santa cruz and capitola and salinas. hulu sent a warning to customers it will raise prices to $17.99 for the tier without the ads, the highest it's ever been. elon musk this morning disputing, or at least clarifying an allegation he

turned off internet access for the ukrainian military as they tried to attack russian ships near crimea. the allegation comes in an authorized biography written by walter isaacson due out next week. isaacson says he followed musk around for more than two years. he's also written a biography of steve jobs. he says musk ordered the starlink system to be turned off as ukrainian drones headed toward the harbor. the drones needed the internet connection to find their way. according to the book excerpt, published by cnn, isaacson says musk explained it this way, i think if the ukrainian attacks had succeeded in sinking the russian fleet, it would have been like a mini pearl harbor and led to a major escalation. we did not want to be part of that. musk on social media clarified and said he didn't turn anything off, it was off. he knew about the strike and he ordered it not to be turned on. >> interesting. >> no matter what you think of musk, there are lots of

companies that say they don't want their products involved in war. that was not the idea of the product itself, right? a lot of google employees objected to a google system that was going to go into the pentagon to the point where google canceled the whole thing. >> interesting. >> thanks, scott. 5:18 right now. an unusual and unexpected delay at the height of a highly anticipated tennis match. climate change protesters last night took their cause to center court at the u.s. open. they began disrupting play at the start of the second set of the women's semifinals featuring u.s. sensation coco gauff. one protester glued his feet to the floor. play stopped for nearly one hour. when play resumed, coco gauff shook off the tension, 7-5, to earn her first trip to the

finals, which happens tomorrow night. >> she looks pretty happy about that. >> don't get in her way. don't get in kari's way, because it's the weekend. >> the all-important forecast. there's a lot going on around the bay area, and we've seen some great weather. we just hope that doesn't change. it does look pretty good. we have the a's game happening later on today, we're starting out temperatures in oakland in the mid-50s, we're seeing a few clouds. as we go throughout the rest of the day it's going to be clearing out and temperatures slowly warming up, but not too bad. headed for 77 degrees for the afternoon. for napa, we're going to reach 78 degrees, really comfortable for much of the peninsula and into the inland east bay. it will be slightly warmer for some of our inland valleys like fairfield, hitting 90 degrees, and 88 degrees in morgan hill and in san martin. tomorrow expect it to be just a little warmer in some of those valley spots in the south county. in the north bay, santa rosa

reaching 85 degrees, and in novato reaching 84. san francisco, 71. we've been talking about a modest warming trend and this is it. we're not looking at any extreme heat, except there will be some mid-90s in fairfield. concord reaching 92, some of those valley temperatures will be slightly hotter. then we go into early next week with a warming trend, but then we don't see that lasting very long. by the middle of next week we're in the low 80s, even upper 70s on the way for the next weekend. it looks really nice beyond the seven-day forecast. as we take a look at what to expect inland, once again, some of our valleys will be reaching the peak of the heat on monday, with highs in the low 90s, then we'll bring it back to the low to mid-80s for the rest of next week. san francisco just seeing some changes from upper 60s to low to mid-70s. so not really drastic here as well. really nice weekend ahead for your outdoor activities. mike, are you still seeing

some slowing out there? >> we are seeing slowing, highway 4, slow coming into pittsburg out of antioch. a little more slowing. i think the last of the crews is clearing eastbound. they're likely picking up cones and there may be traffic slowing because of additional crews getting ready to leave. we have new slowing for west 37, which we predict happening on a friday. the morning commute is kicking in and that enhances the slowing we saw on highway 4. in fremont, smooth drive, and in palo alto, a smooth drive 101 into san francisco. 5:21 right now. coming up next on "today in the bay," nbc bay area responds. >> they're spinning their wheels with a couple of companies who were sitting on their complaints. so they

happy friday. nori in pleasanton shared a variety of issues with a pricey certified used car, including mismatched tires and a dmv registration the dealer botched. the dealer didn't expect all that was expected until we stepped in. the dealer also toss in a cash bonus for the inconvenience, in all a $3,500 win. next, jeffrey in san jose told us an airline owed him 80 bucks for a taxi. the carrier had caused a hiccup, caused him to miss his connecting flight in dallas. he said the airline could only

friday. you've made it. meteorologist kari hall has a look at what we can expect for this friday forecast. how is it looking? >> it looks great. we're going to enjoy more sunshine going into the weekend, slightly warmer temperatures, but not too bad. let's get you started with a live look outside in san jose, checking out our trend throughout the afternoon. so we're starting out low 60s, where we usually do see those temperatures, and then as we go into the rest of today, it will be in the low 80s with a lot of sunshine into the afternoon. now, for the rest of the bay area, mostly upper 70s from oakland down to hayward and upper 70s for mountain view, toward san mateo 75 degrees. santa rosa is headed up for 84 degrees. there's lots of events going on this weekend, so i'm going to show you a few of those coming up in just about five minutes. mike, you're also giving us a look at how the friday commute is shaping up. >> it's looking friday-ish. the bay bridge smooth, no backup

at the toll plaza, no metering lights just yet. the map shows you a little slowing at the top of the screen, traditional even on a friday. highway 37, we saw the sensors change from yellow to orange and red. there should be less slowing here, i just saw the chp grid and the caltrans grids update and we do have clear crews now from highway 4 through the area where the overnight construction was continuing. but it was going to be clear west of bailey. looking at 580 coming into the area, the headlights move smoothly toward the dublin interchange. just a little slowing in the altamont. back to you. >> thank you. a gruesome murder case now heading to the courtroom and this started with the discovery of human remains along the bay. >> "today in the bay"'s kris sanchez joins us live in dublin this morning. it sounds like the victim was in a volatile relationship with the suspect. >> reporter: it sounded very tumultuous by police accounts and by accounts of the neighbors, and accounts from the family, though indirectly.

the suspect is here at the santa rita jail in dublin and he'll be before a judge today to face those murder charges for killing allegedly his girlfriend, 27-year-old rachel buckner's body was found in a bag along alameda shoreline back in july. her body was not intact. her boyfriend, 42-year-old joseph roberts, was arrested at the apartment in pleasanton where they lived together. neighbors told us that they were horrified to hear of buckner's death but said the trouble started long before that, with frequent arguments they could hear through the walls. >> it's just, honestly, really scary, like i was kind of scared for her and i always wanted to go over to see, like, hey, do you need something? >> reporter: now, investigators told us that roberts also assaulted several of buckner's family members. today he will be arraigned on murder charges, perhaps other

charges as well. he will be before a judge this morning. in dublin, kris sanchez, "today in the bay." >> tragic story there. >> it really is. 5:33 right now. newly released video shows the tense moments leading up to a police shooting that seriously injured a man in san francisco's tenderloin 12 days ago. >> we just want to help you. that's it, man. you're scaring everybody. >> sfpd yesterday presented body cam video during a town hall meeting. you could hear officers there trying to calm the suspect down. 54-year-old richard everett, who they say had been threatening people with a knife. after 15 minutes of trying to get him to surrender, police say he lunged at officers who responded with gunfire and non lethal bean bag rounds. >> mr. everett's knife was on the ground next to his right hand. officers observed the knife appeared to be tied or tethered to his right wrist with a belt. >> the suspect is still in

police custody. the da's office is reviewing the incident. monday marks 22 years since the september 11th terror attacks. a live look this morning in new york city. as always, a memorial will be taking place that day, 9/11, with the reading of the names at the memorial plaza at one world trade center. during the ceremony, six moments of silence is observed to acknowledge the attacks on the world trade towers and the pentagon, as well as that crash of flight 93, which was heading to san francisco. events will also happen at the pentagon and the pennsylvania crash site. meantime, new york city first responders remind everyone to rush to help -- who rushed to help on that fateful day, continue to die from related illnesses. the latest, andrew enders, who died last week at the age of 56.

he actually worked as a new york city paramedic for 25 years. his death comes as new york city's fire department says this week 43 new names were added to the 9/11 memorial. today marks one month since the deadliest wildfire in modern u.s. history. teams in maui still poring through the list of missing persons following the firestorm. the official number of dead still stands at 115. maui leader, meantime, are asking travelers to come back and visit the island to help boost what has been a struggling economy. one month later, many say the gravity of what happened has still not sunk in. happening today, more than a dozen musicians will perform a live stream benefit for maui fire victims, ll cool j, sarah mclaughlin taking apart. the event will be streamed on youtube. people can donate directly from the live stream page. the money will go to the maui

strong fund providing aid to those impacted by the fires. it will start at 5:00 p.m. on ziggy marly's youtube channel. local victims include one in livermore at the three steves winery at 6:00 p.m. then at half moon bay there's an event at the can nina garden at 7:00 p.m. a small step forward in the project to create more emergency housing near levi's stadium. for months, san jose has been fighting to build 200 units of traditional housing on vta property just off zanker road. the state has awarded funding, but vta says the zanker road location is not a right fit. leaders raised concerns about safety and the ability to actually expand operations. last night after a debate, the board agreed to draft a plan for the original site, while sirging out if other options are available. the board will meet with the

city again in october with all of the reports. let's take a live look at oracle park. sometimes it's just nice to come home. giants still in the thick of the playoff chase, but a sweep in chicago leaves them sitting at .500, within 2 1/2 games of the last wild card spot. let's hope they can turn it all around starting tonight when they host the rockies. the games airs here on nbc bay area. coverage begins at 7:00 p.m. i'm planning a little watch party for the kids. we've got some baseball fun happening. meteorologist kari hall joins us. is the weather going to cooperate? >> it's going to be great. typical weather, cool, windy, low 60s, but at least sunny. we see the wind gusts that pick up to about 18 miles per hour, it's going to be breezy. as we go into late this evening, dropping into the upper 50s. so definitely much more comfortable to watch it right here on nbc bay area. then if you're thinking of making weekend plans, taking

some pictures at some of the pumpkin patches, they're starting to open. lemos pumpkin farm will be open and temperatures in the mid-60s throughout the afternoon. also, there will be the mountain view art and wine festival. beautiful weather there. we're going to see temperatures headed for 80 degrees, both saturday and sunday. and then, also, throughout the weekend we have oakland pride, the parade will be on sunday morning, starting at 11:00, going through downtown oakland we're going to see temperatures in the low 60s to start, and then reaching into the low 70s, so it will be very beautiful out there, very comfortable weather. then heading to paso robles, that's where we have hot temperatures going from 90 today to upper 90s by the end of the weekend. but, of course, lots of sunshine there, as you enjoy some wine. and if you do plan to go to palisades tahoe this weekend, it is going to be great.

that's actually a live picture there at the resort and we're going to see temperatures in the low 70s, headed for mid-70s by the end of the weekend. so we'll keep an eye on all of this and talk about the bay area forecast coming up. mike, is it still slow on highway 4? >> it is still slow, but it's a little bit better. the tail end of the slowing is starting to ease up. we talked about the crew clearing from this area into pittsburg out of antioch. we do have recovery. remember, this is at the same time as more traffic tends to come in out of antioch on the friday commute, and that's what we do see. so things are moving nicely. be patient if you're leaving antioch. there will be a slower drive. you're okay once you get toward bay point and concord. a little more build for highway 37, nothing dramatic. growing out of vallejo and into richmond as well for westbound 80 out of el cerrito. the bay bridge toll plaza, no big deal getting into san francisco. we all just talked about the game and we're rooting for the giants as they're fighting for that last spot.

with slight warming for the weekend. we're watching some tropical moisture arriving on saturday, especially for areas to our south, with a chance of some southern california rain. the bay area may just see some high clouds moving through. as we take a look at berkeley, what to expect as you head out the door, temperatures in the mid-50s to start and we'll be in the mid-60s as the sky clears at lunchtime, as we head down to the south bay with a look at our high temperatures for this afternoon, we're anywhere from 82 in san jose to 89 in los gatos, and up to 85 today for a high in gilroy. as you're looking at the seven-day forecast at the bottom of the screen, temperatures once again just go up a couple of degrees for the weekend, but it's been pretty mild, with martinez reaching 84 degrees today. we'll see some mid-70s in san mateo, and san francisco reaching into the upper 60s, especially downtown, while our north bay highs range from 64 in bodega bay to 90 in ukiah. we've been talking about how things are shaping up so far. i wanted to show you the update

on how many california wildfire acres have burned as we get an update on our fire season. actually, this year we're just a little bit above what we had last year, which was a very dry year. we're still seeing quite a few acres burn, but we are well below our average number of over a million acres that we usually see at this point, as we once again have a great update for our drought monitor as the drought shifts off to the east. no drought as of today for any of california, just abnormally dry in a few spots. we're going to head into a warmer weekend as we see our temperatures headed for the low 90s inland, and then a little bit of a cooldown for the middle of next week. overall, very nice and quiet weather pattern ahead. >> thanks so much, kari. 5:52 this morning. happening now, jeff bezos' ex-wife mckenzie scott is donating $20 million to a

welcome back. a live look at the oakland coliseum. a lot of people are already starting to wonder what comes next for the coliseum property once the a's finalize a move elsewhere. developments suggest it may be a drawn-out process. the african american sports and entertainment group wants to work with the city of oakland to build housing and restaurants

there. but the a's now co-own the property, along with alameda county. this week the team rejected an offer from the group to buy its half of the property. in a letter, a's president says the team appreciates the offer, but it's not interested in selling or otherwise disposing of their interest in the coliseum. the baseball season now winding down. it's still not clear when or if the a's will actually move to las vegas. an unusual and unexpected delay at the height of the highly anticipated tennis match. this was at the u.s. open. climate change protesters last night took to the center court there at the u.s. open. they actually began disputing play at the start of the second set of the women's semifinal. this was featuring u.s. sensation coco gauff. one of those protesters actually gluing his feet to the floor. play stopped for nearly an hour.
